California on Brink of Further Expansion of Fair Pay ProtectionsCalifornia’s legislature is close to passing three bills to expand the state’s fair pay laws. The bills, introduced in early 2017, were designed to expand upon, or clarify, the amended California Fair Pay Act (CFPA).The bills include:

• Assembly Bill (AB) 1209: To require employers with at least 500 employees in California to collect and submit information to the California Secretary of State regarding: (1) the difference between the median and mean salaries of male and female employees located in California who are exempt under the white collar exemptions; and (2) the difference between the median and mean wages of male and female board members who are located in California. The Secretary of State will publish this information on a publicly available website.

• AB 168: To prohibit employers from seeking salary history from job applicants.• AB 46: To amend the CFPA to clarify that its provisions apply to both public and private

employers.While all three bills are moving toward adoption, AB 1209 is the closest.

AB 1209As of September 11, 2017, an amended version of AB 1209 had passed both the Assembly and the Senate over the written objections of groups representing employers. AB 1209 has been amended as follows:

• To provide that wage differentials between men and women are not presumed violations of the CFPA or limit an employer’s ability to demonstrate a basis for the wage differential.

• To require employers to update and republish information biennially on July 1 (as opposed to annually, as provided in the original bill).

• To provide that the collection of this information is limited to employees and board members located in California (there was no geographic limitation in the original bill).

Governor Jerry Brown has until October 15, 2017, to sign or veto the bill.

AB 168AB 168 was passed by the Senate on September 12, 2017, and the Assembly is considering the bill.The bill prohibits employers from seeking job applicants’ salary history. On September 8, 2017, the bill was amended to provide that:

1. An employer may not rely upon the salary history information of an applicant (unless it is disclosed voluntarily and “without prompting”);

2. Applicants may voluntarily “and without prompting” disclose salary history information to a prospective employer; and

3. Nothing in the bill shall be construed to allow prior salary, by itself, to justify any disparity in compensation.

AB 46On September 12, 2017, AB 46 was ordered unanimously approved by a Senate Appropriations Committee and is pending before the legislature. The bill has not been amended since its introduction.* * *California already had strong fair pay laws. With the passage of these amendments, employers must be proactive in examining and fixing their pay practices to ensure compliance.

Here’s a quality update on Qualifying and license re-newals with some ‘fly by night’ fingerprinting facts for out of state contractors…Q: We received our renewal in the mail today. Do we need to have our Qualifier re-take the exams when submitting the renewal application?

A: No, your Qualifying Individual is not required to re-test when submitting a renewal application. Just be sure to have your Qualifier as well as an Officer associated with the license sign the application. If your Qualifier is an Officer, only his/her signature is required.

Q: We are having our President fly out to California to get fingerprinted via live scan next week. He plans to fly in to LAX. Are there any mobile fingerprinting services available so he can just fly in and fly right back out that night?

A: Yes there are mobile live scan services available. The Department of Justice (DOJ) has a list of live scan locations listed by County. I looked up Los Angeles and most of the locations have mobile services avail-able. A link to the DOJ live scan locations is available on our website (cutredtape.com).

Q: We are filing an application to replace our Quali-fier who left the company in early July. Based on the CSLB’s processing times, when is the earliest our new Qualifier can anticipate taking the exams? If he happens to fail, how soon could he expect to be able to re-test? He’s coming from Texas so we are trying to prepare for his travel schedule.

A: At the time, your new Qualifier can anticipate taking the exams approximately 6 weeks after the ap-plication is submitted. Keep in mind processing times change on weekly basis. If he doesn’t pass the exams, he will need to pay a $60 reschedule fee and the CSLB

will schedule his re-examination about three weeks out. Since he is coming from out of State, I would suggest if he not successful with the exams, to inform the Test Proctor. Since he is from out of state, he can request they allow him to come back the next day to retake the exams.

Q: How many companies with the same Parent Com-pany could a Responsible Managing Officer Qualify for?

A: An RMO/RME cannot Qualify more than one license based on having the same parent company. The only way a Qualifying Individual may Qualify for more than one license is if 1) The RMO owns at least 20% of each entity for which they Qualify; 2) One entity directly owns at least 20% of the other; or 3) more than 51% of the personnel of each licensee is the same.

Q: What records should I submit with my license ap-plication with regards to a conviction I have from 20 years ago?

A: You would start with marking “yes” to Question 11 on the application. You should attach a “Disclosure Statement Regarding Criminal Plea/Conviction” form for each offense explaining the circumstances of each event. Usually that is enough to satisfy the CSLB, however in some individual cases they ask for addi-tional documentation such as court records, probation reports, etc.

Safety Tip of the WeekHEAVY EQUIPMENT BACKING

Operations involving heavy equipment should always be planned to avoid backing the equipment as much as possible. In many operations, to avoid the awkward backing movement of the equipment is not always economically or environmentally possible. hen the backward movement cannot be eliminated the machine or equipment must be adapted for backing movements.

Many pieces of heavy construction equipment that are wheeled vehicles such as dump trucks, front end loaders, cement trucks, etc. are equipped with special mirrors to help eliminate blind spots. Even with these seeing aids, there are still blind spots from the operator's control position. Blind spot diagrams for each type of construction equipment are available from the manufacturer, showing what an operator can see toward the rear of the machine. Some types of heavy construct ion equipment have no view to the rear at all, and therefore require a guide or spotter to assist the operator in backward movement.

Back-up alarms are installed on most construction equipment. The advantage of the reverse alarm is that any person close to the rear of the equipment is alerted to the forthcoming rearward motion of the machine. This device alone has helped reduce the number of workers being struck by backing equipment.

The real key to preventing equipment backing accidents is the people on the job. That's you and me. Avoid parking vehicles or placing material or equipment in areas where heavy equipment is operating to eliminate obstacles to the machines movement, and STAY ALERT when working nearby.

Operators of heavy equipment, including trucks, should check for obstacles before they begin moving. Be aware of blind areas and never back up unless you are certain the area is clear. Have someone act as a guide in congested areas. Equipment operators, with the cooperation of contractors, workers and the public, can eliminate most, if not all, equipment backing accidents by following the procedures mentioned here and keeping SAFETY foremost in their thoughts.
