1 Himachal Pradesh State Electricity Board Limited (HPSEBL) is a deemed licensee under first

provision of Section 14 of the Electricity Act 2003 for distribution and supply of electricity in

the state of Himachal Pradesh Consequent to the enactment of the Electricity Act 2003

(hereinafter referred to as the Act) the process of approval of proposed additional

surcharge is vested with the Ronble HPERC Based on the provisions of sub-sectionmiddot (4) of

section 42 of the Act and the Sub-regulation 3 of regulation 6 of HPERC (Cross Subsidy

Surcharge Additional Surcharge and Phasing of Cross Subsidy) Regulation 2006 HPSEBL

is filing the current petition in order to recover its financial losses

Al INTRODUCTION

The petition pertains to determination of Additional Surcharge (FY 2016-17) on Short Term Open Access consumers purchasing power from withinoutside the State of Himachal Pradesh in accordance with sub-section (4) of section 42 of the Act and of Regulation 6 of HPERC (Cross Subsidy Surcharge Additional Surcharge and Phasing of Cross Subsidy) Regulations 2006

A2 BACKGROUND

21 Honble Himachal Pradesh Electricity Regulatory Commission (HPERC) has allowed Open Access to all consumers having contract demand of above one MY A and to all the generators irrespective of their installed capacity Under the ambit of specific regulations for the purpose some consumers of HPSEBL are purchasing power from outside the State at the platform of Energy Exchanges through short term open access

22 As per the Hanble Himachal Pradesh Electricity Regulatory Commission Order dt 18th Feb 2016 in Petition No 1032015 HPSEBL has been directed to file additional surcharge petition for FY 2017 by 31sl Mar 2016

23 The Sub-regulation 3 of regulation 6 of HPERC (Cross Subsidy Surcharge Additional Surcharge and Phasing of Cross Subsidy) Regulation 2006 referred herein is also reproduced as under

6 Additional surcharge - (1) An open access cansumer shall also pay to the distribution licensee an additional surcharge to meet the fixed cost of such

~ distributian licensee arising out of his obligatian to supply as provided under subshy

~ ~tian (4) ofsectian 42 of the Act

r~) Additional surcharge will be payable by any consumer including anyWf nsumer who puts up a ruptive plant for his own use

~ (3) The additional surcharge for obligatian to supply as per sub-sectian 4 ofsection n(a~ 42 of the Act shall become appliruble only if it is canclusively demanstrated that

- the obligation of a licensee in terms ofexisting power purchase commitments has been and continues to be stranded or there is an unavoidable obligation and incidence to bear fixed costs consequent to such a cantract The fixed costs related to network assets would be recovered through wheeling charges

(4) Each distribution licensee shall submit to the Commissian details of fixed costs which the licensee is incurring towards his obligation to supply

(5) In determining the additional surcharge the Commission shall scrutinize the details offixed costs submiHed by the distribution licensee and invite and consider objections ifany from the public and affected parties

(6) The additional surcharge shall be determined on annual basis and it run be collected either as onetime payment or an manthly basis

32 In FY 2015-16 the stations from which the capacities were stranded during different time blocks due to short term open access includes Anta-gas AntashyLNG Anta-LF Auriya-G Auriya -LNG Auriya -LF Dadri-G Dadri-LNG Dadri-LF Unchahar-I Unchahar-II Unchahar-II1 Rihand-I Rihand-II RihandshyIII Kahalgaon-II Dadri-II JhaJbar and Singrauli Projects The stranded power data is enclosed inAnnexure A

33 For determination of additional Surcharge HPSEBL has considered fixed costs for FY 2015-16 of power stations Anta (gas) Auriya (gas) Rihand-I Rihand-ll and Rihand-III same as considered by Honble Commission in Order dt 18th Feb 2016 on Petition No 1032015 Even though the quantum of total power surrendered from Stations is more than the quantum of short term open access the impact to be considered shall be restricted to the same due to srOA

34 The Average rate of fixed cost per kWh calculated on the basis of fixed charges for the aforesaid projects has been computed as per the details in Table 1

Al INTRODUCTION

The petition pertains to determination of Additional Surcharge (FY 2016-17) on Short Term Open Access consumers purchasing power from withinoutside the State of Himachal Pradesh in accordance with sub-section (4) of section 42 of the Act and of Regulation 6 of HPERC (Cross Subsidy Surcharge Additional Surcharge and Phasing of Cross Subsidy) Regulations 2006

A2 BACKGROUND

21 Honble Himachal Pradesh Electricity Regulatory Commission (HPERC) has allowed Open Access to all consumers having contract demand of above one MY A and to all the generators irrespective of their installed capacity Under the ambit of specific regulations for the purpose some consumers of HPSEBL are purchasing power from outside the State at the platform of Energy Exchanges through short term open access

22 As per the Hanble Himachal Pradesh Electricity Regulatory Commission Order dt 18th Feb 2016 in Petition No 1032015 HPSEBL has been directed to file additional surcharge petition for FY 2017 by 31sl Mar 2016

23 The Sub-regulation 3 of regulation 6 of HPERC (Cross Subsidy Surcharge Additional Surcharge and Phasing of Cross Subsidy) Regulation 2006 referred herein is also reproduced as under

6 Additional surcharge - (1) An open access cansumer shall also pay to the distribution licensee an additional surcharge to meet the fixed cost of such

~ distributian licensee arising out of his obligatian to supply as provided under subshy

~ ~tian (4) ofsectian 42 of the Act

r~) Additional surcharge will be payable by any consumer including anyWf nsumer who puts up a ruptive plant for his own use

~ (3) The additional surcharge for obligatian to supply as per sub-sectian 4 ofsection n(a~ 42 of the Act shall become appliruble only if it is canclusively demanstrated that

- the obligation of a licensee in terms ofexisting power purchase commitments has been and continues to be stranded or there is an unavoidable obligation and incidence to bear fixed costs consequent to such a cantract The fixed costs related to network assets would be recovered through wheeling charges

(4) Each distribution licensee shall submit to the Commissian details of fixed costs which the licensee is incurring towards his obligation to supply

(5) In determining the additional surcharge the Commission shall scrutinize the details offixed costs submiHed by the distribution licensee and invite and consider objections ifany from the public and affected parties

(6) The additional surcharge shall be determined on annual basis and it run be collected either as onetime payment or an manthly basis

33 For determination of additional Surcharge HPSEBL has considered fixed costs for FY 2015-16 of power stations Anta (gas) Auriya (gas) Rihand-I Rihand-ll and Rihand-III same as considered by Honble Commission in Order dt 18th Feb 2016 on Petition No 1032015 Even though the quantum of total power surrendered from Stations is more than the quantum of short term open access the impact to be considered shall be restricted to the same due to srOA

34 The Average rate of fixed cost per kWh calculated on the basis of fixed charges for the aforesaid projects has been computed as per the details in Table 1

37 HPSEBL has considered Power Grid losses 379 for FY 2015-16 till Feb16 A~ power grid losses vary from time to time therefore annual average has been taken The detailed Power grid losses are enclosed in IIAnnexure B

38 The losses for HPPTCL system and 132 kV amp 220 kV distribution systems for FY 2015-16 have been taken as 075 and 4 respectively as per the tariff orders

IV Computation of Additional Surcharge

39 The average per kWh recovery from Ell consumers through Demand Charges as considered for the purpose of estimation of revenue under the Tariff Order for FY 2015-16 is 6926 paise per unit After adjusting 245 paisekWh (ie 50 of the wheeling charges for EHV consumers) the balance recovery through demand charges works out to 4476 paisekWh Therefore the Fixed cost component computed shall bE reduced by 4476 paiseunit to arrive at final rate
