• PAYMENT: Cash, Check, Visa, Master Card, & American Express accepted. All items must be paid for sale day, prior to removal of items. On checks over $5,000 a bank letter of guarantee made out to Burley Auction Gallery will be required, unless bidder is known to us. If a bank letter of guarantee is not present, a valid credit card will be required to guarantee the check. If there is not a bank letter of guarantee present, Burley Auction reserves the right to hold purchased items until check clears.

• There will be a 15% Buyers Premium added to each item purchased. • Unless exempted by law, all applicable sales tax will be charged. Prospective buyer should present their tax

exemption information at the time of registration. • Auctioneer reserves the right to accept or refuse any bid. Pace of the auction & bid increment are at the sole

discretion of the auctioneer. Auctioneer reserves the right to reject small opening bid amounts or nominal bid increments.

• Auctioneer reserves the right to add to, or withdraw any items from auction. • In the event of a dispute between a buyer & seller, the auctioneer shall act as mediator & auctioneers word will be

deemed final. • The highest bidder acknowledged by the auctioneer shall be deemed the buyer. The item becomes the buyer’s

property & responsibility when the gavel falls & the winning bidder is acknowledged by the auctioneer. In the event of a tie bid, the auctioneer reserves the right to reopen the item to bidding at that time, prior to the next lot.

• It is the buyer’s responsibility for removal of purchases from the auction house in a timely manner. Any items left 30 days after the auction will be considered abandoned unless arrangements have been made with Burley Auction Gallery, in writing. Abandoned items will be sold at owner’s expense including standard commission, storage fees, & any other expense associated with said items.

• Buyer is responsible for any and all shipping charges associated with purchase.SHIPPING: All shipping is handled by the independent professional shipper of your choice. Buyer must pick items up at the auction gallery, or arrange & pay for shipping. Burley Auction Group will be happy to assist in arranging shipment if requested. We will coordinate with your shipper of choice to arrange for item pick up by shipper or we will deliver to any local shipper of your choice, within 10 miles. Buyers assume all responsibility for removal & transportation of purchases. Burley Auction is not responsible for performance of independent shippers. All removal & shipping is at the risk of the purchaser. Any shipping related claims will be between the buyer (owner) & the shipper/carrier.

• In the event of a reserve, auctioneer reserves the right to bid on behalf of the seller up to, but not beyond, the reserve amount in order to get the item to the minimum required amount to meet the reserve.

• All Applicable Federal Firearms Regulations & Apply To Any & All Firearms Sold. Any post 1898 firearms must be purchased in accordance with federal & State of Texas firearm regulations & laws. Any modern firearms shipped, must be shipped to a licensed FFL dealer. We do not ship guns to California.

• All sales are final & items may not be returned. With the exception of, if the catalog description is catastrophically incorrect. Items will be returnable within 10 days of receipt, not to exceed 30 days from auction end. All sales are final 30 days after the auction, without exception.

• In the event we are prevented from delivering the purchased property due to theft, damage, fire, or any other reason, our liability shall be limited to the full purchase price of the item.

• The buyer hereby assumes and does agree to indemnify and hold harmless the auctioneer and sellers from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have occurred or have been caused by or during removal or use of items purchased.
