The Environmental Quality Act (EQA) 1974 has undergone six amendments since 1974. The review is on-goingto ensure relevance to current development and needs. The latest amendments in 2012 included

strengthening investigation and prosecution powers and the self-regulatory approach under the Clean AirRegulation (CAR) 2014, Industrial Effluent Registration (IER) 2009 and Scheduled Waste Regulation (SWR)2005. These developments were shared by Julaidi Rasidi, Principal Assistant Director of Enforcement fromthe Department of Environment (DOE) at FMM’s Seminar on Strengthening Environmental Compliance inIndustry on March 5, 2015.

STRENGTHENING ENVIRONMENTALCOMPLIANCE IN INDUSTRY

DOE would also be enforcing the polluter pays principleand the EQA has provisions to impose and collectcess. The rate, manner of collection and exemptionhas yet to be finalised. DOE has held consultationswith stakeholders, including FMM since 2013 on thedraft Environmental Quality (Payment of Cess) Order.Companies practicing 4R (Reduce, Reuse, Recycleand Recover) or more than 2R could receive certainexemptions. The Environmental Fund Committee hasindustry representation. Initially, cess would be imposedon scheduled wastes (SW) generators, SW prescribedpremises and SW management centre.

Kiu Jia Yaw, a member of Bar Council’s Environmentand Climate Change Committee, briefed theparticipants on the link between corporategovernance and compliance with environmentalstandards and regulations. Companies which areenvironmentally responsible would be more agile inadapting to future regulations.

Julaidi Rasidi informed that the definition of pollutionunder Section 2 EQA 1974 is revised to removealteration of chemical properties, which is difficult toprove. DOE’s power of investigation is enhanced tobe equivalent to those of the police under theCriminal Procedure Code. DOE now has powers ofarrest, including persons acquainted with a case butdid not turn up for questioning, forfeiture of items andmaterials and access to computerized data. Rewardand protection of informers is also provided under theEQA 1974.

Self-regulatory approach is applied to several clausesin CAR 2014, IER 2009 and SWR 2015 specifically onnotification, design and construction, operation andmaintenance, performance monitoring of biologicaland chemical processes as preventive maintenanceand for periodic and monthly monitoring, which areapplicable online. The IER 2009 has been upgradedto Online Environmental Reporting (OER).

Desiree Nathan from the Environmental ResourcesManagement shared common issues or constraintsfaced by companies in managing environmentalcompliance inspection. Sustainability should be theobjective i.e. to reduce unnecessary environmentalrisks and to incorporate resource conservationand pollution prevention principles, leading toimprovement in environmental, economic andsocial performance.

Dr Chen Sau Soon of SIRIM gave insights on theMalaysian equivalent to the EU and industry sectorspecific directives on product-related environmentalregulations. Compliance is voluntary or driven bysupply chain requirements. The green market in mostparts of the world is driven by governments throughpublic procurement. Businesses are encouraged topractise sustainable production by adopting

environmental management techniques,technologies and producing green productswhich are resource and energy efficient, have lowcarbon footprint and with improved environmentalperformance. The three most widely applied tools inthe market are life cycle assessment, environmentallabelling and eco-design.

Two companies shared their best practices inenvironmental compliance. Shell Refining Company(FOM) Berhad and Nets Printwork Sdn Bhd bothconcurred that commitment from the top isnecessary to drive the environmental agenda.Both were past winners of the Prime Minister’sHibiscus Award. Shell Refining Company (FOM)Berhad won the 2012/2013 Challenge Trophy forExceptional Achievement while Nets PrintworkSdn Bhd won the SME Award in 2010/2011.

A study visit was also organised for the participatingcompanies to learn best practises on leanmanagement systems. The visits were organised toWSA Engineering Sdn Bhd and Petzl ManufacturingMalaysia on April 1, 2015.

The Lean System Development Programme is acollaboration between FMM and the MalaysianProductivity Corporation. It aims to promote leanmanagement and culture among FMM membersgiven the rising cost of doing business and thenecessity for companies to review their operationsand introduce lean management. The Leanprogramme is proven to benefit companies withimmeasurable improvements in work processefficiency and bottom line performance.

Congratulations to FMM Immediate Past President,Tan Sri Datuk Yong Poh Kon and Vice President,

Tan Sri Lim Wee Chai for receiving the ABAM “LifetimeAchievement Award” and “Priority Integration ExcellenceAward (Rubber Sector)” respectively on April 24, 2015.

The Lifetime Achievement Award is presentedto prominent, illustrious and long servingbusiness personalities, in recognition of theirvast experience, exceptional success andsignificant contribution to the Malaysianbusiness environment. Tan Sri Yong is theManaging Director of Royal SelangorInternational Sdn Bhd, a globally-renownedbrand in pewter.

Tan Sri Yong was also recognised for hisactive role in the business community andpublic and private sector collaboration.Tan Sri Yong has served for over 30 years inthe FMM Council, having served as itsPresident for five years and is currently itsImmediate Past President. In 2007, he wasappointed by the Prime Minister to be theCo-Chair of PEMUDAH, the Task Force toFacilitate Business, with the Chief Secretaryof the government of Malaysia.

This includes the recognition ofintegration and connectivity betweenASEAN businesses initiated and participated byrecipients. The Top Glove Success began in1991 as a local business enterprise with a singlefactory and three production lines. Industrial waste management is challenging for manufacturers. To sustain theenvironment, manufacturers need to be responsible in managing their industrial

waste, specifically hazardous waste as well as to adopt more environmentally friendlytechnologies that have become increasingly important in influencing consumers’purchasing decision.

Taking cognisance of the need for greater awareness,FMM organised the FMM Industrial Waste ManagementConference 2015 with the theme “Best Practices andTechnologies for Waste Management for EnvironmentSustainability” on March 26, 2015.

This annual conference held for the second timeattracted 245 participants comprising CEOs, MDsand those from the environmental and safetyindustries. Others included production managers,engineers and executives as well as factory andplant personnel.

The conference was designed to updatemanufacturers and service providers on legislativerequirements, best practices and technologieson conversion of waste to energy, managementof scheduled waste, industrial air pollution, CO2emission and organic waste.

The opening remarks were delivered by YM RajaDato’ Abd Aziz bin Raja Muda Musa, FMM VicePresident and the following key issues on industrialwaste addressed by FMM over the last few yearswere highlighted:

INDUSTRIAL WASTE MANAGEMENTFOR ENVIRONMENT SUSTAINABILITY

• FMM proposed for Department of Environment(DOE) to consider its review of regulations to allowfactories with smaller amounts of wastes to storelonger or in an amount not exceeding a certainvolume subject to meeting the general safetyregulations for the storage of scheduled wastes.

• On the collection of cess, FMM raised memberconcerns and was currently in discussion with DOEto consider alternative proposals on a fair andacceptable cess rate, particularly for industrieswith scheduled wastes that could be recovered,reused or recycled.

• FMM’s Environmental Management CommitteeChairman, Dato’ Haji Mizanur Rahman Ghani hasbeen appointed to sit in the Environmental FundCommittee which manages cess and donationsrelated to waste management.

• On household e-Waste regulation, FMM submittedinputs from the manufacturers of electricalappliances and ICT products for the considerationof DOE. DOE agreed to continue to engage FMMand other stakeholders in the development andimplementation of measures and rules throughout2015 and 2016 before the regulation was gazettedin 2017.

Many participants showed keen interest on theupdates on legislative requirements of industrialwaste management presented by NorhazniMat Sari, Director of Hazardous Substances Division,Department of Environment, Ministry of NaturalResources and Environment.

Other speakers at the conference were fromDepartment of Standards Malaysia, Ministry ofScience, Technology and Innovation, Kualiti AlamSdn Bhd/Cenviro Group, Cenergi SEA Sdn Bhd,Hiap Huat Holdings Bhd, Master Jaya EngineeringSdn Bhd, UMW Toyota Motor Sdn Bhd and NestléManufacturing (M) Sdn Bhd.

OVERSEAS RETAILING: MARKET OUTLOOKAND OPPORTUNITIES

Two established exporters, Pensonic Holdings andPerfect Food Manufacturing shared their experiencesand presented papers on challenges and practicalsolutions for overseas retailing. Participants were alsotreated by Perfect Food Manufacturing to its recentlylaunched Julie’s Hershey’s chocolate cookies duringthe seminar.

The highlight of the seminar was a presentationfrom Sadashiv Nayak of Future Retail Limited, India.Nayak presented a paper on Indian retail landscape,background of Future Retail Limited and its promotionalactivities. Participants attended an additionaldiscussion session with Nayak and gained more insightsinto Indian consumer preferences as well as supplychain requirements of Future Retail Limited.

The 8th FMM Marketing and Branding Seminar which was held on April 16, 2015 was attended by morethan 50 participants from marketing, business development and sales background. This seminar, which

focused on overseas retailing, saw speakers from GfK and MATRADE updating participants on internationalretail scene and government grants for exporters respectively.

VISIT TO INDAH WATER KONSORTIUM SDN BHDLed by Michelle Hah amember of the FMM Womenin Business Committee,the delegation of38 members, was briefedon the types of services,tariff charges and how therates were calculated.The participants also gainedbetter understanding aboutsewage treatment.

Following the briefing,participants toured thesewage treatment plant.Zayd Zainuddin, an engineerfrom IWK was on hand toexplain the technicalitiesof the sewage processes.Participants also learnt ofIWK’s move towards greentechnology and environmentsustainability by re-usingbioeffluent to better controlpollution and help to sustainwater usage.

On March 25, 2015, FMM organised a site visit to the national sewagecompany in Malaysia, Indah Water Konsortium Sdn Bhd (IWK),

Bunus Treatment Plant in Mukim Setapak.

MPA-IHS CHEMICAL SEMINAR

It proved to be an opportune time to delve into this particular subjectas the recent decline in oil prices had a drastic impact on numerousindustries, such as energy, transportation, food and especially petrochemicals.Participants benefited from the agenda of the seminar which covered arange of interesting topics relating to petrochemicals, including olefins andfeedstocks, plastics and also aromatics and derivatives.

The event was well received and managed to draw a crowd of 50 participantsfrom 16 companies and also representatives from the relevant governmentagencies such as the Ministry of International Trade and Industry and theMalaysian Investment Development Authority.

The Malaysian Petrochemicals Association (MPA) and IHS Chemicals jointly organised a seminar entitledThe Impact on Petrochemicals of the Great Energy Price Deflation on March 11, 2015. The seminar was

part of MPA’s initiative to provide more value-add activities for its association members.

VISIT TO GERMAN-MALAYSIAN INSTITUTE

The Associated Chinese Chambers of Commerce and Industry of Malaysia together with FMM SelangorBranch and Kuala Lumpur Foundry and Engineering Industries Association jointly organised a visit to

the German-Malaysian Institute (GMI) on March 26, 2015. The visit was led by Dato’ (Dr) Ir Andy Seo,FMM Vice President and Chairman of FMM-SMIs Working Committee.

A total of 75 participants toured the facilities onindustrial electronics namely GMI-KUKA RoboticsCentre and GMI-Emerson Management TechnologyCentre. Participants also viewed the exhibits onproduction technology namely GMI-Zeiss IndustrialMetrology Centre and GMI-DMG Mori Seiki CNCMachining Centre.

The visit concluded with a networking lunch hostedby GMI which provided ample opportunities forparticipants to establish business relations withGMI officials.

ONE-ON-ONE BUSINESS MATCHING

The objective of the business matching meetingswas to meet potential buyers or importers fromMalaysia, explore the business opportunities inMalaysia for Korean products and to understand themarket demand and pricing of Korean products.

Products ranging from skincare, LED face massager,menstrual cramp reducer, LED lighting and RFIDreader were introduced to the Malaysian companies.

Among the Malaysian companies who attendedthe one-on-one business matching meetingswere Parkson Corporation Sdn Bhd, Titan LEDway

Sdn Bhd, AM PM Pharmacy Sdn Bhd, Arish Miracle,Chua Trading Company Sdn Bhd, The Candy Skin,SCP Resource Sdn Bhd and UG InternationalSdn Bhd. These companies expressed interest inKorean products and gained further informationfrom the meetings.

Site visits were organised to Ogawa World Berhadand Watson’s Personal Care Stores Sdn Bhd onMarch 6, 2015. Product presentations were alsoorganised during these site visits with bothOgawa and Watson indicating interest in theKorean products.

Over 25 business matching meetings were arranged for five delegates from Suwon City, South Korea onMarch 5, 2015. The delegation from Suwon was led by KT Lee, Office Coordinator, International Business

Department, Suwon City Hall assisted by Jeon Sung-Hoon, Assistant Manager, Korea Federation of SMEs.

• The graduation ceremony under the Northern Corridor Implementation Authority programme and supportedby the Skim Latihan 1 Malaysia (SL1M) Secretariat, Economic Planning Unit for SL1M’s graduates. The ceremonywas held in conjunction with FMM Appreciation and Networking Dinner on March 6, 2015. The Kedah StateExco for Industry and Investment YB Dato’ Dr Ku Abd Rahman Ku Ismail was the Guest of Honour at the event.
