I. OVERVIEW

The BMSD Commercial Corridors are defined as:

Broward Boulevard (north side only) from NW 24th Avenue West to NW 31st Avenue

Sunrise Boulevard from NW 24th Avenue West to NW 31st Avenue

NW 27th Avenue from Broward Boulevard North to Sunrise Boulevard

State Road 7/U.S. 441 (west side only) from Peters Road to Interstate 595

(Unincorporated parcels only)

Peters Road (south side only) from State Road 7 to SW 45th Avenue

Davie Boulevard Extension from State Road 7 to SW 45th Avenue

The programs’ objectives are to:

Create employment opportunities for BMSD residents

Encourage private investment in the visual improvement BMSD commercial corridors

To eliminate blight and prevent further deterioration of the BMSD’s specific target area to

include the BMSD commercial corridors

Provide financial assistance to property owners along the BMSD Commercial Corridors

for the purpose of redevelopment, economic enhancement, or removal of non-conforming

structures

To eliminate conditions which are detrimental to the life, health, safety, and welfare of the

BMSD community

Reduce vacancies and encourage the appropriate and sustainable re-use of properties

along the BMSD commercial corridors

Encourage compliance with the County’s zoning and building codes

Certain business types are ineligible for the program, including, but not limited to, businesses

such as: adult businesses, packaged liquor retailers, gambling establishments, gun shops,

massage parlors, pawn shops, tattoo parlors and businesses operating from residential property.

Non-permanently affixed business equipment is also ineligible.

Façade/Property Improvement Grant Program (80%-County/20%-Business Match)

The Façade/Property Improvement Grant Program is intended to remove blight along BMSD’s

commercial corridors by assisting businesses and commercial property owners in improving

building aesthetics and by bringing commercial sites into conformance with current codes. By

improving the appearance of building façades, the program serves to improve the economic

sustainability and viability of these areas. These improvements increase property values, improve

the marketability of space within the buildings and draw business, customers and residents to the

area.

Owners or tenants of for-profit commercial/industrial structures willing to improve the exterior of

properties located within the program target areas are eligible to apply to the program. Owners

of vacant properties with intent to attract an eligible business to the property are eligible for the

program; however if the property is sold or occupied by an ineligible type within 12 months,

applicant must repay all grant funds. Use of the building must conform to all current codes and

ordinances; non-conforming uses are not eligible. All renovations must undergo Broward County’s

development review and approval process. An applicant may utilize the program in conjunction

with other programs.

The following are eligible improvements for façade matching grants:

Exterior painting, re-surfacing,

Restoration of exterior finishes and material

Masonry repairs and tuck pointing

Removal of architecturally inappropriate or incompatible exterior finishes and materials

Repair or replacement of exterior windows and doors

Window flashing and repair

Canopy or awning installation or repair

Installation or repair of exterior signage

Exterior lighting

Parking lot improvements (visible from public road in BMSD)

Decorative fencing and landscaping (visible from public road in BMSD)

Business Development/Redevelopment Grant Program

(50%-County/50%-Business Match)

The Business Development/Redevelopment Grant Program provides BMSD businesses and

property owners with access to flexible financial assistance to help them implement projects that

cannot be undertaken with traditional financing programs. The Development/Redevelopment

Grant Program would assist locally initiated public/private partnerships to leverage investments

in commercial corridor and industrial redevelopment and revitalization projects that would

otherwise not proceed.

It would be the priority for the program to focus limited available capital funding on those projects

that display significant potential for improving economic growth and the creation of jobs. The

application process managed by OESBD will require sufficient information and documentation

indicating a project's performance projections, estimated economic impact and the potential for

job creation. Key areas of focus would include:

Owner-generated funds to be leveraged

Number of direct and indirect (permanent, non-construction) jobs created by the project

Property Value Improvement/Tax Generation

Benefit to BMSD residents, either directly or indirectly, from the project as a result of its

day-to-day operations

Blighted area and/or facility elimination and/or reuse

The program would be available for a wide spectrum of projects from large to smaller scale

projects (in blighted commercial corridors, industrial areas, etc.) and will be both competitive and

consistent with the County’s development priorities in the BMSD community. The program could

be combined with other programs to reduce the economic challenges of redevelopment projects

and increase their investment potential.

The following are eligible improvements for business development/redevelopment grants:

Interior painting, re-surfacing

Permanent existing structure improvement such as interior room construction or addition

Restoration or repair of interior finishes and material of walls, ceiling, flooring

Improve/repair/replace of interior lighting

Fire suppression systems

Improvements or replacement of other permanently affixed interior fixtures and/or

business equipment consistent with the current or intended business use

New vertical construction may be considered for the Business Development/Redevelopment

Grant Program only and will be subject to program limits and permanent new job creation

requirements. Permanent new job creation standards will be based on overall project parameters.

Demolition Program (50%-County/50%-Business Match)

The Demolition Program is intended to accelerate the demolition of unsafe and unsuitable

structures to help speed the recovery of the area. The removal of nuisance properties through

demolition increases public safety, improves appearance and enhances property values in

neighborhoods. These activities also clear the path for new development.

The Demolition Program identifies properties for demolition based on physical condition, local

input and other criteria. It would create partnerships with deed holders of unsuitable properties to

increase the number demolished in any given year. The program would provide financial

assistance to deed holders of nuisance properties that seek assistance in demolition. Vacant

properties that are left after the structures have been demolished may be purchased through the

Strategic Land Assembly Program, held for future development, or converted to other productive

uses consistent with development priorities.

II. DEFINITIONS

A&E means Architectural & Engineering Services.

Applicant means a legal owner of property within the BMSD, specifically along the BMSD

corridors that applies for a grant under the terms of the programs.

BMSD means the Broward Municipal Services District.

Certified County Business Enterprise (CBE) means those firms who are currently certified as

such with the Broward County Office of Economic & Small Business Development.

CMD means the Construction Management Division of Broward County Government

Grant Agreement means the Contract between Owner and Broward County for grant funding.

The Grant Agreement consists of this document, signed by the owner and the County.

Grant Program means the Broward County Façade, Demolition, and/or Economic

Development/Redevelopment Grant Programs, administered by Broward County’s CMD and

OESBD, with all work being done by County CBEs and SBEs.

OESBD means the Office of Economic and Small Business Development Broward County

Government

Owner means any parcel owner within the BMSD Commercial Corridors.

Payment Affidavit means the document prepared and submitted to the County by the Project

Manager upon completion of the agreement (or completion of a specific scope of work) to pay the

A/E Design Firm or Contractor.

Project Manager means a Broward County Construction Management Division Project Manager

or construction project management firm retained by the County. If a construction project

management firm is retained by the County, the firm may serve as a general contractor for work

performed under the Grant Program.

Review Committee means the group of designated County staff that makes determinations

regarding the Grant Program.

Small Business Enterprise (SBE) means those firms who are currently certified as such with

the Broward County Office of Economic & Small Business Development.

Sub-Contractor means any Broward County Certified County Business Enterprise (CBE) or

Small Business Enterprise (SBE) that will be working under the direction of a general contractor

on a grant funded project within the BMSD Commercial Corridors.

III. FUNDING

Applies to all 3 programs

A. All funding requests reviewed and recommended by the Review Committee are subject to

approval by the Board of County Commissioners.

B. The recipient of Grant Program funds must be the property owner, as confirmed by

Broward County Property Appraiser records.

C. Owner’s investment (private funding) must be deposited into the specific County fund line

earmarked for the owner prior to the start of work. The owner and/or tenant will be

responsible for any and all debt incurred.

D. Repayment is required if, prior to a five-year period, property ownership transfers or

funded improvements are removed or otherwise unmaintained. To ensure compliance with

the terms of the grant, Broward County will place a lien on subject properties. After five

years the lien may be released.

E. Funding for the Programs is reserved on a first come – first qualified basis subject to

eligibility and the annual budget allocation for the program. An application which is not

funded solely because program funds are depleted may be resubmitted on the first day of

the following fiscal year and thereby secure its place in line.

F. Grant funding will not be provided as a reimbursable for work already completed by the

owner or any work not specifically approved by the Review Committee. Owner is

responsible for the costs of any (extra) work not shown on the approved A&E plans.

Applies to Façade Grant Program only

G. Applicants may receive funding up to an 80% County and 20% Applicant matching basis.

The funds will be provided once all work is complete or as partial payment as Contractor

completes specific scopes of work as determined by Project Manager. All supporting

documentation is required prior to final payment, including copies of all Broward County

building permits and completed inspection reports for the project.

Applies to Economic Development/Redevelopment Grant Program only

H. Applicants may receive funding up to a 50% County and 50% Applicant matching basis.

The funds will be provided once all work is complete or as partial payment as

Contractor/Sub-contractor complete specific scopes of work as determined by Project

Manager. All supporting documentation is required prior to final payment, including copies

of all Broward County building permits and completed inspection reports for the project.

I. Firms may be required to hold job fairs targeting BMSD residents. The County will

provide applicant firm with free recruiting site at a County-owned facility within the BMSD

and publicize the job fair for the applicant. Agreement will contain a claw-back provision

in the event the firm does not create the agreed upon number of jobs. Employees who

leave employment within 1 year must be replaced by other eligible employee.

J. In the event that the economic development, creation of new permanent jobs,

redevelopment, and/or measurable community benefit(s) to the redevelopment area was

not completed as proposed in the application, and within three (3) years from the final

grant disbursement, the applicant shall be required to return 50% of the grant amount

disbursed.

IV. REVIEW COMMITTEE

A. The Review Committee will be composed of, at a minimum, the following staff and a

designated alternate for each member:

Assistant County Administrator - 1

Broward County Office of Economic & Small Business Development - 1

Project Manager - 1

Broward County Construction Management – Project Manager – 1

B. Review Committee will meet as applications are submitted

C. Review Committee has responsibility for determinations as to the economic viability of

proposed projects, such as that the business unit will be occupied immediately after the

rehabilitation and the likelihood that the rehabilitated building will remain occupied or in

the case of demolition, that removing a structure serves the intent of the Program.

The Broward County Board of County Commissioners shall approve or delegate the approval of

all agreements.

V. PROJECT MANAGER

A. Project manager shall perform periodic inspections throughout the duration of all Grant

Agreements.

B. The Project Manager will estimate the cost of all projects recommended by the Review

Committee, and ensure that the A & E and project design costs do not exceed 15% of the

estimated total cost of the project.

C. The Project Manager shall provide cost verification and inspection services for all

approved projects.

D. Project Manager shall provide a quality project in a timely manner and to provide problem

solving for Owners, and SBE/CBE Sub-Contractors.

E. The Project Manager will conduct as many site visits as necessary to assure the work flow

of each Agreement is progressing in a workmanlike, consistent, and timely manner.

F. During the course of the Agreement, Project Manager may submit Payment Affidavits as

specific scopes of work are completed to facilitate prompt payment to CBE/SBE A/E firms

and CBE/SBE Sub-Contractors.

H. The final inspection(s) will be performed by the Project Manager in conjunction with the

Owner or their agent, and must meet the satisfaction of all parties before the Contractor

may request final payment. A confirmation of a passing inspection must be submitted with

the signed Contractors request for pay before final payment is made.

I. Project Manager will submit copies of all records pertaining to the Agreement to the

County, upon completion of the Agreement.

VI. THRESHOLD CRITERIA THAT ALL APPLICANTS MUST MEET

A. Site Eligibility - Grants must be for property abutting the BMSD commercial corridors as

noted in Section I above. Parcels must be free from code violations/liens and used

compliance with certificate of use, building code, and zoning ordinances.

B. Commercial structures and vacant lots are eligible. Residential structures are eligible for

demolition grants only. (See paragraph H below).

C. Applicants must be the Owner of a property or legal designee.

D. The applicant must be the Owner of record or legal designee; agree to use the property in

a lawful manner with regard to occupancy, zoning ordinance, and the property

maintenance code; maintain the premises in a decent, safe and sanitary condition

pursuant to applicable codes and ordinances (including agreeing to operate their

businesses during the hours as provided for); and pay all insurance and property taxes

annually.

E. Applicant shall owe no delinquent property taxes or other fees to Broward County.

F. Owner must submit proof of financial capability.

G. The application package must be complete.

H. Properties that carry a homestead exemption are ineligible.

I. Project design must be consistent with BMSD design criteria.

Eligible Hard Costs: All construction costs. Other expenses approved on a case-by-case

basis by the Review Committee.

Eligible Soft Costs: Environmental Assessments, Asbestos Surveys, Architecture and

Engineering Fees, Business Plan Development, Financial Statements/Analysis, Building

Permits.

Ineligible Costs: Acquisition of Real Estate; County Impact Fees, Payment of Real Estate

Taxes and Tax Delinquencies; Payment of Tax Liens and Property Assessments;

Payment of Delinquent Utility Costs; Marketing of Project Site(s); Litigation expenses;

Property Maintenance; Improvements made prior to Agreement approval; Improvements

to properties that do not or cannot meet building and safety codes; Refinancing existing

debts; Non fixed improvements; Inventory/fixtures/equipment not part of building structure;

Sweat equity payments (i.e., Owner’s own labor & performance); Work performance that

is not consistent with the BMSD Design Guidelines.

VII. PROGRAM PROCEDURES (in order)

A. Interested Owners may contact OESBD at 954-357-6400 for any information related to

the BMSD Façade, Demolition or Economic Development/Redevelopment Grant

Program.

B. OESBD/Code Enforcement will investigate, via the corridor property database, if the

Owner is current on the property taxes for all parcels Owner possesses in Broward County

and that the parcels are free from code violations/liens; whether the property is being used

in a lawful manner with regard to occupancy, zoning ordinance, and the property

maintenance code; and whether the premises are being kept in a safe decent, safe and

sanitary condition pursuant to applicable codes and ordinances. If the Owner does not

meet any of these standards, OESBD staff may then inform the owner that they are not

currently eligible for grant funding.

C. If Owner meets the standards described in Section VI, OESBD will then arrange a pre-

application meeting with the Review Committee to discuss the owner’s conceptual plans

for the property in an informal setting. Owner must bring photos of the property and proof

of financial capability to this meeting. Review Committee will discuss eligibility criteria,

program requirements, proposed scheduling, and consistency of the proposal with BMSD

Design Guidelines. Owner will be informed at that meeting whether his project is feasible

or not. If the project is not feasible the Owner will be informed that he/she is not currently

eligible for funding.

D. If the Review Committee determines the project is feasible, initial funding for

Architectural/Engineering (A&E) work will proceed. A&E contractors must be Broward

County Certified SBEs, conforming to the requirements of Section VII (E). Once the initial

drawings are completed, OESBD shall assist the Owner with the Application and

supporting data. A&E plans, color boards, and cost estimates will be a major portion of the

application package. Applications may be submitted throughout the year. If funding is not

available, applicant may be placed on a wait list or offered other alternatives. Applications

must be complete with appropriate attachments and submitted to the County at: Broward

County Office of Economic and Small Business Development, 115 S. Andrews Avenue,

Annex A-680, Fort Lauderdale, FL 33301.

E. The terms of all grant funding shall stipulate the use of Broward County Certified County

Business Enterprises (CBEs) or Broward County Certified Small Business Enterprises

(SBEs) for all grant-funded work. The County’s Project Manager will choose the SBE A/E

firm from the SBE A&E Reserve Library. The A/E firm must receive OK from Project

Manager before beginning work as noted in section V (B). Construction portion of the work

shall be bid out by the County as either a CBE or SBE reserve contract. The County

recognizes that certified firms may not be available to perform certain scopes of work. In

that case, every non-CBE/SBE Contractor/Sub-Contractor shall for the record, provide

copies of current insurance, licensing, Broward County vendor number, and his/her tax

identification number. Project Manager should pursue all activities necessary to determine

qualifications, workmanship, and reputation for satisfactory work.

F. The terms of all grant funding shall stipulate the use of Broward County Certified County

Business Enterprises (CBEs) or Broward County Certified Small Business Enterprises

(SBEs) for all grant-funded work. In order to qualify for grant funding, all Owners must

have their A&E work performed by an SBE as selected by the County’s CMD Division to

ensure quality control. If the A/E firm elects to subcontract work, only Broward County

certified CBE/SBE firms may be utilized. CBE and SBE firms may not be replaced without

first notifying the CMD Project Manager and OESBD. No building Owner, lessee, lessor,

tenant, occupant, employee, or relative of the same, shall be paid to serve as a contractor

or subcontractor on the agreement, or shall act as a recently hired employee of a

CBE/SBE firm as noted in Section VI (I) Ineligible Costs. Any violations of this requirement

will render the Agreement void.

G. A & E drawings/site plans are reviewed by the Site Plan Committee during their regular

meeting at Broward County Governmental Center West at 1 N. University Drive in

Plantation.

H. Grant agreements are approved by the Broward County Board of County Commissioners.

I. A pre-work conference is held at the property. The meeting will include the Project

Manager, Sub-Contractor(s), the Owner, and County staff, including elements of the

Review Committee. The purpose of the meeting is to review the details of the construction

and time schedule.

J. An Agreement will then be signed by the Owner and the County.

K. Contingency Fund Set-aside: The Sub-Contractor’s bid does not include extra funding for

tasks not listed in the specifications. It is not unusual to discover unexpected additional

problems once the work commences. Examples would be unknown underground storage

tanks, unidentified contamination, abandoned utilities or previous work that is not in

compliance with codes and current health and safety standards. Therefore, after a

discussion with the Owner, the grant amount might include a contingency amount. These

funds are only for unforeseen tasks that must be completed as a pre-requisite to the

specified project. The funds will not be dispersed without a written change order signed

by both the Project Manager and the County.

VIII. WORK PROCEDURES

A. Procedures for Starting Work:

After an Agreement has been signed, a Notice to Proceed order will be sent by the

Project Manager to the A/E firm, and the Owner.

The A/E firm is required to begin the project within 30 days of receiving the Notice to

Proceed and complete the entire design within 30 days thereafter.

When design is approved by the Site Plan Review Committee, the Project Manager

shall notify the County and commence work within 60 days.

The Project Manager ensures that all required permits are secured prior to

commencing work.

During construction, the Project Manager will conduct inspection as deemed

necessary, and upon completion will conduct a final inspection.

Projects involving external funding may utilize lender-provided Project Manager.

B. Change orders are discouraged. If a required change order to the original agreement

arises, then it can only be incorporated into the grant when approved by the Project

Manager, Owner, and the County. If a change order is required that exceeds the original

grant amount then the Owner can apply for an increased grant amount not to exceed the

terms of this program or pay the Project Manager directly for costs incurred.

C. It is the Project Manager’s responsibility to monitor construction daily. The County will be

monitoring construction at a minimum of once a week.

D. The Project Manager, in consultation with the County, will determine if all terms and

conditions of the agreement have been followed strictly.

E. The Owner shall not let other work for hire while under Agreement with the Grant program,

without first contacting the Project Manager, who may allow work of an emergency nature,

such a plumbing or A/C repair.

IX. GENERAL PROJECT REQUIREMENTS

A. Safety and Security of the Premises

The Project Manager shall be responsible for the secured control and safety of the

premises throughout construction/demolition. Reasonable control measures shall be

made to prevent the unauthorized entry of non-project related persons. Measures may

include, but are not limited to, construction locks or lock boxes at entry doors and

temporary barricades. Trenches, ditches or other excavations that are falling or tripping

hazards shall not be left unattended unless protected by temporary fencing or other barrier

designed to prevent unauthorized entry.

B. Daily Activities

All Contractors, suppliers and their agents and employees shall maintain a respectful

demeanor toward the neighborhood and community while on-site. Additionally, it is of

utmost importance that the project site is maintained in as clean and orderly fashion as is

reasonably accomplished by the on-going construction activities (e.g. broom swept and

organized at the end of each work day).

C. Safety Precautions

Contractors shall be responsible for initiating, maintaining and supervising all appropriate

safety precautions and programs in connection with the performance of the Agreement.

In the event a Contractor encounters material on site reasonably believed to be asbestos,

polychlorinated biphenyl (PCB) or any other suspect material which has not yet been

rendered harmless, the Contractor shall immediately stop work in the affected area and

report the condition to the County. A written report identifying the suspect materials and/or

conditions shall be submitted to the County within one business day. Work shall remain

on hold until written notification by the County has been issued explaining that the suspect

materials have been rendered harmless.

Safe working conditions shall be maintained at all times. Contractor shall use all

precautions necessary, such as suitable guard rails, barriers and warning lights, especially

at excavations, to provide necessary protection for workers, the public, and inspectors

visiting the site.

D. Other

Debris shall be removed from the site in an approved carrier to legal disposal sites in

accordance with local ordinances and applicable environmental regulations. The use of

burning or explosives is strictly prohibited.

The Owner will have removed items deemed salvageable prior to commencement of the

work specified herein. Remaining items shall become the property of the Contractor.

Storage or sale of removed items will not be permitted on site. No right, title, property or

interest of any kind whatsoever in or to the land or premises upon which such buildings or

structures stand is created, assigned, conveyed, granted or transferred to the Contractor

except only the license and right of entry to remove/renovate such buildings and structures

in strict accordance with these specifications and Agreement.

All excavations shall be leveled with approved clean fill and compacted substantially to

prevent future settling. Contractor shall be responsible for providing any and all granular

fill material required to fill and compact excavations. Contractor shall provide prior written

notification of the planned activities to the County representative so that a visual inspection

of the fill material and the method of compaction may be observed and approved.

Adjacent properties and items scheduled to remain on project property shall be protected

from damage at all times. All shrubs and trees in working areas shall be protected by the

use of appropriate barriers and/or guard shields of adequate strength to protect same.

Contractor is to restore and correct all damage caused in the performance of his work

using materials and workmanship matching the quality and type of damaged area or item.

Contractor shall be responsible for keeping streets, sidewalks and other areas in the public

right-of-way free of mud and/or debris as a result of their activities, including hauling and

grading activities.

The Contractor shall not obstruct or close streets, walks or other occupied facilities without

X. PAYMENT PROCEDURES

A. Funding will be dispersed under the County’s prompt payment procedures. Multiple partial

payments may be distributed during the course of a project, to individual CBE/SBE

Contractors, when a project scope of work has been completed. Contractors will be paid

upon submittal by the Project Manager of an Affidavit of Payment to the County.

B. When the Project Manager is satisfied that the work has been completed, he/she shall

submit a Payment Affidavit to the County.

C. Payments will be made directly from the County to the Contractor(s). In the case of

projects involving external loan financing, the County may elect to disburse grant funds to

the lending institution for co-disbursements with lender funds.

D. The invoice must be approved, signed and dated by the Project Manager, Contractor and

County.

E. All Contractors will sign a release of lien at the time of final payment.
