KXII Broadcasters, Inc., licensee of Television

Broadcast Station KXII, Channel 12, Sherman, Texas and

Television Translator Station K02EQ, Paris, Texas 1 hereby

respectfully submits its consolidated Petition for

Reconsideration to the Fifth Report and Order, 62 Fed. Reg.

26966, published May 16 1 1997, and the Sixth Report and

Order 1 62 Fed. Reg. 26684 1 published May 14, 1997 1 in the

above-entitled proceeding. This is a consolidated Petition

for Reconsideration under the procedure announced in a

public notice published today (June 13, 1997) in the Federal

Register, 62 Fed. Reg. 32240.

1. KXII seeks reconsideration of the combined result

of the Fifth Report and Order and Sixth Report and Order in

order to assure continued service by Station K02EQ, which

serves an area which would otherwise be deemed a television

"white area", unserved by any over-the-air television

station but which for the last 27 years has been served by

KXII/K02EQ. Therefore, KXII requests the Commission to

assign Channel 36 to Paris, Texas as a DTV Channel and to

issue to KXII Broadcasters, Inc. an "Initial Modification

License for DTV" thereby modifying the license of K02EQ to

specify operation on Channel 36.

2. Station K02EQ has operated since July 1, 1970,

providing service to Paris, Texas, population 24,699 (1990

Census) . Paris is county seat of Lamar County. As can be

seen from the attached compendium of coverage maps

abstracted from Television Factbook, no Grade B contour of

any commercial television station encompasses Paris.

3. K02EQ carries programming which serves Paris and

which is popular with Paris residents. The 1996 Nielsen

County Coverage for Lamar County, Texas shows KXII(TV) with

a 14 share, the second most watched station in the county,

Sunday-Saturday, 7 a.m.-l a.m. With respect to news

programming, KXII again ranks second (only behind WFAA(TV)

from Dallas-Fort Worth) with a 15 share for the 6 p.m.

newscast and ranks third (behind WFAA (TV) and Dallas - Fort

Worth station KXAS(TV)) with a 14 share. Paris is 70 miles

east of Sherman, Texas, KXII(TV)'s city of license. KXII

provides continuous and on-going news, weather and sports

coverage of events in Paris, Texas. With respect to

weather, Paris is in a region renowned for severe storms and

tornadoes, and KXII!K02EQ serves it with (a) coverage, along

with Sherman and Ardmore, Oklahoma on every weathercast, of

current weather statistics and specific weather forecasts,

(b) operation of an Enterprise DWSR-90 Doppler Radar

designed for detection and depiction of wind velocities of

tornadic strength, which depicts Paris on 75 1 150 and 300

mile maps, and (c) KXII/K02EQ's "8KYWARN11 early weather

detection system, which automatically superimposes weather

watches and warnings impacting 20 counties in the Red River

valley region of northeast Texas and southeast Oklahoma,

including Lamar County, where Paris is located.

4. Therefore, KXII urges the Commission to reconsider

its earlier decisions in this docket in order to assure

continuous future service to this television "white area ll

now served by station K02EQ. KXII urges the Commission to

assign Channel 36 to Paris, Texas as a DTV channel and to

issue to KXII Broadcasters 1 Inc. an "Initial Modification
