BUILDING WORK CONTRACTORS ACT 1995

Exemption

TAKE notice that, pursuant to Section 45 of the Building Work Contractors Act 1995, I, Dini Soulio, Commissioner for Consumer Affairs, do hereby exempt the licensee named in Schedule 1 from the application of Division 3 of Part 5 of the above Act in relation to domestic building work described in Schedule 2 and subject to the conditions specified in Schedule 3.

2. This exemption does not apply to any domestic building work the licensee contracts to another building work contractor, for which that contractor is required by law to hold building indemnity insurance.

3. That the licensee does not transfer his interest in the land prior to five years from the date of completion of the building work the subject of this exemption, without the prior authorisation of the Commissioner for Consumer Affairs. Before giving such authorisation, the Commissioner for Consumer Affairs may require the licensee to take any reasonable steps to protect the future purchaser(s) of the property, including but not limited to:

• Providing evidence that an adequate policy of building indemnity insurance is in force to cover the balance of the five-year period from the date of completion of the building work the subject of this exemption;

• Providing evidence of an independent expert inspection of the building work the subject of this exemption;

• Making an independent expert report available to prospective purchasers of the property; and

• Giving prospective purchasers of the property notice of the absence of a policy of building indemnity insurance.

Notice of Policy by the Minister for Education and Child Development

PURSUANT to Regulation 60 (2) (a) of the Education Regulations 2012, I, the Minister for Education and Child Development publish the following Capacity Management Plan for the purposes of the enrolment of a child at the Mawson Lakes School:

CAPACITY MANAGEMENT PLAN

Mawson Lakes School

This Capacity Management Plan sets out the conditions for enrolment at Mawson Lakes School (‘the school’).

School Enrolment Limit

The number of students entering at Reception in any given year is limited to 120 students.


Criteria for Enrolment

Year level: Reception

Priority consideration will be given to applications for enrolment from parents of prospective Reception students to attend the following school year, if they have been living inside the school zone prior to week 2, term 3 and whose application is received by this time.

If more than 120 applications for enrolment are received from parents living in the school zone by the end of week 2, term 3, places will be offered based on whether any, all or a combination of the following applies:

• The child has siblings currently enrolled in the school;

• The length of time the child has lived in the school zone;

• The child’s family has been relocated to the school zone by the defence force; and/or

• The distance of the child’s residence from the school.

The school will notify parents of the outcome of this process by the beginning of week 4, term 3. Unsuccessful applicants will be placed on the enrolment register, and referred for enrolment to other neighbouring schools.

Families who move into the school zone after the end of week 2, term 3 will only have their applications considered if or when vacancies exist, with priority consideration afforded to those applicants already on the enrolment register. If no vacancies exist the applicants will be placed on the enrolment register and referred for enrolment to other neighbouring schools.

Out of Zone Applications with Siblings Currently at the School

Applications for enrolment from parents of prospective Reception students, who live outside the school’s zone and have older siblings who currently attend the school, will be given consideration for enrolment, if the student is living in:

• the suburb of Mawson Lakes in the area bounded by the corner of Port Wakefield Road and Salisbury Highway, heading north east along Salisbury Highway, turning left on Elder Smith Road in a straight line to Port Wakefield Road, turning south back towards Salisbury highway (commonly referred to as the ‘sanctuary’).

All other applications for enrolment from parents of prospective Reception students, who live outside the school’s zone and have older siblings who currently attend the school, will only be given consideration for enrolment if:

• all Reception applications from parents of children living in the school zone have been considered, and

• the school is under its student enrolment limit of 120 Reception students as at the end of week 2, term 3.

In these cases, places will be offered based on the distance from the school of the child’s residence and other personal needs.

Intensive English Language Centre (IELC) Students

Any Reception student offered enrolment at the school and who is eligible to attend an Intensive English Language Centre (IELC), will be able to attend the IELC during Reception and begin Year 1 at the school the following year.

Year levels: 1 to 7

Applications for enrolment from parents of prospective students living inside the school zone will be considered if or when vacancies exist, with priority consideration afforded to those applicants already on the enrolment register.

In these cases, applications will be considered based on siblings at the school, the length of time the child has lived in the school zone and the distance of the child’s residence from the school.

The school will notify parents by the end of week 10, term 3, if a vacancy is available for their child to attend the following school year.

If no vacancies exist the applicants will be encouraged to remain at their current primary school, or referred for enrolment to other neighbouring schools, and upon an applicant’s request placed on the school’s enrolment register.

Out of Zone Applications with Siblings Currently at the School

Applications for enrolment from parents of prospective students, who live outside the school’s zone and have siblings who currently attend the school, will not be considered for enrolment.

International Education Program

No new international students will be offered enrolment at the school.

Special Circumstances

Enrolment for special consideration for compelling or unusual reasons, including but not limited to students under the guardianship of the Minister may be given by the Principal, in consultation with the Education Director. These will be assessed on a case by case basis.

Mawson Lakes School zone

A school zone is a geographic area surrounding the school from which the school accepts its core intake of students. Mawson Lakes School operates within the following zone:

• Students living in the area bound by Montague Road, Main North Road, Bennett Road, Adeline Street, Cathedral Circuit, Mapleton Circuit to Salisbury Highway turning south towards Port Wakefield Road.

Enrolment Register

Only applications for enrolment from parents of a child living in the school zone will be placed on the register.

Parents whose child’s name has been placed on the enrolment register will only be contacted if vacancies become available.

The enrolment register will be reviewed and updated annually by the school.

Where a child’s name appears on the register is confidential and will only be disclosed as required by law.

Enrolment Process

All parents are required to complete the school enrolment form and provide the school with a copy of the following:

• proof of the child’s identity and date of birth;

• proof of the child’s residential address; and

• copies of any family law or other relevant court orders.

Upon receipt of the above to the satisfaction of the school the processing of the parents’ enrolment application may begin.

Parents will be invited to attend a pre-enrolment interview or information session with the school once a vacancy is offered.

Monitoring and enforcement

It is the responsibility of the parents applying for enrolment to be able to verify to the satisfaction of the school that the information provided is true and factual.

The Principal is responsible for the implementation of this Capacity Management Plan and all decisions on enrolments.

This Capacity Management Plan will be reviewed annually.

FISHERIES MANAGEMENT ACT 2007: SECTION 90 (2)

Department of Primary Industries and Regions SA—Fisheries Division

NOTICE is hereby given pursuant to Section 90 (2) of the Fisheries Management Act 2007, that the following items have been seized by Officers of the Department of Primary Industries and Regions SA, Fisheries and Aquaculture.

• Rock lobster pot, red 4-litre soft float, small blue noodle, red neck, stainless steel mesh.

The above items were suspected to have been used, or intended to be used, in contravention of the Fisheries Management Act 2007, and were taken into possession at Cape Jaffa.

After the expiration of one month from the date of this notice the items listed above shall, on the order of the Minister for Agriculture, Food and Fisheries, be forfeited to the Crown and shall be either disposed of by sale or destruction.

The above items may be viewed at the Kingston office of the Department of Primary Industries and Regions SA, Fisheries and Aquaculture.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, Dr Charlie Huveneers of Flinders University, School of Biological Sciences, Sturt Road, Bedford Park, S.A. 5042 (the ‘exemption holder’), or a person acting as his agent, are exempt from Sections 52 and 70 of the Fisheries Management Act 2007 and Regulation 7 and Clause 72 of Schedule 6 of the Fisheries Management (General) Regulation 2007, but only insofar as the exemption holder may undertake the activities specified in Schedule 1 (the ‘exempted activity’), subject to the conditions set out in Schedule 2, from 7 April 2017 until 31 May 2017 inclusive, unless varied or revoked earlier.

SCHEDULE 1

Six shots of a prawn trawl net of no more than 40 minutes each using demersal double-rig prawn trawl with standard mesh and a maximum cod end mesh of 50 mm.

SCHEDULE 2

1. The exempted activity must be conducted using the SARDI research vessel Ngerin.

2. The exempted activity may only be undertaken on one night during the permitted time frame.

3. The exempted activity is to be undertaken in the waters contained within Gulf St Vincent commencing at position latitude 3445.00S, longitude 13817.00E then to position latitude 3447.00S, longitude 13817.00E then to position latitude 3447.00S, longitude 13815.00E then to position latitude 3445.00S, longitude 13815.00E then to the point of commencement.

4. The exempted activity may not be undertaken in daylight hours between sunrise and sunset for Adelaide (as published in the South Australian Government Gazette, pursuant to the requirements of the Proof of Sunrise and Sunset Act 1923).

5. Two hours before undertaking the exempted activity, the exemption holder or a person acting as an agent must contact PIRSA Fishwatch on 1800 065 522 and answer a series of questions about the exempted activity.

6. While engaged in the exempted activity, the exemption holder or agent must be in possession of a copy of this notice. Such notice must be produced to a Fisheries Officer immediately upon request. Exemption No. ME9902934.

7. The exemption holder must provide a summary of catch to the Director, Fisheries and Aquaculture Policy, (G.P.O. Box 1625, Adelaide, S.A. 5001) upon completion, giving a list of species caught, including any threatened, endangered and protected species.

8. The exemption holder must not conduct any other fishing activity including recreational fishing while undertaking the exempted activity.

9. All species caught during the exempt activity must be returned to the water as soon as practical.

The exemption holder or nominated agent will need to have a copy of the exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related issues.

4. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice.

This notice does not purport to override the provisions or operation of any other Act including, but not limited to, the Marine Parks Act 2007. The exemption holder and his or her agents must comply with any relevant regulations, permits, requirements and directions from the Department of Environment, Water and Natural Resources when undertaking activities within a marine park.

2. No fishing activity may be undertaken between prescribed times of sunrise and sunset for Adelaide (as published in the South Australian Government Gazette pursuant to the requirements of the Proof of Sunrise and Sunset Act 1923) during the period specified in Schedule 2.

3. Fishing must cease:

(a) in the area north of the fishing area known as the ‘Mid/North Gulf’ (as described on page 48 of the Management Plan for the South Australian Commercial Spencer Gulf Prawn Fishery1 October 2014) if the average catch per vessel, per night (based on the best information available to the committee at sea) drops below 600 kg;

(b) in the area north of the line extending from 33°58.00S 137°35.00E, to 33°50.00S 137°21.00E, if the average catch per vessel, per night (based on the best information available to the committee at sea) drops below 600 kg or five fishing nights are fished; or

(c) in the area known as the ‘Southern Gulf’ area (as described on page 48 in the Management Plan for the South Australian Commercial Spencer Gulf Prawn Fishery1 October 2014) if the average catch per vessel, per night (based on the best information available to the committee at sea) drops below 350 kg.

No fishing activity may occur without the authorisation of the Co-ordinator at Sea, Greg Palmer, or another Co-ordinator at Sea appointed by the Spencer Gulf and West Coast Prawn Fishermen’s Association. 6. The authorisation of the Co-ordinator at Sea must be in writing, signed and record the day, date and permitted fishing area within the waters of Schedule 1 in the form of a notice sent to the fishing fleet or vary an earlier authorisation issued by the Co-ordinator at Sea. 7. The Co-ordinator at Sea must cause a copy of any authorisation for fishing activity or variation of the same, made under this notice to be emailed to the Prawn Fisheries Manager immediately after it is made. 8. PURSUANT to Regulation 15 of the National Parks and Wildlife (National Parks) Regulations 2016, I, John Erwin Schutz, Director of National Parks and Wildlife and authorised delegate of the Witjira National Park Co-management Board, and also authorised delegate of the co-management boards of Ikara-Flinders Ranges National Park, Lake Gairdner National Park, Vulkathunha-Gammon Ranges National Park in my capacity as Group Executive Director, Parks and Regions, impose fire restrictions for National Parks and Wildlife Reserves located in the South Australian Country Fire Service Fire Ban Districts as listed in Schedule 1 below.

MARINERS are advised that the Number 7 starboard hand turning basin marker at the inner end of the Whyalla Outer Harbour Channel, in position 33°02.09S, 137°36.17E is lying on the sea bed. A replacement marker buoy has been put in place. Reflective tape has been placed on the buoy and works are underway to have it lit.

Wilderness Protection Areas—Fire Restrictions

AIRCRAFT PARKING CHARGES:

General aviation aircraft parked longer than two hours in designated general aviation parking areas and aircraft will incur a charge of $17.46 per day or any part of a day.

Code ‘B’ or greater—the charges for parking of Aircraft in the category of Code ‘B’ or greater is by arrangement with AAL from time to time.

Definitions

(a) Government Mandated Services means those services which AAL provides to RPT Operators and other users of the Airport which are mandated by the Commonwealth Government (in applicable legislation and ministerial or Commonwealth Department directions) or other lawful authority and includes (but are not limited to) the following services:

(i) terminal passenger checked bag screening; and

(ii) terminal passenger screening; and

(iii) airside inspections; and

(iv) other services required by the Commonwealth Government or other lawful authority.

(b) Infant means children less than 2 years old, not occupying a seat.

(c) Landing Charge means the amount from time to time charged by AAL to an aircraft operator in respect of the use by an aircraft of AAL’s runways, taxiways and aprons. The Landing Charge is a single charge made on each arrival (landing) of an aircraft.

(d) MTOW means maximum take-off weight as specified by the manufacturer.

(e) Passenger Facility Charge (‘PFC’) mean the amount from time to time charged by AAL to an RPT Operator in respect of its Passengers using a Terminal for the purpose of recovering costs relating to the Terminals.

(f) RPT (Regular Public Transport) Operation means an operation of an Aircraft for the purposes of the carriage of people, or both people and goods, of an air service that:

(i) is provided for a fee payable by persons using the service; and

(ii) is conducted in accordance with fixed schedules to or from fixed terminals over specific routes; and

(iii) is available to the general public on a regular basis.


Per Passenger Charge Rules

(1) Applies to all arriving and departing passengers and excludes transit passengers, infants and positioning crew.

(2) Applies to all arriving, departing and transit passengers and excludes infants and positioning crew.

(3) Applies to departing passengers only and excludes infants and positioning crew.

(4) Applies to departing passengers and departing transit passengers and excludes infants and positioning crew.

(5) Applies to all transit passengers excluding infants arriving from a port outside Australia.

Notes

(i) Charge Base An Aircraft Operator may elect, by agreement with AAL, and entirely at AAL’s discretion, to incur Aeronautical Charges on a MTOW or Passenger basis, which basis is then fixed for the ensuing twelve (12) month period.

(ii) Minimum charge: a minimum charge applies to all General Aviation customers as follows:

(a) Fixed Wing Aircraft $46.83 per landing

(b) Rotary Wing Aircraft $23.39 per landing

(iii) AAL has a growth incentive scheme which provides discount on the landing charges indicated above for airlines which exceed a target growth rate for the year. Details of this scheme are available to airlines on request.

(iv) The PFC will be adjusted annually by the increase in the Consumer Price Index (All Groups Weighted Average of Eight Capital Cities) on the anniversary date of the commencement of charging for the PFC (17 February 2006). The PFC will be reviewed every five years; the next review date is 17 February 2021.

MINING ACT 1971

PURSUANT to Section 15 (5) of the Mining Act 1971 (the Act), I advise that the Mineral Resources Division of Department of the Premier and Cabinet (DPC), will be undertaking geoscientific investigations commencing on 11 April 2017 and concluding on 7 October 2017.

RULES OF COURT

Magistrates Court of South Australia Amendment 60 to the Magistrates Court Rules 1992

PURSUANT to section 49 of the Magistrates Court Act 1991 and all other enabling powers, we, the undersigned, do hereby make the following amendments to the Magistrates Court Rules 1992 as amended.

1. These Rules may be cited as the ‘Magistrates Court Rules 1992 (Amendment 60)’.

2. The Magistrates Court Rules 1992 as amended by the following amendments apply to and govern all actions commenced in the Criminal Division of the Court on and after the date on which these amendments are gazetted, except amendment 5 which will commence on the day that the Housing Improvement Act 2016 comes into operation.

3. Rule 65.01 is deleted and replaced as follows:

65.01 An application pursuant to s 30ZL, s 30ZM or s 33T of the Controlled Substances Act 1984 must comply with Form 23.

4. Rule 69.02 is deleted and replaced as follows:

69.02 An application for the remission or reduction of a fee must be made to the Registrar on oath or by affirmation in Form 123 and the Registrar must maintain a copy of the application separately from the file of the action or proceeding.

5. The following is inserted directly after rule 75:

76.00 Housing Improvement Act 2016.

76.01 An application for a warrant made pursuant to s 11(4)(a) of the Housing Improvement Act 2016 must comply with Form 140.

76.02 A warrant under s 11(4)(a) of the Housing Improvement Act 2016 must comply with Form 141.

76.03 A warrant issued under s 11(4)(a) of the Housing Improvement Act 2016 will cease to have effect no later than 7 days after it is issued by the Magistrate.

6. Form 140 is inserted.

7. Form 141 is inserted.

NOTICE is hereby given, pursuant to Section 10 of the Roads (Opening and Closing) Act 1991, that the Corporation of the City of Port Augusta proposes to make a Road Process Order to close and retain by Port Augusta City Council merging with Allotment 13 in Township Plan 3306010, more particularly delineated and lettered ‘A’ on Preliminary Plan No. 17/0022.

A copy of the plan and a statement of persons affected are available for public inspection at the office of the Council, 4 Mackay Street, Port Augusta and the Adelaide Office of the Surveyor-General during normal office hours.

AT the close of nominations at 12 noon on Thursday, 6 April 2017, the following people were accepted as candidates and are listed in the order in which they will appear on the ballot paper.

Postal Voting

The election will be conducted by post. Ballot papers and pre-paid envelopes for each voting entitlement will be posted between Tuesday, 18 April 2017 and Monday, 24 April 2017 to every person, or designated person of a body corporate or group listed on the voters roll at roll close on Tuesday, 28 February 2017. Voting is voluntary.

A person who has not received voting material by Monday, 24 April 2017 and believes they are entitled to vote should contact the Deputy Returning Officer on (08) 7424 7420.

Completed voting material must be returned to reach the Returning Officer no later than 12 noon on Monday, 8 May 2017.

A ballot box will be provided at the Council Office, Customer Service Centre, 12 James Street, Salisbury, for electors wishing to hand deliver their completed voting material during office hours.

Vote Counting Location

The scrutiny and counting of votes will take place at Council Chamber, 12 James Street, Salisbury, as soon as practicable after 12 noon on Monday, 8 May 2017. A provisional declaration will be made at the conclusion of the election count.

Campaign Donations Return

All candidates must forward a Campaign Donations Return to the Council Chief Executive Officer within 30 days after the conclusion of the election.

DISTRICT COUNCIL OF THE COPPER COAST

PUBLIC CONSULTATION

Review of Elector Representation

NOTICE is hereby given that the District Council of the Copper Coast has undertaken a review to determine whether a change of arrangements in respect to elector representation will result in the electors of the area being more adequately and fairly represented.

As an outcome of this review Council proposes the following:

Proposal

(1) The principal member of Council continue to be a Mayor elected by the community.

(2) The Council area not be divided into wards (i.e. the existing ‘no wards’ structure be retained).

(3) The future elected body of Council comprise the Mayor and nine area councillors.

(4) Further consideration be given to the proposal to change the Council name to ‘Copper Coast Council’.

Report

Council has prepared a report which details the review process, public consultation undertaken and the proposal Council now considers should be carried into effect. A copy of this report is available on the Council’s website www.coppercoast.sa.gov.au, or a copy can be inspected and/or purchased at the Council office, 51 Taylor Street, Kadina.

Written submissions are invited from interested persons from Tuesday, 11 April 2017 and should be directed to the Chief Executive Officer, P.O. Box 396, Kadina, S.A. 5554 or emailed to [email protected] by close of business on Friday, 12 May 2017.

NORTHERN AREAS COUNCIL

Change of Road Name

NOTICE is hereby given that the Northern Areas Council at its meeting held on 16 October 2016, resolved that pursuant to Section 219 (1) of the Local Government Act 1999, that the public road, being Whyte Street, Laura, be changed to White Street, Laura.

Notice is hereby given that the Northern Areas Council at its meeting held on 21 March 2017, resolved that pursuant to Section 219 (1) of the Local Government Act 1999, that the public road Unnamed Road (also known locally as James Road) be named Jared Road, Laura, situated on the northern boundary of Plan F125119A1.

Both of these name changes will take affect from Monday, 1 May 2017.

A plan which delineates the section of road which is subject to the change of name, together with a copy of the Council’s resolution is available for inspection at each of the Council’s Offices, during the normal opening hours of the aforementioned.
