Using electrical equipment in bath or shower rooms has always needed care to ensure safety. The IEE Wiring Regulations (16th Edition) identifi ed particular zones within the bathroom to indicate what type of electrical equipment can be installed. These zones have now been updated by the 17th Edition of the IEE Wiring Regulations.

The diagram below is shown for guidance only - always refer to the current IEE Wiring Regulations or a qualifi ed electrician to ensure that you are following the latest regulations/code of practice.

Zone 0 - The interior of the bath or shower which can hold water.

Zone 1 - The area directly above Zone 0, limited vertically to 2.25m above the bottom of the bath or shower. Also, 1.2mhorizontally from the centre of a shower outlet to the height of the outlet or 2.25m, whichever is the higher.

Zone 2 - The area beyond Zones 0 and 1, 0.6m horizontally and up to 2.25m vertically. Zone 2 also included any recessed window with a sill next to the bath.

1. Contract Formation1.1 We may issue quotations (which are not offers to sell that are capable of acceptance) at any time, which shall lapse after 30 days.1.2 You may issue orders to us by telephone, fax, or email. All ‘sales’ telephone calls to us are recorded.1.3 If we choose to accept your order, a contract between us will be created for the sale and purchase of the goods, on the earliest to occur of: 1.3.1 issue to you of an order acknowledgement (subject to the goods ordered by you being in stock); or 1.3.2 delivery to you of the goods, subject in each case to the order being within the limits of credit (if any), or any other limits to orders being made on your account, that we have previously notified to you.1.4 These terms and conditions, the acknowledgement of order, delivery note and any special order form shall form part of the contract, to the exclusion of any terms and conditions, purchase orders or other documents issued by you.

2. Price2.1 The price quoted excludes VAT (unless otherwise stated). VAT will be charged at the rate applying at the time of delivery. 2.2 We will not levy a delivery charge for deliveries to the delivery address provided by you to us on your account opening form. We reserve the right to levy a delivery charge (over and above the price of goods delivered) if we deliver to any other address at your request, for orders under £50 (excl. VAT), and for delivering range cookers, in which case the delivery charge will be notified to you upon or prior to our acceptance for your order.2.3 Unless otherwise stated, the price quoted is an illustrative estimate only and the price charged (including trade discounts) will be our price current at the time of delivery.2.4 We will also levy a £40 (excluding VAT) charge for our home delivery service, if you complete and submit our home delivery form with your order. We can only provide the home delivery service if you provide able bodied assistance to our driver, and we will only deliver to the property doorway, not inside the property.2.5 Rates of tax and duties on the goods will be those applying at the time of delivery.2.6 At any time before delivery we may adjust the price to reflect any increase in our costs of supplying the goods.2.7 We may agree to discount our prices because you agree to display the goods for at least 6 months from the date you receive them. We will agree any such discount separately and on such form as we (or our suppliers) may require. Such discounted goods will be identified on the relevant sales invoices as “display” goods. If you fail to display them for that period then we may withdraw the discount which is then immediately payable and we may invoice you for it and also for any discount from our own supplier that we lose because of your default (without prejudice to clause 4.7 below).

3. Delivery3.1 All delivery times quoted are estimates only.3.2 If you accept delivery of the goods after the estimated delivery time, it will be on the basis that you have no claim against us for delay (including indirect or consequential loss, or increase in the price of the goods).3.3 We may deliver the goods in instalments. Each instalment is treated as a separate contract.3.4 We shall deliver to the delivery address shown on your account opening form, or such other address as we may agree (but subject to our right to levy a delivery charge). We will endeavour to send you a delivery notification email approximately 2 days before our estimated delivery date.3.5 We may decline to deliver if: 3.5.1 we believe that it would be unsafe, unlawful or unreasonably difficult to do so; or 3.5.2 if we have not provided you with any credit account or other terms of credit (i.e. you are required to pay for the goods on delivery) and you have not rendered payment for the goods immediately prior to delivery; or 3.5.3 the premises (or the access to them) are unsuitable for our vehicle.

4. Payment Terms4.1 You are to pay us in cash (or other cleared funds) on delivery unless we have given to you (in our absolute discretion) an approved credit account.

4.2 If you have an approved business credit account, payment is due no later than 30 days after the date of our invoice unless otherwise agreed in writing.4.3 If you fail to pay us in full on the due date, we may: 4.3.1 suspend or cancel future deliveries; 4.3.2 cancel any discount offered to you; 4.3.3 charge you interest at the applicable rate pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 (the “Act”): 4.3.3.1 calculated (on a daily basis) from the date our invoice became due until payment; 4.3.3.2 compounded on the first day of each calendar month; 4.3.3.3 claim fixed sum compensation from your pursuant to the Act; and 4.3.3.4 recover the costs of taking legal proceedings against you.4.4 If you have an approved credit account, we may without notice withdraw it or reduce your credit limit or bring forward your due date for payment. 4.5 You do not have the right to set off any money you may claim from us against anything you may owe us.4.6 While you owe money to us, we have a lien on any of your property in our possession.4.7 You shall indemnify us in full and hold us harmless from all expenses and liabilities we may incur (directly or indirectly and including without limitation legal costs on a full indemnity basis) following any breach by you of any of your obligations under these terms.

Title5.1 Title to the goods supplied by us shall not pass to you until we have received payment in full (in cash or cleared funds) from you for: 5.1.1 those goods; and 5.1.2 any other goods that we have supplied to you in respect of which payment has become due.5.2 Until title to the goods has passed to you: 5.2.1 you shall hold the goods on a fiduciary basis as our bailee; 5.2.2 you must store them so that they are clearly identifiable as our property; 5.2.3 you must insure them (against the risks for which a prudent owner would insure them) and hold the policy on trust for us; 5.2.4 you may use those goods and sell them in the ordinary course of your business, but not if: 5.2.4.1 we revoke that right (by informing you in writing); or 5.2.4.2 you become insolvent or are in breach of this contract.5.3 You must inform us (in writing) immediately if you become insolvent.5.4 If your right to use and sell the goods ends you must allow us to remove the goods.5.5 We have your permission to enter any premises where the goods may be stored: 5.5.1 at any time, to inspect them; and 5.5.2 after your right to use and sell them has ended, to remove them, using reasonable force if necessary.5.6 Despite our retention of title to the goods, we have the right to take legal proceedings to recover the price of goods supplied should you not pay us by the due date.5.7 You are not our agent. You have no authority to make any contract on our behalf or in our name.

6. Risk6.1 The goods are at your risk from the time of delivery (or the time when we tried to deliver but were unable to do so due to your default).6.2 You must inspect the goods on delivery. If any goods are damaged (or not delivered), you must write to tell us within seven working days of delivery (or the expected delivery time). You must give us (and any carrier) a fair chance to inspect the damaged goods.

7. Warranties7.1 We warrant that the goods: 7.1.1 comply with their description on our acknowledgement of order form and/or delivery note; and 7.1.2 are free from material defect at the time of delivery (as long as you comply with clause 6.2).7.2 We give no other warranty (and exclude any warranty, term or condition that would otherwise be implied) as to the quality of the goods or their fitness for any purpose.7.3 If you believe that we have delivered goods which are defective in materials or workmanship, you must:

7.3.1 inform us (in writing), with full details, within 7 days of delivery; and 7.3.2 allow us to investigate (we may need access to your premises and product samples). 7.4 If the goods are found to be defective in material or workmanship (following our investigations, and provided you have complied with those conditions (in clause 7.3) in full, we will (at our option) replace the goods or refund the price. If the defective goods are any of the following, a credit note will be issued (instead of a replacement or refund) once an inspection and credit has been agreed with the relevant manufacturer. 7.5 We are not liable for any other loss or damage (including indirect or consequential loss, financial loss, loss of profits or loss of use) arising from breach of the warranties in clause 7.1.7.6 Our total liability to you for damage to property caused by our negligence (from one single cause) is limited to two and a half million pounds.7.7 For all other liabilities not referred to elsewhere in these terms our liability is limited in damages to the price of the goods.7.8 Nothing in these terms restricts or limits our liability for death or personal injury resulting from negligence.

8. Specification & Special Order Goods8.1 If we agree (in our absolute discretion) to prepare (or order from our suppliers) goods in accordance with your specification or instructions (“Special Order” goods), you are responsible for ensuring that the specifications or instructions are accurate. You shall sign and return to us a special order form setting out details of the Special Order goods, which shall set out the goods you are obliged to purchase. If you fail to take delivery of such goods in accordance with these terms, we reserve the right to charge you 25% of the price of the goods, and you shall pay the same within 30 days. You must ensure that goods prepared in accordance with those specifications or instructions will be fit for the purpose for which you intend to use them. You shall ensure that any specification issued by you does not infringe any third party rights (including without limitation intellectual property rights).

9. Return of Goods9.1 We will accept the return of goods after delivery to you only in the circumstances, and subject to the terms, in this clause 9: 9.1.1 You must notify us of the goods to be returned within 14 days of our delivery of those goods to you; 9.1.2 You must make the goods available for collection by us, at a time and date to be agreed with us in writing, within 60 days of our delivery to you of the goods; 9.1.3 You must pay to us a re-stocking charge equal to 15% of the price of the goods returned, within 7 days of the goods being returned; 9.1.4 We will only collect goods to be returned from the address that we originally delivered the goods to; 9.1.5 We will only accept returns subject to an official uplift number issued by us; 9.1.6 The returned goods (and the packaging) must be as fit for sale on their return as they were on their original delivery to you.9.2 The right to return goods referred to in clause 9 shall not apply and/or shall be forfeited: 9.2.1 If we arrange with you to collect the goods, and the goods are not available for us to collect on the agreed collection date (in which case we will also charge, and you shall pay, a handling fee equal to 15% of the price of the goods in question); or 9.2.2 If you have not made the goods available for collection by us within 60 days of the date that we originally delivered the goods to you. 9.2.3 Fitted items will only be accepted for return if accompanied by a manufacturer’s authorisation reference. Furniture is deemed to be fitted (i) if the fascia has had hinges attached or handle hole(s) drilled or (ii) if a cabinet has had cams/dowels attached. 9.2.4 Damaged or faulty goods must be notified within 3 days after delivery.

10. Cancellation10.1 We may suspend or cancel the order, by written notice if: 10.1.1 you fail to pay us any money when due (under the order or otherwise); 10.1.2 you become insolvent; 10.1.3 you fail to honour your obligations under these terms.10.2 Subject as set out in this clause, you may cancel your order at any time prior to delivery of the goods to you, provided that you either (i) provide notice to us in writing to confirm your cancellation, or (ii) call us to confirm the cancellation, in each case prior to delivery.

11. Waiver & Variations11.1 Any waiver or variation of these terms is not binding unless: 11.1.1 made (or recorded) in writing; 11.1.2 signed on behalf of each party; and 11.1.3 expressly stating an intention to vary these terms.11.2 All orders that you place with us will be on these terms (or any that we may issue to replace them). By placing an order with us, you are expressly waiving any printed terms you may otherwise seek to rely on.

12. Force Majeure12.1 If we are unable to perform our obligations to you (or can only do so at unreasonable cost) because of circumstances beyond our reasonable control, we may then cancel or suspend any of our obligations to you, without liability,12.2 Examples of those circumstances include acts of God, accident, explosion, fire, transport delays, strikes and other industrial disputes and difficulty in obtaining supplies.

13. General13.1 English law is applicable to any contract made under these terms. The English and Welsh courts have non-exclusive jurisdiction.13.2 If you are more than one person, each of you has joint and several obligations under these terms13.3 If any of these terms are unenforceable as drafted: 13.3.1 it will not affect the enforceability of any other of these terms; and 13.3.2 if it would be enforceable if amended, it will be treated as so amended.13.4 We may treat you as insolvent if: 13.4.1 you are unable to pay your debts as they fall due; or 13.4.2 you (or any item of your property) become the subject of: 13.4.2.1 any formal insolvency procedure (examples of which include receivership, liquidation, administration, voluntary arrangements {including a moratorium} or bankruptcy); 13.4.2.2 any application or proposal for any formal insolvency procedure; or 13.4.2.3 any application, procedure or proposal overseas with similar effect or purpose.13.5 All brochures, catalogues and other promotional materials are to be treated as illustrative only. Their contents form no part of any contract between us and you should not rely on them in entering into any contract with us.13.6 Any notice by either of us which is to be served under these terms may be served by leaving it at or by delivering it to (by first class post or by fax) the other’s registered office or principal place of business. All such notices must be signed. 13.7 No contract will create any right enforceable (by virtue of the Contract (Rights of Third Parties) Act 1999) by any person not identified as the buyer or seller.13.8 The only statements upon which you may rely in making the contract with us, are those made in writing by someone who is (or whom you reasonably believe to be) our authorised representative and either: 13.8.1 contained in our estimate (or any covering letter) and not withdrawn before the contract is made; or 13.8.2 which expressly state that you may rely on them when entering into the contract.13.9 Nothing in these terms affects or limits our liability for fraudulent misrepresentation.
