RAY Colbert knows sooner or laterhe will lose his battle withasbestosis, but before that daycomes he is determined to raiseawareness of the deadly disease.The 65-year-old, who relies onoxygen 24 hours a day, will drivehis motorised wheelchair fromToowoomba to Brisbane later thismonth to bring attention to theplight of sufferers and raisemoney for medical research.The journey will take MrColbert through the flood-affectedIpswich and Lockyer Valleyregions during InternationalAsbestos Awareness Week.“I chose this route because one

thing highlighted by the floods inthis area was how much asbestoswas brought out into the open,”Mr Colbert said.“People need to be aware that it

is not safe to handle it and it needsto be cleaned up by council orskilled contractors.Mesothelioma and asbestosis

are the two most commonasbestos related diseases and atpresent no cure is available foreither illness.Mr Colbert said asbestos related

diseases develop slowly,sometimes over decades.“I served in the engine rooms ofthe Royal Australian Navy aircraftcarriers HMAS Melbourne andSydney for nine years,” Mr Colbertsaid.“When the planes would land on

the Melbourne it would shake andasbestos fibres would fall, just likesnow coming down.“If you were going to becontaminated with it (asbestos),that was a good place to get it.”

During the event, nicknamed“Ray’s Ride”, Mr Colbert will beflanked by two support vehiclescontaining a wheelchair mechanic,safety marshal and paramedic.Footpaths will be used insteadof roads where possible tominimise disruption to traffic.

Tireless advocate for asbestos disease sufferers passes away following long battleLeading Queensland asbestos safety advocate, charity fundraiser and support worker Raymond Colbert has passed away following a long battle with asbestos disease.

It is with great sadness that the Asbestos Related Disease Support Society Queensland is advising the community of Ray’s passing.

Mr Colbert, who was the Secretary of ARDSSQ for the past five years, had suffered from asbestosis for more than a decade, however his health had deteriorated very recently. He sadly passed away on Wednesday, May 21.

He had worked tirelessly, alongside his wife Helen, on behalf of asbestos disease sufferers for many years.

ARDSSQ Vice President Andrew Ramsay said Ray would be remembered for his strength and courage, which never faded, even in his final days.

“Ray never asked for pity or sympathy and took everything in his stride,” Mr Ramsay said.

“When people would ask how he was going, Ray would quickly reply: ‘Always well!’

“The tireless efforts of Ray and Helen, with the help of fellow volunteers, built the Society into the well-respected not-for-profit organisation it is today.”

One of Ray’s greatest achievement was “Ray’s Ride” (www.raysride.com.au) in 2011, when he travelled from Toowoomba to Brisbane to increase awareness of the danger asbestos exposure still posses to many in the community.

“Ray, who was wheelchair bound and on oxygen 24 hours a day, took five days to complete the ride, battling the November heat and plenty of flies,” Mr Ramsay said.

“He travelled along many rough roads through the towns of Grantham, Gatton, Laidley, Ipswich, and ended at the Cathedral of St Stephen in Brisbane for the yearly Asbestos Awareness Week Ecumenical Service.

“His journey raised well over $60,000 in much needed donations to support Queensland sufferers of asbestos diseases.”

Ray was born in Victoria on August 12, 1946, before moving to Queensland at a very young age. He served in the Royal Australian Navy from June 1964 until July 1973, and was diagnosed with asbestos disease in 2001.

Ray became a volunteer with the Society in 2004, and by 2006 he had the position of Chairperson of Meetings. With the passing of the Society founder Shirley White in 2009, Ray and Helen became the Society’s Secretary and President.

Through their efforts, the Society has become a leader in asbestos disease support, information and help, responding to a constant flow of enquiries from asbestos victims and their families.

Ray is survived by his wife Helen, sons Darrel, Carl and Christopher, and Grandchildren Lucinda, Matthew and Emily.

Kingdom. HMAS Otway was part of the commissioning fleet of

Oberon class submarines which Ray served on.

In accordance with the Constitution and Rules of the Asbestos Related Disease Support Society QLD Inc., the Annual General Meeting will be held, 10.30am Tuesday 9th September, 2014 at 16 Campbell Street Bowen Hills with the election being held at that time. Nominations are now open for the positions on the ARDSSQ Committee.

At the Annual General Meeting of the Association, all the members of the Management Committee for the time being shall retire from office, but shall be eligible upon nomination for re-election. All the existing committee will stand again for the positions on the committee. Unfortunately, due to the passing of Raymond Colbert, the Secretary and Chairperson position needs to be filled.

If you would like information about any of the committee positions, particularly Secretary and Chairperson which need to be filled, please contact the Society offices on 1800 776 412.

The Management Committee would like to strongly encourage all of you to continue your membership of this Society. The support of our members has seen us transform from a group of like-minded people to a strong lobby group advocating on behalf of all asbestos disease sufferers in Queensland.

The Society also supports and works with other Asbestos Related Disease Support Groups around Australia, “Working together to make a Difference”.

Although there have been many improved asbestos safety control measures put in place, there is still much more to be done.

Sleepiness or the Fatigued Patient

Sleepiness is a problem reported by 10 to 25 per cent of the population depending upon the definition of sleepiness. Sleepiness occurs more frequently in young adults and older adults.

It can be defined as a state of need. It is estimated that in the year 2000 adults in the general population slept for at least one hour less than people did in 1900.

Hence in many cases sleepiness is a result of people trying to do too much in too short a time and not resting.

Sleepiness (fatigue) can be caused by:-

1 Reduced sleep time2 Poor sleep quality (fragmented or

disrupted sleep resulting in abnormal sleep architecture)

3 Pain4 Obstructive sleep apnoea5 Limb and movement abnormalities6 Chronic disease states7 The parasomnias (sleep terrors)8 Snoring without associated apnoea may

also result in sleepiness9 Sedating drugs. Discontinuing alerting

drugs and by various neurological diseases

10 Poor sleep quality with disruption of circadian rhythms (shift work and jet lag)

11 Depression and psychiatric illness12 Lack of physical exercise, poor and

inadequate diet and nutrition and various endocrine abnormalities

13 Alcohol, drug abuse and stress and anxiety.

A thorough clinical history and physical examination and knowledge of the drugs that patients are taking is necessary to discover the cause and seriousness of sleepiness.

Sleepiness when excessive and persistent is a symptom that the patient should not ignore. It is dangerous and life threatening to continue without sleep.

Patients with asbestos related disease may be depressed, frightened and anxious or suffer from chronic pain, recurrent chest infections, cough and dyspnoea.

Lack of sleep and sleep disturbance in these patients may result in a change of diurnal rhytbm and chronic fatigue and tiredness. Chronic excessive day time sleepiness may affect patients with asbestos related disease further decreasing their quality of life. Disturbed sleep should be assessed as a complication of Asbestos Related Disease and should be investigated.

In those who have asbestosis and low lung volumes the risk of developing obstructive sleep apnoea may be increased.

Limitation Periods

Most compensation claims are subject to limitation periods, meaning that an injured person or indeed for instance persons who have suffered loss as a result of a commercial transaction have only so much time to lodge their claim for compensation.

In many circumstances this is fairly straightforward as a person is well aware of when they suffer an injury or loss and understand how that loss has occurred. In asbestos disease claims this is more complex, particularly in the circumstances where an asbestos disease slowly worsens over time. A person may initially be diagnosed with a non-disabling pleural plaque condition but which over time develops into asbestosis or more sinister disease. A person may be diagnosed with lung cancer but not be aware until much later that asbestos exposure has played a role. When does the time limit start to run?

The unique nature of asbestos disease where it generally slowly worsens over time led to the abolition in Queensland of the time limit for court claims for those who suffer from asbestos disease. Therefore for a person with asbestos disease who seeks to bring a court action for their injury (in respect of exposure in Queensland) – no time limitation period applies. It is still very important though that a claim be lodged in a person’s lifetime.

The Queensland Court of Appeal recently considered whether the abolition of the time limit for asbestos court claims extends to claims brought by dependants of those who pass away from asbestos disease.

WorkCover Queensland argued that the abolition of the time limit did not extend to these types of claims. Thankfully though for dependants of asbestos disease the Court of Appeal on 6 June 2014 held that the abolition of the time limit did extend to dependency claims and they are not subject of time limitation periods. This provides consistency to claims for damages not just for those suffering from the disease but for dependants as well.

It is worth nothing though that whilst there is no time limit for court actions for asbestos disease arising from asbestos exposure in Queensland, there is still a time limit for workers’ compensation claims and whilst there is some discretion to extend the time, a person only has six months from diagnosis with an asbestos disease to lodge a claim under the workers’ compensation system. For some injuries, such as pleural plaques, there may not be much need to lodge a claim but for more serious injuries that six month time limit is important. Furthermore, regardless of the type of claim, claims must be lodged in a person’s lifetime for any significant compensation to be recovered.

This fact sheet provides advice to employers, workers and site controllers on the selection and use of vacuum cleaners that are used to collect asbestos and hazardous dust.

SELECTIONNever use domestic vacuum cleaners for this purpose, even those fitted with HEPA (High Efficiency Particulate ir) filters.

Vacuum cleaners used to collect asbestos must have a dust class, level ‘H’ filter and must comply with AS 60335.2.69:

2003 Household and similar electrical appliances – Safety – Particular requirements for wet and

dry vacuum cleaners, including Power Brush, for Industrial and Commercial Use. Annex AA of the standard provides an outline of the requirements for vacuum cleaners, suction sweeping machines and dust extractors used to collect dusts which are hazardous to health.

Vacuum cleaners must display the high hazard (H) class symbol and contain information such as the model type, and the manufacturer’s name and trademark. Vacuum cleaners with an ‘L’ or ‘M’ class symbol are not suitable for use.

The following warning labels must be displayed:

The lettering on the labels must be at least 3mm high and the labels visible by the operator when switching the vacuum cleaner on or off and when it is in use. Removable covers and guards should be fitted with a ‘REMOVE FOR CLEANING’ label.

Suppliers of these vacuum cleaners should provide information that confirms:

• the vacuum cleaner complies with AS 60335.2.69: 2003

• safe methods for collection, removal, disposal and decontamination

• the maximum flow rate (m3/h) and maximum under-pressure (hPa)

• the personal protective equipment (PPE) to be worn

• how to service the vacuum cleaner, including how to remove covers of non-dust proof compartments for cleaning

• where spare parts, such as filters and dust collectors, can be obtained.

If possible, don’t hire a vacuum cleaner to collect asbestos or hazardous dusts. If you must hire one, ensure it is from someone who specialises in these vacuum cleaners. They should be properly trained in using these vacuum cleaners and maintain them in good condition.

Painter faces $50,000 asbestos clean up costs for using high pressure sprayer

A painter who used a high pressure water spray unit to clean a customer’s asbestos roof faces a $50,000 clean up fee after facing court action in Brisbane recently.

The painter used a high-pressure water spray unit on asbestos containing material and pleaded guilty in the Brisbane Magistrates Court on 1 May to breaching of section 446 of the Work Health and Safety Regulation 2011. The owner’s property, and those of nearby neighbours, were contaminated with asbestos fibres.

He was fined and placed on a good behaviour bond. He also faces a possible $50,000 clean up bill. Some clean ups in recent years have cost up to $100,000.

The Brisbane prosecution followed another in March this year in Ayr where the court ordered a 12 month work health and safety undertaking, with surety of $20,000, over a case of the ‘smash and bash’ demolition of a building containing asbestos materials.

Painters and roof cleaners are warned that where there is exposure to risks from asbestos contamination, they must use methods that do not release asbestos fibres into the air.

The Asbestos Related Disease Support Society QLD Inc. would like to thank the Queensland Council of Unions for inviting the Society to take part in Workers Memorial Day.

Due to the inclement weather, at short notice the event was held indoors at the nearby Traders Inn. As many as 300 people were in attendance to pay their respect to those workers who have been injured, developed a work related illness or who have never made it home.

Workers Memorial Day is an international day when unions, workers and community members remember those who have been injured, developed a work related illness or killed at work and renew our commitment to fight for the living.

Since April 2013 to April 2014, the society had been informed of 104 society members who passed away with an Asbestos Related Disease.

What is the May Day BBQ and why is it so important to the Society?

ARDSSQ involvement in the May Day BBQ started as a fundraising event back in 2005. It has become an opportunity to thank one of our major corporate sponsors CFMEU without whose help we would be unable to operate as efficiently as we do.

The Management Committee would like to take this opportunity to thank everyone involved in the Annual May Day BBQ, from its organisation through to the many hours of labour which goes into creating a successful conclusion to May Day.
