    mycommandexperiencegainedin14yearsofmilitaryserviceasaCaptainwith31experienceasapublicaffairs,intelligencestaffofficerofacommunicationbattalionas32commanderof40soldersatanyonetimetrainingeveryunitforcombatreadinessfor33

    theIraq/Afghanwars;andthereafter,havefouryearsexperienceasalicensed1CaliforniaRealEstateBroker,andamcurrentlyraisingmyinfantsonandfouryearold2daughteruntiltimepermitsmybusinesstooccupymyeffortsagain.Asallegedinmy3complaint,IamadulyregisteredelectorandaffiliatedmemberoftheCalifornia4RepublicanParty,andscheduledtovoteattheJune8,2010RepublicandirectPrimary,5andthenattheGeneralElectionin2010;andassuch,Iamadamantonthe6requirementthatanycandidateandorpublicofficerservingthepeopleofthestateof7Californiamustabsolutelybeaboveanyappearanceofimproprietyasthefiduciary8guardianofourpublicrecords,asitisthemostimportantofficeintheStateandNation,9asCaliforniamaybethesixthlargesteconomyintheworldthatdeterminestheelection10ofthePresidentandassuchmusthaveasecretaryofstatethepeoplemusttrustand11haveconfidenceintosafeguardtheirpropertyandproprietaryrecords.12

    ARGUMENT ON THE FACTS13Forverygoodreason,IdonottrustDefendantDamonJerrellDunn(a.k.aDamon14

    Dunn,DefendantDunn),whobaseduponthefactsandlawcannotbeentrustedwiththe15responsibitytoserveastheSecretaryofState.TomyalarmMr.Dunnhasbeenwrongly16placedontheCaliforniaRepublicanPartyprimaryballotasadeclaredcandidateforthe17StateofCaliforniaRepublicanPartyCandidateforSecretaryofStateofCaliforniaon18June8,2010,aidedandabettedbyDefendantDebraBowenwhoinherofficialcapacity19

    astheSecretaryofStateoftheStateofCaliforniawithCAL.ELEC.CODE10:20

    CaliforniaCode-Section10isthechiefofelectionsofficerofthestate,andhasthe21powersanddutiesspecifiedinSection12172.5oftheGovernmentCode,iswithoutthe22discretioninherministerialdutiestomaketheoutrageousconnivancedoneinthe23

    matterofMr.Dunnsballotaccess;andtherefore.Mr.Dunnmustberemovedbeforethe1electionandorawritofprohibitionandmandamusissuedtoguaranteetothepeopleof2Californiathattherecordsandproprietarypropertywouldremainsafe.3

    ThataccordinglytoCAL.ELEC.CODE18500:CaliforniaCode,asthefactsshow4Mr.Dunncommitsfraudorattemptstocommitfraud,andaswithanypersonwhoaids5orabetsfraudorattemptstoaidorabetfraud,inconnectionwithanyvotecast,tobe6cast,orattemptedtobecast,isguiltyofafelony,punishablebyimprisonmentfor167monthsortwoorthreeyears,andmustberemovedfromtheballotandthePeopleof8Californiaprotectedfromhispatternofconnivanceenteringsuchofficeoftrust..9

    FurthermorewashealreadySecretaryofState,accordinglytoCAL.ELEC.CODE1018501:CaliforniaCode-Section18501,andMr.Dunnsuchpublicofficialwho11knowinglyviolatesanyoftheprovisionsofthischapter,andtherebyaidsinanywaythe12illegalcastingorattemptingtocastavote,orwhoconnivestonullifyanyofthe13provisionsofthischapterinorderthatfraudmaybeperpetrated,shallforeverbe14disqualifiedfromholdingofficeinthisstateanduponconvictionshallbesentencedtoa15stateprisonfor16monthsortwoorthreeyears;andmustberemovedfromtheballot16andthepeopleofCaliforniaprotectedfromhispatternofconnivance.17

    Thatbeforetheadventofthe2002HelpAmericatoVoteActthereisthehistory18surroundingtheNationalVoterRegistrationActof1993(a.k.a.MotorVoter)that19nationallywithACORNandotherSocialJusticeOrganizationsisinfamouslyknownand20hereinCaliforniaespecially,hasanoutrageoushistorythatmustnotbeforgottenand21guardedagainstarepeatbyatrustworthySecretaryofStatesoasnottoallowthe22treacheryofvoterfraudagainasassociatedwiththe1996electionoftheHonorable23RobertK.Dornan,RepublicanCongressmanwhoinhisownwords(seeExhibit 4),was24

    outrageouslydefeatedbyDemocratLorettaSanchezbyaminimumof2,369and1possibly4,623alienvoteswithimpunityinwhichnotasingleindividualwascharged2withthousandsoffelonieshavingbeencommitted.3

    Thatforanexampleofballotremovalinre:WilliamWallaceMurreysoughtthe4AmericanIndependentPartylineandwasoriginallyapprovedbytheOrangeCounty5Registrarontheballot,andMr.KellytheOrangeCountyRegistrarwasnotifiedthat6MurreywasaRepublicanuntillateDecember2009,soMr.KellyremovedMr.Murrey7fromtheBallotandheldthatitwasanoversightbytheOrangeCountyRegistrarsoffice,8whichisadecisionavailablebyFOIL.9

    However,thecasebeforethisCourtandtheSecretaryofStateisnotaboutasimple10ballotremovalaswithMr.Murrey,becauseMr.Dunnisculpablebywithholdinghis11previousregistrationaddressthenactedtofurtherconcealtheexistenceoftheprevious12addressofregistrationinFloridabyattemptingtoexpungeittherebyexhibitswhatin13jurisprudencedoctrineofBad-mantheoryabadpersonrepresentsasthebesttestof14whatthelawCEC8001actuallyis.BecauseMr.Dunncarefullycalculatedprecisely15whattherulesallowandattemptedtooperateuptoformaximumcampaignexposure16andfundraisingcapabilitywithCEC8001(a)1only,butknowingtherewasa17permanentrecordinFloridathatwouldjeopardizehiscandidacyMr.Dunnwentbeyond18thelimitsofthelawandwithuncleanhandsattemptedtoexpungetheFloridarecords19therebycombineasanadmissionagainstinteresttobeconsideredbytheCourtherein.20

    ARGUMENT ON THE LAW21TheCaliforniaElectionCode(CEC)requiresthattobeeligibletobeaqualified22

    candidateforSecretaryofStateadeclaredandanominatedcandidateshallunder20123oftheCaliforniaElectionsCodebearegisteredvoterandotherwisequalifiedtovotefor24

    thatofficeatthetimenominationpapersareissuedtotheperson;andMr.Dunns1RegistrationFormistobedeemedinvalidforbeingfalselysubmittedwithoutvoluntary2correctionofwhatotherwisewouldbeaninadvertenterrororomissionwasntinfacts3wasintentionalandmaliciousconcealmentinordertocircumventanyministerial4investigationofapriorregistrationthatwouldtriggeruseofCEC8001(a)2beyondthe5simpleNewregistrationasapplieswithuseofCEC8001(a)1ONLY.6

    InthatCECandrelatedlawrequireswithCEC8001:CaliforniaCode-Section78001.(a)Nodeclarationofcandidacyforapartisanofficeshallbefiled,bya8candidateunless(1)atthetimeofpresentationofthedeclarationandcontinuouslyfor9notlessthanthreemonthsimmediatelypriortothattime,orforaslongashehasbeen10eligibletoregistertovoteinthestate,thecandidateisshownbyhisaffidavitof11registrationtobeaffiliatedwiththepoliticalpartythenominationofwhichheseeks,and12(2)thecandidatehasnotbeenregisteredasaffiliatedwithaqualifiedpoliticalparty13otherthanthatpoliticalpartythenominationofwhichheseekswithin12months,14(b)Theelectionsofficialshallattachacertificatetothedeclarationofcandidacy15showingthedateonwhichthecandidateregisteredasintendingtoaffiliatewiththe16politicalpartythenominationofwhichheseeks,andindicatingthatthecandidatehas17notbeenaffiliatedwithanyotherqualifiedpoliticalpartyfortheperiodspecifiedin18subdivision(a)immediatelyprecedingthefilingofthedeclaration.19

    ThataccordingtoCAL.ELEC.CODE18203:CaliforniaCode-Section18203.20

    Mr.Dunnmustbeconsideredinlightofhiswithholdingofthepriorregistrationaddress21fromtheSOSwhenhefiledorsubmitsforfilinganominationpaperordeclarationof22candidacyknowingthatitoranypartofithasbeenmadefalselyispunishablebyafine23

    notexceedingonethousanddollars($1,000)orbyimprisonmentinthestateprisonfor116monthsortwoorthreeyearsorbyboththefineandimprisonment.2

    Moreover,DefendantDunncommittedvoterfraudaccordingtostatutesCEC318203and18500byintentionallynotenteringinhisvoterregistrationcard4informationaboutthefactthatheregisteredsomewherebeforeandthatheregistered5asaDemocrat,maliciouslyfailedtoprovideatSection16oftheformshownasExhibit6AthathewaspreviouslyregisteredinFlorida,andtherebyconcealedevidenceofa7crimeDefendantDunnintendedtocommittobecomeCaliforniaSOS.TheRegistration8formdoesNOTdifferentiateanypriorregistrationaddress,whichmaybeactive,inactive9orexpireddoesnotapplyandthattheSOSministerialdutydoesnotgivediscretion.10

    ThatbaseduponinformationandbeliefandaccordingtoaletterwrittenApril13,112010byJeanMarieAtkinsDirectorofVoterAdministrationtheDuvalCountyBoardof12ElectionandobtainedinpersonbyDr.OrlyTaitzwhileinFlorida,onJuly10,2009,13DefendantDunncontactedtheFloridaBoardofElectionstohaveanyrecordof14enrollmentoraffiliationwiththeFloridaDemocraticPartyintheDuvalCountydatabase15expungedfromtheofficialrecord.16

    TheFloridaBoardofElectiondatabaseinDuvalCountyrecordsthatDefendant17DunnregisteredinFlorida,isshownpreviouslyaffiliatedwiththeDemocraticParty.18ThatbaseduponinformationandbelieftheFloridaBoardofElectionsOfficialwiththe19

    fiduciarydutytosafeguardtherecordsoftheBoardofElectionsincludingthoseof20

    DefendantDunnrefusedtoexpungetherecordswhenheaskedJuly10.2009,and21provethatDefendantDunnwasaFloridaDemocratwithinthe12monthperiodpriorto22DefendantDunndeclaringhiscandidacyinCaliforniaonNovember5,2009.23

    ThataccordingtoCAL.ELEC.CODE17:CaliforniaCode-Section17.The1SecretaryofStateshallestablishandmaintainadministrativecomplaintprocedures,2pursuanttotherequirementsoftheHelpAmericaVoteActof2002(42U.S.C.Sec.315512),inordertoremedygrievancesintheadministrationofelections.TheSecretary4ofStatemaynotrequirethattheadministrativeremediesprovidedinthecomplaint5proceduresestablishedpursuanttothissectionbeexhaustedinordertopursueany6otherremediesprovidedbystateorfederallaw.Thecreationofanationalvoter7registrationdatabasewiththeElectionAssistanceCommissionistopreventmultiple8registrationsandvoterfraudthatsince1993andMotorVoterhasbeenrampantand9epidemicrequiringrigoroususeofHAVAtopreventfraudbytheSOSandthisCourt.10

    ARGUMENT FOR RELIEF11VenueisproperintheCountyofSacramentoandthisisthepropercourtforthis12
