Advice of availability is given in the Government Notices and Business issues immediately following the day of publication. Periodic issues are not available on subscription, but standing orders are accepted for all selected issues. Purchasing and Disposals issues of the Gazette provide information on Commonwealth purchases and disposals and other matters of general interest to persons buying from or selling to the Commonwealth. These issues are published each Wednesday and sold at $3.95 or on subscription of $220.00 including postage for 50 issues. Index issues contain references to entries in the Government Notices and the related Special and Periodic issues. Index issues are published quarterly, are available over the counter from Commonwealth Government Bookshops and are supplied without charge to annual subscribers to the Government Notices issues. Application for commercialisation of insect-resistant cotton

Organism to be released: Cultivated cotton (Gossypium hirsufum)

Brief description of the nature and effect of the genetic modification: Two new genes are expressed in the transgenic plants. One encodes the Cry/A(c) gene ( INGARDTM) from the bacterium Bacillus thuringiensis variety kurstaki which produces the Bt delta endotoxin. The toxin produced in the Bt cotton is specific to lepidopteran (caterpillar) larvae, including two Helicoverpa species which are major pests of cotton.

The other gene is a ‘marker’ gene from the bacterium Escherichia coli that allows identification of the transgenic plants. This gene encodes neomycin phosphotransferase which confers resistance to the antibiotics kanamycin and neomycin.

Further information: This proposal is being considered concurrently by the National Registration Authority for registration of the cotton as a plant-pesticide.

(a) Appointments will as far as possible have regard to the Commonyrealth Government’s objective of equal representation of women on industry bodies, boards and authorities.

3. Period of Appointment

(a) The Complaints Commissioner shall be appointed for a period of three years, and will be eligible for re-appointment.

SALE AND ADVERTISING OF FORMULA FOOD FOR VERY LOW ENERGY DIETS

The Authority has prepared a draft Code of Practice on the Restriction of the Sale and Advertising of Formula Food for Very Low Energy Diets (VLED), as part of its consideration of Proposal P49 - Formula Food for VLED. The draft Code sets out the conditions under which VLED can be sold and advertised. It applies to all those involved in the production, sale or distribution and supply of all products described as formula food for VLED. This includes manufacturers, importers, wholesalers, distributors, packers, retailers, pharmacists, dietitians and general practitioners.

The proposed Code of Practice will provide a framework within which VLED products, manufactured in accordance with the composition and labelling requirements proposed in draft Standard R10 - Food for Special Medical Purposes, can be sold and advertised. The draft Standard has been subject of full assessment and is now subject of an inquiry. It is proposed that the Code of Practice be adopted prior to any recommendation on the proposed Standard is made to the National Food Standards Council.

To assist in this process, the Authority invites written submissions on the draft Code of Practice (copies of which are available from the Authority) by 18 December 1995. Copies of draft Standard R10 can also be obtained from the Authority.

The Authority has completed inquiries into draft variations to amend the Australian Food Standards Code prepared after full assessments of the following Applications and has made recommendations to the National Food Standards Council. On 11 October 1995, the delegate of the Secretary of the Department of Human Services and Health for the purposes of subsection 14(1) of the Therapeutic Goods Act 1989 ('the Act') gave his consent for Bristol-Myers Squibb Pharmaceuticals Pty Limited of 556 Princes Highway, NOBLE PARK VICTORIA, ('the company') to supply 'KENACOMB OTIC DROPS' (triamcinolone acetonide 0.9mg/mL, gramicidin 0.225mg/mL, neomycin (as sulfate) 2.25mg/mL, nystatin 90 000 units/mL) 7.5mL eardrops bottle (AUST R 19200) which do not comply with the requirements of Therapeutic Goods Order N o . 48 - "General requirements for labels for drug products'' paragraph 3(2)(b) with respect to the 1.5mm minimum letter height requirement.

For the purposes of subsection 15(1) of the Act the company must adhere to the following conditions in supplying the abovementioned product:

1. The type face of the printed text on the immediate container label shall be not less than lmm in height.

2. The immediate container label used must conJorm to that presented to the delegate on 2 October 1995.

Supply of this product is subject to the standard conditions applying to the supply of goods listed in the Australian Register of Therapeutic Goods.

SECTION 14 NOTICE

On 29 September 1995, the delegate of the Secretary of the Department of Human Services and Health for the purposes of subsection 14 (1) of the Therapeutic Goods Act 1989 ("the Act") gave her consent for Sanofi Winthrop Pty Ltd of 82 Hughes, Ermington, NSW ("the Company"), to supply isoprenaline hydrochloride (Isuprel) injection 200microgram in 1mL ampoules (Aust R 12582) and lmg in 5 mL ampoules (Aust R 48213) with labels which do not comply with the requirements of Therapeutic Goods Order No.48 - "General requirements for labels for drug products".

For the purposes of subsection 15(1) of the Act, the Company must adhere to the following conditions in supplying the product:

1. The only batches exempted are batch M205ND of the 200 microgram in 1mL strength and batch M050NA of the lmg in 5mL strength and o n l y 2000 cartons of each of the exempted batches will be supplied in Australia.

2. The period of exemption is from 29 September 1995 to 1 March 1996 only, after which only Australian ampoule labels will be used.

3 . The carton labels are to be those provided in the Company letter of 19 September 1995 relating to this application.

4. A copy of the 'Dear Customer' letter, provided with the Company letter of 19 September 1995, will be inserted into each carton of the exempt product supplied in Australia.

I, KENNETH KELL, Manager,Flight Recorder Services Section, Bureau of Air Safety Investigation, Department of Transport, a delegate of the Civil Aviation Authority:

(1) under subregulation 207 (2) of the Civil Regulations, direct that: (a) if the Australian aircraft bearing the nationality and

registration marks VH-SGY is flying in aerial work operations, it must be fitted with instruments, and must be fitted with, or carry, equipmezt, In accordance with section 20.18 of the Civil Aviation Orders; and

registration marks VH-SGY is flying in any other class of operations: ( i ) it must be fitted with instruments, and must be fitted

with, or carry, equipment, in accordance with subsections 3,4,5,7,8,9 and 10 of section 20.18 of the Civil Aviation Orders: and

(ii) it must be fitted with a cockpit voice recorder system that records the parameters and meets the requirements set out in section 103 of the Civil Aviation Orders: and

(b) if the Australian aircraft bearing the nationality and

(2) under subregulation 207 (3) of the Civil Aviation Regulaticqg, direct that the instruments and equipment that must be fitted to, or carried in, the Australian registered aircraft bearing the nationality and registration marks VH-SGY must be fitted, carried or used in accordance with section 20.18 of the Civil Aviation Orders.

Section 20.18 of the Civil Aviation Orders has effect in relation to the Australian aircraft bearing the nationality and registration marks VH-SGY only in so far as set out in these directions.

These directions commence on 9 October 1995 and remain in force until the end 16 October 1995.

I, PETER JEREMY BALDWIN, Minister for Social Security, make the following Notice under subsection 1237AB (1) of the Social Secwizy Act 1991.

Citation 1. This Notice may be cited as the Social Security (Eligible Debts)

Notice (No. 1).

Commencement 2. This Notice commences on 1 December 1995.

(Notc: Paxapph 1237AB (3) (b) of ?he Act provides that a class of debts cannot be taken to be spccificd bcfore UK end of the time within which the notice may be disallowed]

Interpretation 3. In this Notice, unless the contrary intention appears:

"Act" means the Social Security Act 1991;

"clothing and textile industry worker" means a person who works in the clothing and textile industry on 1, or more than 1, of the following processes:

(a) designing; (b) pattern making; (c) tuning; (d) sewing; (e) -ngup; (f) clipping and trimmin €5 (9) embroidery;

"fishing industry worker" means a person who works in: (a) the catching of fish or the taking of other marine organisms; or (b) the selling or buying of fish or other marine organisms, except fish

or other organisms sold to, or bought from, a retailer;

46industry-related debt" means a debt to the Commonwealth in relation to income of a clothing and textile industry worker, a fishing industry worker or a partner of a former industry worker that:

(a) was earned as a clothing and textile industry worker or as a fishing

(b) is disclosed to the Department by that person in the period from 1

being a debt arising under, or as a result of the operation of, a provision of the Act;

industry worker before 1 December 1995; and

"partner of a former industry worker" means a person who was the partner of a deceased clothing and textile industry worker or a deceased fishing industry worker.

social security payment was made before 1 December 1995 is specified for the purposes of subsection 1237AB (1) of the Act.

I, ROBERT EDWARD TICKNER, Minister for Aboriginal and Torres Strait Islander Affairs, under subsection 9A (1) of the Aborigirial Land Grurzt (Jervis Bay Territory) Act 1986 and being satisfie$ that:

declare that all the land within the Jervis Bay National Park and all the land within the Jervis Bay Botanic Gardens is Aboriginal Land.

the land within the Jervis Bay National Park is of significance to the Aboriginals who are members of the Wreck Bay Aboriginal Community Council; and the land within the Jervis Bay Botanic Gardens is of significance to those Aboriginals; and it would be appropriate to grant the land referred to in paragraphs (a) and (b) to the Council: and the Council and the Director of National Parks and Wildlife have entered an agreement under which the Council agrees to grant to the Director a lease of the land referred to in paragraphs (a) and (b);
