    BANT Launches its all New Learning Zone After many months of hard work and ‘no stone left unturned’

    testing, BANT is proud and excited to announce the launch

    of the much anticipated Learning Zone. The idea was first

    conceived in December 2009 and after a year and half of

    really hard work, and a few false starts, we are finally in a

    position to go live. The Functional Medicine modules in the

    Learning Zone will be the fundamental part of the assessment

    process for all Associate Membership applications. Over time,

    it will be expected that all BANT members will need to

    Advertising Rules Committee (ARC) Update ARC is continuing to work with the CAP on substantiation that will enable

    you to talk about more specific conditions in your marketing materials. We

    also attended the ANH seminar on 21st May to ensure that everything we

    are doing from an ASA and advertising point of view ties in with the EU

    regulations. Over the next few months we will be working with the BANT

    administrator to develop more tools and advice for members’ on the whole

    regulatory landscape and what it means in practical terms to your practice.

    Responses to the toolkit have overall been very positive; we are continuing

    to receive questions from members, some of which have already been

    covered in the FAQ documents, so we do urge you to refer to those

    as well. New questions have been raised and we are answering those by

    adding the FAQ’s on a monthly basis, the dates for these updates are as

    follows:

    27 June, 25 July, 22 August, 26 September, 24 October, 21 November

    19 December

    It’s probably worth making a couple of points based on feedback we’ve had

    from members

    The work of ARC is aimed at providing interpretation of the CAP code

    for our members. A number of members have pointed out that there are

    numerous BANT members and other websites and other marketing

    materials out there, which don’t comply with the code. All we can do is

    advise you on our best interpretation, based on discussions with CAP. If a

    website doesn’t comply, and this is brought to the attention of CAP (which

    the Nightingale Collaboration may well start doing) then an evaluation will

    be made and the owner of the website or leaflet or ad will be asked to make

    changes.

    BROAD BEAN, COUS COUS AND ROCKET SALAD

    Preparation and

    cooking time: 20 minutes

    Per serving:

    Calories: 300kcal

    Fat: 6g

    Salt: 1.3g

    5 A DAY: 1.5

    Ingredients: (serves 2)

    150g/5oz podded young broad beans

    A few sprigs of fresh mint

    Juice of a lemon

    2 teaspoons of balsamic vinegar

    2 teaspoons of sugar

    100g/3½oz bag of rocket leaves (or mixed salad leaves if preferred)

    100g/3½oz cous cous – made with water or reduced-salt vegetable

    stock according to instructions, but without adding any butter or oil

    4 pitted black olives (optional), halved

    20g/¾oz feta cheese, cubed

    Small bunch of coriander, chopped Method

    1. Cook the broad beans in boiling water for 2 minutes. Drain, refresh

    under cold water, drain again then pop them out of their skins.

    2. Chop the mint and blend with the lemon juice, balsamic vinegar and

    sugar to form a low-fat salad dressing.

    3. Mix together the salad leaves and cous cous and split the mixture

    between two plates; sprinkle with the broad beans and drizzle with the

    dressing.

    4. Top with the olive halves, feta cubes and coriander.

    Top Tip

    Broad beans make a delicious low-fat source of protein. They are best used

    when they are still young and juicy.

    Another frequent question is ‘can I say x,y,z’. The short answer is that ARC

    has sought approval from CAP for a specific set of words, which are

    provided on the BANT leaflet. We took a conservative approach because

    we wanted to have something that members could say. If you want to say

    something different and want to have it checked by CAP then you can post

    it on their new on-line enquiry form. Doing this won’t increase the likelihood

    that someone will complain about your website or leaflet. At the moment

    CAP are struggling to field all the enquiries, so they are not actively

    monitoring.

    Don’t forget that while the ASA are using Nutrition and Health Claims

    Regulation (NHCR) as the basis for what is allowed, there are aspects of

    NHCR that extend beyond advertising rules, which is what we will be

    helping to explain over the next few months.

    We do know that it is frustrating and rather daunting for members but we

    urge you to bear with the process. Lots of other industries face rules and

    regulations in all sorts of areas. A lot of these new rules and regulations

    feel extreme, but we have to keep the faith that what we do works and is

    effective. We are having some teething troubles persuading everyone of

    that, but we will get there and our profession will flourish!

    Regional co-ordinators are reporting back on their meetings in June and

    finding them very useful for sharing great ideas and having presentations

    from experts on different topics. Practitioners are advised to see these

    regional groups as opportunities to collaborate and work with their extended

    network of contacts. These meetings are not obligatory, but it is recom-

    mended that you could attend at least one meeting of these per year, and

    ideally 4 times per year (quarterly). Not all regions are covered. We have

    currently 47 regional co-ordinators (including 10 student co-ordinators).

    BANT New sletter Discussion: Kick off with the latest one (ask participants to read in advance)

    ASA Toolkit: make sure all members have read and consequently adjusted all marketing materials (including websites)

    Case Discussions: Ask members to bring suitable case histories for discussion/ advice/learning

    Research: review latest relevant research, see the BANT newsletter; you could also agree on 1-2 people presenting one or two relevant

    papers (in brief) per session

    CPD Events: Discuss latest upcoming events, agree on who could attend and feed back to the group

    Guest Speakers: Think which speakers could be invited on particular topics of interest (e.g. Bionutri, Nutri-Link and others are likely to come

    to your meeting at no charge; make contact)

    AOB: ask participants to send you any questions they may have.

    Get Involved - BANT Needs You!

    Regional Co-ordinator Questions Answered by BANT These are some BANT responses to comments raised by a regional group. We feel they will ring bells with most practitioners an d report them in this

    newsletter for your information.

    Q - The overall perspective of business was very gloomy and felt nutrition therapy was 'under attack'.

    A - We certainly do have a difficult path ahead of us and NT has been under attack for many years now. Understanding the history may serve to help.

    Until recently, our profession was not regulated but we now have voluntary regulation under the CNHC. Voluntary regulation do es not protect the

    professional title of Nutritional Therapist, and does not prevent practitioners who are not as well trained as BANT members from calling themselves

    Nutritional Therapists. There is also no law to stop them practising in the UK. BANT fully supports the role of the CNHC and recommends that all BANT

    members seek registration with the CNHC as soon as possible. The BANT message to the general public will continue to be that working with a BANT

    practitioner is the best approach to improving health.

    Q - Most practitioners are still trying to get their heads around the implications of the new regulation. Most fel t that there was a long list of

    what they 'couldn't/shouldn't do' with very little advice on what 'they could do/could say'.

    A - BANT is doing its level best to drive a reasonable path through the regulation, consulting on behalf of practitioners in orde r to give them suffic ient

    guidance to remain within the law but also trying not to give any ground that we feel we deserve to retain. BANT cannot give clear legal advice to

    practitioners. We can give guidance but it is up to the members to make themselves aware of the legislation. We have provided you with websites to visit

    (in past newsletters) where you can find material related to the legislation. BANT are also working on a simplified version o f the rules and regulations

    affecting NT practice and this should be ready sometime this month. We will create a dedicated page on our website with the a im of having everything in

    one specific place.

    The BANT Advertising Rules Committee (ARC) continue to field questions from members about the new ASA rules and answer them as clearly as

    possible. In any event, since BANT is working with the powers that oversee these regulations, we are of the mind that i f a pr actitioner is targeted they

    would be dealt with in a very reasonable way and would be advised of the misrepresentation, asked to change it and that would be the end of the matter.

    Please be assured we are continuing to do as much as possible to retain any claims that we feel NT should right fully own but the amount of paperwork

    that this demands means that progress will remain slow. We are always pleased to hear from members who are prepared to help i n any way by giving

    some of their time freely to further this work and to support their profession and BANT.

    Q - Has BANT had a meeting with DOH to establish the role of preventative health/public health in the new NHS plan?

    A - BANT has not at this time had a face to face meeting with the Department of Health. We have in the past had contacts with personnel within e.g.

    Foods Standards Agency (now under the DoH), the Health Professions Council (HPC) & the Medicines & Healthcare products Regula tory Agency

    (MHRA) but the history is very complex.

    The topic of how NT can play a part in health care promotion continues to be an area that needs considerable input. At the same time other nutrit ion

    professions, better placed to work with the NHS, are beginning to make moves to incorporate the processes that we have been using in NT for many

    years and beginning to train traditional allied medical professions in the style of work that we do. As these are already sta tutorily regulated professions

    they have an advantage over us in the non-statutory professions.

    BANT is currently fielding many areas of work with a limited array of voluntary council members. Whilst we would love to be able to move forward quickly

    by selectively employing expert help we do not have the funds and have no hope of increasing income to the required level in the short term. We do what

    we can and would, again, be very pleased to hear from anyone who may have experience of how to tap into the commissioning asp ects associated with

    the new programmes being developed by the government and also share other ideas.

    We have had a number of queries recently regarding the acceptability of using leaflet drops to

    publicise members’ services.

    The section of the Code of Practice this relates to is Section 9: Advertising. Confusion arises as although

    it states in Section 9.2, ‘You may circulate literature intended to inform the public about the work of a

    nutritional therapist and the scope of your services ’, it also states in Section 9.1, ‘Direct advertising

    through unsolicited canvassing, door-to-door visits, telephone or personal visits is not allowed. ’

    Although this might sound like an anomaly, the point is that a general leaflet drop is deemed to be

    acceptable as long as the leaflets are not directed at specific names and addresses; as opposed to

    canvassing of a more targeted nature in which specific individuals or groups of individuals are identified

    and marketed to.

    It is also worth noting here that any leaflets that are produced to promote nutritional therapy services

    should comply with the Advertising Standards Authority rules and must comply with the European

    Parliament health claims regulations.

    Professional Practice Committee (PPC) - July FAQ

    The Institute for Functional Medicine, a USA based, not for profit foundation is

    bringing their acclaimed 5 day ‘Applying Functional Medicine in Clinical

    Practice™’ to the UK for the very first time. This will be held at the Hilton

    Kensington London from the 3rd to the 7th October 2011.

    What is functional medicine?

    In 1990 Jeffrey Bland Ph.D. created the concept of functional medicine

    as a discipline that married progress in basic medical sciences with clinical

    medicine to address the growing problems associated with chronic

    disease. In 1991 Jeffrey and Susan Bland founded and funded the Institute for

    Functional Medicine (IFM) with the mission to both educate and provide clinical

    support for the implementation of medicine across disciplines within the health

    care sector for functional medicine. The charter of the Institute for Functional

    Medicine was conceived by its founders as a systems biology approach to the

    prevention and management of chronic disease utilising the appropriate facets of

    nutrition, lifestyle, exercise, environment, structural, cognitive, emotional and

    pharmaceutical therapies to meet the individual needs of the patient.

    Functional medicine emphasises a definable and teachable process of

    integrating multiple knowledge bases within a pragmatic intellectual matrix that

    focuses on functionality at many levels, rather than a single treatment for a single

    diagnosis. Functional medicine uses the patient’s story as a key tool for

    integrating diagnosis, signs and symptoms, and evidence of clinical imbalances

    into a comprehensive approach to improve both the patient’s environmental

    inputs and his or her physiological function. It is a clinician’s discipline, and it directly addresses the need to transform the practice of primary care.

    What is Applying Functional Medicine in Clinical Practice (AFMCP™-UK)?

    Open to graduates of an accredited medical, osteopathic, chiropractic, naturopathic, homeopathic, dietetics, acupuncture, pharmacy, physiotherapy or

    DEFINING CFS: DIAGNOSTIC CRITERIA AND CASE DEFINITIONS

    Speaker: Dr. Leonard Jason of DePaul University

    In this presentation, Dr. Leonard A. Jason explores whether current CFS and ME/CFS

    case definitions and whether they adequately identify patients who have this illness. He

    offers the argument that better case definitions might help identify more homogenous

    patient groups, which could facilitate the identification of biological markers for this illness.

    Dr. Jason has been engaged in several of the efforts to craft meaningful definitions for

    CFS. He will discuss the various CFS case definitions, how they impact research and care,

    and how the definitions might be improved to better serve researchers/clinicians/patients.

    XMRV: IMPLICATIONS FOR CFS

    Speaker: Lucinda Bateman, M.D., Fatigue Consultation Clinic

    Dr. Lucinda Bateman, an internist whose practice is dedicated to the management and

    care of people with CFS and fibromyalgia covered the basics of research linking XMRV (a

    human retrovirus) and CFS. She shared some early insights into what this discovery might

    mean for the field and for patients, as well as her perspective on other current research

    efforts. Unfortunately, a technical problem occurred during the presentation that prevents

    us from posting an archived version. Dr. Bateman will return on July 15 to give an update

    ARC FAQS - Part 3 Update Some high profile nutritional therapists list a whole lot of conditions on their si tes –

    do you think they may need to oblige by the same ASA rules as us? I am asking as

    CAP has just recommended for me to remove references to medical conditions but

    they said it is not a compulsory request – only as I asked how I comply.

    We are aware that there are members who have not yet updated their publicity to fall in line

    with the current guidelines. We have laid out our recommendations in the Advertising

    Regulations Committee Toolkit, which is on the BANT website. However, there is no

    obligation for nutritional therapists to follow these; but by not doing so they may be at risk

    of being the subject of a complaint to the ASA. What is permitted by the ASA is clearly laid

    out in the Toolkit, so NTs who breach these rules do so at their own risk.

    I run a weight loss programme which I would like to advertise through flyers which

    would go to households. I understand why flyers for therapy would be seen as

    inappropriate. But if the advice is of a general nutritional nature I don't see how we

    are different to weightwatchers etc.

    The PPC have answered this query in this newsletter: the section of the Code of

    Professional Practice this relates to is Section 9: Advertising. Confusion arises about the

    distribution of leaflets as although it states in Section 9.2,

    ‘You may circulate literature intended to inform the public

    about the work of a nutritional therapist and the scope of

    your services’, it also states in Section 9.1, ‘Direct

    advertising through unsolicited canvassing, door-to-door

    visits, telephone or personal visits is not allowed.’

    Although this might sound like an anomaly, the point is

    that a general leaflet drop is deemed to be acceptable as

    long as the leaflets are not directed at specific names

    and addresses; as oppose to canvassing of a more

    targeted nature in which specific individuals or groups of

    individuals are identified and marketed to.

    It is also worth noting here that any leaflets that are

    produced to promote nutritional therapy services should

    comply with the Advertising Standards Authority rules

    and must comply with the European Parliament health

    claims regulations.

    As a new therapist trying to weave my way around

    the advertising regulations, I would really appreciate

    your advice on my marketing plan.

    I am also looking to purchase the ANH DVD, as I

    expect this will be invaluable. I assume we'll be

    notified when this is available?

    cases. However, we would suggest that as you write your marketing copy, you refer to the

    ARC Toolkit which is available on the BANT website, along with the advertising FAQs. If

    of the Advertising Standards Authority for their approval.
