1. Introduction

1.1 Role of the Document Brighton & Hove City Council has prepared a Statement of Consultation 1 in relation to consultation undertaken on the Proposed Further Modifications to Policy CP8 Sustainable Buildings in the Submission City Plan Part 1. This statement sets out how the city council published the Proposed Further Modifications to Policy CP8 Sustainable Buildings in the Submission Brighton & Hove City Plan Part 1 and advertised the opportunities for people to make formal representations to the Inspector about the soundness of the proposed further modifications in accordance with the council’s adopted Statement of Community Involvement (SCI) and the Town & Country Planning (Local Planning) (England) Regulations 2012. This statement shows that the requirements set out in the adopted SCI and government regulations have been met. The statement also indicates the number of representations received and provides a summary of the key issues raised in those representations. Annexe 1 provides a schedule of the representations received. Copies of the original representations made in accordance with Regulation 20 are published in Annexe 2 which is available electronically from the council’s website or a paper copy from the Customer Service Centre, Hove Town Hall. This document sets out:

i) How the general and specific consultation bodies who were invited to make representations at earlier stages of the plan preparation (under regulation 18) were notified of the publication of the Proposed Further Modifications to Policy CP8 Sustainable Buildings; ii) How and within what period the representations had to be made; iii) The procedure for making representations; and iv) A summary of main issues raised as a result of the representations received.

Previous stages of consultations are outlined in the Statement of Consultation June 2013 (BP/010) published at submission stage, the February 2015 Statement of Consultation (BP/060) prepared after the Proposed Modification Consultation stage (November - December 2014) and the September 2015 Statement of Consultation (BP/066) published after the further proposed modifications stage (June – August 2015).

1.2 Compliance with Statement of Community Involvement The council adopted its revised Statement of Community Involvement in March 2015. The SCI is a statutory document that formally sets out the policy and standards for engaging residents, local groups, stakeholders and

statutory consultees in preparing development plans and how the council will consult on planning applications. Consultation on the City Plan has previously been guided by the approach set out in the 2006 SCI; however the consultation on the further proposed modifications has been guided by the approach set out in the revised 2015 SCI.

2. Consultation on the Further Proposed Modifications to the City Plan Part 1

2.1 Background The Brighton & Hove City Plan Part 1 was submitted to the government in July 20132 and is still under examination by an independent planning Inspector appointed by the government. Hearings were held in October 2013. In accordance with section 20(7C) of the 2004 Planning and Compulsory Purchase Act (as amended) Brighton & Hove City Council formally requested that the Inspector recommend any modifications to the Brighton & Hove City Plan Part 1 needed to rectify matters that make the Plan unsound/not legally compliant and thus incapable of being adopted. The Planning Inspector published her Initial Conclusions Letter 13 December 20133 setting out her initial concerns and indicating where further work was required or where modifications to the plan were required. These changes were consulted upon from November to December 2014 and the consultation comments were sent to the Inspector (February 2015) for her consideration. The council proposed a number of further changes or ‘Further Proposed Modifications’4 to the submitted City Plan Part One in response to the Inspector’s further ‘Matters and Issues’ published in April 2015 as part of her examination of the Plan. Consultation on the further proposed modifications was undertaken 29 June – 10 August 2015 and the consultation comments were sent to the Inspector (September 2015) for her consideration. In August 20155, the Inspector raised concerns that the further proposed changes to policy CP8 Sustainable Buildings (consulted upon 29 June - 10 August), could not be considered effective or consistent given recent government announcements (10 July Fixing the Foundations: Creating a more prosperous nation and the 18 June Written Ministerial Statement ‘Local Planning’). Therefore further modifications to Policy CP8 Sustainable Buildings were made in response to her concerns. The proposed further modifications to CP8 Sustainable Buildings were focused on ensuring the policy is consistent with recent changes in national policy by:

Removal of reference to zero carbon allowable solutions Removal of reference to the zero carbon homes standard

2015 in relation to wind energy

Consequential changes to the policy, supporting text and relevant Implementation & Monitoring targets are also proposed as a result of the changes set out above6.

The Proposed Further Modifications to Policy CP8 Sustainable Buildings have been subject to a similar process of publicity and opportunity to make representations as at the regulation 19 stage and the requirements for sustainability assessment have been met with Sustainability Appraisal of the proposed modifications undertaken (Sustainability Appraisal Addendum September 2015).

2.2 Proposed Further Modifications Policy CP8 Sustainable Buildings in the Submission Brighton & Hove City Plan Part 1

i) When the Proposed Further Modifications were published The Proposed Further Modifications to Policy CP8 Sustainable Buildings were published for a six week period of consultation starting Monday 28th September 2015 and ending 5.00pm Monday 09th November 2015.

ii) The Proposed Further Modifications to Policy CP8 Sustainable Buildings Consultation Documents Alongside the Schedule of Proposed Further Modifications to Policy CP8 Sustainable Buildings (September 2015) which set out how the policy and supporting text was to be further modified, the following supporting documents were updated:

Sustainability Appraisal Addendum (September 2015) o Non-Technical Summary to the Sustainability Appraisal

Other examination/ city plan documents which informed the preparation of the City Plan remained available to view on the council’s website.

iii) Where the consultation documents were made available The Schedule of Further Proposed Modifications, accompanying documents, the Public Notice which set out the details of where and when the documents could be inspected, guidance note and the response form were made available on the dedicated Proposed Submission City Plan Part 1 section of

It was clarified in the consultation documents that the public consultation on the further proposed modifications put forward were without prejudice to the Inspector’s final conclusions on the Plan and that all representations would be taken into account by the Inspector.

the council’s website: http://www.brighton-hove.gov.uk/content/planning/local-development-framework/city-plan-consultation and could also be accessed via the council’s consultation portal (http://consult.brighton-hove.gov.uk/portal ) and paper copies were made available at the following public deposit points:

Customer Service Centre (Brighton), Customer Service Centre (Hove), Jubilee Library (Brighton), Hove Library, Portslade Library

The public deposit points had paper copies of all the Proposed Modification documents. A Guidance Note to making representations and background to the further proposed modifications, and paper copies of the response forms were also made available. The documents were made available from the 28th September 2015.

iv) Notification of Consultation A public notice was published in the Brighton & Hove Independent Newspaper Friday 25 September; and published online in the Brighton & Hove Independent newspaper website (see appendix 3). The public notice was also published on the council’s website. Emails or letters were used to notify organisations and individuals who were logged as relevant consultees on the council’s LDF database. The database includes statutory consultees and also the organisations and individuals who were invited to, or have responded to previous consultations on the Core Strategy / City Plan (Regulation 18) including the Publication (submission consultation) and examination and proposed modification and further proposed modification stages. The LDF is continuously updated with new consultees that engage during or between consultation periods being added to the database. Over 1,000 LDF database consultees were notified by email or letter of the Proposed Further Modifications to Policy CP8 Sustainable Buildings consultation (see Appendix 1). The notification email included a website link to the council’s website where the documents could be read or downloaded and the consultation portal. Letters were sent if there was no recorded email address. The letter advised of the availability online of a guidance note for making representations (sees Appendix 4 for copy of letter and email). Consultees received full details of the duration of the representation period, where documents could be viewed and how to make comments. A guide to the proposed further modifications to Policy CP8 Sustainable Buildings and to making representations (see Appendix 4) was made available on the council website and in deposit points. Respondents were able to respond:

Electronically via the council’s Consultation Portal (http://consult.brighton-hove.gov.uk/portal ). This is directly linked to the consultation section on the council’s website and gave respondents an opportunity to respond to the response form online and gave the option to provide more detailed written responses.

By downloading from the City Plan consultation web-page and completing a response form and sending this to the council by email or by post or by hand

Written representations (not using form) were also accepted via post and by hand.

v) Media The council issued a press release on its web page on 25 September and this is set out in Appendix 3 of this document. There were two articles regarding the further proposed modifications in the Brighton & Hove Independent and in The Argus, the later contained details of the consultation. These articles are included in Appendix 3. A public notice was placed in the Brighton and Hove Independent newspaper on 25 September and available one line on the newspapers website and council’s webpage.

3. The Number of Representations Received A total of 15 respondents commented on the Schedule of Proposed Further Modifications to Policy CP8 Sustainable Buildings. Dear Consultee, Re: Consultation on Proposed Further Changes to Policy CP8 Sustainable Buildings in the City Plan Part One We are writing to you as you have previously engaged in the City Plan process or you have expressed an interest in being notified of future stages of the City Plan Part One. The council is proposing further modifications to policy CP8 Sustainable Buildings in the submitted City Plan Part One in response to the Inspector’s letter published in 13 August 2015 as part of her examination of the Plan. The Inspector has raised concerns that the June 2015 further proposed modifications to the policy just consulted upon, could not be considered effective or consistent given recent government announcements (10 July Fixing the Foundations: Creating a more prosperous nation and the 18 June Written Ministerial Statement ‘Local Planning’). The Inspector has asked the City Council to undertake public consultation on these proposed further changes to the policy. The proposed further modifications to CP8 Sustainable Buildings are focused on ensuring the policy is consistent with recent changes in national policy:

Removal of reference to zero carbon allowable solutions Removal of reference to the zero carbon homes standard Removal of the BREEAM standard for residential conversions Inclusion of reference to the Written Ministerial Statement 18 June

Sustainable Homes. Brighton & Hove propose a 19% reduction in carbon emissions against Part L 2013 which is equivalent to level 4 and therefore accords with the Ministers Statement. 2) The Planning and Energy Act 2008 Section 1(1)(c) grants local planning authorities powers to require that ‘development in their area to comply with energy efficiency standards that exceed the energy requirements of building regulations’. 3) Amendments to the Planning and Energy act have been provided for in the Infrastructure Act 2015 under ‘Section 43’ but have not been enforced, therefore MM1 are legal amendments. Section 43 is proposed to remove powers to require energy efficiency standards above building regulations. However, this has not yet been brought into force. It is not possible to know when or if the government will proceed with this statutory instrument. During this period of changeability, the future direction of government cannot be predicted with certainty despite published intention. 4) Brighton & Hove City Council prepares for the possibility that government will action a Commencement Order for Section 43 by further proposed modifications at Paragraph1, (MM1). 5) The adoption of minimum energy efficiency standards is within current legal provisions but adequate flexibility is provided in proposed modifications to facilitate any future national policy changes introduced by legislation. The Legislation.gov.uk website sets out further detailed information and debate around ‘Section 43’: (http://www.legislation.gov.uk/ukpga/2015/20/notes/division/5/45) Representation provides evidence of changing government position on energy efficiency. When the Infrastructure Bill passed through the House of Lords, changes to housing technical standards were proposed in the context of plans to introduce zero carbon housing standards from 2016. Discussion in the House (from Hansard) centred on concern that there should be no drop in energy efficiency standards during the transition to new standards. Now that the zero carbon standards have been dropped, the direction government will take on energy efficiency standards cannot be predicted with certainty. Fixing the Foundations stated that whilst a raised energy efficiency standard would not be introduced through Buildings Regulations, energy efficiency standards would be kept ‘under review’. The 21st July 2015 statement by Energy and Climate Change Secretary indicates that new announcements are to be made this autumn: "Energy efficiency is the most effective way to reduce carbon and reduce bills - it is the

win-win. I'm particularly ambitious in this area and I want to put together a long-term framework for homes and fuel poverty. I'm looking at the various initiatives that have been in place under the last Government to find out which ones are working best and which ones have not worked well, so that we can work with industry to design a system that will deliver most cost effectively…”. For the reasons given above, Brighton & Hove should be permitted to adopt a policy requiring a 19% reduction against Building Regulations Standards with their caveat for succession by national policy. Energy efficiency is a policy area in which government is making rapid and successive changes. Through the further proposed modifications at Paragraph 1 (MM1) Brighton & Hove City Council have future proofed their proposed policy, preparing for the possibility of government action. This allows national policy to supersede proposed standards in future. J Bray (1); Support Removal of BREEAM standard for residential. BHCC should operate to the same standards as the rest of the country. Prevailing building regulations are entirely adequate to ensure ecologically efficient homes that can be built at a reasonable price. In a time when we are seeking to provide more “affordable” homes the £20K+ additional cost for a modest 3 bedroom home required to meet BREAM standards is an obstacle. Even with the revisions the City Plan is still a strong disincentive to developers who can develop more profitably outside this city yet still deliver state-of-the-art energy-efficient homes. OBJECT Proposed Further Modifications are not consistent with national policy House Builders Federation (4) Seeking to go further than the current Part L of the Building Regulations would be contrary to these national standards and would be contrary to national planning policy. The consequence of July 2015 Government announcement that is has decided not to proceed with the zero carbon Allowable Solutions carbon off-setting scheme, or the proposed 2016 increase in on-site energy efficiency standards is that the energy efficiency standard for new residential dwellings remains fixed at Part L 2013. Consequently, if the Council demands a 19% improvement in energy efficiency above the current Part L of the Building Regulations for residential development it will be doing so in direct conflict with the national standard and national policy and does not have the discretion to do this.

Comments Noted. The remaining BREEAM standard in the table applies to non-residential development. Power for LPAs to require energy efficiency standards for non-residential development is not being changed by government under the Infrastructure Act; changes under S43 are applied to dwellings only. The Planning & Compulsory Purchase Act 2004, Planning and Energy Act 2008 and WMS are the framework under which the energy efficiency standards are proposed. MM1 includes wording ‘unless superseded by national policy or legislation’ in the event government approach is confirmed and/or commenced.

A 19% increase on Part L 2013 is equivalent to stipulating Code 4 for energy. House builders are only required to meet the current requirements of the Building Regulation for energy - Part L. It should be understood that the ability to go further than Part L of the Building Regulations depended very much on the Government agreeing the mechanics of an Allowable Solutions carbon offsetting scheme. Because the Government has decided not to proceed with this carbon offsetting scheme it means that the national standard remains at Part L 2013. This is what the Government has judged to be feasible. The government rational also was to “reduce net regulation on housebuilders”. Brighton Council policy undoes this. Policy CP8 should therefore be amended by removing the energy performance requirement of a 19% carbon reduction improvement against Part L 2013. The policy should also be amended to remove the reference in bullet (c) for the need for residential development to demonstrate how it “facilitates on-site low or zero carbon technologies…” etc. Applicants are only required to meet Part L of the Building Regulations. The manner in which they do so will be a matter for them to decide. This cannot be made a requirement of planning permission. The wording of Part 1 of the policy reads: “All development will be required…”. In keeping with the change to the preamble of this policy which replaces the word ‘require’ with the word ‘seek’ Part 1 of the policy as the very least should be changed to read: “All development will be encouraged to achieve…”. However, in keeping with our argument above, any requirement or even encouragement that applicants achieve a 19% improvement on Part L should be removed from the plan since this is contrary to national policy. The difference between the words ‘require’ and ‘seek’ or ‘expect’ (the word used in Part 2 of the Policy) is largely semantic and it is unclear how these nuances would be interpreted by applicants and decision-takers. In effect an ‘expectation’ that a developer would meet this higher standard is tantamount to a ‘requirement’ since an applicant could not be sure that his application would not be rejected if he chose only to meet the Building Regulations. The lack of clarity in the policy is contrary to NPPF paragraphs 15, 17 and 152. This lack of clarity would contribute to uncertainty and delay. Trustees of Toads Hole Valley and Pecla Investments Limited (15) The new table should be deleted as it is not necessary given that compliance with national policy and legislation is proposed to be included in paragraph 1; the requirement for minimum standards to be achieved is also not necessary and should be removed. The footnote cross reference to Code for Sustainable Homes (Level 4) should be removed in accordance with Written Ministerial Statement (18th March 2015). References in certain criteria in Part 2 of the

Allowable Solutions and ‘19% improvement on Part L’ bear no relation to each other. Allowable Solutions were created to enable zero carbon development (equivalent to Level 5). They were not intended to be used at Level 4. Policy for renewables (also known as ‘zero carbon technologies’) is supported through: Planning and Energy Act 1.1.(c) which is not subject to amendment; and NPPF paras 17, 93,97, 98. ‘Zero carbon energy’ is a description of an energy technology whereas ‘zero carbon homes’ refers to a performance standard. These are two different things. The Hyde Group (14) Draft Policy CP8 should be deleted in its entirety for the following reasons: Given that the Deregulation Act received Royal Assent

(26th March 2015), Policy CP8 should not contain any requirements relating to the construction, internal layout or performance of new dwellings in accordance with the WMS;

Any standards relating to energy performance or water performance which exceed Part L of the 2013 Building Regulations should remain voluntary for developers and not enforced by the City Plan; The Government is currently aiming to streamline the planning application process in order to increase building and growth. The duplication of legislation places unnecessary cost and complexity to the development control process for applicants.

The requirement to demonstrate that particular BREEAM or performance levels will be achieved for proposed developments is normally addressed by planning conditions.

The process of obtaining the necessary BRE certificate and applying to the City Council for these conditions to be discharged can regularly take up to 6 months, thereby causing significant and unnecessary delays to the construction process.

The requirement to discharge conditions relating to sustainable building construction also places an unnecessary burden on the Council's development control team which is already under resourced.

Matters relating to sustainable construction methods left to be addressed through the Building Regulations regime. Proposed Further Modifications Have weakened policy J Hill (5) The proposed changes are execrable. If every town (and every country) simply gave up on properly limiting Co2 emissions and on energy saving in the ways suggested by this feckless and myopic government then humanity could be facing catastrophe in the next century. Thanks to recent strides forward in design that affordable homes can now be built to the highest environmental standards within required budgets. contrary to localism and are not putting local people’s wishes first. The Planning Policy Team should stand up and say no to this government's environmental vandalism. The Planning Inspector needs to put back in all the environmental protections that have been literally ruled out, and reject state-sanctioned irresponsibility. South Downs National Park Authority (SDNPA) (12) The authority recognises that these changes are in response to the Inspector’s Letter (dated 13 August 2015) to ensure Policy CP8 is effective and consistent in light of the recent government announcements. However the Authority would like to express disappointment that this policy wording is being diluted. R Scott (13) The modified policy seems to remove almost all mandatory ‘requirements’; and entirely aspirational which will leave both applicants and public in an unacceptable (and thus ‘unlawful’?) state of uncertainty which risks wasting BHCC time in repeated discussions on applicability of policy. As the policy also appears not to identify any sanctions for non-compliance with the policy, CP8 is a waste of everyone’s time and should be deleted. If the government no longer permits LPAs to create legally binding sustainability provisions CP8 should be deleted (with possibility of developing a voluntary policy that would apply to council developments and those of all other public sector bodies).

Page 9 of the SA recommends the wording that appears in the Main Modification that is being consulted upon. We oppose this wording – the use of ‘required’.

Comment not considered to be directed at the SA. See officer response under MM1 above. The SA clearly sets out at page 6 the changes to version 1 of the policy that the SA assessed, not the SA recommendations. With Version 1 of the policy, the SA assessed the change in policy wording which included the change from “required” to “expected”. The SA recommended on page 9 that this should not be pursued due to the uncertainty it raised. This led to version 2 of the policy being developed. Version 2 of the policy is appraised at Page 10 onwards

These types of houses are unlikely to match present needs such as garage and storage space. There is a shortage of land that can be developed so we may have to build much taller. R Scott (13) Given recently submitted Devolution bid by BHCC and neighbouring authorities to unify at least their economic activity and governance (which self-evidently includes land use planning and use allocations), all current work on City Plan should be suspended and work begin to draft modifications as appropriate to ensure overall coherence and consistency between the Planning Framework of all these local authorities and the development and determination of a single Master Local Plan.
