    Energy North America Inc., submitted its Public Invo lvement Program plan (" I'll' '') for review pursuantio Section IOOOA of the rules of the New York State Board on Electl;c Genera tion Si ting and theEn vironment ("S iting Board"). CVWP seeks a cen ificate of environmenta l compatibility and public needunder Ar ticle X of the Public Service Law to construct an approximate ly 200-285 megawatt wi nd electricgenera ting facility in the Town of Cape Vincent, Jefferson County, New York (the "Project").

    Department of Public Service ("DpS") professionals reviewed CVWP's proposed PIP and, onOctober 17, 2012, provided CVW I' a number of recommended additions to the I'll' to sat isfy relevantrequirements in the new Article 10 regu lations. CVWP hereby submits its revised PIP which addressesand incorporates all of th e DPS recommendations. CVWP's revised program provides the framework foreffective dissemination ofinfon11ation about the Project, events, Anicie 10 procedure and opportunitiesfor public participation and comment. This revised framework allows for a robust public involvementpro,b'Tam anticipated to fo ster meaningful and educared participation by slakeholders and othe r interestedpan ies.

    PUBLIC INVOLVEMENT PROGRAM

    l. INTRODUCTION

    Case 12-F- 0410

    According to the rules of the ew Yo rk State Boa rd on Elect ric Generat ion Siting andtbe Enviro nment ("Sit ing Board" ), appl icants proposing to submit an app licat ion to constructa major elect ric generating fac ility under Alt icle 10 of the Public Ser ice Law (" PSL") mustsubmit a Public m Program plan for Depa rtment of Publ ic Service C'DPS") reviewat least 150 days prior to filing a Preliminary Scoping Statement ( 16 NYC RR 1000 .4). ThePu bl ic Ln volvement Program (, -PIP" or the "Plan") must include:

    ( I ) consul tat ion with the affected age ncies and other stakeholders;(2) pre-app lication ac ti vities to encourage stakeho lders to participate at the earliest

    opportuni ty;(3) activities des igned to educate the publ ic as to the spec ili c proposa l and the Article 10

    review process, including th e ava ilabi lity of fun ding for municipal and loca l part ies ;(4) the establishment ofa webs ite to disseminate infonna tion to the pu bl ic ;(5) notifica tions; and(6) act ivities designed to encourage part icipation by stakeho lders in the certification and

As discussed ingreate r detail in the fo llowing sect ions, the Project is actua lly the product of combining twoadjacent proposed wind farms. Since 2007, BP Wind Energy has been seek ing approva l toconst ruct th e Cape Vincent Wind Fa nn ("CVW F") under the State Environmental Qua lityReview Act C'SEQRA"). Con tem poraneously, Acc iona Wind Energy was seeking approva l,a lso under SEQRA, to const ru ct the Sl. Law rence Wind Farm ("S LWF"). BP Wind Energyacqui red Acciona' s rights to the SLWF project in February 20 12. Accordingly, forapprox imately five years, bot h CVWF and SLWF have been subject to extensive pub licrev iew and participation. In fact , the SLWF co mpleted the SEQRA process wi th a favo rableFindings Statement issueci by the Town of Cape Vincent in Sep tember 20 I 0, while th eCVWF completed a substantial port ion of th e S EQRA process hav ing subm itted both a DraftEn vironmental ~ l 1 p Sta tement ("DE lS" ) and Supplement al Drall Environmen ta l Im pactStatement ("S DEIS" ).

    CV WP has decided to submit an Article 10 application for a number of reasons. TheArticle 10 process affords CVW P a "one stop" applicat ion process as opposed to thetrad itional SEQRA approach whi ch requires an applicant to deal with a panoply of state andloca l permitting requirements. Additionally, the Article 10 process contains a 12 month timeperiod for rev iew of a complete app lica tion as we ll as the abil ity to pre-empt unreasonableloca l laws and regulations. The Article 10 process also a llows the transmission lin e review tobe included in one permitting review.

    Before Article 10 was enacted, loca l si ting of elec tric generating fa cil ities wasco nducted under SEQRA. Under SEQRA, loca l agenc ies or governments genera lly assumethe role of lead agency fo r the purpose of eva luat ing the environment al com patibi lit y aproposed generating projec t. Now , however. by law SEQRA does not apply to major electricgenerating fac ilities over 25 MW.

    Article 10 incorporates an d expands upon the SEQRA process. For exam ple, underSEQRA, before fi ling a DEIS app licants go through a scoping phase. Similarly, app lican tsunder Article 10 must prepare a preliminary scoping statement ("P reliminary Scop ingStatement" or " PSS"), conduct stud ies and then prepare and file an app lica tion. Article 10then provides for hearings and a reco mmended decision by the presiding examiner, a ll openfor comment by stakeholders, befo re the Siting Board renders a decision. Article 10 a lsoin volves the same federal. state. and loca l agenc ies that partic ipate in the SEQRA process.Un like SEQID\ , however, from the out set Article 10 requires comprehensive public outreachand in volvement which con tinues tlll'oughout th e ent ire process. To fo ster publi cinvolvement, Article 10 requires th at applicants submit to DPS for comment , a PublicInvolvement Program plan lh at the applicant will fo llow throughout the Art icle 10 process.In addition, during both the Preliminary Scoping Statement phase, as we ll as th e applicat ionphase of Art icle 10, the applicant is required to prov ide intervenor fundin g for use byintervenors and other parties to reta in experts and lega l counsel. SEQRA does not req uireintervenor funding and has a much more limited public involvement program. The SEQRAprocess also has no provision for pre-empt ing loca l or state law provisions that are deemed tobe unreasonably restricti ve.

    As necessitated by Article 10, CVWP submits this Public Involvement Program planto build upon extensive public outreac h already co nducted in th e CVWF and SLWF SEQRAproceedings.II. THE PROJECT

    A. Company In formationBP is a global leader in energy. hl the U.S . alone, BP ha s in vested more th an anyother oi l and gas company in the past tive years. In fact , with more than $52 billion in cap ital

    spending between 2007 and 20 II , BP in vests more in the U.S. than in any other country. Thecompany is the nation's second largest produce r of oi l and gas , a major oil refiner and aleader in a lternative energy sou rces inc luding wind power and biofuels.By the end of20 12 , BP's wind energy business will have built and will be ope rating

    around 55 bill io n worth of wind fa rms across the U.S. The company has interests in 16 windfarms in Ca li fornia, Co lorado, Idaho, Hawaii, Indiana , Kansas, Pennsylvani a. South Dakotaand Texas. BP Wind Energy has three wind farms in const ruction and in 2012 BP WindEnergy 's wi nd business ranks among the top three developers in U.S. By year end, the2

    company will have a gross generating capacity of over 2,500 MW - enough affordable,renewable electricity to power over 775,000 average American homes.

    At BP Wind Energy, throughout the planning stage of each new wind farm, weconduct a thorough assessment of the potent ial soc ial, environmental and conservationimpacts of our projects and take steps to reduce impacts through engagement wi th thecommun ity, engineering, design, and technology.

    B. Project Summa.-y of the proposed Cape Vincent Wind Farm, JeffersonCounty, New YorkSince 2005 , there have been two wind projects proposed for the Cape Vincent area:

    Acciona's 79.5 !W SI. Lawrence Wind Fal11l (SlWF) and BP Wind Energy's 210 MWCape Vincent Wind Farm. Since the acquisition of the SLWF in February 20 12, the Projectteam has worked diligent ly to optimize the foo tprint of the revised Cape Vincent Wind Fann.The combined Project, the Cape Vincent Wi nd Farm (CVWF), will yie ld a project thatdelivers greate r economic and environmental benefits over the prior two stand-alone projectsfor those who live in Cape Vincent and the greater Jefferson Coun ty area. The SlWF des ignhad consisted of 51 turbines whi le the original Cape Vincent Wind Fann had envisioned 84turbines, making the total number of turbines between the two projects equa l to 135 turbines.After an extensive review to opt im ize the layout of the combined project , CVWP hasremo ved II turbines, reducing the s ize to 124 turbines. Many of the eliminated turbinelocat ions had been sited close to the SI. Lawrence River, an area the Town of Cape Vincentand the community ind icated was sensi tive. By incorporating commun ity feedback in to thelatest design, the project removed the turbines closest to th e SI. Lawrence River and nowgenera lly mainta ins a setback of one mile trom Ule SI. Lawrence Ri ver.

    By removing the turbines closest to the SI. Lawrence River, the Project will avoid theimpacts that would have been associated wi th these turbines. This includes potential visual,noise, wetland, and cultu ral impacts. A pre liminary Project turbine array is attached asExhibit I.

    The SLWF had contemplated using turbines tbat ranged in output from 1.5 to 3.0 MW perturbine, while the range for turbines under consideration for the CVWF was from 1.5 to 2.5MW per turbine. The maxi mum blade-tip height was est im ated to be app roximately 430' andthe rotor width (diameter) to be approximately 300" to 328 ". The latest turbine options underconsideration would have the maximum blade-tip height increasing to 499' and the rotorwidth to approx imately 390'. The increased turb ine height allows the Project to takeadvantage of imp roved technology whi le reducing the total number of turbine locat ions forconstruction.

    By increasing the height of the turb ines , the potential visual. noise, wetland, and culturalim pacts will change. Stlldies are in process to determine the relative impacts associated witha taller turbine. Setbacks for the combined CVWF have been increased in some areas or havebeen maintained; no setbacks bave been decreased. The table below provides a summary ofkey setbacks and illustrates how the combined Project ut ilizes setbacks tbat match or exceedprevious ulresholds:

    CVWF is owned and w ill be operated 100 percent by BP Wind Energy. The Projectis pro posed on some 26,000 acres of private land th at is primarily agricultural, with windturbines to be s ited in the Town of Cape Vincent and the associated transmission line andrelated equipment sited in the Towns of Cape Vincent and Lyme . The Project does notinclude any wind turbines in the Town of Lyme. Once built, tbe footprint of the wind farmwould cover a small amount of the total leased acreage enabling farmers to continue withtheir regular fanning activities and rema in as stewards of their land. For purposes of thi sPublic Involvement Program, the Preliminary Study Area for the CVWF has been identifiedas an area within a five mile radius of the pro posed P roject in frastructure and interconnec tionfacili ties. It is expected that the Preliminary Scoping Sta tement will further define the areasto be stud ied for potentia l impacts.

    Once in operation the Cape V incent Wind Fa nn will add significant renewable powergeneration to the New York State power system. At approximately 200-285 MW in size, theCVWF could generate enough renewable energy to power a c ity the s ize of Syracuse, help ingthe State o f New York to meet the renewable energy goa ls of its Renewable Port fo lioStandard of 30 percent by 2015. The CVWF is also closely aligned w ith the state energy planand supportive of Governor Andrew Cuomo's Energy Hi ghway Blueprint issued by the ewYork State En ergy Highway Task Force. The renewable power that the CV WF w ill generatewill avo id significant emissions of air pollutant s and greenhouse gases generated byconventional power plant s such as coa l and gas fu ed plants. Wind fann s can he lp mitigatethe hannfi.Il impacts these pollutants have on human health, wildli fe and th e ecosystem.

    C. Economic Benefits of th e Cape Vincent Wind FarmThe Cape V incent W ind Farm w ill generate sign ificant additional an d predictable

    annual re enue for landow ners, res idents or the greater Cape Vincent community, andJefferson County. Development of th e wind fa rm will mean an investment by BP WindEnergy of approximately 5300 mill ion.

    Based on a previously approved tax structure by the Jefferson County IndustrialDevelopment Agency for a proposed wind fa rm withul the Coun ty, and assuming that the

    CVWF generates approximate ly 200 MW, the CVWF would make an annual tax payment of$ 1.7 million in year one of the wind fa lln 's operation (escalating to over $2.4 million in year15 ), benetitting the School Districts, the Town of Cape Vincent and Jefferson County. Thi smoney flows tlu'ough th e local communities to improve schoo ls, roads, and other loca linfrastructure, and is important to help stimul ate economic recovery at a time whencommuniti es have been hard bit by the recent economic down tum. This is particularlytimely, as the Cape Vincent Elementary School budget, which is in the Thousand IslandSchool District, ha s been struggling to the point of possible closure. Addi tionally, annualro ya lty payments to landowners participating in the Proj ect wi ll be in excess of$ 1 million peryear once the wind farm is operationa l. The economic benefits ol'the Cape Vincent WindFalln wi ll playa critical role in providing a sustainable communi ty th at wi ll ensure growthand economic stren gth for future generat ions,[[I. PRIOR PUBLIC INVOLVEiVfENT

    To place the Public Involvement Program pl an in context, it is necessary tounderstand the significant amount of public pa'1icipation and outreach already conducted inthe SEQRA proceedings for the indiv idual projects.' Since 2007 an extensive amount ofoutreach has been carried out in the cour se of developing the SI. Lawrence Wind Farm andCape Vincent Wind Farm projects. Both of these projects have been the subject of signiti cantand extens ive SEQRA review which bas included the local co mmunity, members of thepublic, and stakeholders, a ll of which have been ve ry actively engaged and ha ve been keptwell infomled about wind power generally and, more spec ifically, about the proposed windprojects fo r the area. In fact , the SLWF completed the SEQRA process with a favorableFind ings Statement issued by the Town of Cape V incent Board in September 2010. Adetailed c1u'onology of the public outreach effort s that have been conducted to date isincluded in Exhibit 2.

    IV. PROPOSED PUBLIC INVOLVEiHENT PROGRAMT lu'oughout the Al1icle 10 application process, CVWP will con tinue its strong trackrecord of close community engagement and outreach. CVWP comm its to take the followingsteps to inform . engage. and so licit add itiona l input ti-om statutory parties, the localconununity, general pUblic, and other stakeholders:A. Identification Of Specific StakeholdersCVWP in consultation wi th its attomeys, technical consultants and commun ityrelations professionals, has developed a list of stakeholders using the following criteria (apreliminary spec.ific list of stakeholders is attached as Exhibit 3):

    Group, Lions C lu b, Chambers of Commerce, American Legion, andthe lmprovement League);9. Host landowners who have a land agreement with CVWP;lO. Adjacent landowners w ho are within 500 feel ora co ll ec tion lin e o r2,500 feet of a turbine; andII . State and federal elected officials representing the host municipalities.

    Additiona lly, CVWP has identified a potential environmental justice area that may beaffec ted by the Project. CV\VP has used the New York State Department of En vironmentalConservation C'DEC") current county maps showing potential environmental justice areas.These maps were generated using the 2000 U.S. Census block groups 01'250 to 500households each to identify census block groups that had populations that met or exceeded atleast one of the following thresho lds:

    I. At least 33.8 percent of the population in a rural area reported th emse lves to bemembersof minori ty groups; or

    2. At least 23.59 percent of the population in an urban or rural area had householdincomes below the federal poverty level.

    CVWP will use the above criteria and the 20 I0 U.S. Census data to reflect any changes in thepercentage minor ity populations and income threshold populations within the Census blockgroup, For purposes of detennining disproportionate impacts 00 envi ronmental ju sticecommunities, the impact study area for the Project will be defUled as a one-half mile radiusaround the loca tion of the turbines or transmission infrastructure located within or adjacent tothe portion of the Project within or near the potential environmental justice areas (the " ImpactStudy Area") . The "adjacent communit ies" will be defined by the next one-half mile radiusaround the Impact Study Area .

    Based on the 2000 Census Data , CVW P has identified tbe presence of a potent ialenvironmental justice area in the northeast comer of the Town ofCape Vincent. Th isenvironmental justice community is depicted on the attached lllap in Exhibit 4. Thenortheas tem pOl1ion of the Project containing approximately I I turbines. is located within thecensus block group that overlays this area. The area associated with these turbines is definedas rural. Ni nety-three percent of the population in tbis census block group ha s an 31Ulualinco me that is less than the poverty tlu'eshold and 45 percent of the population is defined as a'M inority population' as identified or reco l,'I1i zed by the U.S. Census Bureau as Hi spanic,African-American or Black , As ian and Pa citlc Islander, o r Ame rican [ndian. Thi s populationincludes a prison population whi ch co ntributes to th e minority designation of the potentialenvironmental justice area but not the povert y designation. The Project is not anticipated tohave a potentiall y significant adverse enviro nmenta l impact resu lting from it s construct ionand/or operation that is di fferent in type, scope, or magnitude compared to the populationlocated in the broader geographic area surrounding the proposed wind farm.

    While the Project is not an ticipated to have a potenti ally signi ficant adverseenviromn ental impact resulting from its construction and/or operation tbat is different in type,scope, or magnitude compared to the popUlation loca ted in the broader geographic areasurrounding the proposed wind farm , CVWP plans to implement the following targetedoutreach measures to address th e potential environmental ju st ice area:

    Working witb DEC, CVWP will identify stakebolders loca ted in the Impac t StudyArea, including residents, local elected officials s llch as the Town Supervisor. andcommunity-based organi zations. Cape Vincent Wind Power will confer with DECand co mmunity leaders initia lly to identify the specific methods of communicationthat would be most success ful for th e stakeholders within the environmental ju sticearea. For in stance, CVWP will work with comlllunit y leaders to detemline ifadditional public meetings, loca ted within the envirorunental justice area are neededto so lic it input from stakeholders in the co mmuni ty and to provide an opportunity toengage in a dialogue wi th members of the Project team. Altematively, CVWP w illalso consider if it may be necessary to provide transportation to and from scheduledevent s in Cape Vincent to accommodate participation of the community locatedw ithin the environmental ju stice area. Fo llowing discussions with the loca lcommunity leaders , o ther communica tions mechani sms may be identified andcons idered for implement ation by CVWP.

    Cape Vincent Wind Powe r will also assemble a primary contact list of indi viduals andorganizat ions with a direct stake in the envirorunental ju stice co mmunit y. This mayinclude reaching out to:

    o residents/neighborhood groups who are near or adjacent to the proposedProject;

    o community boards, community leaders. loca l community. civic andrecreational organizations, environm ental and business group s;

    o people who have expressed an interest in the proposed Project by attend ingpublic meet ings, writing or calling;o people who have expressed an interest in sinlilar projects or ill projects

    affecting the same neighborhood or com munity;o neighborhood re ligious es tab lislunents; ando elected o ffi cials who li" e in and/or represent the community o f concem.

In addition, the project ha s alsomaintained a website containing all of the updated documents and studi es co ntained inth e Draft Environmental Impact Statement (DEIS) and Supplemental DEIS submitted toth e Town of Cape Vincent. To date, all ac ti vities ha ve been des igned to reachstakeholders most directly impacted by th e proposed wind fann, including local res id ents,town official s of the Towns of Cape Vincent and Lyme, local media outlets, andstakeho lders tlu'oughout the region.     C. Key Issues Identified in Prior Public OutreachFo llow ing is a list of the areas of conce rn most commonly raised by members of thecommunity in the Towns of Cape Vincent and Lyme and how the concems wereaddressed. These issues likely will not change in the up coming Ani cle 10 proceedingthereby gi v ing CVWP the advantage of know ing ahead of time the main conce rn s ofstakeholders and a llow ing CVWP to conduct a Public Invo lvement Program to addresssuch concern s. Turbine noise and visual impacts to homes loca ted on the St. Lawrence Ri ver.

    The concelllS over the sound leve ls of wind turbines are a community-sensitiveissue. In 2007, in preparation for the first open house event, CVWF created aninfo rm a tion boa rd , "Sound Assessment Study" to he lp explain background soundstudies performed in the Cape V incent area, (see Exhibit AS). With the SLWFhaving been acquired ea rli er th is year, the layout for the revised CVWF wasoptimized, reduc ing the proj ect size from 135 turbine locations to 124 turbinelocations. Thi s reduction in project size resulted in elimination of several turbinelocat ions that had been origina lly been s ited in closer proximi ty to the St .La wrence Ri ver and Village of Cape V incent (two areas deemed sensitive by thelocal conununity). Compared to the origin al array plan, the elimination ofturbines reduces the concellls over sound leve ls and visual impacts along the mostsensiti ve areas.

    Impacts of wind power on property va lues. Many o f the conce rn s raised byres id ents related to potential impacts on pro perty va lues fro m wind turbines,especially by owners of vacation homes loca ted near the wa terfront. To addressthese concerns the deve lopment team coord inated a publi c education forum on8/3 III I (see above): The keynote speaker, Mark Thayer, co-author of theBerkeley ational Lab, U.S. DOE funded stud y on the impacts of wind powerdeve lopments on propeny va lues. The developers invited an independent experton thi s issue to expl ain hi s peer-rev iewed study and to answe r ques tions about theresul ts of his findings to address this concelll. Based on the data and analys ispresented in this repOlt, no evidence is found that home prices sUlTounding windfac ilities are consistently, measurabl y, and significantly affected by e ither theview of wind facilities or the distance o f the home to those facilities.

    Impacts on tourism: The community raised conce rns about the impacts of a wi ndfarm on summer tourism. The Economic [mpacts of Wind Energy Deve lopmentrepon , addresses tourism and wind 1 l l 1 and includes tourism statis tics fromoperating wind fann s (See Ex.hibit F- I, pages 16-1 7). The report c ites thepositive tourism impacts of the neighboring Wo lfe Island Wind Fann , which iscomparabl e in size at about 200 1v[W and \ hich recently reac hed commercialoperation in June 2009. The 8/3 1/1 1 public educa tion fo rum (see above) includedstati stics about the impacts of operating wind fa l111S on tourism and how thepresence of wind turbines do not nega tivel y impact tourism of comm unitiessimilar to the Cape Vincent area.

    Impacts of wind turbines on birds, bats, and wildlifeBP Wind Energy organized meetings with a key, regiona l environmental group,Save the Ri ver on two occasions (11112 /07 and 8/2411 0). An initial mee ting tookplace to introduce BP and answer questions and conc ems about wind power in thearea. BP Wind Energy organized a second meeting in August 20 I0, following thestaltup of the Wolfe Island Wind Fallll, to address conce rns raised by the groupabout the impacts of wind turbines on birds tn rhe reg ion.
