INTERAGENCY AGREEMENT BETWEEN DEPARTMENT OF CHILDREN, YOUTH, AND FAMILIES AND WASNGTON STATE OFFICE OF PUBLIC DEFENSE THIS INTEGENCY AGREEMENT (IAA) is made and entered into between the Department of Children, Youth, and Families (DCYF) and the Office of Public Dense (OPD). I. Purpose II. The puose of this IAA is to establish the basis of a relationship between the Department of Children, Youth, and Families and the Office of Public Dense whereby OPD may receive partial reimbursement r payment r services incued by OPD r the representation of parents in dependency and termination cases. Background Under RCW 13.34.090 and RCW 13.34.092 all indigent parents who have children who are subjects of a dependency or termination of parental rights case are entitled to an attoey to represent em in those dependency and teination cases, d in appeals related thereto. The Office of Public Dense (OPD) manages the Parents Representation Program, which contracts with attoeys and agencies that provide legal representation to pents in dependency d termination proceedings brought under chapter 13.34 RCW. Pursuant to RCW 2.70.020, OPD manages the program that provides and nds attoeys to represent indigent parents in these proceedings. OPD also administers the indigent appellate proam r the state, pursuant to RCW 2.70.020(1)(b), whereby OPD contracts with attoeys who represent indigent parents in dependency and teination appeals. State nds pay r this attoey representation and related litigation costs. Title IV-E reimbursement of expenses r legal representation r parents in dependency and termination cases and appeals shall be in accordance th the Children's Bureau Child Welfe Policy Mual's stated objectives of ensuring reasonable efforts are made to prevent removal d finalize children's peanency plans, ensuring that parents and youth are engaged in and complying with case pls, and the Manual's requirement at attoeys r parents' representation be independent of and not overseen by the IV-E agency. As a matter of constitutional separation of powers, responsibility to regulate the practice of law is assied to the judicial branch and operationalized through rules adopted by the Washington Supreme Court. Background
