HOWARD A. MAVITY Fisher & Phillips Howard A. Mavity is a partner with Fisher & Phillips, one of the nation’s oldest and largest law firms devoted exclusively to representing management in labor and employment matters. The Firm has approximately 230 attorneys in 25 offices.

Mr. Mavity has been with Fisher & Phillips for almost 27 years. He is the Co-Chairman of the Firm’s Workplace Safety and Catastrophe Management Practice Group. Howard is a graduate of both the undergraduate and law schools of Vanderbilt University. Prior to Fisher & Phillips, Mr. Mavity grew up in Dalton, Georgia and developed a background in construction, transportation, and materials handling. He devotes the majority of his time to managing workplace fatalities and catastrophes, union organizing drives, and other high-visibility matters, including whistleblower claims and internal investigations. Howard advises employers in handling day to day personnel matters, dealing with government investigations, and engaging in acquisitions, restructuring, and strategic planning involving labor and personnel issues. Mr. Mavity has handled approximately 400 fatality

cases and countless OSHA inspections in 45 states. He maintains professional relationships with federal and state plan administrators, as well as with the D.C. OSHA and Solicitors’ Offices. He coordinates the abatement and compliance efforts of nationwide manufacturers in higher hazard industries, and works extensively with construction contractors in multi-employer settings.

Mr. Mavity devotes a substantial amount of his time to working proactively with employers to train managers and develop effective corporate wide policies and programs in order to avoid safety, union, and legal challenges. Howard has handled well over 225 occasions of union activity in 25 states, as well as representing employers with amicable union relationships. He oversees comprehensive HR, Safety and Labor audits of his clients. Mr. Mavity has been involved in rulemaking and comments. He is a member of the Associated General Contractors (AGC)-National Safety Committee, the Georgia AGC, the National Alliance for Model State Drug Laws, the ABA-OSHA Section, the NFPA, and various Chambers of Commerce. He was featured as one of the “Georgia Super Lawyers” in the 2004, 2005, and 2006 Atlanta Magazine survey, and the 2006 Georgia Trend Magazine, Georgia Legal Elite.

Mr. Mavity is active in the Atlanta Area Boy Scouts, United Way, the Marist School and Christ Church Presbyterian Church. He has coached and participates in adult and children’s baseball, cross-country, and karate programs. He has mentored Georgia Tech students. He is married to Karla Mavity, a nursing administrator with Children’s Healthcare of Atlanta. They have a daughter, Megan and a son, William. Mr. Mavity is a runner and has competed in martial arts and full contact fighting.

RICHARD FAIRFAX Deputy Assistant Secretary of Labor Occupational Safety and Health Administration Richard Fairfax was named to his new position by Assistant Secretary David Michaels where he began his duties on April 5, 2010. As Deputy Assistant Secretary, Mr. Fairfax is responsible for supervision of the work of the Occupational Safety and Health Administration’s 10 Regional Offices across the country and the Directorates of Enforcement and Construction. Immediately prior to this position, Mr. Fairfax served as the Director of Enforcement Programs and Acting Director of Construction Programs for OSHA. A certified industrial hygienist, he has worked for OSHA for 32 years as a field industrial hygienist, regional industrial hygienist and as a senior industrial hygienist before becoming Director of Enforcement Programs.

Mr. Fairfax also writes a column and serves on the Editorial Review Board for the Journal of Occupational and Environmental Hygiene.

No matter how safely you drive, you can’t control other drivers. Seat belts are your best protection against drivers who are careless or have been drinking. It takes about three seconds to fasten your seat belt when you get into a car or truck to travel. Using lap/shoulder belts cuts your chances of being killed or seriously injured in a crash 45-50 percent. This new standard comprehensively addresses key hazards related to cranes and derricks on construction worksites, including the four main causes of worker death and injury: electrocution, crushed by parts of the equipment, struck-by the equipment/load, and falls. This course will provide an overview of the requirements in this new rule including: inspection requirements; rigging and signal person training requirements; qualification or certification of crane operators; and procedures for working in the vicinity of power lines. Thomas, MD - OHS-COMPCARE As drug testing has become more prevalent in the work place, employees have devised a number of ways they think will help them beat the system. Dr. Thomas will talk about the various types of drug screens and the ways employees try to mask the drug they have been using. His talk will include ways employees try to bring in samples from other individuals, utilize supplements to try to mask results and other methods to attempt to complicate collection methods. He will discuss how these attempts are caught and the recourse employers have when they are. MARK S. DAMON Damon, Inc.

Mark S. Damon, President, Damon, Inc., a fall protection training and consulting company in Mission, Kansas, has been active in the safety industry since 1975. Mark worked with Rose Manufacturing Company, Englewood, Colorado, a major manufacturer of Fall Protection Equipment until 1981. He served as Vice President of Marketing and Sales. While with Rose, Mark served on the OSHA Committee responsible for the revision of fall protection standards.

Mark also worked with the US Navy on the development of their fall protection programs. Mark was Vice President of Day Star Corporation, a distributor of safety equipment in Kansas City, Missouri from 1981-1987. From 1987-2012, Mark was a Manufacturer’s Representative of personal protection equipment, specializing in fall protection. He served as President of Process Marketing Group from 2000-2012.

He has served on an ANSI committee for fall protection standards and has taught at the OSHA training institute on fall protection. Mark has also served as an instructor for the OSHA 500 and 501 courses. Mark graduated from the University of Missouri-Columbia with a B.S. in Marketing in 1972, and received his MBA from the University of Missouri-Kansas City in 1976.

AJ GAJDOSIK, CSP, ARM-P Nationwide Insurance

After graduating from Central Missouri State University with a Bachelor of Science Degree in Safety Management, AJ began his career in safety working for a large oil and gas company in Houston, Texas as a Safety, Health and Environmental Representative. From there he began work as a Loss Control Representative for an agribusiness insurance company. Following this position, he worked for a monoline workers’ compensation carrier serving as a technical safety specialist. AJ has also worked for a large regional multi-line

insurance carrier where he provided high level training and safety services to key accounts. Currently he serves as a consultant for Nationwide Insurance in the Loss Control Technical Organization which supports the field Loss Control professionals serving Nationwide’s members.

AJ has earned a certificate in Human Performance Improvement through the American Society for Training and Development. He has also earned the Certified Safety Professional (CSP) designation conferred by the Board of Certified Safety Professionals and the Associate in Risk Management (ARM) designation with Public Entity (-P) certification from the Insurance Institute of America. In 2005, AJ joined the adjunct faculty of the Midwest OSHA Education Centers (MOEC) teaching a variety of OSHA Training Institute (OTI) courses including the OSHA Authorized Outreach Trainer courses. He is an OSHA Authorized Construction and General Industry Outreach Trainer and an Instructor Trainer for the American Red Cross in First Aid, CPR, AED and Emergency Response.

Mr. Gajdosik is an active member of the St. Louis Chapter of the American Society of Safety Engineers serving on the executive board. In 2008, AJ was named Safety Professional of the Year for the St. Louis ASSE Chapter. RANDALL GAMMILL, MBA, SPHR Connell Insurance, Inc.

Randall Gammill worked with the Missouri Division of Workers' Compensation from 1992-2004 as an employer consultant. In 2004, he joined Connell Insurance in Branson and became a partner in 2006. Randall now specializes in workers' compensation, self-insurance programs, and human resources consulting. Randall is certified by the Society for Human Resources Management as a Senior Professional in Human Resources (SPHR) and serves as the Missouri Director of Legislative Affairs for the Missouri Society of Human Resource Management.

He is also certified by the Institute of Work Comp Professionals as a Certified Work Comp Advisor. He holds a Bachelor of Science degree in Business Administration from College of the Ozarks in Point Lookout and an MBA from Drury University in Springfield.

KEN GRIST, MS, CIH, CHMM SMACNA

Ken Grist has over 25 years’ experience in the environmental, health and safety profession. His current position with the Sheet Metal and Air Conditioning Contractors National Association supports over 50 member companies with OSHA, EPA and DOT compliance.

DWAYNE HARTMAN, CSP, CRIS Lockton Companies

Dwayne is a 1994 graduate of the University of Central Missouri, where he obtained a Bachelor of Science degree in Safety Management. He is currently a Vice President and Senior Loss Control Consultant with Lockton Companies in Kansas City, MO. In his current role, Dwayne provides comprehensive safety and health consulting services to a wide range of Lockton’s construction industry clients. Prior to joining Lockton in 1998, Dwayne was employed by a Midwest masonry subcontractor as their Safety Director and by a national general contractor as a Safety Specialist.

Mr. Leach holds a Bachelor’s degree from Kansas University. March of 2012 marked his 41st year with American Rigger's Supply. For the last 26 years Jim has been manager of sales and marketing where his approach has been to educate end users regarding proper rigging. When it comes to lifting and moving loads, “what you don't know can hurt you”. Jim’s goal is to help prevent that from happening. He is currently a Crosby “authorized trainer” and a NCCCO “certified rigger”.

Bill was selected as the Area Director, St. Louis Area Office in November 2001. Bill has earned distinction as a Certified Safety

Professional (CSP). Prior to his selection as Area Director, he served as Assistant Area Director for 3 years and as an OSHA Industrial Hygienist for 10 years. Bill also served as an Industrial Hygienist for the U.S. Air Force for 5 years prior to joining OSHA.

Bill has a B.S. in Industrial Hygiene from Central Missouri State University. Bill has been honored with many awards during his career with the Federal Government including the OSHA Leadership Award for 2005, and the OSHA Region VII Leadership award in 2005, 2006, and 2007. Bill received the St. Louis Federal Executive Board Leadership award for small agencies in 2007, 2008, and 2009. Through his efforts as a strong proponent of public-private safety and health partnerships, Bill also received the 2007 Federal Official of the Year Award from the National Association of Home Builders.

Ramona McEnaney has been with Lockton Companies, for the past eight years as a Senior Claims Consultant.

HARRY MILLER, CSP Black & Veatch

Harry Miller is an ESH&S Manager for Black & Veatch in Overland Park, KS. Harry formally worked with the Carpenters District Council of Greater St. Louis working with Contractors and Union Members promoting health and safety issues. He has worked in safety for the last 15 years performing audits, reviews, inspections, and trainings in OSHA Compliance.

Harry is an authorized trainer for OSHA in both General Industry and Construction. In addition, he is a trainer for Hazardous Waste Operations, Emergency Response, and he is a Licensed Lead Supervisor in the state of Missouri. Harry has served the safety needs for both public and private sector customers. He holds a Bachelor’s Degree in Human Resource Management and a Master’s Degree in Business from Lindenwood University in St. Charles, Missouri. J.W. is currently the safety director for Lytle Construction Inc. in Lee's Summit, MO. He has worked for Winn-Senter Construction, J.E. Dunn, and owns his own safety consulting company, Construction Safety Consulting, specializing in small construction companies providing job site inspections and training.

JIM A. PICKEL Cates Sheet Metal Industries, Inc.

Jim has been in the Environmental and Safety field for 30 years. He was a laboratory director for a local asbestos and environmental laboratory for 14 years and was an EPA certified trainer for asbestos and lead abatement. Jim has written several EPA and State approved training manuals in these subjects.

Mr. Pickel has been safety director for Cates Sheet Metal for 7 years. In 2011, Mr. Pickel was named Safety Professional of the Year for 2010, by The Builder's Association.

Jill Puterbaugh is a Construction Account Manager at Chartis Insurance. She works extensively with employers and insurance brokers to successfully manage the insurance program. She coordinates activities with employers, insurance brokers, claims and defense attorneys for the defense of claims. Jill has been in the insurance industry for 20 years.

STEVE RATLIFF Concrete Supply of Topeka

Steve has over 15 years health and safety experience. He is a past Missouri Occupational Safety and Health Consultant and has been providing OSHA and MSHA health and safety support in the cement/concrete industry for the past 8 years. Mr. Ratliff has a Master of Science degree in Industrial Hygiene from UCM.

BRIAN SCHRADER McCownGordon Construction

Mr. Schrader is the Safety Director for McCownGordon Construction. He has spent the last 22 years working either for, or with commercial contractors. Throughout the years, Brian has been employed as field construction employee, project safety specialist, loss control manager, risk control consultant and corporate safety director for large insurance carriers and general contractors.

Brian holds a Bachelor of Science and Master of Science in Industrial Safety Management from the University of Central Missouri. He is an authorized instructor for the Occupational Safety and Health Administration (OSHA). Mr. Schrader is an instructor for the 40 hour NCCCO Prep Course and has passed the written NCCCO exams. Brian is also a frequent guest lecturer at Pittsburg State University and serves on the Environmental, Safety and Health Advisory Board at Pittsburg State University.

Brian serves on the National Safety and Health Advisory Committee for the Associated General Contractors of America and the Executive Board for the Construction Safety Group of Kansas City.

ROBERT SIMMONS, MS The Builders’ Association/AGC

Robert started with The Builders’ Association in 2007. Prior to joining the safety and health services team, he was Assistant Director of the

Division of Labor Standards and Program Manager for the State of Missouri’s Onsite Safety and Health Consultation Service. He has over 17 years’ experience in the safety, health, and environmental field and is responsible for serving the association’s members in Columbia, Jefferson City, and Springfield.

Robert holds a Bachelor and a Master of Science in Industrial Hygiene from University of Central Missouri. He is an authorized Occupational Safety and Health Administration (OSHA) Construction Outreach Instructor, has a teaching certificate from the State of Missouri for Vocational Construction Trades, is a Principle Course Instructor for the Environmental Protection Agency (EPA) for RRP Lead Training, and is an American Red Cross Instructor.

Robert currently serves as a board member for the Mid-America Safety, Health, and Environmental Conference. In 1999, Robert became the Region VII Executive Board Member for the National Association of Occupational Safety and Health Consultation Programs representing the interest of state consultation programs in Kansas, Iowa, Missouri and Nebraska to the Federal Department of Labor. In 2006, Robert was elected Vice President of OSHCON. He is a member of the American Industrial Hygiene Association and American Society of Safety Engineers.

Daniel Stark is the Program Manager for the Missouri On-site Safety and Health Consultation Program within the Missouri Department of Labor, Division of Labor Standards. She investigated ground accidents, conducted training and briefings. She started her career with OSHA approximately 20 years ago in the St. Louis Area Office as a Compliance Officer. Later she became a supervisor in the St. Louis Area Office; which she loved. She has a passion for safety and health and enjoys sharing that passion with others.

Daryl L. Thomas, M.D. is board certified by the American Board of Internal Medicine and as a medical review officer. He is experienced in occupational medicine, emergency medicine, and internal medicine; and is a Certified Independent Medical Examiner. MARK WOODWARD, M. Ed Missouri Employers Mutual

Mark has a Master’s in Education from William Woods University and a Bachelor of Science in Safety Management from University of Central Missouri. This is his fifteenth year as a safety and health professional. Mark has instructed thousands of Missouri workers through three-thousand safety sessions. Mark has developed hundreds of safety resources, wrote numerous safety articles published both in Missouri and nationwide, and created safety partnerships with industry associations throughout Missouri.

Mark is a certified trainer through the University of Missouri and the American Society for Training & Development, CPR, First Aid and AED trainer, Defensive Driving instructor and OSHA Outreach Trainer capable for the OSHA 10 and OSHA 30 in Construction. His experience includes transportation safety and managing workers compensation claims & safety as a MEM policyholder.

For the past fifteen years Mark has been active in Missouri fire & ambulance service as a firefighter and EMT. ROBERT YAHL Yahl Contracting, Inc.

Robert Yahl has been in the construction industry for over 30 years. He first started out as a carpenter and turned that into his own successful construction company in Missouri. Mr. Yahl specializes in the building of new single, multi-family homes, and also light commercial buildings. He has supervised work crews up to 80 carpenters, journeymen, foundation, and general labor personnel.

Robert is a member of several organizations; Carpenters Union Local 92, Association of General Contractors, Home Builders Association and Better Business Bureau, to name a few. He strives to keep up-to-date on the industries’ new products and standards. Robert enjoys sharing his knowledge with others.
