IN pursuance of the powers conferred on it by The Western Australian Turf ClubAct 1892, The Western Australian Turf Club Gives Notice that on 7 May 1984 thefollowing amendments to the By-laws of the Club were submitted to the Ministerfor Administrative Services . The amendments to the by-laws have not been disallowedand will come into operation upon publication in this Gazette.

1 . By-law 42 be amended-(a) By deleting "first meeting of the Committee after the" ; and(b) By deleting "Any vacancy occurring in the interim shall be filled up by

Committee." and substituting the following-"Provided that any vacancy occurring in the office of Chairman

or Vice-Chairman during the period between election to either office and thenext General Meeting shall be filled up by the Committee ."

2 . After By-law 42, the following by-laws are inserted-

42A . (1) The election of the Chairman and Vice-Chairman shall be thefirst item of business at the first meeting of the Committee afterthe General Meeting.

(2) For the purpose of electing the Chairman and Vice-Chairmanunder By-law 42 the Chairman of the first meeting of the Com-mittee after the General Meeting shall be either ;

(a) The Chairman holding office at the date of the GeneralMeeting, or in the event that he is not present ;

(b) The Vice-Chairman holding office at the date of theGeneral Meeting, or in the event that he is not present ;

On Sunday, 17 June 1984 between 8 .00 a .m .and 12.00 noon. All the water contained withinthe gazetted Lake Kununurra water ski area whichis defined by markers .

Amendment Regulations (No . 2) 1984.2 . These regulations shall come into operation on 1 July 1984 .

ACTING pursuant to the powers conferred by section66 of the Western Australian Marine Act 1982 theDepartment of Marine and Harbours, by this notice,defines that portion of Lake Kununurra set out here-under as areas of navigable waters closed to navigationby vessels ; provided that this closure will apply onlyon the following day and time but will not apply tocompetitors or other craft authorised by the KununurraWater Ski Club taking part in activities approved bythat Club .

On Sunday, 17 June, 1984 between 8 .00 a.m. and12.00 noon . All the water contained within thegazetted Lake Kununurra water ski area and whichis defined by markers .

(a) at least two thirds of the area has been in-tensively cultivated and adequately watered forthe growing of marketable crops of fruit and/orvegetables to the satisfaction of the Minister .

(b) A residence to comply with the buildingby-laws of the Local Authority must be erectedto Top Plate stage and 50% completed to thesatisfaction of the Minister .

(c) the boundaries of the land have been fencedwith a stock-proof fence to the requirements ofthe Local Authority and to the satisfactionof the Minister .

A purchase price of twenty-two thousand dollars($22 000 .00) shall apply for a period of 3 years fromthe date of approval of the lease (following whichperiod the price shall be subject to review) and feesassociated with the issue of a Crown Grant shall bepayable .

The land is made available for leasing subject to thefollowing conditions :-

(1) The land shall not be used for any purposeother than Horticulture without the prior ap-proval in writing of the Minister for Landsand Surveys .

(2) The rent shall be subject to reappraisementat the end of the third year of the term ofof the lease and each successive three yearlyperiod thereafter .

(3) The lessee shall not without the previous con-sent in writing of the Minister assign, transfer,mortgage, sublet or part with the possessionof the demised land .

(4) The land shall be occupied and used by thelessee for the purpose specified within nine (9)months of the commencement of the lease andthereafter will be continuously so used to thesatisfaction of the Minister .

(5) The lessee shall within two years from thecommencement of the lease complete the fol-lowing minimum development to the satisfac-tion of the Minister :-

(a) Establish an adequate water supply .(b) Fence the external boundaries with a

stock-proof fence in accordance withLocal Authority requirements and to thesatisfaction of the Minister .

(c) Develop for the lease purpose not lessthan one third of the area of the land .

(6) All buildings, erections, paving, drainage andother works shall be to the approval of theLocal Authority and the lessee shall perform,discharge and execute all requisitions andworks unto the demised land as are or maybe required by any local or public authorityoperating under any statute, by-law orregulation .The only residence permitted will be that ofthe Lessee or a Manager or Manager/Care-taker.The lessee shall indemnify the Minister againstall claims for damage to property or personsarising from the use of the land .

(9) The Minister or his representative may enterthe land for inspection at any reasonable time .

(10) The land shall be filled to levels specified by,and acceptable to the Minister or his nomineeand the Shire Council .

(11) Compensation will not be payable for damageby flooding of the demised land .

(12) Compensation shall not be payable to thelessee in respect of any improvements effectedby him on the demised land and remainingthereon at the expiration or earlier determina-tion of the lease .

(13) It shall be lawful for the lessee at any timewithin the three calendar months immediatelyfollowing the expiration of the term or earlier

determination of the lease, to take down,remove, and carry away any buildings, struc-tures, improvements and plant the property .of the lessee .

(14) On determination of the lease, the lessee shallfill in, consolidate and level off any uneven-ness, excavation or hole caused by him duringthe term of the lease or by removal of hisimprovements and shall leave the demised landin a clean, neat and tidy condition to thesatisfaction of the Minister and shall removeany or all waste matter as required by theMinister .

(15) All irrigation and drainage works and con-struction shall be to the standards and require-ments approved by the Public Works Depart-ment and the Department of Agriculture .

(16) Neither the Government nor the Local Auth-ority will be responsible for the provision ofadditional services to the land .

A person in the employ of the State must applythrough the Under Secretary for Lands for the Gov-ernor's permission to hold this land . Written approvalof the Permanent Head concerned should accompanysuch application.

The Council of the Shire of Esperance under andby virtue of the powers conferred upon it in that behalfby the Town Planning and Development Act 1928 (asamended) hereby amends the above Town PlanningScheme by:-

(i) Reclassifying portion of Esperance Location812 from the "Rural Zone" to "Reserve forParks and Recreation" and "Special RuralZone" on the Scheme Map all as shown on theaccompanying Scheme Amendment Map.

(ii) By adding to the Schedule of Special Provi-sions under Clause 5.10.1 (Special RuralZones) of the Scheme Text after entry relatingto "Esperance Location 824 Balance and Lots4 and 5 and Special Provisions" relating thereto,the following:-

(f) In order to conserve the ruralenvironment all trees shall be re-tained unless their removal isauthorised by Council except inthe cases of trees which are pro-posed to be removed to makeway for house construction,fences, firebreaks and constructedaccessways .Exposed areas shall be replantedextensively to provide conceal-ment and shelter as required byCouncil .

(h) Waste disposal shall be the res-ponsibility of the individual land-holder and shall be effected byseptic waste disposal systemsinstalled to the specifications ofCouncil .

4 . Regulation 12 of the principal regulations is repealed and thefollowing regulation is substituted-

11 12 . An application for a prospecting licence shall beaccompanied by-

(a) an application fee of $50 .00; and(b) rent of $1.00 per hectare or part thereof with a minimum

of $10 .00. " .

5 . Regulation 18 of the principal regulations is amended-(a) in paragraph (a) by deleting "$150 .00" and substituting the
