    EXPLANATORY NOTE NOTE EXPLICATIVE

    The Bill enacts the School Boards Collective Bargaining Act,2013. The Act establishes a framework for two-tiered bargain-ing for collective agreements between school boards and theiremployees. Here are some highlights of the Act.

    Le projet de loi dicte laLoi de 2013 sur la ngociation collec-tive dans les conseils scolaires. La Loi cre un cadre permettantlinstauration dun systme deux paliers pour la ngociationdes conventions collectives entre les conseils scolaires et leursemploys. En voici quelques faits saillants.

    In general terms, theLabour Relations Act, 1995 governs collec-tive bargaining within the framework established by the newAct. (See section 4 of the Act.) The new Act may be enforcedas if it formed part of that Act. (See section 43 of the Act.)Expressions used in the new Act relating to collective bargain-ing have the same meaning as in theLabour Relations Act, 1995and expressions relating to education and the school systemhave the same meaning as in theEducation Act.

    The Act applies to every school board in Ontario, to the bargain-ing agents that represent their employees, to the employeesthemselves, and to the employer bargaining agencies and em-

    ployee bargaining agencies that are designated for the purposesof central bargaining. (See section 3 of the Act.) The expres-sion school board, as defined in subsection 2 (1) of the Act,refers to district school boards, school authorities and the Pro-

    vincial Schools Authority, unless the context requires otherwise.

    Sections 5 to 11 of the Act provide for bargaining units andbargaining agents. For teachers, the bargaining units and bar-gaining agents are as specified in sections 9 and 10 of the Act.(Currently, those bargaining units and bargaining agents arespecified in Part X.1 of the Education Actand in theProvincialSchools Negotiations Act.) For school board employees who arenot teachers, the bargaining units and bargaining agents are asdetermined under theLabour Relations Act, 1995. (See sections7 and 11 of the Act.)

    Sections 12 to 22 of the Act set out the framework for centraland local bargaining. Under subsection 12 (2) of the Act, cen-tral bargaining is mandatory if a central table is established un-der the Act for specified school boards and specified bargaining

    bargaining agency and an employee bargaining agency. Forlocal bargaining, the parties are a school board and a bargainingagent. The Crown is entitled to participate in central bargaining

    but not in local bargaining.

    The rights, privileges and duties of employer bargaining agen-cies, employee bargaining agencies and the Crown in connection

    ith central bargaining are set out in sections 15 to 18 of theAct. An employer bargaining agency cannot exercise specifiedrights and privileges under the Labour Relations Act, 1995 un-less it has the prior consent of the Crown to do so. (See subsec-tion 15 (2) of the Act. See also subsections 34 (4), 41 (1), 42 (3)and 44 (2) of the Act.)

    The employee bargaining agencies for teachers are designated insection 19 of the Act. For other employees, the Minister is au-thorized to designate employee bargaining agencies. (See sec-tion 20 of the Act.) A council of trade unions may be designatedas an employee bargaining agency in specified circumstances.

    The employer bargaining agencies for school boards are desig-nated in subsection 21 (1) of the Act. In specified circum-stances, a council of trustees associations may be designated asan employer bargaining agency. Under section 22 of the Act, acommittee may be established by the Lieutenant Governor inCouncil to exercise the rights and privileges and perform theduties of a designated employer bargaining agency if, in the

    Section 23 of the Act provides for the establishment of centraltables. Central tables are established in the Act for teachers

    bargaining units. The Minister is authorized to establish othercentral tables. A central table cannot have more than one em-

    ployer bargaining agency or more than one employee bargainingagency.

    Sections 24 to 28 of the Act govern the scope of central andlocal bargaining.

    Under subsection 24 (1) of the Act, the scope of central bargain-ing at a central table shall be bargained by the parties at the tableand the Crown. Certain restrictions apply. The Crown is per-mitted to reserve a matter for a central table on the basis that, inthe Ministers opinion, the matter could result in a signi ficantimpact either on the implementation of provincial education

    policy or on expenditures for one or more school boards. (Seesubsection 24 (2) of the Act.) If the parties and the Crown donot agree upon the matters to be included within the scope ofcentral bargaining at a central table, any of them may apply tothe Ontario Labour Relations Board to decide the issue. (Seesubsection 28 (2) of the Act.)

    Sections 29 to 38 of the Act contain several of the modificationsto theLabour Relations Act, 1995 that apply in connection withcentral and local bargaining under the new Act. For example,the date for giving notice to bargain may be advanced by regula-tion. (See subsection 31 (5) of the Act.) Section 34 of the Actspecifies modifications relating to strikes and lock-outs. Section38 specifies that, if both central and local bargaining occur, amemorandum of settlement of the central terms must be ratified

    by the parties at the central table and the Crown, and a memo-randum of settlement of the local terms must be ratified by the

    parties to the local bargaining.

    Sections 39 to 42 of the Act govern collective agreements. Theparties to a collective agreement are the school board and thebargaining agent. If both central and local bargaining occur, thecollective agreement includes the central terms and the localterms. (See section 39 of the Act.) If a collective agreementcontains central terms, the parties who were at the central tablemay, with the consent of the Crown, settle a difference regardingthe interpretation of those terms. (See section 42 of the Act.)

    Sections 46 to 53 of the Act set out consequential amendmentsto several other Acts. Part X.1 (Teachers Collective Bargain-ing) of theEducation Actis repealed. The short title of thePro-vincial Schools Negotiations Actis also changed: it becomes the

    Provincial Schools Authority Act.

    Provincial Schools Authority means the ProvincialSchools Authority continued by section 2 of the Pro-vincial Schools Authority Act; (Administration descoles provinciales)

    school board means a district school board and, unlessthe context requires otherwise, includes a school au-thority and the Provincial Schools Authority; (conseilscolaire)

    24. (1) The scope of central bargaining at a centraltable shall be bargained by the parties at the table and theCrown, subject to the restrictions set out in this sectionand sections 25 and 26.
