MOTION FOR LEAVE TO FILE UNDER SEAL OF OF SOUTHERN CALIFORNIA EDISON COMPANY (U 338-E) REGARDING

CONFIDENTIAL EX PARTE COMMUNICATION

Pursuant to Rule 11.4(a) of the Commission’s Rules of Practice and Procedure, Southern

California Edison Company (SCE) hereby respectfully submits this motion to file under seal the

confidential version of an ex parte communication. As detailed in SCE’s timely October 16,

2014, ex parte notice in this proceeding, following the Commission’s Least-Cost Dispatch

workshop held in this proceeding (SDG&E LCD Workshop), at approximately 4 p.m. on

October 15, 2014, SCE Senior Attorney Russell Archer sent a written communication, which

consisted of an email with a non-confidential attachment to Administrative Law Judge (ALJ)

Roscow; Matthew Tisdale, Advisor to Commissioner Florio; and the attendees of the SDG&E

LCD Workshop (which included employees of SCE, Pacific Gas & Electric Company, San

Diego Gas & Electric Company, the Office of Ratepayer Advocates, and Energy Division). The

email and attachment are attached hereto as Exhibit A. SCE sent the email in response to a

question from Michelle Kito of the Energy Division.

In addition, at approximately 4 p.m., Mr. Archer sent a follow-up email to ALJ Roscow,

Mr. Tisdale, Ms. Keto, and ORA’s Ravinder Mangat, which included the confidential (i.e.,

unredacted) version of the attachment referenced earlier (Confidential Attachment). That second

email is attached hereto as Exhibit B.

Pursuant to direction received from the Commission’s Docket Office, SCE is now filing

this motion for leave to file under seal to protect the confidentiality of the Confidential

Attachment. Good cause exists to grant this motion because the Confidential Attachment is

confidential pursuant to the Commission’s rules and decisions, including D.06-06-066. As noted

in the email in Exhibit A, the attachment is an excerpt from SCE’s ERRA review testimony (in

A.14-04-006). As noted in the email in Exhibit B, the Confidential Attachment is the

confidential version of that testimony. That confidential testimony was supported by a

confidentiality declaration when it was originally served in A.14-04-006, a copy of which is

attached hereto as Exhibit C. The confidentiality declaration demonstrates the reasons the

testimony is confidential pursuant to the Commission’s rules. Accordingly, SCE’s motion to file

under seal should be granted. In accordance with Rule 11.4(a), SCE has attached a proposed

ruling granting this motion as Exhibit D hereto.
