RE: Complaint against State Senator Maria Sachs for violation of s. 106.0701, F.S.

Dear Chairman:

Please accept this letter as my formal complaint against State Senator Maria Sachsfor violation

of section 106.0701, Florida Statutes.

1. I allege that Senator Maria Sachs has failed to file form DS DE-102 with the departmentPursuant to Section 106.0701 (1) for her political committee Moving Florida Forward PC.

2. I allege that Senator Maria Sachs has failed to disclose on her website,http://movingfloridaforward.net within five business days after deposit all contributions

receivedand expenditures made by the organization, pursuant to Section 106.0701

(4), F.S. for her political committee Moving Florida Forward PC.

In support of this allegation, I offer the following for your consideration:

1. Section 106.0701 (1), F.S. requires "candidates for such offices who directly or indirectlysolicit, cause to be solicited, or accept any contribution on behalf of an organization that

is exempt from taxation under s. 527 or s. 501(c)(4) of the Internal Revenue Code, which

such individuals, in whole or in part, establish, maintain, or control, shall file a statement

with the division within 5 days after commencing such activity on behalf of the

organization."

2. A letter dated June 4, 2013 from the division acknowledged the statement oforganization for Moving Florida Forward PC.

3. On August 5, 2013, Moving Florida Forward CCE transferred $21,465.05 to MovingFlorida Forward PC, and notified the division in the attached letter that Moving FloridaForward CCE will cease business and be disbanded on August 15, 2013.

4. Section 106.0701 (3), F.S. requires individuals who file a statement under subsection106.0701(1), F.S. to promptly create a public website that contains a mission statement

and the names of persons associated with the organization. To comply with this

requirement, Senator Maria Sachs has created http://movingfloridaforward.net.

5. On August 5, 2013, Moving Florida Forward CCE transferred $21,465.05 to MovingFlorida Forward PC, and notified the division in the attached letter that Moving Florida

Forward CCE will cease business and be disbanded on August 15, 2013.

6. I have reviewed http://movingfloridaforward.net/ and read the declaration therein thatMoving Florida Forward PC is affiliated with Senator Maria Sachs.

7. Based on this public declaration, it is my personal knowledge that Senator MariaSachs established, controls, and is affiliated with Moving Florida Forward PC.

8. On January 19, 2014, I reviewed and downloaded as text files (attached) campaignfinance activity for Moving Florida Forward PC using the Campaign Finance Data Base at

http://doe.dos.state.fl.us. According to the departments website, the information

contained therein was obtained from the Committee's Campaign Treasurer's Report

filed with the Division of Elections.

9. According to the Campaign Finance Data Base at http://doe.dos.state.fl.us and thepublic website for Moving Florida Forward PC, on 12/30/2013 the Florida Panthers

Hockey Club LTD were solicited for $6,000.00 and on 11/14/2013 CSFI - R (New York

Developer) was solicited for $4,000.00.

10.Because Senator Maria Sachs established, controls, and is affiliated with MovingFlorida Forward PC, it is my personal knowledge that she directly or indirectly

solicited, caused to be solicited, or accepted contributions on behalf of Moving

Florida Forward PC on December 30, 2013 and on November 14, 2013, without

filing the required statement of solicitation required under s. 106.0701, F.S.

11.On January 19, 2014, I accessed http://movingfloridaforward.net and took the attachedscreenshot.

12.According to the Division of Elections (photos attached), on 11/12/2013 anexpenditure of $2,430.00 was paid to MESSER CAPARELLO, P.A. at 2618

CENTENNIAL PLACE TALLAHASSEE, FL 32308 for LEGAL/ADMINISTRATIVE FEES.

No such disclosure has been posted to the webpage.

13.Because more than five days have elapsed since the expenditure was made on11/12/2013 and January 19, 2014, when the webpage was accessed, I allegeSenator Maria Sachs and Moving Florida Forward PC have violated s. 106.0701 (4),

F.S.

Therefore, I ask the Florida Division of Elections to fully investigate this matter, and where

appropriate, apply the applicable sanctions.
