5. While engaging in the exempted activity, the exemption holder must be in possession of a copy of this notice. Such notice must be produced to a Fisheries Officer as requested.

6. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice.

MINING ACT 1971 PUBLIC NOTICE

Notification of Airborne Geophysical Survey in Northern South Australia The South Australian Government, through the Geological Survey of South Australia, is about to commence an airborne geophysical survey over Regions 5, 6A, 6B, 7 and 9B,on the attached map, which are within a geological region known as the Gawler Craton. The survey is a scientific investigation that is being undertaken in accordance with section 15 of the Mining Act 1971. The survey is scheduled to begin in March 2018 and will take up to 5 months to complete. The survey will be performed by one of several models of fixed-wing Cessna, with a single propeller engine. The aircraft will fly approximately 60m above the ground along east-west and north-south oriented flight lines spaced 200m apart. As this is an airborne survey, there will be no on ground data collection or sampling. The aircraft use sensors that will capture magnetic intensity, radiometric and elevation data. This information will provide a greater understanding of the composition of rocks at and beneath the earth’s surface that will help to inform natural resources management, resource potential and water research activities in the region. The survey is being led by the South Australian Government in partnership with Geoscience Australia (part of the Federal Government’s Department of Industry, Innovation and Science). This survey is a key program of the Plan for Accelerating Exploration (PACE) Copper Initiative, which is part of South Australia’s Copper Strategy. A dedicated website www.minerals.dpc.sa.gov.au/gcas has been developed to inform the community about the Gawler Craton Airborne Survey. The website will provide information about aircraft activity during the survey and allows the community to subscribe to email updates on the progress of the survey. (6) any used agricultural machinery; (7) plant diagnostic samples.

5.3 Sub-paragraph 5.2 does not apply in relation to any item for which importation or introduction is prohibited under sub-paragraph 5.1. 6. Quarantine Areas – Pursuant to Section 8 of the Act 6.1 The following portions of the State are declared to be quarantine areas:

(1) in respect of the pest Onion Smut; (i) Hundred of Forster – that part registered in Certificate of Title volume 290 folio 4 and defined by the following

coordinates: Latitude Longitude S340 50’ 48.6” E1390 36’ 44.6” S340 50’ 52.5” E1390 36’ 42.9” S340 50’ 49.4” E1390 36’ 36.1” S340 50’ 45.6” E1390 36’ 38.3”

(2) in respect of the pest fruit flies, any area within 1.5 kilometres radius of the centre of a fruit fly outbreak (as described in the Standard), the centre being the point where eggs, larvae or adults of fruit flies have been detected.

(3) in respect of the pest fruit flies, for the purpose of excluding fruit flies from the Riverland of South Australia (i) the County of Hamley, and (ii) the Hundreds of Bookpurnong, Cadell, Gordon, Holder, Katarapko, Loveday, Markaranka, Moorook, Murtho, Parcoola,

Paringa, Pooginook, Pyap, Stuart, Waikerie, Eba, Fisher, Forster, Hay, Murkbo, Nildottie, Paisley, Ridley, and Skurray. (4) the whole of Kangaroo Island with respect to the declared diseases of potato, namely bacterial wilt (Ralstonia solanacearum

Race 3) and potato cyst nematodes (Globodera rostochinesis and Globodera pallida). This quarantine area is to be known as the ‘Kangaroo Island Protected Production Area’.

6.2 The quarantine areas established under sub-paragraph 6.1(1) and indexed by Roman numerals cease to exist on the following dates:

Subparagraph (i) on 3 October 2017 6.3 Measures to be taken in Quarantine Areas

(1) The owner of any commercial premises within a portion of the State declared to be a quarantine area in respect of the pest Onion Smut must take the measures prescribed in the Standard for eradication of that disease.

(2) The owner of any commercial premises within a portion of the State declared to be a quarantine area in respect of the pest fruit flies must take the measures prescribed in the Standard for the eradication of such flies.

(3) The owner of any commercial premises within the ‘Kangaroo Island Protected Production Area’ established under sub-paragraph 6.1(4) must take the measures prescribed in the Standard for eradication of the declared diseases of potato.

6.4 Measures for the exclusion of fruit flies from the Riverland of South Australia (“the Riverland Fruit Fly Quarantine Areas”): (1) Host fruits of fruit flies (“host fruits”) as defined in paragraph 5.2 (1) are prohibited and must not be imported or introduced

into the quarantine areas declared in paragraph 6.1 (3) (“the Riverland Fruit Fly Quarantine Areas”) unless: (i) if the host fruit was produced in a State or Territory other than South Australia: the host fruit complies with the

provisions of the Standard. (ii) if the host fruit was produced in any part of South Australia outside the Riverland Fruit Fly Quarantine Areas: the host

fruit has been certified by an inspector under the Act as having been either: • grown in an area free of fruit flies as defined by the Standard;

or • treated against fruit flies by a method set out in the Standard.

(iii) if the host fruit was originally produced in the Riverland Fruit Fly Quarantine Areas, but has moved outside those areas and is now proposed to be re-introduced into those areas, the produce must either be: • be certified by an inspector that it has been maintained in an area free of fruit flies or treated against fruit flies by a

method set out in the Standard; or

• moved under an accreditation arrangement as approved by the Minister under Part 4 Division 2 of the Act and regulation 7 of the Plant Health Regulations 2009.

(2) Subparagraph (1) (ii) does not apply to host fruit grown for the purpose of sale if that fruit was grown within a fruit fly outbreak suspension area.

(3) Subparagraph (1) does not apply to host fruits that have been purchased within South Australia and are accompanied by an itemised retail purchase docket applicable to that produce.

7. Incorporation of Codes and Standards - Pursuant to Section 59 of the Act 7.1 The Plant Quarantine Standard South Australia (the Standard) as in force from time to time is hereby adopted under Section 59 of

the Act and provides the basis on which declared pests under 3.1 of this notice are specified, and items listed under 5.2 of this notice may be imported into the State. In addition to being available under Section 59 (2)(a) of the Act, the Standard will be available from the PIRSA website http://pir.sa.gov.au or by phoning Biosecurity SA – Plant Health on (08) 8207 7820.

7.2 The Plant Health - Plague Locust Control Plan as maintained as part of Primary Industries and Regions South Australia’s Emergency Management Documents as in force from time to time is hereby adopted under Section 59 of the Act.

Parl I - Preliminary

I . 'hort Tille

Thi by-law may be c ited as the Ca1s By-law 2018.

2. Commencement

This by-law will come into operation four months after the day on which ii is published in the Gazelle in accordance with Section 249(5) of the local Governmenl Act /999.

3. Definitions

3.1 In thi by-law:

3.2

3.1. 1 cattery mean a buildi ng, tructure, premise or area approved by the relevant authority pursuant to the Development Acl /993 for the keeping of cats on a temporary or pennanent basis that is operating in accordance with all relevant approvals;

3.1.2 cat means an animal oflhe species Fe/is catus;

3. 1.3 effective control by means of physical restr.iint means:

3.1 .3. 1 the person is exercis ing effeclive control of the cal by m an of a chain, cord or leash that does not exceed 2 metres in length restraining the cat

3.1 .3.2 the person has effectively ecured the cat:

(a) by plac ing it in a cage, vehicle or other object or tructure; or

(b) by tethering it to a fixed object by mean of a chain, cord or leash that does not exceed 2 metres in length.

3.1.4 keep and kept include the provision of food or shelter;

3.1 .5 premises includes:

3. 1.7 public notice has the same meaning as in Section 4( I aa) of the L-0ca/ Government Act ! 999;

3.1.8 responsible for the conlrol means a person who has pos ess ion or control of Lhe cat;

3.1 .9 wander at large mean the cat is in a public place or a private place wi thout the consent of the occupier, and no person is exerc ising effective control of the cat by means of physical restraint.

For Lhe purpo es of this by- law:

3.2. 1 the prescribed lim it, in respect of the number of cats to be kept on premises, is two cats:

3.2.2 the prescribed manner in which a cat is to be identified is :

3.2.2. 1 by means of implanted microchip that:

3.2.2.2

(a) i permanently implanted;

(b)

(c)

confonn with the requ irements of Regulation IO(l)(c) or 10(8) of the Dog and Cat Managemelll Reg11/a1ions 2017 (as if the requ irement were in force at tl1e commencement of thi s by-law); and

is implanted in accordance with Regulation lO(l)(d) of the Dog and Cat Management Regulations 2017 (as if that requirement was in force at the commencement of thi s by-law); and

at all times wh ile the cat is not effecti vely confined to premi es of which tlte owner of the cat is the occupier, by means of a collar around its neck to which a registration lag issued by the Council for tJ1e cat i attached.

Parl 2 - Registration and Identification of Cats

4. Cats Must be Registered

4.1 Every c.at kept in the ouncil 's area must be registered under thi by-law.

4.2 !fa cat i unregi tered, any per on who own or i re pon ible for the contro l of the cal i guilty ofan offence.

4.3 If a person is guil ty of an offence by reason of a cat being unregistered, the person is guilty of a continuing offence for each day that the cat remains unregistered.

4.4 A person is not guilty ofan offence by reason of the fact that the cat is unregistered if:

4.4.1 lhe cat is le s than 12 week of age; or

4.4.2 less limn 14 days has elapsed since the person:

4.4.2.1 fi rst owned or became respon ible for the control oflhe cat; or

4.4.2.2 caused or pe1mi1ted the cat to be usually kept with in the area oflhe Counci l; or

4.4.3 lhe cat:

4.4.3.1 is Ira ell ing with the person; and

4.4.3.2 is not u ually kept within the area of the Council ; or

4.4.4 lhe person is responsible for the contro l of the cat only by reason of lhe cat being kept, for business purpo es, at prescribed premises.

5. Registration Procedure for Cats

5.1 An application for registration of a cat must:

5. 1.1 be made to the Council in the manner and fonn approved by the Counc il: and

5. 1.2 nominate a person of or over 16 years of age who consents to the cat being registered in hi or her name; and

5.1.3 nominate, with reference lo an addre o f premi e , the p lace at which the cat , ill u ually be kept; and

5. 1.4 include the unique identification number a igned to the microchip implanted in the cat in accordance , ith paragraph 8; and

5.1.5 be accompan ied by the registration fee and, if app li cable, any late payment fee set by the Counci l by resolution for the cat.

5.2 Subject to subparagraph 5.3, on application and payment of the registration fee and any fee for late payment of the registration fee, the Counci l must register the cat in the name of lhe person nominated and i sue to that person a certificate of registration in the form approved by Council.

5.3 The Council may refuse to register a cal under lhi by-law if:

5.3.1 the number of cats kept or proposed to be kept at premises exceeds the prescribed limit; or

5.3.2 keeping a cat at the proposed premises would be contrary to any Act, Regu lation or By-law.

5.4 A cat registered in the name of a particular person must, on application to the Counci l, be registered in the name of ome other person who i of or over 16 years of age and consent to the cal being registered in hi or her name.

6. Duration and Renewal of Registration

6.1 Registration under this by-law remains in force until 30 June next ensuing after registration wa granted and may be renewed from time to time for further periods of 12 months.

6.2 I fan application for renewal of registration is made before 31 August of the year in which lhe registration expired, the renewal operates retrospectively from the date of expiry,

7. Accuracy of Records

7.1 The person in whose name a cat is ind ividual ly registered must in form the Council as soon as practicab le after any of the fo llowing occurs:

7. I. I lhe cat is removed from the place recorded in the register as the place at which the cat is usually kepi with the intention that it wi ll be usually kept at some other place (whether in the area of the Counci l, in a di fferent Council area or outside the late);

7 .1.2 the cat dies;

7 .1.3 the cat has been missing for more than 72 hours;

7 . 1.4 the residential address or telephone number of the owner of the cat change;

7.1.5 the ownership of the cat is transferred to another person.

7.2 Information given to the Council under th is section must inc lude such details a may be rea onably required for the purposes ofcnsuring the accuracy of records kept under tJ1c Dog and Ca, Ma11ageme111 Act 1995 and this by-law.

7 .3 If ownersh ip of a cat is transferred from the person in whose name the cat is individually registered, the person must give to the new owner the certificate of registration last is ued in respect of the cat.

8. Identification of Cats

8.1 Every cat kept in the Counci l's area mu t be identified in the prescribed manner.

8.2 If a cat i not identified in the prescribed manner any person who owns or is re ponsible for the control of the cat is gui lty of an offence.

8.3 A person is not gui lty ofan offence by reason oflhe fact that the cat is not identified in the prescribed manner if:

8.3.1 the cat is less than 12 weeks of age and ha not been sold;

8.3.2 less than 28 days has elapsed s ince the per on first owned or became re pon ible for the control of the cat; or

8.3.3 the cat:

8.3 .3.1 is travell ing with the person; and

8.3.3.2 is not u ually kept within the area of the ouncil; or

8.3.4 the person is responsible for the control of the cat only by reason or the cat being kept, for busines purposes, at prescribed premises; or

8.3.5 the ouncil has granted the owner of the cat an exemption from the requirements of this paragraph or an extension of time witJ1in which to comply with the requirements;

Part 3 - Cat Management and Control

9. Cats not to Wa nder at Large

9.1 A person who owns or i responsible for the control of a cat must not al low the cat 10 wander at large.

9.2 A person i not guilty of an offence by reason of the fact that a cat is wandering al large if the cat i wanderi ng at large:

9.2. 1 within a designated span of hours;

9.2.2 within a designa ted area.

9.3 In this paragrJph:

9.3. 1 des ignated spun or hours means the span or spans of hours determined by the ounci l, by resolution. when the requirement of thi pa ragraph will 1101 apply;

9.'.2 designated area mean a part or parts of the ounc il that the ouncil may. by re olution. determ ine that the requ irements of this paragraph will not apply.

11. Lim it on Cat Numbers

11. 1 A person must not, without perm ission, keep nny cal on any premises where the number of cats on the premises exceeds the prescribed I imi t.

11.2 Pe1111iss ion under this p,1ragr;1ph may be given iflhe Council i satis fi ed that:

11.2.1 no insan itary cond ition exists or is li kely Lo arise on the premises as a resu lt or the keeping of cats;

11.2.2 a nuisance is not caused to an neighbour as a resul t of the kee ping of cats on the premise.; and

11.2.3 all cats kept on the premi. es are desexed in accordance with any requ iremenl~ of the Dog 011d Ca, Manage111en1 Ac! 1995.

11 .3 The pre cribed limit does not apply to:

11 .3. 1 prescribed prem ises; or

11.3.2 any cat under 12 week of age.

Part 3 - M iscellaneous

12. Requirement to Publish Determ inations

If the ounci l makes a detennination under paragraph 9 ofthi by-law, the ouncil must give publ ic notice of the mak ing of thal determination.

The forego ing by-law was duly made and passed at a meeting of The District Council of Yankalilla held on the 20'h day or February 20 18 by an absolute majority of the memb rs for the time being consti tuting the Council. there being al least two thirds of the members present.
