Burke County was formed in 1777 from old Rowan County and presents a variety of research problems due to the destruction of a large number of records by Union forces during the 1860's. 'Some records did survive however, including a few wills, a substantial series of court minutes, some estate files, and a series of tax lists.

In compiling this volume ^11 original wills\(or copies of wills in the North Carolina State Archives ( C . • . 014.801.1) were abstracted, as well as those recorded in Will Books 1, 2, and 3 with probate dates through 1910. Surviving minutes of the Court o Pleas and Quarter Sessions and the Superior Court were examined for the period prior to record destruction and references relating to probate of wills were obtained. One might hope that perhaps a second copy of a destroyed will might yet be found among private family records. The earliest volume of court minutes prior to 1791 is missing, preventing our knowing what wills existed for the earliest years. The diligent researcher would be advised to consult known surviving Burke County records, Morgan District Court records, and North Carolina Supreme Court records, since dispute:, regarding property were frequently resolved in the higher courts.

For ease of reference each abstract has been assigned a unique number and it is this number to which reference is made in the index to these abstracts. Since a will occasionally may not provide surnames for individuals, a puzzled reader will surely wish to read the entire will to which he or she may be directed by an abstract. Whenever the surname of an individual is not stated, the index was prepared based on the surname of the deceased or the implied name. Thus, for example, a daughter who is married, but whose married name is not stated, is indexed by her parent's surname.

We have attempted to remain faithful to spellings of names. It will be noted that some handwritings are quite difficult to read. In cases where no definitive decision could be reached on the script at hand, a question mark is included.

These abstracts are usually formatted as follows: name of devisor, date of will, date of probate, devisees, executors, witnesses, and additional probate information if available. Finally the book and page number where the will is recorded is given. If an original will exists, one should obtain a copy or examine the original, since a number of errors are possible as transcriptions ar? made over a period of time. Anyone requesting copies should ask for copies of all records relating to the will. For those wills referred to in the court minutes but for which no original has been found, the date of probate is given and who presented the will for probate, qualified as executor, and/or proved the will.

This publication is a companion volume to similar abstracts for the counties of Caldwell and McDowell Counties and continues the series begun by your compilers with the publication of abstracts of wills for Polk, Rutherford, and Cleveland Counties, North Carolina.
