1. Roll Call Roll was called and it was determined a quorum was present. 2. Telephonic Participation Vote – Ed Rebholz – Last minute request-not on agenda Motion was made by Mr. Pollitt and seconded by Mr. Watt to approve Mr. Rebholz’s telephonic participation. In a voice vote, motion passed unanimously. Before getting started on the voting items, Mr. James introduced the new Assistant Airport Manager, Spencer Thornton. He also mentioned that we are almost fully staffed. with the exception of two maintenance positions. He announced the recent staffing promotions of Travis Bryan as the new Operations Supervisor, Nick Slagle promoted from Maintenance to Operations and the addition of Micka Bouchelle as one of the administrative staff. VOTING ITEMS Chairman Kwoka noted, for the record, that UPDATE ITEM F, Noise Abatement Program Overview Presentation, on this agenda, was previously heard at the February meeting and is on the agenda in error. 2. Approve Minutes of February 25, 2016 Meeting Motion was made by Mr. Kroon and seconded by Vice Chair O’Malley to approve the minutes. In a voice vote, motion passed unanimously. 3. Taxiway Foxtrot Pavement Rehabilitation Project 11999 Kimley Horn and

Associates, Inc. – Task Order No. 1 Staff recommends approval of Task Order No. 1 with Kimley-Horn and Associates in the amount of $349,697.

Motion was made by Mr. Kroon and seconded by Mr. Watt to support staff’s recommendation. In a voice vote, motion passed unanimously. 4. Taxiway Foxtrot Pavement Rehabilitation Federal Aviation Administration

Grant Application-Project 11999. Staff recommends that the City accept and execute a grant from the FAA for a maximum amount of $314,727 for design of the Taxiway Foxtrot Pavement Rehabilitation project. Motion was made by Mr. Moody and seconded by Vice Chair O’Malley to support staff’s recommendation. In a voice vote, motion passed unanimously.

5. Parcel 20/20A-Sheltair Executive South, Inc., Extension Amendment to Lease Agreement

Staff recommends that the City Commission authorize the City Manager to enter into an Amended Lease for Parcel 20 with Sheltair Executive South, Inc. for an additional six (6) months, expiring November 28, 2016. Motion was made by Mr. Kroon and seconded by Mr. Moody to support staff’s recommendation. In a voice vote, motion passed unanimously. UPDATE ITEMS A. Noise Compatibility Program Ms. Straugh gave an update. B. Development and Construction Mr. James provided an update. C. Arrearages

Mr. James reported that there are no arrearages for the month of March. D. Communications to the City Commission The Board had nothing to communicate to the City Commission. E. FLL Update

Ms. Straugh had nothing to report; however, she did announce that the Broward County Aviation Noise Abatement Committee will be meeting on Monday, June 13, 2016. Chairman Kwoka added that he attended the Transportation and Mobility event with Ms. Reese and noted that Fort Lauderdale-Hollywood International Airport (FLL) has grand plans to build terminals there in the near future. Ms. Straugh noted that they are in the process of doing that now.

Other Items and Information

After being asked for a general update of available properties at Executive Airport, Mr. James told the Board that there is nothing on the aviation side but there are non-aviation properties available for development on the south side of the Airport near Commercial Boulevard. The Airport is working with CBRE to market those sites; however, no proposals have been received to date. The City is trying to come to some conclusion as to whether CBRE will continue to serve the Airport. Mr. James was asked if there has been any new activity on the vacant parcel on Cypress Creek Road (2800 W. Cypress Creek Road “Performance Trading”). Mr.

James responded that the City’s Utilities Department is interested in renting it. We have provided them with the building plans so they can determine what type of additional work will be required to bring the building up to their specifications. We are waiting to hear back from them. Mr. James was asked for an update on the W Aviation Project to which he reported that they met with W Aviation on several occasions and as an outcome of those meetings, W Aviation hired Kimley Horn & Associates to oversee the project and help them through the process. Within two weeks of the contract being in place with Kimley Horne, we received a timeline from them identifying the work that will be taking place and when it is going to be done. Mr. James told the Board that the completion date for the two hangars would be March 2017. The lease is written to include a phase 3, which calls for another hangar and a terminal building, which should be completed by 2019. Commissioner Bushnell inquired if the property behind Tamarac Lakes North and Caporella Park is owned by the airport and if can be developed. Mr. James answered that the Airport does own that property and it can be developed; however, since it is a natural resource area, the County has placed limitations on what can be built there. In a joint effort, the City Manager of the City of Fort Lauderdale and the City Manager of Tamarac, proposed to do a park of some sort on the property. Research is being done to see if we can get it developed for the better good of both communities and to shed good light on the Airport.

Mr. Moody asked about the status of the Waterpark and Mr. James responded stating that he spoke with the former Airport Manager, Clara Bennett who was called to give a deposition about the whole process. Information is still being gathered, but as of now, it is still in litigation.

Mr. Watt asked for an update regarding the Burger-Fi project. Mr. James responded saying at this point, we haven’t heard where the relationship is with BurgerFi and Sheltair. He told the Board we have met with Sheltair on a few occasions to discuss some changes to the site plan and asked questions about storm water drainage. In the next few weeks, we should have some rendering of a new site plan that Sheltair will be proposing.

Mr. James shared a couple of other notable items with the Board:

He told the Board that Governor Rick Scott proclaimed the month of April as Aviation Appreciation Month and that the City recognized the Airport with a Resolution, as well.

He shared some exciting news, about Customs providing a global entry kiosk at their facility and that it is the first in the Country at a General Aviation Airport. The Airport is also looking at the automated passport control kiosk. Customs is in favor of our request and has submitted it to Washington, DC. The Airport would like to have two of the kiosks in place, making the whole process that much quicker and easier for our customers and neighbors.

The last point Mr. James made was to thank staff for their efforts in completing the Annual Report. A copy of the Report was handed out to the Board members (copy

attached).

Before the meeting closed, Ms. Reese reported that the Foreign Trade Zone would be getting an application tomorrow from JL Audio, who initially submitted an application to operate as a warehouse and distributions center under Foreign Trade Zone 241. They now will be expanding and doing the manufacturing of their speakers, which will provide them with significant savings. This will be our first manufacturing Foreign Trade Zone under FTZ 241.

On behalf of the Fort Lauderdale Executive Airport (FXE), we are pleased to provide you with the 2015 Annual Report. With the support and guidance from the Aviation Advisory Board, Fort Laud-erdale City Commission, and City Manager’s Office, FXE continues to strengthen its position as the premier General Aviation airport in the nation.

This report highlights some of the signature accomplishments that Executive Airport achieved during 2015 in pursuing its core mission of attracting businesses to the area and helping those businesses prosper. A division of the City of Fort Lauderdale’s Transportation and Mobility Department, FXE is a high volume operation with a team of professionals overseeing day-to-day operations of the Airport, Industrial Airpark, Downtown Helistop, and Foreign-Trade Zone No. 241. We have a tremendous responsibility to provide the highest quality programs and services to benefit the community.

The 2015 year was an exciting and productive time for the Executive Airport team and Airport tenants. Airport tenants continued to grow their businesses at FXE and, during the past year, completed construction improvement projects valued at approximately $5.5 million. The FXE team has taken a forward thinking approach by looking toward the future and securing $2.5 million in grant funding from the Florida Department of Transportation (FDOT) to perform design and construction improve-ments of the existing infrastructure to better serve the tenants and users of the Airport.

This year consisted of numerous exciting improvements to FXE, including the construction of a new LEED Certified Silver U.S. Customs and Border Protection Facility, as well as the construction of a new Air Traffic Control Tower. The development of the Airport reflects trends in business and leisure activity in the surrounding community and parallels the history and growth of the City of Fort Lauderdale.

As professionals, the FXE Team looks forward to the coming year as we continue to strengthen our commitment to attracting businesses to the area, offering assistance and resources to help those busi-nesses prosper, and providing the highest quality programs and services to benefit the community. We are excited about the future of FXE and its positive impact on the aviation and business community in and around Fort Lauderdale. The Fort Lauderdale Executive Airport Operations Division has experienced another exciting year with 160,000 annual aircraft operations and over 900 based aircraft. This year, Operations staff trained more than 300 tenant employees, provided more than 30 airfield tours, and conducted over 700 airfield and Helistop safety inspections.

>> Completed the East Perimeter Loop Road Construction Project, 3,500 feet in length

Implementing the world’s first fully integrated Airport Noise and Operations Monitoring System (ANOMS) in 1989, Executive Air-port’s Noise Abatement Program remains one of the most proactive programs in the country. Conducting outreach to pilots and com-munities and utilizing advanced technology to accurately identify and analyze aircraft noise issues, are tools that have been critical in developing effective noise reduction measures at FXE. The City continues its commitment to expanding, enhancing and support-ing the program’s objective to reduce aircraft noise and main-tain quality of life for our neighbors.

>> Completed FAA Part 150 Noise Exposure Map Update, which benchmarked noise impacts, confirmed that noise levels continued to be reduced, and will serve as an important tool for current and future land use planning

>> Replaced three Noise Monitoring Terminals with upgraded equipment and wireless communications

>> Initiated efforts to lift the runway weight bearing capacity restrictions to enhance productivity of aviation businesses and improve the airport’s global status for General Aviation

>> Hosted the Achievements in Community Excellence Award Ceremony honoring Sano Jet Center for their outstanding contributions and participation in airport programs and initiatives, enhancing their business at the airport, encouraging the promotion of business aviation commerce, and benefiting the community

>> Conducted multi-homeowner association Noise Abatement outreach meetings to address noise concerns, provide program information, and answer questions from neighbors

Executive Airport seeks business opportunities and implements initiatives that stimulate revenue growth. Staff encourages joint marketing and promotional opportunities between the Airport, the City, Envision Uptown and area economic development or-ganizations. Ongoing efforts continue as we work with part-ners to advance opportunities for retention, expansion and work-force development.

Land has been cleared and is ready for development on on seven vacant parcels at FXE. Plans are in place to evaluate the highest and best use for these properties.

VOTING ITEMS 1. Contract Renewal for HDR Engineering, Inc. (HDR) Motion was made by Mr. Milledge and seconded by Vice Chair O’Malley to support staff’s recommendation. In a voice vote, motion passed unanimously. UPDATE ITEMS A. Noise Compatibility Program Ms. Straugh gave an update. Mr. Rebholz asked when would the Environmental Assessment Form project happen?

Ms. Straugh answered that we first have to complete the Environmental Assessment Form followed by some other steps and that we are anticipating by the end of the year. B. Development and Construction Mr. Harrison provided an update, after which he told the Board that he will be putting together a presentation, for a meeting in the future, to go over some of the programs that the Airport has taken over the years to help reduce runway incursion. Chairman Kwoka asked what is FXE ranked? Mr. Harrison answered we are #1. For the time-period from May 2015 to present, we have had 13 surface incidents; broken down into pilot deviations, operational errors (mistakes by controllers) and pedestrian deviations. Of those 13 incidents, 12 are pilot deviations. He explained that when we receive an alert by the tower, our Operations staff inspects the area making sure the proper markings and signage are in place and check to see if there are any other mitigating factors that could have stopped the incident from happening. The Airport is always active in this regard and does everything we can to prevent these incidents. One of the biggest takeaways is reaching out to the pilot community to make sure they are doing the preflight planning before getting out on the taxiway. Chairman Kwoka asked if a comparison can be put together of what dollar figures is being put into systems like lights, marking vs. education programs? Mr. Harrison agreed to do so. Mr. Rebholz asked what action does the FAA take on pilot deviations? Mr. Harrison answered that right now, there is no punitive action taken, they usually do some counseling.

Ms. Straugh provided an update, announcing the Broward County Airport Noise Abatement Committee will be meeting at 6:00 PM on June 13th. F. FltPlan 2016 Pilots’ Choice Awards Mr. James announced that Banyan Air Service was rated as the top US Fixed Based Operator in this region by a survey taken by FltPlan. He acknowledged Banyan for the dedicated service they provide to the flight crews, as well as passengers that use the facility and Airport. Other Items and Information Chairman Kwoka asked Mr. Hayden of Sheltair if he was aware of the runway incursion situation and is Sheltair doing anything to get the word out? Mr. Hayden responded that the issues he was made aware of are primarily on the trolling taxiways, where people are not paying attention to helicopters going in and out. He spoke about adding signage for people who drive across the taxiways, warning them of low flying aircraft, but wanted to check the Airport’s standard for signage first. He also spoke about sending out a blast email out to the east side of the Airport. Mr. James added that, typically, if an errant vehicle or pedestrian accesses the airfield on the movement area, a $500.00 fine is imposed, the police issue an NTA and the offender has to go before a judge to address the fine that will be imposed. This restriction has been in place for 15 years and it has helped with vehicular and pedestrian types of incidents. Mr. Watt inquired if there was an update on the Schlitterbahn or BurgerFi proposals? Mr. James answered that he and the City Manager gave their depositions and he expects they will get back to court the end of July or beginning of August to finalize everything. On the BurgerFi matter, Mr. James stated that there is still a pending lawsuit. He explained that CPC is contesting not having access to the airfield from that fee simple property they purchased. The FAA discourages through the fence operations if they can avoid it. When the lease was made, with Aero Toy Store in 2008, language was placed

in the lease to insure that when that lease was terminated or transferred to someone else, the through the fence rights would stop. Therefore, when Aero Toy Store’s lease was terminated the through the fence right went away with it, as well. Before closing the meeting, Chairman Kwoka mentioned that due to operational challenges there are no minutes this month and that they would be included in the next meeting packet. Project 11998 – Weekley Asphalt Paving, Inc. The Florida Department of Transportation (FDOT) conducted a pavement evaluation inspection in 2012 at Fort Lauderdale Executive Airport. The evaluation determined that the asphalt pavement on Runway 9/27 and 13/31 needs preventative maintenance in the form of crack-sealing and the application of seal coat in order to extend their useful pavement life. The Airport’s General Engineering Aviation Consultant, HDR Engineering, Inc., developed plans and bid specifications to address the above concerns. The construction includes crack sealing, milling and re-surfacing of the runway centerline, seal coat, and pavement striping along both runways and their corresponding connectors. The plans were prepared with a base bid (Runway 9/27) and alternate bid (Runway 13/31) options to allow for award of separate phases if the bids were to exceed the funding amount. Invitation to Bid 663-11718 was opened on April 26, 2016 and two bids were received. Weekley Asphalt Paving, Inc., of Pembroke Pines, Florida, was the lowest cost, responsive and responsible bidder with a bid in the amount of $946,716.90 for both the base and alternate bid options. This amount is in excess of the engineer’s estimate of $810,838.47. After staff’s review of the bid prices with the consultant and contractor, there was agreement to proceed with the award of the base bid portion, in the amount of $603,141; as well as the pavement striping on Runway 13/31 alternate bid items, in the amount of $63,480. Bidders Bid amount Weekley Asphalt Paving, Inc. $ 946,716.90 Griffin Contracting, Inc. $1,148,561.28 Funds for this task order are available from within the project budget and from a Joint Participation Agreement from FDOT, in the amount of $432,000, for the reimbursement of approximately 80% of the anticipated project costs. FDOT has indicated that they will provide additional funding in the form of a Supplemental Joint Participation Agreement to cover the additional project costs. Staff Recommendation The staff recommends award of the contract to the low responsive bidder, Weekley Asphalt Paving, Inc., of Pembroke Pines, FL in the amount of $666,621 for the Runway 9/27 pavement rehabilitation and pavement striping on Runway 13/31

Application - Project 12206 The Federal Aviation Administration (FAA) developed a comprehensive and multi-year program to identify, prioritize, and implement solutions to mitigate runway incursions. Nine areas were identified by the FAA and airport staff as areas of concern that could potentially lead to runway incursions. Airport staff proposes to address these areas by installing in-pavement and elevated LED Runway Guard Lights and surface painted signs. New conduit and cabling will also be installed as part of the project, as well as modifications to the electrical vault. The design was completed by HDR Engineering, Inc., the airport’s engineering consultant firm. The project was advertised on April 19, 2016 and bids were opened on June 7, 2016 with three bids being submitted. The low, responsive bidder was H.L. Pruitt Corporation of Winter Springs, FL, with a bid in the amount of $484,027.50. Bidders Bid amount

The FAA has agreed to provide grant funding for 90% reimbursement of eligible construction costs for this project. James, Airport Manager SUBJECT: Parcel 8AB – KC FXE- Second Amendment to Lease Agreement KC FXE Aviation Investments, LLC (KC FXE) leases Parcel 8AB at Executive Airport (Exhibit 1) through a 30-year lease agreement dated November 1, 2009. This property, consisting of 8.683 acres of aviation property, has been improved with 29,520 square feet of hangar and FBO office space. Rental payments are $161,012.96 per year and are adjusted annually in accordance with the Consumer Price Index. The next adjustment is scheduled for November 1, 2016. Mr. Ignacio Martinez acquired the membership interests of KC FXE Aviation Investments, LLC including the Parcel 8AB lease. Mr. Martinez has business interests at Executive Airport, which includes controlling interest in Professional Flight Transport, Inc. d/b/a Windsor Jet Management (Windsor Jet). Windsor Jet is a Part 135 charter operator based at Executive Airport Parcel 2A. Additionally, Mr. Martinez is an owner of Mach 1 Jet Services which provides aviation maintenance and repair services to the Windsor Jet fleet and for third parties. According to the terms of the lease, KC FXE is required to redevelop Parcel 8AB in three phases totaling approximately $5,000,000. Mr. Martinez intended on fulfilling the minimum construction requirements and deadlines contained in the Lease Agreement by developing a first-class FBO facility on the leasehold. Phase I involved the demolition and clearing of the old restaurant located on the property within 12 months of the commencement date of the new lease, and has been completed. Phase II involved construction of a minimum 21,577 square feet of aircraft hangar and office space, roadway access, automobile parking, and site improvements. Phase III consisted of construction, by November 1, 2019, with a minimum of two hangars totaling approximately 39,300 square feet and a 10,000 square foot terminal building. KC FXE has encountered several challenges in fulfilling the Phase II construction requirements but has made progress with the Broward County Stormwater Management Department and the City’s Building Department for the necessary construction permits. Unfortunately, these challenges have resulted in delays for KC FXE and will require a lease amendment to address the Phase II construction requirements.

KC FXE is requesting additional time to complete the Phase II and Phase III construction improvements (Exhibit 2). The Phase II construction requirement will commence upon receipt of the master building permit and is schedule to be completed within 332 days, which will now include construction of a minimum of two aircraft hangars and office space totaling approximately 44,680 square feet. Phase III construction completion date is being extended to December 31, 2022 and will consist of a minimum 22,340 square feet of aircraft hangar and office space, and a 7,500 square foot FBO terminal building. A Construction Assurance Deposit (CAD) of two percent of the total construction cost was also negotiated for Phase II and Phase III, which will be forfeited to the Airport in the event construction is not completed by the agreed dates. In consideration for the additional time, KC FXE has agreed to increase the current rent by five percent, increasing the rent to $169,063.56, effective on the date of the amendment for Phase II construction requirements, plus regularly scheduled Consumer Price Index (CPI) adjustments. Additionally, KC FXE has also agreed to increase the rent by five percent, effective October 2019 for the Phase III construction requirement extension, plus the regularly scheduled CPI adjustment. Staff Recommendation Staff recommends approval of a Second Amendment to the KC FXE Aviation Investments, LLC Lease for Parcel 8AB in order to allow for construction of approximately 67,020 square feet of hangars and attached office space, and a new 7,500 square foot FBO terminal building.

Noise Abatement Workshop for Pilots A Noise Abatement Workshop for pilots is scheduled for Wednesday, June 29, 2016 at 11:00 a.m. The workshop will be an outreach opportunity to remind pilots about FXE’s noise abatement measures to reduce aircraft noise over the neighborhoods. We also hope to receive feedback from the pilots on the effectiveness of the program and the best ways to increase pilots awareness. Nighttime Jets There were no jet departures over 80 dB at night between 11:00 p.m. and 7:00 a.m. during the month of May 2016.
