MINUTES

Commissioners Present: Cheryl Sanders – Chairman, William Massey – Vice Chairman, Pinki Jackel, Noah Lockley, and Joseph Parrish Others Present: Marcia Johnson – Clerk of Courts, Mark Curenton – Assistant County Planner, Michael Shuler – County Attorney, Michael Morón – Deputy Clerk to the Board Call to Order (9:00 AM) Chairman Sanders called the Meeting to order. Prayer and Pledge (9:01 AM) There was a prayer followed by the Pledge of Allegiance. Commissioner Jackel gave an update on the NACO Conference she recently attended. Chairman Sanders provided additional information regarding the newly elected president of NACO. Approval of Minutes (9:03 AM) Commissioner Jackel asked that the motion regarding the soccer field is re-worded. Motion by Massey, seconded by Lockley, to approve Minutes of the July 1, 2014 Regular Meeting, with Jackel’s requests for re-wording motion for soccer field, and the July 1, 2014 Public Hearing; Motion carried 5-0. Payment of County Bills (9:05 AM) Motion by Massey, seconded by Parrish, to approve the payment of the County’s Bills as presented; Motion carried 5-0.

Department Supervisors Report Howard Nabors – Superintendent of Public Work (9:06 AM) Mr. Nabors updated the Board on the easements for a ditch in Carrabelle. Chairman Sanders and Commissioner Massey discussed several other issues in Carrabelle that need attention. Chairman Sanders and Clay Kennedy, of Preble-Rish, discussed a problem with a driveway along the new multi-use path at Carrabelle Beach. Mr. Kennedy stated that he will look into this matter. Commissioner Jackel asked Mr. Kennedy about the expense of moving any mailboxes during the re-paving project on South and North Bayshore Drives in Eastpoint. Commissioner Jackel suggested an informational flyer for new paving projects to keep the public informed. Mr. Kennedy stated that this project will take about 5 months. Chairman Sanders and Mr. Kennedy discussed the Oak Street project. Commissioner Lockley and Mr. Nabors discussed a problem on Earl King and Jacoby Street in Apalachicola. Fonda Davis – Solid Waste Director (9:13 AM) Mr. Davis presented his activity report but had no action items for Board approval. Nikki Millender – Parks & Recreation (9:14 AM) Mrs. Millender updated the Board on the Dixie Belles softball team moving on to the Nationals and provided information on the expenses for that trip. She mentioned all of the other teams who have been involved in the tournaments. Mrs. Millender stated that a lot of work is needed at the facilities on Carrabelle Beach. She discussed this item further. Chairman Sanders and Mrs. Millender discussed picnic tables at Carrabelle Beach Park. Commissioner Lockley and Mrs. Millender discussed the public safety aspect regarding the beach facilities. Motion by Jackel, seconded by Massey, to start the process for quotes and project plans for Carrabelle Beach facilities and the bathrooms on St. George Island beach; Motion carried 5-0. Mrs. Millender discussed the soccer field/basketball court proposal at D. W. Wilson. She explained another possible cost that wasn’t included in the original proposal, such as labor,

power, and installation. She stated that inmate labor will be needed, which will require a request to the prison from the Board. Commissioner Parrish stated that the project should be funded from capital outlay. Commissioner Jackel stated that she is for the project but wasn’t in favor of funding this project from County tax dollars. She explained that these types of projects should be funded by grants but realized it was too late to have it completed in time this year. She explained the process of how she would like to see this project funded and believes that it would be approved under the FRDAP. Betty Sasnett, President of Franklin County Youth Soccer League (FCYSL), stated that she wants to see this project completed and not put off, as has been done in the past. The Board and Mrs. Sasnett discussed the cost, quality and, implementation of the project. Commissioner Lockley stated that even if we started the process now, the funds won’t be spent before the end of this fiscal year. Scotty Lolley, of the FCYSL, stated that the County needs to invest in children of the County and not continue to wait on grants. Chairman Sanders and Commissioner Jackel responded to his comments, explaining some of the other ways the Board has invested and supported youth sports in the County. The Board and Mrs. Millender discussed saving some money by using inmate labor for this project. Chairman Sanders recommended bidding the project and then addressing the funding. The Board discussed this further. Carla Cates agreed that budgets are important but the fields are not safe and the kids are getting hurt. She explained that constant maintenance is needed to keep the fields in good shape. Mark Curenton explained the bidding process and possible timetables. Motion by Lockley, seconded by Parrish, (amended) to start project, but only commit $57,000 from the Capital Outlay funds; (Motion was rescinded by Lockley and Parrish) Motion by Lockley, seconded by Parrish, to begin the process of bidding the entire soccer field/basketball court project; Motion carried 5-0. Pam Brownell – Emergency Management (9:55 AM) Mrs. Brownell presented her report to the Board. Action Items:

1. Asking for the Boards direction regarding Tipping Fees for the 2 local municipalities. If we get a storm this year we don’t need to lose money because we don’t charge the 2 cities and VMS again. We cannot get reimbursed from FEMA for final disposal of their debris if we don’t charge them a tipping fee on a regular basis per FEMA. We need something in place or the $24,000 we lost with Debbie will be minimal compared to what we would stand to lose in a major storm. The cities I believe have their own debris contractors and the tipping fees are a reimbursable charge for them, so they don’t lose

money but we don’t either. Also with charging the tipping fees on a regular basis that money could help offset the cost of equipment replacement for solid waste.

The Board and Mrs. Brownell discussed having the cities pay the tipping fees. The Board suggested that Mrs. Brownell discuss this issue with both cities, along with Fonda Davis, and come back with a recommendation. Commissioner Lockley suggested that we require the State and Transfield Services to pay their tipping fees. Mrs. Brownell stated that she will speak with Transfield Services regarding this matter.

2. Asking for the Boards approval and signing of the contract for Debris Monitor with

Thompson Consulting Services as the standby Debris Monitor. Motion by Jackel, seconded by Massey, to approve Chairman’s signature on the contract for Thompson Consulting Services as a standby Debris Monitor; Motion carried 5-0. Information Items:

1. Wednesday July 2nd, Pam Brownell did the Final Inspection on the HMPG 1831-11-R Final Closeout on Small Drainage Project. We are waiting on the close out letter from the State.

2. 07/09/14 to 07/11/14 EOC will be attending the Gadsden County Summit.

3. On 07/17/14, the Property Appraisers office, Emergency Management and the local

Damage Assessment Team will be attending an IDAM training at the EOC office.

4. 07/21/14 – 07/23/14 EOC will be holding the G386 Mass Fatality Class at the Franklin County EOC.

Eric Lovestrand – Extension Agent (10:04 AM) Mr. Lovestrand had no action items for Board approval. Chairman Sanders asked for an update on the office manager position for his office. Mr. Lovestrand stated that he has almost completed the interviewing process. UF/IFAS Extension Faculty have been involved in the following Extension activities during this period. General Extension Activities:

Staff continued to move forward with filling vacant Extension Office Mgr. / Program Assistant position. Interviews took place on July 11 and 14 and a selection will likely have been made prior to this meeting. However, due to this report submission date prior

to the completion of interviews the selection is not known at the time of this writing. The selection will be made known in the subsequent BOCC report from the Extension office. The office received 18 applications for the position and interviewed 6 applicants.

Erik Lovestrand participated in the Estuarine Research Reserve’s 5-year Review that is conducted by NOAA. A conference call regarding the Reserve’s education and outreach efforts took place on July 1.

Erik Lovestrand is enrolled and participating in the UF/IFAS online course titled: Certificate in Teaching and Learning in Extension.

Erik Lovestrand drafted several short articles on various topics that may be used in various media outlets. One article is attached for reference as it pertains to a proposed rule change that would ease restrictions in California’s importation of Gulf Oysters.

Sea Grant Extension

Coordinated with FDACS staff to finish up last two days of required oystermen training prior to penalty fee deadline. Overall license sales this year were approximately 1,270 with over 400 occurring on the last two days. Extension staff provided educational support by showing the FDA required 20 minute training video throughout the last two weeks of the pre-penalty period. This also provided an opportunity to distribute free Extension literature and other items to the participating harvesters, including calendars, ink pens, fish measurement stickers, book marks, etc. This was also a great opportunity for the new Extension Director to meet people involved in the oyster industry.

Scott Jackson (Sea Grant/Bay Co.) and Erik Lovestrand spent time working with FWC on logistics for sea turtle lighting grant. This grant will provide funds for coastal residents and rental companies to replace lighting that is out of compliance with the Franklin County ordinance. It will fund on temporary position that will be hired under the County Parks and Recreation Department.

Erik Lovestrand met with Gulf County Extension Director Roy Lee Carter to visit a shrimp aquaculture operation for a tour with the operator.

4-H Youth and Volunteer Development:

4-H Summer Camp session for Franklin County children takes place July 7-11 at Camp Timpoochee in Niceville. This year there are 8 campers from Franklin County. Extension Director, Erik Lovestrand, spent a day with the children and other Extension faculty at the camp facility to become familiar with the annual routine.

Anne Birchwell – Library Director (10:06 AM) Ms. Birchwell had no action items for Board approval. She updated the Board on the summer events at the Library. Ms. Birchwell brought some kids to tell the Board what they like about the Library’s summer reading programs. Kim Bodine – Presentation of Gulf Coast Workforce Budget (10:09 AM)

Ms. Bodine presented items that required Board action. The Board and Ms. Bodine discussed funding for the Literacy program. Ms. Bodine stated that there will be Literacy programs offered throughout the County, even though Franklin County Literacy program is closing. She explained that before she got the notification of the Literacy Program closing, there was a contract in place to assist them with funding. Commissioner Lockley and Ms. Bodine discussed the Workforce’s role with the re-shelling program and the eligibility for those funds, including the Tropical Storm Debbie funding, and the training phase of their funding. Commissioner Massey also commented on this item. Motion by Massey, seconded by Jackel, to approve the extension for direct services, the budget and waiver as presented; Motion carried 5-0. Pam Shiver – Franklin County School Board – Request for Authorization for Ballot Referendum (10:21 AM) Liz Sisung presented the request as Mrs. Shiver wasn’t able to attend the Meeting. Motion by Parrish, seconded by Massey, to approve the request for authorization for ballot referendum; Motion carried 4-1, Lockley opposed. Recess (10:24 AM) Chairman Sanders called for a recess. Reconvene (10:36 AM) Chairman Sanders reconvened the Meeting. Planning & Zoning Consent Agenda (10:36 AM) Mr. Curenton presented the items for Board approval. 1-Approved by P&Z - A request to construct a single family dock located at McIntyre Road in Section 10, Township 6 South, Range 3 West, east of Carrabelle, Franklin County, Florida. Dock will be 32x12 with a 16x4 access walkway and an upland deck of 40x8. Request submitted by GEA, Inc., agent for Loansome Partnership. Motion by Massey, seconded by Jackel, to approve request to construct a single family dock located at McIntyre Road in Section 10, Township 6 South, Range 3 West, east of Carrabelle; Motion carried 5-0.

Motion by Massey, seconded by Jackel, to approve request to construct a single family pier at Lot 16, Bay Palm Village, 1415 Evodia Ct., St. George Island; Motion carried 5-0. 3-Approved by P&Z - A request to construct a single family dock at 153 Harbor Circle, Alligator Point, Florida. The access walk will be 250x4 with a terminus platform of 20x8 and 11x12 boatlift. Request submitted by Larry Joe Colson, agent for James and Dora Landsberg. Motion by Massey, seconded by Jackel, to approve request to construct a single family dock at 153 Harbor Circle, Alligator Point; Motion carried 5-0. 4-Approved by P&Z (3/1 vote) - A commercial site plan for a request to consider a ten slip commercial dock as a principal use in the C-1 District on property located 530 US Highway 98, Eastpoint, FL. Request submitted by GEA, Inc., agent for Steve’s Dockside. Mr. Curenton presented a site plan for this request and discussed it further with the Board. Commissioner Jackel asked for additional information on this matter. Dan Garlick responded to Commissioner Jackel’s questions and provided additional information on the project. Motion by Jackel, seconded by Massey, to approve commercial site plan for a request to consider a ten slip commercial dock as a principal use in the C-1 District on property located 530 US Highway 98, Eastpoint; Motion carried 5-0. 5-Approved by P&Z - A sketch plat for a three lot subdivision named Pine View Cove 2, the lots will access off of Mary’s Beach Lane is accesses off of Highway 98. Request submitted by Thurman Roddenberry, agent for Willis Timber Limited Partnership. Motion by Massey, seconded by Jackel, to approve sketch plat for a three lot subdivision named Pine View Cove 2 off of Mary’s Beach Lane; Motion carried 5-0. 6-P&Z Approved and concurred with the Advisory Board of Adjustment - A request for a Special Exception to locate a telecommunication tower on a 100x100 sq, ft parcel located at 3567 US Highway 98, Summer Camp, St. Teresa, FL. Request submitted by Blackwater Group, agent for AT&T. Commissioner Parrish verified that the County will be able to co-locate repeaters on this tower. Chairman Sanders verified that the tower will be far enough off of the road that if it falls it wouldn’t fall on Highway 98.

Megan Roberts, of AT&T, explained that the towers are designed to collapse inward rather than fall forward. She also verified that the County could co-locate on the tower and that there are no other towers in that area. Motion by Parrish, seconded by Massey, to approve request for a Special Exception to locate a telecommunication tower on a 100x100 sq, ft parcel located at 3567 US Highway 98, Summer Camp, St. Teresa; Motion carried 5-0. Commissioner Jackel and Mr. Curenton discussed problems with being able to have a meeting quorum at the Planning & Zoning Board. Motion by Jackel, seconded by Massey, to direct Staff to send a letter to current members of the Planning & Zoning Board thanking them for their service and remind them of the importance of attending meetings; Motion carried 5-0. Marcia M. Johnson – Clerk of Courts – Report (10:52 AM) Mrs. Johnson discussed an item regarding the State asking for the County to sign a lease for network printers or copiers. Motion by Massey, seconded by Lockley, to authorize Chairman’s signature on copier lease, if it becomes necessary; Motion carried 5-0. The Board and Mrs. Johnson discussed Thursday and Friday’s budget workshop schedule. Mark Curenton – Assistant County Planner – Report (10:55 AM) Mr. Curenton presented his report to the Board. 1 – We have received the grant agreement from the Division of Emergency Management for the reroofing of the jail. The grant is for $582,528.00. The County’s match is $194,176.00. The finance office has the match budgeted in the fine and forfeiture fund. Board action to sign the grant agreement. The Board and Mr. Curenton discussed the type of roof being installed. Motion by Massey, seconded by Parrish, to approve Chairman’s signature on grant agreement for roof on the jail; Motion carried 5-0. 2 – We have received the grant agreement from the Department of Environmental Protection for improvements at Vrooman Park, which include relocating the T-ball field, expanding the children’s playground and providing netting to catch foul balls. The grant is for $50,000. Board action to sign the grant agreement.

Motion by Massey, seconded by Jackel, to approve Chairman’s signature on grant agreement with DEP; Motion carried 5-0. 3 – FDOT has found $122,000 to pay for the box culvert on Bluff Road. This will only cover a portion of the replacement. The total cost of installing the box culvert is $195,313.10. The Board has previously approved taking the additional $73,313.10 needed to pay for the box culvert from Commissioner Parrish’s road paving funds. Board action to approve the resolution approving the Supplemental Agreement No. 3 and authorizing the chairman to sign the supplemental agreement. Motion by Parrish, seconded by Massey, to approve resolution approving Supplemental Agreement No. 3 and authorize Chairman’s signature on agreement; Motion carried 5-0. 4 – Board action to approve Change Order No. 2 for C. W. Roberts Contracting, Inc. to add $195, 313.10 to their contract for Bluff Road to install the box culvert. Motion by Massey, seconded by Parrish, to approve Change Order No. 2 for C. W. Roberts Contracting, Inc. to add $195, 313.10 to their contract for Bluff Road to install the box culvert; Motion carried 5-0. 5 – Board action to approve a memorandum of understanding between the Florida Department of Agriculture and Consumer Services and Franklin County relating to mosquito control. This MOU allows the County to trap mosquitoes and the Dept. of Agriculture to pay for the identification of the mosquitoes. Motion by Massey, seconded by Jackel, to approve memorandum of understanding between the Florida Department of Agriculture and Consumer Services and Franklin County relating to mosquito control; Motion carried 5-0. 6 – Recommend awarding the contract for building the docks at the Abercrombie Boat Ramp to the low bidder, H. G. Harder & Son, Inc. in the amount of $94,495.00. Board action to award the contract. Commissioner Parrish stated that this project has been 2 years in the works. Motion by Parrish, seconded by Lockley, to approve awarding the contract for building the docks at the Abercrombie Boat Ramp to the low bidder, H. G. Harder & Son, Inc. in the amount of $94,495.00; Motion carried 5-0. 7 – The staff at the Florida Communities Trust has gone over the County’s request for funding and has disallowed some items as not reimbursable, such as recording and transfer charges, property taxes and settlement and closing fees. The amended amount Franklin County can expect from the Eastpoint Working Waterfront grant is $317,540.00.

In addition the attorney at the FCT has informed me that the deeds for the Eastpoint property do not contain the necessary reverter clause required by Florida Statutes. Likewise a Declaration of Restrictive Covenants will need to be recorded on the property. These covenants basically say the property must be used in accordance with the Eastpoint Working Waterfront Management Plan which the Board has previously approved. Board action to authorize the chairman to sign the revised deeds and Declaration of Restrictive Covenants when they are reviewed and approved by the County Attorney. Motion by Jackel, seconded by Massey, to approve Chairman’s signature on the revised deeds and Declaration of Restrictive Covenants once reviewed and approved by the County Attorney; Motion carried 5-0. 8 – There will be a Grand Opening and Ribbon Cutting for Phase 1 of the Carrabelle Beach Multi-Use Path next week on Wednesday, July 23, at 11 a.m. The event will start with a ribbon cutting at the Carrabelle Beach RV Resort, followed by a walk or bicycle ride to the Crooked River Lighthouse for refreshments. The Board commended Mr. Curenton on a job well done while Mr. Pierce has been on vacation. Michael Shuler – County Attorney – Report (11:04 AM) Attorney Shuler discussed the Ballot language for the Franklin County Tourist Development Council’s proposed 2% increase. Commissioner Jackel commented on both versions of the ballot language. She stated that the TDC board recommended the language that dedicates 1% to national advertising, so she was supporting that language. Commissioners Lockley, Parrish, Massey and Sanders were in favor of the language that doesn’t support dedicating the 1% to national advertising, as that funding could be used for other items throughout the County. Motion by Jackel, to recommend version #2 of the ballot language; Motion dies for lack of second. Attorney Shuler explained the language in version #1 of the Ballot, which doesn’t dedicate the 1% to national advertising and stated that this is the version he recommends. The Board discussed this matter further. Motion by Jackel, seconded by Massey, to recommended version #1 of the Ballot language; Motion carried 5-0.

Chairman Sanders and Attorney Shuler discussed Sacred Heart Hospital’s request to meet with him. Commissioners and Public Comments (11:15 AM) Commissioner Jackel discussed an email she received which included a Resolution regarding Courthouses being able to post an “In God We Trust” message. Motion by Lockley, seconded by Jackel, to start discussion to create a fire inspector/code enforcement position for the County; Motion carried 4-1, Parrish opposed. Commissioner Parrish asked for Board action to have the Weather Channel restart the daily weather reports for Franklin County locations. Motion by Parrish, seconded by Jackel, to direct Staff to send letter to Weather Channel requesting a restart for weather reports for Franklin County locations; Motion carried 5-0. George Floyd Kirvin updated the Board on his efforts with the DEP and a snagging permit Resolution. He provided an informational handout on this matter. Mr. Kirvin also informed the Board of a proposed dredging project on St. George Island and asked the Board for a Resolution of Support for this project. Commissioner Parrish and Mr. Kirvin discussed why he changed his request from a partnership to a Resolution of Support. Motion by Lockley, seconded by Massey, to authorize Resolution of Support; Motion was rescinded. Attorney Shuler asked that the Board give him the opportunity to look at this matter further before any action is taken. IFAS Extension Franklin County

Franklin County Extension Activities July 11 - July 31, 2014

UF/IFAS Extension Faculty have been involved in the following Extension activities during this period.

General Extension Activities:

Erik Lovestrand has assisted County residents including field visits in the areas of citrus tree health, bees in residence under hot tub,

vegetation species on purchased lot and natural area access in the Plantation. Many others have received assistance and information

through phone calls or emails.

Erik Lovestrand will be attending the New Faculty Development Academy at UF in Gainesville Aug. 11-13. This is the first of two

sessions with the second in November.

Erik Lovestrand will be attending the Gulf and South Atlantic States Shellfish Sanitation Conference at the Duke University Marine

Laboratory, Sept.9-11 to participate in regional discussions that affect our local seafood industry. This is also important for Mr.

Lovestrand’s introduction to HACCP training and current strategies used by other Gulf states in managing shellfish resources.

The Office Manager/Program Assistant position has been filled by Mrs. Jamie Johnson. Jamie possesses a diverse set of skills that are

important to this position. She has much experience with the Microsoft Office suite of programs that are utilized in Extension as well

as experience with Quickbooks for accounting purposes. She scored the highest on the typing test that was administered. Current and

former supervisors gave excellent references when called regarding Jamie’s work ethic, workplace professionalism and all general

employment aspects discussed. Jamie also has good social media skills which are very important now in Extension outreach and

education programs. She will be a strong asset for Extension services as she develops in this positon.

Sea Grant Extension

Erik Lovestrand assisted the Bay County Sea Grant agent at the Ocean Fest event in Panama City on Saturday July 26. The Bay

County agent is currently partnering with Franklin County on a grant to address sea turtle lighting issues on St. George Island. Much

information was gathered at the event pertaining to the invasion of the red lionfish in our Gulf waters. Franklin County CED may

partner with the FWC Lionfish Coordinator for a booth at this year’s Florida Seafood Festival.

Erik Lovestrand met with Tommy Ward to discuss history of his business and shelling program on his leases.

Erik Lovestrand participated in a webinar on NOAA’s efforts to establish a National Saltwater Recreational Fisheries policy. The

meeting basically covered their plans on gathering public input on this topic. An agenda is attached and the website for this activity is

Erik Lovestrand will attend a Gulf red snapper recreational fishing workshop in Carrabelle on July 31 hosted by FWC.

4-H Youth and Volunteer Development:

4-H University took place during the week of July 28-31. Franklin County had one participant, Miss Ursula Countryman who

attended as a delegate to participate in the following activities on and around the UF campus.

The Wakulla County Extension Director conducted two workshops for Franklin County residents on preparing an autumn garden.

One was conducted at the Carrabelle branch of the library and one at the Eastpoint branch.

ALLYN, INC.

Administrative Services

CONTRACT EXTENSION

This contract extension agreement is entered into this 1st day of October, 2014, between the Franklin County

Tourist Development Council (FCTDC) and Allyn, Inc. Allyn, Inc. agrees it shall act as the continuing

FCTDC’s administrative, research, and accounting services staff and perform all necessary services and

responsibilities associated with these functions including:

Serving as administrative and accounting staff for the FCTDC, Allyn, Inc. will provide the following duties:

scheduling and attend meetings, drafting agendas, taking minutes, handling all correspondence;

Maintaining an accessible public office facility, maintain files;

Respond to requests for information regarding FCTDC programs;

Assist FCTDC in the preparation of procedural documents, request for proposals or bids, and contracts;

Collect and maintain information on Franklin County tourist tax revenue collections;

Process invoices and expedite payment requests to Franklin County’s Finance Office;

Financial: Draft and monitor budgets, create, present, and interpret monthly financial statements and

perform budget analysis;

Manage the FCTDC Grant Program, including noticing grant program funds, conduct training sessions

for applicants, oversee applications and contracts, monitor grantees, and obtain follow-up reports;

Assist in carrying out such promotional activities as may be requested by the Board;

Manage activities relating to BP Oil Spill grant funding and assist in providing such promotional

services as such grants require;

Other duties as requested by the FCTDC.

The FCTDC agrees to reimburse Allyn, Inc. at the rate of $42.00 per billable hour, plus advertising, postage,

special equipment costs, telephone services, and bulk printing costs. The rate per hour includes all personnel

requirements, all equipment such as computers, printers, copiers, rent, utilities, and any other necessary

equipment to perform the duties listed.

No website maintenance service is made a part of this contract.

Allyn, Inc. will thoroughly document time and expenses. Any disagreement that arises out of this agreement

shall be resolved by arbitration in accordance with Florida Law. Both parties agree to adhere to any such

settlement agreement. The term of this agreement will be from October 1, 2014 through September 30, 2015.

Contractor will not be able to assign, transfer, convey, sublet, or otherwise dispose of this contract, or of any

and all of its rights, title, or interest therein, or his or its power to execute such contract to any person, company,

or corporation, without prior written consent of the FCTDC. Applicant must be willing to submit financial

documentation, such as audits, if requested.

All work performed under the contract must be the property of Franklin County, Florida, for whatever use

and/or disposition may deem appropriate, and shall have the full right to reproduce and/or use any products

derived from the contractor’s work under this contract, without payment of any royalties, fees, etc.

Service includes reformatting appropriate articles and re-releasing as news releases. “Special Sustaining Program Funding”

This Contractual Agreement is entered into with the Franklin County Tourist Development

Council (hereafter known as the “FCTDC”), and The City of Apalachicola’s operation of their

Center for History, Culture, and Art, (hereinafter known as the “Grantee”). Each non-profit

organization receiving funding agrees to operate a facility which provides tourist-related services

to out-of-county visitors.

The Franklin County Tourist Development Council will fund the approved organization an

annual total of $10,000 to be used as “sustaining program funding“. This year, the organization

must match 50% ($5,000) of the grant funding award, and must meet the following requirements,

as well as provide a completed and signed Quarterly Expense Report and a Monthly Visitation

Report using the official FCTDC Sign In Sheet, to receive the payment for reimbursement of

operational expenses.

1. The organization must be a governmental agency, or not-for-profit 501 (c)(3)

organization or incorporated in the State of Florida as a non-profit corporation.

2. Services provided by the organization must appeal primarily to tourist audiences.

Such services shall be of a cultural, historic, and/or artistic nature.

3. The organization must operate a facility that is open to the public a minimum of ten

(10) hours per week. These hours must be approved by the FCTDC, established,

posted, constant and widely promoted to encourage visitation.

4. Entrance fees should not be restrictive in nature.

5. Funding will be limited to sustaining operational expenses - to include personnel

costs associated with maintaining visitation hours, utilities, insurance, office supplies,

promotional materials, developing exhibits, visitor services/programs, and postage.

All other expenses will be the responsibility of the organization.

6. Each facility receiving funding must display an appropriate standard image sign to be

approved by the FCTDC. The sign will include the FCTDC logo. See Attachment A.

7. Each facility will provide restrooms, and provide display space for standardized

tourist information approved by the FCTDC.

8. Each facility’s promotion and websites must include the FCTDC logo on each page

and the FCTDC logo must be hyperlinked to www.saltyflorida.com.

9. FCTDC reserves the right to audit financial records of any sustaining grant recipient.

10. Each facility will provide a Certificate of Insurance with minimum limits for

$200,000 combined single limit for personal injury and property damage and name

Franklin County as an additional insured. City-owned facilities will provide coverage

through their League of Cities limits of insurance.

promotional materials, developing exhibits, visitor services/programs, and postage.

All other expenses will be the responsibility of the organization.

6. Each facility receiving funding must display an appropriate standard image sign to be

approved by the FCTDC. The sign will include the FCTDC logo.

7. Each facility will provide restrooms, and provide display space for standardized

tourist information approved by the FCTDC.

8. Each facility’s promotion and websites must include the FCTDC logo on each page

and the FCTDC logo must be hyperlinked to www.saltyflorida.com.

9. FCTDC reserves the right to audit financial records of any sustaining grant recipient.

10. The grant recipient must procure, and maintain in force during the terms of the grant

award, at its expense, liability insurance in companies and through brokers approved

by the FCTDC adequate to protect against liability for damages claims in the

minimum amount of $200,000 combined single limit for personal injury and property

damage and shall timely provide proof of such general liability insurance to the

FCTDC and name Franklin County as an additional insured. City-owned facilities

will provide coverage through their League of Cities limits of insurance.

At the board's direction, I met with Mr. Floyd following your July 15, 2014,meeting to discuss his request that the county join him as a co-applicant on his permitto dredge the old St. George Island Marina. Because the liability to the county as a co-applicant is too great, I have informed Mr. Floyd that I would recommend that thecounty not sign as a co-applicant on his dredging permit. Mr. Floyd indicated that hewas going to withdraw that request. He also indicated that he was proceeding with thedredging permit individually. I have not expressed any opinion one way or the otherregarding his project, except for my recommendation that the board not become a co-applicant with him.

Faison reported the Governor had vetoed all proposed budgets for telemedicine projects.

Per Faison, an article would be published in the Tallahassee Democrat regarding the

Economic Development Council (EDC) of Tallahassee/Leon County’s support of

telemedicine in the rural communities. In May, the EDC had unanimously adopted a

resolution in support of state appropriation for TMH’s telemedicine program.

Faison shared a telemedicine stroke protocol pilot was being performed within TMH, to be

extended to the rural hospitals after working out any issues.

New Facility Update An update was given by Larry Throneberry with Adams Management on the progress

towards a new facility.

Final RFP for construction manager was pending the amount of funding approved

by the USDA and architectural plans.

The proposed budget ($10.25 million) and anticipated expenditures, such as fees,

architects, etc. (at approximately 35%) were discussed. Required renovations and

the need to prioritize were emphasized. Throneberry shared that they had received

the first draft of numbers from BKD.

Brownsworth emphasized the construction manager should be engaged early to

value engineer and ensure constructability of the project. Additionally, he

recommended a work group for construction plans.

Davis gave a reminder of community expectations detailed in the sales tax

referendum. Brownsworth agreed and stated that as much clinical space as possible

should be new construction.

Throneberry anticipated an updated flood plain engineering study would be

required.

Senior Care

Agreement

An updated agreement for continued hospital pharmacy services through Senior Care

Consultant Group, LLC was presented for approval. The new agreement reflected revisions

for 24 hour pharmacy coverage, necessary to comply with AHCA. The agreement would

be for an interim period of 4 to 5 months until remote pharmacy coverage was realized.

The cost for the additional services would result in an increase of $1,500 per month (total

cost $6,500/ month).

Financial Report The following financial reports were presented and reviewed in detail:

5/31/14 Balance Sheet & Income Statement, Clinic Income Statements YTD, Key

Operating Indicators, Critical Financial & Other Ratios FYE 2011-FYE 2014 YTD, Cash

Balance, Statement of Operations and Hospital Statistics.

Graham reported that $800,000 of uncollectable, bad debt accounts would be written

off. He explained that after the write-offs, the ratio between gross and net revenue

would be an accurate reflection.

Davis questioned the $110,083 difference in sales tax receivables between April and

May. Graham explained the sales tax income did not have a large variance; the

difference was a reflection of when the check was received and posted.

Contractual allowances were discussed. A recommendation was made to include

contractuals as an item in future financial indicator reports.

The decreasing trend in hospital statistics was addressed. Harrison questioned the

consistency in the data collection methodology from 2011 to 2013. Brownsworth

recommended future statistics be tracked by the number of tests versus the number

of patients. Brownsworth responded that one factor in decreased outpatient visits

was the impact of HMOs, such as Capital Health Plan (CHP), and their restrictions

on approved diagnostic facilities. Brownsworth stated that he continued to lobby

with CHP to become an approved provider of all services.

USDA Update Brownsworth reported that he had informed Mary Gavin with the USDA of his departure.

Brownsworth’s recommendation was a narrative addressed to the USDA by the Board

explaining why the change in leadership would not have a significant impact operationally,

financially, or strategically. Bachrach requested Board permission to proceed with

Brownsworth’s recommendation.

The consensus of the board was to proceed with the letter as recommended.

Brownsworth anticipated he would have a draft of the full BKD report the following week.

Ultrasound Dr. Conrad addressed the Board on behalf of the Southland physicians. At Dr. Sabat’s

request, the physicians explored the potential of ultrasound services at Weems. Dr. Conrad

explained while other radiological tests were static images, ultrasound images were in

constant motion, requiring the specialized skill of a diagnostic medical sonographer

(ultrasound technician). For the diagnosis of ectopic pregnancy, testicular / ovarian torsion,

uterine hemorrhage, or deep vein thrombosis, an ultrasound technician and their successful

transfer of images to a radiologist was imperative. In the absence of a technician, cases such

as those should be transferred for an ultrasound exam and possible surgical consult.

However, the physicians agreed to the bedside use of ultrasound, in non-life threatening

situations, such as rapid access for blood / fluids, venous IV insertion, or gallstone

recognition. While these uses would expand services and improve patient care, they would

not increase revenue. On the other hand, the provision of PICC line (peripherally inserted

central catheter) services did have income potential. Dr. Conrad explained that many

Swingbed patients had PICC lines; and at present, a patient must travel to Tallahassee or

Panama City for PICC line insertion by a trained nurse under ultrasound guidance.

Huckeba questioned the potential of employing an ultrasound technician. Brownsworth

explained that the emergent presentations were the main need for ultrasound services and

for full coverage, an ultrasound tech would be necessary on a 24/7 basis. He stated that the

provision of outpatient ultrasound services would be secondary to the ER needs and would

not be the first priority in operations. Brownsworth requested Board permission to proceed

with purchase of ultrasound equipment, stipulated by the Foundation’s agreement to

provide reimbursement for the purchase. He estimated the cost to be $12,500 to $16,000.

obstetrical ultrasound exams.

E.H.R. Update Per Brownsworth, the go-live date for several components of the electronic health record

system had been delayed. The delay would allow CSS to work out several interface issues,

and for this reason Brownsworth accepted the amended go-live date of October 1st.

Because the implementation delay would result in the delay of meaningful use attestation

until 2015, the continued availability of incentive monies and potential payment penalties

was being researched.

Brownsworth reported the clinic software had been implemented the previous week.

Clinic Schedules Due to various provider absences, Brownsworth informed the Board that the Weems West

clinic would be closed to patient appointments for a few days in the next 2 months. His

decision to close the Apalachicola versus the Carrabelle location was based on the

availability of the ER.

Report to the Board of County Commissioners

August 5, 2014

1- Board action to sign contract documents with H.G. Harders to make the Abercombie

Boat Ramp improvements as funded by FWC Boating Improvement Grant.

2- Board action to sign contract documents with Southern State Pavement to make the

Lake Morality Road improvements as funded by an FDOT grant.

3- Board action to sign FAA grant for $30,192 for improvements related to pavement

improvements at the Apalachicola airport that was discussed at the July 1 BCC meeting.

4- Inform the Board that I submitted the CIGP project for the milling, widening, and

resurfacing of CR 67 in Carrabelle from US 98 to the approaches to the Pine Log Bridge

approach. DOT has acknowledged receipt.

5- I have inquired with FDOT on the ranking of the SCOP projects previously submitted,

and FDOT is still scoring the projects.

6- Board action to adopt Equal Employment Opportunity Policy so that the Franklin

County Sheriff’s Office can continue to receive US Dept. of Justice (DOJ) grants through

FDLE. The policy to be adopted is required by DOJ. The county commission has to

adopt the policy because the DOJ grant applications are signed by the Chairman, even

though the funds are sent to the Sheriff’s Office. The proposed policy should be in the

Board packet, but it is a policy that states in many forms that Franklin County as an

employer does not tolerate unlawful discrimination or unlawful harassment.

7- Board action to allow the 5th annual Race for the Bay marathon to take place on

Sunday, Oct. 26, 2014. The race route is similar to the route in the past, except that the

beginning will take place at Riverfront Park, and not under the Bridge. The City of

Apalachicola has approved the starting location, and I am waiting on confirmation from

the Sheriff’s Office that they are assisting in traffic control.

8- There are two issues on Alligator Point I need Board direction on.

A) A house at 1349 Alligator Drive, which is a beachfront house, has been

completely undermined by the ocean and is on the verge of collapse. The house and

property have not been secured by the owner, an absentee owner in Minnesota, so it is

open to vandalism. Board action to direct Mr. Shuler to take the appropriate steps to get

the owner to secure or remove the house.

B) A house at 1581 Alligator Drive applied to DEP to build a boardwalk and

beach viewing platform seaward of the Coastal Construction Control Line (CCCL).

Anything seaward of the CCCL requires a DEP permit, and DEP sets the standards for

location and construction unless the county has adopted higher standards. Up to this time

the county has not adopted any higher standards. In the case at 1581 Alligator Drive, the

beach viewing platform is well forward of every other structure on the beach and the

neighbors are concerned that the beach viewing platform represents a risk to them. At

this time there are no roofs over any of the beach viewing platforms on the beach and

everyone has equal unobstructed views of the beach. I disagree with the DEP

determination of where the primary dune is, and thus where DEP allowed this beach

viewing structure to be built, and I have asked DEP to review their determination, but

while that is going on I do not want to compound the problem with a roof being built. At

this time no permit has been sought for a roof over, but I am requesting the Board

consider adopting an ordinance prohibiting roofs over beach viewing platforms on

Alligator Point that are seaward of the Coastal Construction Control Line. The dune

system on the west end of Alligator Point is completely different than the dune system on

the other Franklin County beaches. Countless hurricanes have completely flattened these

dunes so structures are more exposed to hurricane surge.

9- Board action to allow Ms. Lori Switzer, SHIP Administrator, to move the unspent

2013/2014 Disaster/Foreclosure funds into the 2014/2015 SHIP Down Payment

Assistance funds. Every year that SHIP is funded the Board allocates $60,000 for

disaster funds in the event of a hurricane or some other disaster. Last year only $12,000

was used for eligible applicants, and so there is $48,537.38 of unspent funds that need to

be re-allocated to some other category or the money has to be returned to the state.

10- Board action to open bids related to the re-bidding of the new roof at the EOC. Ms.

Brownell’s consultant had re-bid the job and the bids were turned into the Clerk’s Office

on Friday. The first time the job was bid in July no bids were received. This time there

are two. Open bids and turn them over to Ms. Brownell and her committee for review

and recommendation. Ms. Brownell is out recovering from back surgery.
