Introduction

Human rights situation in Bangladesh has been worsening day by day and this is very alarming as to a

significant stage the rights are being violated by the state itself. From bureaucracy to professionals,

public procurement to conducting of public examination, politicization and criminalization are going

rampantly everywhere. Various institutions are objected to malfunctioning at political will causingfurther deterioration of institutionalization contrary to the good governance and a healthy culture. Lax

law enforcement panics people.

The following statistics is giving a rough idea of the human rights violation of last six months

Many national and international Human Rights Organizations showed their concerns as to the recent

human rights status in Bangladesh such as: 

1.   Amnesty International released a public statement headed by BANGLADESH: POLITICALLY

MOTIVATED ARBITRARY ARRESTS HAMPER IMPARTIAL INVESTIGATION OF CAMPUS VIOLENCE.

The said statement contains that, The government of Bangladesh must refrain from arbitrary mass

arrests, which appear to have been directed only at the opposition student activists. Criminal

investigations must be impartial, regardless of the suspects political affiliation or party

membership..................................2 

2. In another report published on their website,  Amnesty International claimed that, Bangladeshisecurity forces used excessive force during raid.

3In this report, Amnesty accused specially the

Bangladesh Rapid Action Battalion (RAB) for their violent attack.

3.   Human Rights Watch also expresses anxiety about ongoing human rights condition of 

Bangladesh. It stated, ³Bangladesh authorities violated both freedom of expression and due process of law´. The organization called upon the government of Bangladesh to ensure impartial

investigation to be conducted into allegation.4

K illing 

1. A Jubodol leader at Raypur in Narshindi named Siraj Miah (30) died on 31 October¶10 as

local Awami League leader and activists tortured him severely. Siraj Miah, who is also an

accused of a killing incidence, has become severely ill when he brought befor court and he died

after few minutes as he was immediately brought to nearby Zila hospital. The family member of 

the deceased alleged that he was subjected to severe physical torture by Local Awami League

union president and his aide. [1]

2. A teen named Sagar, 16, died the day after he was sent to jail. He lived at Boubazar of 

K utubkhali in the capital. Her mother accused that Sagor was severely beaten by police during

the time of arrest. Ignoring the claim of his family member the police said that Sagor was beaten

 by public when he attempted a mugging. [2]

3. A BNP activist was stabbed to death at Nachhirakandi village of Singra upazila in Natore on

14 December¶10. His dead body was rescued from Atrai River when it appeared floating. Thedeceased was noticed with several injury marks at his throat and belly.

4. The president of press club of Muladi upazila in Barisal named Monir Hossen was stabbed to

death on 22 December¶10. He was candidate at the councilor election of Muladi Pourosaova. His

family member alleged that the cousins of Monir killed him as there was conflict among them

over land issue. [4]

5. BSF shot a Bangladeshi young man to death at Doi K hawa border of Lalmonirhat on 24

December, 10. The victim named Siakur Rahman (20) of Butmari Upazila was involved in

 business of cattle. After shooting him the BSF personnel brought the deceased into India border.

BDR condemn the killing incidence. [5]

6. BSF killed more than 900 Bangladeshi nationals during the last decade. A report entitled

µTrigger Happy: Excessive Use of Force by Indian Troops at the Boarder¶ disclosed the

information in a program recently. [6]

7. Human Rights Day was observed in Bangladesh on 10 December with extrajudicial killing

and torture going unabated and freedom of press and expression being at stake. According to

rights watchdog Odhikar, 249 journalists were killed, attacked, arrested, intimidated or subjected

to other forms of violation of rights between January 1 and November 30. Three journalists were

killed, 109 injured, 40 assaulted, 17 attacked, 2 arrested, 1 abducted, 48 threatened and 13 were

sued and 16 became victims of other forms of rights violation mainly by the ruling class and

other powerful quarters for publishing reports in 11 months.

8. Three were killed and 225 injured as the police clashed with apparel workers, out on

demonstrations for the second consecutive day on 12 December in Chittagong, About 90

vehicles and several factories were also vandalized and ransacked during the clashes. All the

factories in the Chittagong export processing zone suspended production for the day after the

clashes in which three were killed and about a hundred were wounded.  [7]

Intervening Legal Process and Manipulating Administrative Powers

 Newspaper reports show that in December, 2010 the chain of mass apprehension of opposition

  party leader and workers is elongated, top leaders were arrested, tortured in jail, corruption

reached its zenith, Supportive organizations of Awami League stormed off opposition party

leaders, workers, co-workers in every corner of the country with demonstration of power and

even prime minister made verbal allegation without any foundation against opposition party¶s

chairman along with conspiracies and corruption in administration.

1.  Police foiled BNP's rally using batons and firing several rounds of blank shots at Uttar 

Bazar in Sitakunda5

which injured 22 BNP activists. This rally was being held as part of   party¶s central program. While some reports are found that BCL activists were also

involved in this attack 6. Similar combined attacks by police and BCL on BNP rally hurt 11

 people in Barisal7

and At least 20 activists of the BNP were injured as the police charged

 baton on a BNP procession at Madhabdi in Narsingdi.8 

2.  Three students of Dhaka University were ousted from their dormitory by a Bangladesh

Chattra League leader for remaining absent from an anti-hartal program.9

This kind of 

incident has become a regular phenomenon in almost every public university. Opponentstudents as well as suspected opponent students are regularly being ousted from their 

dormitory if any clue about their political belonging is revealed.

3.  BNP top leader and Member of parliament SQ Chowdhury was arrested in charge of 

setting fire during hartal.10

But the home minister said that ³war criminal is caught´11

.

Later BAL advisory body member Suronjit Sen Gupta MP said the SQ would be tried for 

inhuman activities in 197112

Later he was taken into remand for five days and his family13

 

repeatedly said that he was brutally tortured14

. SQ Chowdhury¶s son is going to file case

against UK  for training RAB15

Later he was shown arrest in War Crimes tribunal16

and

sedition case was filed against him17

. His bank account was scrutinized18

. Amnesty

international and US senator John Boozman said that these arrests are accused of being

 politically motivated19 

4.  There had been a number of incidents where activists of Islami Chhatra Shibir were

arrested or harassed by the government. Police arrested 3 ICS activists in charge of being

involved in an alleged killing of BCL activist a year ago which ICS repeatedly denies.20

 

While hundreds of activists of ICS in RU are already in jail since February, the police

frequently arrests students of RU whenever they are suspected to be somehow related with

ICS. In a separate incidence 3 more activists including a Upazila president were arrested

in Tangail of being accused of collecting their subscription money from supporters.21 In

another incidence 3 more ICS activists were arrested in accusation of keeping Islamic books which are not yet made illegal but police termed them Jihadi.

Baria and Selim Apu, Vice president of upazilla Chhatradal has been arrested by police34

 

A Jubodal leader was arrested in Rajbari.35

Chhatradal president of Srimangal upazilla of 

Moulavibazar, Niyamul Hoq Tarafdar, has been arrested by police. He is accused of 

stealing oil, case filed by JTCL in 200536 

9.  There had been numerous case filed against BNP activists. Three BNP leaders and two

others were sued for trespassing into the VIP lounge of Shahjalal International Airport

 prior to BNP Chairperson K haleda Zia's departure for China37. The police are hunting for 

BNP joint secretary general Amanullah Aman, its international affairs secretary

 Nazimuddin Alam and Swechchasebok Dal president Habibun Nabi Sohel after the civil

aviation authority sued them on Sunday night on charge of assaulting police at the VIP

lounge of Hazrat Shahjalal International Airport.38 At least 150 BNP men were sued on

charge of obstructing police duty by attacking the law enforcrs in the morning in

Panchagarh town39

. BNP chairperson K haleda Zia¶s youngest son, Arafat Rahman, and

former shipping minister Akbar Hossain¶s son, Ismail Hossain Saimon, were charged with

money laundering.

10. There had been many reports of manipulating the illegal power in the campus by the BCL.

Three students of Dhaka University were ousted from their dormitory by a Bangladesh

Chattra League leader for remaining absent from an anti-hartal program42

. Panic gripped

resident students of Banamali Girls Hostel of Barisal Government Braja Mohan College

after a group of Chhatra League activists forced their way into the hostel. 43 Residential

students of Rajshahi University alleged that the Chhatra League, the ruling Awami

League¶s associate body of students, forced the general students to take their meal in the

hall dining room by paying increased charge44 

11. Bangladesh Police ransacks opposition party offices frequently. In November policeseveral times attacked Jamaat office and on 15

thDecember police raided Bangladesher 

Samajtantrik Dal (BSD) office in the capital looking for labor leaders suspected of 

instigating apparel workers¶ unrest at K uril in the capital in recent times.45

12. There had been a number of incidents where it is found that the administration dealt with

the Jamaat activists being politically motivated. At least 35 local leaders and workers of 

Jamaat were arrested after a clash with police that left about 20 wounded including 8

 policemen.46 Police appealed that Delwar Hossain Sayeedi to be kept in custody before the

formal charge is formed.47

Investigators petitioned before the International Crimes

Tribunal to keep Jamaat-e-Islami leader Delwar Hossain Sayedee detained till completion

of the investigation into war crimes allegations against him48. The High Court summarily

rejected the petition four top leaders of Jamaat-e-Islami Bangladesh had filed for quashing

the war crimes proceedings for which they were held in custody49

 

13. Attacks on Opposition Party¶s Rally/ Demonstration/ procession/ meeting/ programs:

On the day of Hartal called by BNP, demonstrators faced Chhatra League showdowns with

 police force in many parts of Dhaka city. 3 demonstrators were arrested and 3 journalists were

 beaten up by police50. On the very next day, December 2, numerous cases were filed in different

 places around the country against BNP and Jamaat Leaders and 250 BNP-Jamaat workers have

 been arrested in Comilla, K hulna and Chakoria under 5 cases51

. In Jamalpur, police assaulted 10

 protestors badly52

. On December 2, as a procession held out by BNP workers to celebrate release

of 2 BNP leaders in Boalmari, Faridpur police beaten up the workers and 30 of them were

injured. On December 5, 12, 14 and 20, several demonstrations held out by BNP and BNP-led

organizations in different places had been victim of the police¶s attack. On 13

December, inK ushtia, a clash between RAB, Police and people left 50 journalists and people injured

Chhatra Dal rally was foiled at Dhaka University campus by police54

. Police also foiled

grievance rallies held on against apprehension of Salahuddin Qader Chowdhury in many parts of 

the country55

. Awami League Cadres attacked BNP¶s Victory Day procession and 30 policemen,

  journalist and BNP workers were injured in Rajapur, Jhalakathi56

victory day fearing opposition party¶s attack 58

. Police foiled BNP's rally using batons and firing

. An activist of the opposition

Bangladesh Nationalist Party was killed and about 25 were injured in clashes between the party

and the ruling Awami League at Naghosa in Magura60.

14. Intervening Legal Process and Arresting Top Opposition Leaders:

Government carried on its refuted intervention in legal process. Along with that top leaders of 

opposition parties were apprehended before court¶s issuance of warrants. CID plead court to

grant 10 days remand against ex-home minister Lutfuzzaman Babar and NSI Ex-director general

Brigadier General (retd.) Abdur Rahim on the case of 10 trucks smuggled weaponry on 1st 

December

December, 5 more days of remand were placed on them

. BNP wardcommissioner Manwar Hossain Dipjal¶s plea for bail was ignored by court63. Jamaat¶s Executive

member Rafiqul Islam K han was arrested from jail gate by DB unit just after being bailed out64

.

Court granted Rafiqul Islam 5 day-remand on plundering, picketing and destroying public assets

on the next day65

on 5th

December and placed him on a two-day fresh remand in connection with

a case filed for preventing police from discharging their duties in front of National Press Club in

the city on 15th

December 66

and 4 days of remand on the same charges67

. Court declined a plea

for bail of Mahmudur Rahman, editor of Daily Amar desh68

  Nizami¶s appeal quash of crime against humanity tribunal was denied by court69. A series of 

action without specific and plausible charges on Salahuddin Qader Chowdhury stunned the

nation. On 15th

December, SQ Chowdhury¶s Dhanmondi residence was raided by police70

. On17th, he was arrested by police. Police plead for 5 days of remand and it was granted by court 71.

Police brought charges of arson of a car in Dhaka. But later CMM court brought charges of lese-

majesty. At court premises the defendant¶s lawyers, BNP leaders and a journalist were greatly

. On 21st December, police brought more charges against SQC73

. On 23rd he was sent

to prison and his family members willing to meet him were physically harassed by police. On

24th, police finally brought official charges and signed case of lese-majesty and moved him to a

 jail in Narayanganj74. SQC described a horrendous picture of torture upon him in the remand.

He said that he was threatened to be murdered like missing BNP ward commissioner Chowdhury

Alam in the interrogation cell75. Awami Leader Suranjit Sengupta alleged SQC for crime against

humanity during the war of liberation76. Another Awami Leader ABM Mohiuddin Chowdhury

demanded death sentence to SQC accusing him of being a war criminal, same allegation was also

made by Home minister 77

. CMM court issued that SQC would face tribunal on 20th December,

2010. Cases were also filed against BNP leaders Aman Ullah Aman, Nazim Uddin Alam,

Habibubbabi Sohel and 2 others by Civil Aviation officials on an incident at Hazrat Shahjalal

International Airport on the arrival of K haleda Zia from Saudi Arabia78

. Police plead a remand to

 be placed upon Mufti Ijhar of 10 days on a terrorist case. Mufti Ijhar is the chairman of Islamic

Union; a party in coalition with 4-party alliance. Court has also granted 2-day-remand as was

  pleaded byK

. Investigators  petitioned before the International Crimes Tribunal to keep Jamaat-e-Islami leader Delwar 

Hossain Sayedee detained till completion of the investigation into war crimes allegations against

him80

. A Dhaka court framed charges against former Prime Minister K haleda Zia's younger son

Arafat Rahman K oko and a former BNP minister's son in absentia in a money laundering case81

.

Fatema Monir, an Upazilla chairman from Fatulla, Naraynaganj threatened police on arresting

her son. Police arrested his son while he and his gang tried to occupy a land in Fatulla,

 Narayanganj82

15. Mass Apprehension, Raid and Case:

  News reports revealed that Police raided a BNP supporter ward commissioner¶s house, and

arrested 100 BNP activists on account of Hartal called by BNP on 1st

December 83

. On the same

day, a Jubadal leader was arrested in Chouddagram accused of picketing and arson84

. FiveJamaat activists were arrested for taking part in a rally in Jaldhaka, Nilfamari

and eight BNP activists were arrested in Chatmohor, Pabna86

. On 8th

December, 32 more Jamaat

leaders were apprehended87. Nine arrested Jamaat activists were taken on remand of 1 day88. A

Chhatra Dal leader was arrested for torching train in Shrajganj89

. At Narayanganj, a chhatra Dal

office secretary was apprehended by police90

. Another BNP leader and UP chairman of Akhaura,

Brahmanbaria was arrested91

. In Ramganj a female jamaat worker was arrested while distributing

leaflets featuring price hike, mass apprehension, torture by ruling party92. In panchagar, police

filed case against unknown 200 and known 36 BNP workers with charges of involving a clash

 between poilce and BNP activists93

. In Tangail 3 shibir members were sent to jail94

. 24 including

3 children were arrested accused of association with terrorism at Patuakhali and Natore but

Police found nothing illegal95

. BNP and Jamaat workers in Rajshahi University cannot enter RU

campus fearing mass arrest by police on µunknown cases¶. Up until now 400 students of Rajshahi

University were apprehended after the clash between BNP-Jamaat workers and Police-Chhatra

League workers96

. Another shibir worker was arrested on 22nd

against 100 unknown arsonists in Dhaka made way for mass arrest of opposition party workers98

. In patuakhali, a K rishak Dal leader was arrested by RAB102

. At least 10 people,

including two policemen, were injured in a clash between law enforcers and garment workers

over the sudden closure of a factory at Jamgara in Ashulia103

. The law enforcers raided

Bangladesh Samajtantrik Dal office in the capital looking for labor leaders suspected of 

instigating apparel workers¶ unrest at K uril in the capital in recent times104

. Nationalist Women¶s

Party at Sherpur alleged that secretary of Nationalist Women¶s Party, Sherpur Zilla was arrested

on a falsified case while she went to court as a witness105. Jubadal also protested the arrest of 

general secretary of Jubadal Tuku and Central Secretary Annie106.

16. Assaults upon People and Opposition Party Activist by Awami Organizations:

Chhatra League ousted 3 students from University Halls owing to not attending Chhatra League

rallies in Dhaka University on 2nd

December 107

. At least 15 people including five policemen

were injured in a clash between the activists of Chhatra League (BCL) and Chhatra Shibir inBaralekha upazila in the district108 . A general student of university was beaten by Chhatra

League cadres on refusal to keep illegal weapons in mess. This student was a resident of

. In Lohagara, Narail a college teacher was hammered by extortionist Chhatra league

. Later police took the victim from the spot and admitted to a hospital119

Parliamentarian of Lalmonir Hat -2 physically wounded a college teacher 120. Alongside general

 people, police was also victim of Chhatra League¶s vandalism. In Fulgazi of Feni, 5 policemen

including OC were injured by Chhatra League121. In Chittgong, a traffic police was beaten up by

Chhatra League cadres when he attempted to verify their driving license 122 . News reports

revealed that Juba League activist gang raped an adolescent female garments worker; the victim

was perceived as a prostitute by police when she pleaded justice at court123

. Besides attacks on

rallies, many BNP activists became physically injured in face of Chhatra League and Juba

League¶s attacks. News reports said that 15 Juba League cadres chopped 2 Juba Dal workers

with blades124

. A freedom fighter called Jahangir Sarder was slapped with shoes by an Awami

. Such vandalism is also bestowed upon these leaders¶ offspring. Three including two

students were chopped with Chinese axes by Awami co-workers for protesting eve teasing of an

Awami leader¶s son

17.  Manipulation of Administrative Power in Corruption:

A News report revealed that 66 per cent people of the nation is victim of corruption. Police and

Public administration are the mostly corrupt among all135

. It is also revealed that promotion of 

administration cadres depend on investigation reports prepared by Government¶s detective

agency. If any cadre or any family member or any kinsman of him/her ever involved opposition

 party he would face discrimination in promotion136

. Another news report delivered that police

sources were involving many crimes under police protections137

. TIB reports reveal police

administration is the most corrupt among all administrations138. On 19th December a case was

filed by ACC against a policeman accused of taking bribe139. Police released 5 kidnappers in

Fatulla. These kidnappers attempted to abduct a truck helper 140

. An attempt had been made to

make BNP¶s organization inactive. This attempt was transferring BNP organizations¶ leaders,

secretaries outside Dhaka. In President¶s gadget it is postulated that on secretary of any workers¶

was accused of releasing brother of Home minister after arrest: 39 prostitute-customer arrested

from residential hotel142.

18. Conspiracy/Unverified Accusations and Cases against opposition party leaders and

others:

Prime minister Sheikh Hasina demanded Wealth statement of Begum K haleda Zia. Prime

minister summoned finance minister to verify K haleda Zia¶s accounts of Income Tax and asset

statements. She also demanded to verify if the goods in K haleda Zia¶s cantonment residence

originally belonged to Zia family143

. She also said that how Zia family got the magic box of 

treasure in possession will be revealed soon144

. Suranjit Shengupta said that BNP must re-start

 politics seeking forgiveness from Bangabandhu grave because of their crime against nation; their

. Industry Minister Dilip Barua demanded arrest of Golam

Azam before 27th March accusing of War crime. He also alleged TIB for making ³partial´

reports to save war criminals147

. Barrister Rafiqul Islam, member of BNP¶s permanent committee

 brought allegation that goods of K haleda Zia¶s cantonment resident is taken away without letting

her know in the night148. A news report stated that recently many cases were being filed against

leaders, journalist, etc. accusing their µhindering police duties¶. Some are being held before

issuance of court¶s warrant of arrest149

. Prime minister Sheikh Hasina said that Dr. Yunus was in

his trap. Accounts of his possessions and assets will be verified. She also said Dr. Yunus

accumulated his wealth by sucking blood of the poor 150. Chhatra League protested Dr. Yunus¶s

embezzlement of poor¶s money and demanded that if the accusations turn out to be true, his

 Nobel peace prize should be taken away151

. The state minister for home affairs, Shamsul Haque

terrorist networks

19.  Deterioration of Human Right/ Crossfire/ Assassinations:

Government report stated that average rate of killings is 11 per day in the last 11 months. But

other human right protection organizations said that the rate is more than that in government

report153

. In news reports published on 17th

December, it was found that 2 died in crossfire in

Tangail and Dhaka154. A regional leader of Purba Banglar Communist Party (ML±People¶s War)

was killed by Rapid Action Battalion in µcrossfire¶ at Bharara in Pabna155

. India¶s Border 

Security Force killed a Bangladeshi in the Masudpur border at Shibganj in Chapainawabganj156

.Within a few days, a Bangladeshi cattle trader along Putkhali border at Benapol in Jessore was

shot dead by BSF157.

1. 11 activists of Shibir have been arrested in Cox¶s Bazar on 3 December when they attend in a

regular organization meeting. This incidence of mass arresting occurred as part of recent drive

against Shibir.

2. Clash between two wings of Bangladesh Chhatra League (BCL) made Jagannath University

 battle field and led injuries of 50 students including journalist. It¶s claim that these two wingswere fueled by president and secretary of the university.

3. Jamaat leader Rafiqul Islam K han, president of Dhaka City, has been brought on a five day

remand. Police arrested him earlier violating the court¶s granting of bail.

4. The bail application of Dipzal, one cinema actor, has been rejected and sent to jail on 5

December¶10. Earlier 

5. Charge sheet against Arafat Rahman K oko has been submitted on 2 December in charge of 

money laundering. Anti Corruption Commission filed case against him at the time of care taker 

government.

6. Police was highly stern to bar any attempts of BNP in favor of Hartal. BNP leaders and

activist cannot picket or stand for Hartal as Police dismissed all attempted of gathering together.

7. Lotfurzaman Babor has been brought to a remand on 5 days on 6 December in lieu to the case

of recovering high weapons in Chittagong. The reinvestigation conducted by AL government

alleaged Babor, then state minister of The Home Ministry, as one of the master mind of the

smuggling of high weapons.

8. Police charged baton on Olama Mashayekhs on 6 December as they raised procession

opposing the implementation of the secular education policy and demanding the ousting of 

Director General of Islami Foundation.

9. BNP office was seized by Police during dawn to dusk hartal on 30 November. To bar the BNP

activist from picketing and any other actions in support of hartal, police seized BNP central

office.

-  Local correspondent of The Daily K aler K antha at Mirorsorai upzilla threatened by BCL

(a government back political student wing) leader. Earlier this correspondent publishednews which reflected the unruly activities of BCL leaders. (The Kaler Kantha,

-  Government backed political party activists attacked on a rally of BNP activists at

Rampur upzilla. While BNP activists participating in a victory rally to observe nationalvictory day, then BAL activits attacked on the rally and injured 15 activists of the party.

-  BCL backed terrorists attacked on a rally of their opponent BJCD at Narail Victoria

-  Police baton charged on Olama masaekh leaders (Islamic leaders) in capital. As the

leaders and activists were participating in a rally protesting the controversial nationaleducation policy and demanding the withdrawal of Director General of Islamic

-  A case was filed against the local correspondent of The Daily Sangram at Borlekha

-  Police attacked and baton charged on a rally of National Lawyers Forum at Naogan andinjured 10 lawyers. While lawyers were conducting a rally protesting government¶s

Earlier police tortured 4 jounalistes, while they were covering their assignment.

Torture, Looting and Vandalizing

At the last of the year 2010 the law & order situation is still in the worst situation in comparisonto the other previous months as the ruling party cadres are looting & vandalizing the people¶s

 property as well as terrorizing opposition parties by creating anarchy. Moreover, the govt. also

took some unruly actions against the oppositions parties¶ leaders & activists. Lots of people are

facing the terror of the ruling party¶s student organization. Illegitimate power practice and

influencing administration have become so common while many of the ruling party¶s cadres

were freed despite serious allegations.

1. On 1st

December it came into report that stray incidents mark hartal where some vehicles

damaged, 300 BNP activists arrested. Hearing of case filed by K haleda on court defamation was

not held. Charge Sheet was formed againstK 

oko on money laundering case. Babar and Rahimtaken on 10 days remand on 10 truck arms case.

it was reported that Expelled Juba league leader was

arrested at Dhunat, Mahmudur Rahman got interim bail in the case filed by Rajshahi mayor.5 It

came on the news on 15th

that Jamaat city ameer (chief) was taken on 2 days remand.6

December it was reported that Plea to arrest SQC & Islami Oikkojot Chairman

arrested.1The next day, SQC was tortured after arrested. Hartal called for half day at Chittagong

on Sunday and BNP meeting was vandalized at Jhinaidaha.2
