l. The Plaintiff Mile2 mki, inc is a corporation with its registered office at 113 Main Street Aurelia IA 51005 in the County of Cherokee ·

2. Defendant, Michael Ross Roberts at all times material to this lawsuit was a resident of Cherokee County. 3. Defendant, Wayne Michael Burke, at all times material to this lawsuit, was a resident of3533 Haversham Drive Plano

United Kingdom 5. Cherokee County will have jurisdiction due to diversity.

FACTS RELEVANT TO ALL CLAIMS.

1. The Defendant Michael Roberts was the Petitioner in tumultuous divorce case CDCD002755 in Buena Vista County Iowa. 2. The Defendant Michael Roberts was diagnosed with post traumatic stress syndrome as a result of an attempt to murder

him by his ex-wife, he received other injuries as a result of these assaults. 3. Roberts suffered memory loss and reduced capacity as a result of these injuries and has received criminal compensation

from the Iowa Dept of Justice for attempted Murder. Claim # 1 Improper transfer of assets by defendant Roberts

I. The Defendant Michael Roberts while suffering Post Traumatic Stress improperly transferred assets, namely the www.mile2.com website domain and other related intellectual property assets to defendant Wayne Michael Burke and /or Defendant Mile2 UK Limited. -

2. The asset transfers were made while the business assets and other marital assets were subject to an ~unction under Buena Vista case CDCD002755 prohibiting such transfers.

3. The Plaintiff understands that Defendant Roberts made the transfer of assets under duress and holds him harless conditional upon his cooperation in recovering said assets.

Claim # 2 Improper receipt of assets. 4. The defendants Burke & Mile2 UK improperly received the assets described in Claim# 1 above and used said assets

throughout 2007 & 2008 without proper authorization or payment of any fees, consideration or licenses for the use thereof

WHEREFORE, The Plaintiff respectfully requests that this court enter judgments as follows: 1. That the defendants Burke & Mile2 UK, Limited return the improperly transferred assets to the Plaintiff. 2. That the defendants Burke & Mile2 UK, Limited pay reasonable damages to Plaintiff which are not readily ascertainable

at this time.
