IIASD Make-A-Wish Connection

Talk about a Win-Win-Win event. Gary Joyce, Gerrit Juffer, Steve Walker and I golfed in the Make-A-Wish fundraiser held at the Minnehaha Country Club in Sioux Falls in July. This is one of Make-A-Wish’s biggest fundraisers in South Dakota. Our National Association (IIABA) contributed $10,000 to this Make-A-Wish event on behalf of the IndependentInsurance Agents of South Dakota.

In return, Make-A-Wish gave IIASD radio time, signage, and let our foursome take part in the tournament. So, let’s sum this up, we received free money to get free signage to play in a great benefit golf tournament.

Is that a Win-Win-Win or what????

Make-A-Wish went above and beyond to show the contributors how much they appreciated not only the contribution, but also the suggestions and input we had. They even had lunch served on the course.This organization gave over 75 wishes to children and their families in SD just last year alone and will probably grant at least that many this year. We are proud to contribute to this great organization. After meeting and seeing film clips of past recipients of these grants, it was difficult to imagine what some of these young children go through every day to deal with their medical conditions. In spite of their adversity, they all seemed to be very upbeat about life and the future.

CMS Agent/Broker federal training for the Federally-Facilitated Marketplace (FFM) is now available. South Dakota licensed Agents and Brokers wanting to sell in the Federally Facilitated Exchange (Marketplace) are required to complete the federal online training offered through the Center for Medicare and Medicaid Services (CMS). All training and registration will occur online.

The federal government has indicated there will be two parts to the training. The first part will be the online training portion. Training materials are meant to cover a range of information to prepare agents for assisting consumers, including their obligation to safeguard personal information and act in the best interest of consumers, and the penalties that could be incurred if inappropriate activities are conducted. The second part of the Agent/Broker FFM training will be the registration process, which will be available later in August. At that time, Agents/Brokers will be able to obtain an active FFM User ID by completing a federal identity verification process online (required in order to get commissions via Marketplace enrollment).

We now have technological innovations that have gone as far as creating robots you can interact with and give orders to. If I am not wrong, you can now even get yourself a robot girlfriend if you have failed to find your perfect woman. Do you remember the cartoon show ‘The Jetsons’? Well, then you must certainly remember the flying cars and Rosie, the robot, from this futuristic animated kids’ show! That’s the world of future that Hanna-Barbera wittingly portrayed in ‘The Jetsons’. Everything is automated. Sounds so exciting but is technology becoming your new rival to score a job? Well, it could be. Machines may be very well replacing humans and creating a wider gap between the number of job positions available and the number of applicable candidates for it. Humans created machines and now machines are threatening their jobs. They were supposed to make life easier for you. But, apparently they are making life for your employers so easy that they don’t need much human resources now. Is Technology Ruining Employment Opportunities?The world is quickly industrializing and globalizing. All countries have been influenced by the new technology available at hand. And every single day, we are only trying to outdo ourselves by creating the kind of technology you would have never imagined 10 years ago. The accelerating technology in our new automated world is quickly becoming the number one reason of the rising rate of unemployment around the world. Or maybe it already is. Take this real life scenario for instance:In the 1950s, automobile industry was a flourishing industry in city X and provided employment to most of the residents including African-Americans. The jobs in this industry were respectable, paid well and even provided perks. However, all of this changed after the development of new technology that led to the automation of assembly line. This resulted in the displacementof many workers in the industry and this phenomenon spread like wildfire among all other cities, home to automobile factories, around the country. This is a story of a city that was once ranked amongst the top five largest cities of its country and housed more than 2 million people. This is the story of the “Motor City”, Detroit.Outsourcing to technology reduces the scope for human error to almost zero. Add to that, the advantage that machines don’t complain of fatigue and take leaves. It’s efficient and reduces training costs, employee retention costs and increases the pace of work multifariously. All profit-aiming companies have already began their love affair with technology. Industries predicted to follow this trend are agriculture, food processing, education, oil-refining and public sector holdings.

Has Technology Increased Employment?The counteracting point of view is that advancement in technology has helped increase the level of output, requiring more labor to produce goods and service at such high levels. This has significantly improved levels of employment. This theory dismisses any authentic correlation between technology and unemployment. According to the supporters of this theory, technology may cause a structural change in the composition of employment, however it does not cause any negative effects and leads to absorption of workers in other industries. Citing a proof to it, is the example of the telecommunications industry. It consists of cell phone manufacturing, network services and the Internet. The telecommunications industry provided 1 million jobs to skilled, semi-skilled and unskilled American labor in 2008, even in the face of the then ongoing situation of recession.Structural ChangePost Industrial Revolution, the Luddite movement began as a mass protest against the automation of the textiles industry. Skilled artisans and weavers were replaced with machines to produce textiles, that were operated with unskilled labor. Although, the technological advancement with mechanization of work did lead to employment opportunities, it simultaneously took away the means of livelihood of several people employed in the art of textile making. If these people were to take up these jobs as machine loom operators, it created significant reduction in their income with less pay. Such a phenomenon of shift in employment, despite possessing specialized knowledge or skills, is often seen in many industries and is called structural unemployment.Technology and UnemploymentLet me make this even simpler for you to think over. Did you pay attention to the background story of the movie/novel "Up in the Air"? George Clooney is a corporate down-sizer whose job is to fire people. Ironically, he loses his job after he is replaced by video-conferencing for the same! Umm... yah, the company discovered that they don't have to pay for his traveling and hotel stay expenses, plus they will save up on his salary and cut down costs too if they start firing people over video-conferencing. It's not just you on your treadmill, companies have tightened up their belts and are losing the flab too, the smart way.. err.. by firing people. Continued on Page 7

Frankenstein was a warning to all mankind about the impending consequences of technology. Constant evolution in the world of technology is quickly ending the game for most people with manual labor jobs or average jobs that have no significant contribution to the development and financial progress of companies. Even non-corporate jobs are under fire. Word of advice, better buckle up now and become an important part of your company that it cannot do without before it disposes you more unexpectedly than the next price hike. You may soon not see any cashiers in supermarkets and waiters or waitresses in restaurants with the advent of new technological innovations, for billing and placing orders respectively, that will replace the need for employment of human resources at these places.

It seems that perhaps we are now in an era when technology is destroying more jobs than it is creating. The world has made a swift transition from being labor intensive to capital-intensive in the last fifty years. With this information, there definitely seems to be a close relationship between technology and unemployment. Technology is destroying more jobs than it is creating and this is evident in the economic situation of jobless recovery prevailing in the U.S. even two years post-recession.

Announcement of Elections

Elections to the IIASD Board of Directors will be held at the State Convention during the annual business meeting on Monday October 7, 2013. The meeting will be at the Ramkota Hotel located at 3200 West Maple in Sioux Falls, S.D.

The following Districts will be voting on Board Members:

District 2 – Beadle, Brookings, Clark, Codington, Deuel, Hamlin, Kingsbury. This is a two- year term. Mindy Huntington current Director will be running again.

District 3 - Clay, Lake, Lincoln, McCook, Miner, Minnehaha, Moody, Turner, Union, Yankton. This will be for a one- year term as Steve Walker is moving up to the Executive Committee.

District 4 - Sioux Falls. This is a two- year term. Chad Dubisar will not be running.

P&C NET INCOME, UNDERWRITING RESULTS CONTINUE TO RISE IN 2013; ACCORDING TO A.M. BEST

Continued rate increases and lower losses led the property and casualty carriers to its second consecutive first-quarter underwriting profit in 2013, according to an A.M. Best report. The first quarter of 2013 underwriting results show an improvement over the same period from 2012, with the industry’s combined ratio dropping to 94.7 from 97.4 and underwriting income growing to $4.6 billion compared to $1.5 billion.

The carriers net income climbed to $22 billion in the first quarter compared to $14.2 billion in 2012’s first quarter. Gains were seen in both personal and commercial lines, in part due to lower catastrophe losses Best indicated. Catastrophes accounted for 2.0 points of the combined ratio in 2013’s first quarter compared to 3.2 points in 2012. A.M. Best says several commercial lines showed strong increases in direct premiums written (DPW), notably workers’ compensation (11.1 percent), general and products liability (8.3 percent), commercial multi-peril (7.8 percent) and commercial auto liability (7.6 percent). The Best report indicates that among the major lines of insurance, only two – medical professional liability and accident and health – showed declines in DPW for Q1 2013.

FRAUD CONVICTIONS The feds are blocking new home-health providers and ambulance services from taking on Medicare work in three fraud hotspots of the Chicago, Dallas, and Miami areas. This is the first time CMS is using its moratorium authority allowed under health reform. The moratoriums will last six months and were imposed because of the high risk of fraud in those locales. Those areas have logged an unusually high number of providers compared to beneficiaries; rapid increase in Medicare enrollments apps; and extremely high billings. Crooks often migrate to “softer” locales when the feds step up the heat, so CMS will monitor billings in broad geographical areas.

Someone is selling bogus auto coverage in the Omaha, Nebraska area. The apparent scandal was uncovered when police stopped a woman parked in a handicap parking spot. The officer ran her insurance card and found out her supposed Progressive policy was invalid. She said she bought it through a purported Progressive agent, but alarm bells did not go off when he charged her a total of $100. Entrepreneurs are selling false insurance documents to willing drivers who do not want to pay for real coverage, local police say. Innocent drivers also are getting caught up in the scams.

A body shop owner stole insurance money intended for customers, Rhode Island’s AG announced Tuesday. Dino Coccia owns Americar Sales and Collision Center in Pawtucket. He promised to act as a go-between with customers and their auto insurers. Coccia stole their insurance payouts and spent the money on himself. He also sold and rented out vehicles customers had sent in for repairs, bilking 70 clients. He was handed three years of home confinement and must repay $210,000.

A drunken boating outing turned into a sobering 13-year jail term for Joseph Holyfield. The Sacramento-area man drank about 18 beers while boating with his family on a lake, drove his family home afterward, then sped away in his wife’s BMW to meet a drug dealer. Holyfield blew through a red light at 65 mph and crashed into a Kia occupied by afamily of three. The Kia spun in circles and hit a Volvo. The family and Volvo driver all were hurt. Holyfield left the BMW and ran to his nearby tattoo shop, having an employee drive him home. Holyfield then called his insurer Anchor General to say someone stole the car and to make a claim. The California insurance department and Anchor General investigated. Holyfield bolted to the island of St. Maarten after being arrested. Tired of his boozy and druggy behavior there, the St. Maarten police put him on a plane to Puerto Rico, where the FBI arrested Holyfield. His conviction was a second strike, with a previous conviction for attempted robbery. The irate court landed hard on Holyfield, handing him 13 years and eight months in federal prison.

Yury Khandrius used a corrupt doctor’s name to fuel a $77-million Medicare theft plot. Khandrius set up a Brooklyn clinic, pretending he was Dr. Gustave Drivas, a no-show who lent Khandrius his identifiers and prescription pads to bill Medicare for phantom or useless procedures. Khandrius also bribed corrupt Medicare beneficiaries to hand over their identifiers. Patients were given bottles of tap water disguised as allergy meds. At least one child’s name was used to bill Medicare, and Khandrius started forging treatment records once Medicare started nosing around. The feds planted a camera in a clinic room where ring members paid cash kickbacks to the Medicare patients. The room was marked “PRIVATE” and featured a Soviet-era poster of a woman with a finger to her lips and the words “Don't Gossip” in Russian. Khandrius received eight years in federal prison Tuesday.

Daniel R. Devine

November 2, 1955 - June 18, 2013

JOIN US IN HONORING THE MEMORY

OF DANIEL R. DEVINE

Daniel R. Devine, age 57 of Yankton passed away Tuesday, June 18, 2013 at Avera McKennan Hospital, Sioux Falls, SD.

Daniel was born November 2, 1955 in Yankton, SD to James and Maxine (Sylliaasen) Devine. He grew up on the family farm north of Yankton and lived there until his death. He graduated from Yankton High School in 1974 and began a lifelong love of farming. On March 28, 1981, he married Jeanne Feilmeier. Together they raised their two sons Jesse and Travis.

He was a passionate fan of all of their activities, and he especially loved baseball. Dan began his insurance career in 1981 writing property/casualty insurance with his father, James Devine. Within a few years, the business became too large to work from home so hejoined Midwest Insurance Agency, a life and health agency. His wife, Jeanne, joined the agency and within a short time, they became sole owners of the business. In 1989, they purchased the Ken Schnider Agency and the following year, purchased the Mike Rossiter Agency. Theirson, Travis, is now a part of the agency operation. Dan was committed to all of his clients andhe particularly enjoyed working with farmers. The last few years, he mainly handled the crop insurance side of the agency.

He was a member of St. Agnes Sigel Catholic Church and Choir of Utica, Knights of Columbus, former board member of the Yankton Baseball Association, Mission Hill Cemetery, Yankton Chamber of Commerce, and South Central League Amateur Baseball. He especially enjoyed his grandchildren, newborn calves, and visiting with anyone and everyone. He had a special charm and wit around his family and close friends, especially Deb.

AFFORDABLE CARE ACT - FOR INSURANCE AGENTS, PROCRASTINATION IS NOT AN OPTION

“You cannot escape the responsibility of tomorrow by evading it today.” ― Abraham Lincoln

Perhaps you were not a fan of the Affordable Care Act and its passage. Maybe you hoped it would go away. Or, you were a fan but assumed someone else in your office would learn about the provisions of the Act, or that you would be able download easy “step by step” instructions on the Act. Well, that is not going to happen. Open enrollment under the Act is scheduled to begin October 2013. As the Act places new demands on insurance agents, you will need to make a conscious decision of whether or not you want to assume the risks of providing insurance services and products in the health care market. There are a lot of moving parts in the implementation of this legislation and becoming aware of the requirements and the risks involved is the first step in that decision making process. It is important that you start educating your agency staff today. For agencies with operations in multiple states, keep in mind that with federal and state based healthcare exchanges there may be different training requirements and other state specific guidelines.

Here is a small peek into some of the issues to consider:

Before 2014 (probably in late Summer or early Fall of 2013), agents who wish to sell coverage through Federal or State Health Exchanges will be required to register with the Exchanges, receive required training (around 5 hours for the Federal Exchanges) on Qualified Health Plan options and insurance affordability programs, comply with security and privacy guidelines, and enter into formal agreements with the Exchanges.

Agents will need to be familiar with the requirements and issues for both the individual and group market-places. However, employer groups with approximately 50 or more employees are likely to seek out insurance agents for advice and consultation on how to structure health care plans. Agents will need to be able to answer complex questions such as:

1.As an individual am I eligible for government subsidies based on my current income level? What if my income changes throughout the year?

2.If my company has 60 employees, could I just turn half of them into part-timers and get around the restrictions of having to offer healthcare coverage to all my employees?

3.As a seasonal employer with the numbers of employees shifting by quarter, how do I count my employees for the purposes of the Act?

4.Is there any benefit to considering stop-loss insurance? Can I as an employer accept the volatility?

5.What do I need to do to structure an insurance program that is affordable and provides the proper degree of services to my employees so that I am not assessed penalties under the Act or is it possible that cutting benefits and costs and taking a penalty still creates benefit for my company?

Does your agency have a plan to meet the requirements for selling health coverage as required in the provisions of the Act? Are you able to answer the questions on individual and group plans presented above? If not, now is the time to fast-track your education on the Act and the role of agents? Your exposure to negligence claims will increase tremendously if you do not have the specialized knowledge and expertise required to assist your clients in becoming compliant with the health care regulations.
