PRESS RELEASE _______________________________________________________ __________ The Director of Public Prosecutions (DPP), Keriako Tobiko yesterday ordered the termination of a criminal case in Bungoma law courts against Hon. Dr.Chris Wamalwa, Member of Parliament for Kimilili constituency and Deputy Chief Whip of National Assembly; and Former Kitale Mayor, Joshua Werunga and three others. They had been charged with the offence of fighting in public in a manner threatening the peace. They were alleged to have been engaged in a public brawl during a funeral gathering held on 19 th October, 2013 of the mother of Dr. Charles Ngome, Professor at Mount Kenya University. The brawl was triggered by offensive remarks allegedly made by Rashid Mohammed to the effect that, “Eugene Wamalwa is corrupt and likes going for handouts from Jubilee government to disunite the luhya community.” The funeral was attended by Hon.Moses Wetangula, Hon.Musikari Kombo, Hon. Eugene Wamalwa, Hon. Boni Khalwale, Hon. Cyrus Jirongo among others.

The Director of Public Prosecutions (DPP), Keriako Tobiko yesterday ordered the termination of a criminal case in Bungoma law courts against Hon. Dr.Chris Wamalwa, Member of Parliament for Kimilili constituency and Deputy Chief Whip of National Assembly; and Former Kitale Mayor, Joshua Werunga and three others.

They had been charged with the offence of fighting in public in a manner threatening the peace.

They were alleged to have been engaged in a public brawl during a funeral gathering held on 19 th October, 2013 of the mother of Dr. Charles Ngome, Professor at Mount Kenya University.

After reviewing the file the DPP held that there was no evidence implicating Dr. Chris Wamalwa and there was no reason why he was charged in the first case.

The DPP further concluded, the fight was triggered off by the alleged offensive utterances of Rashid Mohammed.

The DPP directed that Rashid Mohammed should be rearrested and charged afresh with offensive conduct.
