The first is uncertainty. The other is that whatever happens, the BTEA and its members will face that uncertainty together. As we have weathered these last few difficult years, I have thought at times about how much business is like nature. Darwin said, “It is not the strongest or the most intelligent of species that survives—it is the one that is the most adaptable to change.” When there is uncertainty and change, knowledge and communication are powerful tools in determining what future course of action any BTEA contractor or association should take to ensure their continued success. In establishing the goals and objectives for the BTEA for 2013, the Executive Committee has decided the BTEA’s most important responsibility to its members is to foster knowledge and communication between them as we navigate our way through these uncertain times. In closing, I want to sincerely thank the membership for your support and participation in making the BTEA the successful organization it is today and I am asking for you to continue that support and participation as we face the challenges that lie ahead for us in 2013 together. The area contains some of Manhattan’s most recognizable office structures, which in many cases are 70 years or older. These older structures have lower floor to ceiling heights and numerous columns, which are undesirable to Class A tenants who are increasingly looking for open space plans. According to Ms. Hsu-Chen, the city’s proposal focuses new office development with the greatest as-of- right densities on large sites with full block frontage on the streets around Grand Central Terminal and with lower densities along the Park Avenue Corridor. The rezoning proposal, if eventually approved by City Council, would likely result in considerable redevelopment in midtown Manhattan and ensuing construction activity in the coming years. The BTEA will continue to monitor this Bloomberg Administration proposal and will keep the BTEA membership apprised of future developments regarding this matter. BTEA Joins Midtown 21C: Coalition for a Globally Competitive NYCThe BTEA has recently joined the group Midtown 21C: Coalition for a Globally Competitive NYC. Midtown 21C was formed to support the

approval in 2013 of a rezoning of Midtown East that will ensure that this very important business district remains competitive in a 21st

century global economy. Along with ensuring that the area surrounding Grand Central Terminal remains a pre-eminent global business

district, a successful rezoning will spur many good jobs for New Yorkers, both construction and permanent. Other members of Midtown

21C include the Real Estate Board of New York, Building and Construction Trades Council of Greater New York and the New York Building

Congress, among others.

The BTEA continues to work on behalf of its members on legislative

matters at the local and state levels. Most recently, the BTEA was

able to impact an MWBE law recently passed by the City Council

and signed by the Mayor, and continues to fight for reform of the

New York State Scaffold Law.

BTEA JOINS STATE COALITION SEEKING SCAFFOLD LAW REFORMAt the State level, the BTEA has joined a coalition of statewide

organizations seeking to reform the New York State Scaffold Law.

Under the current Scaffold Law, any worker who falls and is injured is

not only eligible to receive worker’s compensation benefits, but also

can sue the developers, owner or contractor, who is considered

liable even if the worker is at fault. New York State is the only state in

the country with such a law, which has been attributed as the major

factor in driving up local contractor insurance costs.

As part of a statewide coalition seeking reform of the New York

State Scaffold Law, the BTEA is supporting State Senate Bill 111 and

Assembly Bill 3104, which would give New York property owners,

business owners and contractors the chance to defend themselves

in court. In addition to the BTEA, members of the Scaffold Law

Reform Coalition include the Business Council of New York State,

General Contractors Association, Allied Building Metal Industries

and the Real Estate Board of New York, among others.

MAYOR BLOOMBERG SIGNS NEW MWBE LAWOn January 7, 2013, Mayor Bloomberg signed into law Intro. 911-A, Local

Law 1 of 2013. This law, which takes effect on July 1, 2013, expands

the scope of minority/women business enterprise (MWBE) program

eligible contracts, while increasing city agency accountability in this

area. Among the major provisions of this law are the following:

• The law requires MWBE firms to provide a “commercially useful

function,” meaning a real and actual service that is a distinct and

verifiable element of the work called for in the contract;

• Participation goals for demographic groups such as Black

Americans, Asian Americans, Hispanics and Women were raised

from 27.69% to 44%, on a project by project basis;

• The contracts these goals are applicable to was expanded by

eliminating the previous $1 million limitation on MWBE contracts;

• The City will be required to post information for certified MWBEs on

its website, including identification of the market sector in which

the business operates, the bonding capacity of the business, the

contract price and specific tasks performed by the business in

its last three contracts, union affiliation (if any) and certification

renewal date.

The BTEA is working with the Mayor’s Office of Contracts and the

NYC Department of Small Business Services to identify additional

information to be added to the MWBE certification questionnaire, in

order to increase its effectiveness as a tool for prime contractors.

In addition, the BTEA also strongly advocated for increasing the

financial threshold for eligible MWBEs from a previously proposed

$14 million in revenues to $50 million in city contracts over three years

and revenues of $14 million over three years. The lower threshold

would likely have had a negative impact on union MWBE contractors.
