Sage Coleman, ORHA Acting PresidentFellow landlord members of Oregon Rental Housing Association, my name is Sage Coleman, your Vice President and now stepping up to fill in for our President, Jason Miller until late summer/early fall of this year. I have been asked to provide a “Letter from the President” on the current state of our organization so I will do my best here.

“We are in an exciting phase of our development”.

This sums up my assessment for the Oregon Real Estate and Property Management Industry of 2018. In the 22 years I have been a member of the Rental Owners Association of Southwestern Oregon , this years hands down is the most exciting in terms of legislative battles being brought from tenant’s rights groups, increasing home values, increasing rents, state budget surplus, a booming Oregon economy, record sustained low mortgage rates, rising new resident population from other states and a pressing urgent need for more housing felt at EVERY INCOME LEVEL….WOW!

I currently serve on the Coos/Curry Housing Task Force where we have regularly met to develop awareness amongst city, county, tribal, forest products, HUD, rental owner association and contractors regarding homelessness, record low vacancy rates and sluggishness in development. On March 3rd the Oregon legislature adjourned the 2018 short session “sine die”, which is the Latin term they use for the official end of the session, meaning roughly “with no appointed date for resumption”. This was a full eight days ahead of the constitutional deadline of March 11th.Our single greatest threat this session was in HB 4085, which would have restricted or eliminated Rental Owner/Managers from receiving prevailing party fees in a landlord vs tenant court action. The bill didn’t pass committee, but we are most certain to see it come

up in the 2019 long session. Nothing else, in my opinion, passed into law that significantly effects our business. Speaking of the 2019 Long session, we need to start having a conversation about what that will look like for us landlords. I am still hopeful that Speaker Tina Kotek will allow the Landlord Tenant Coalition to resume meeting. I have made it clear to the Tenant Advocate Representatives that the Oregon Rental Housing Association values the collaborative effort the coalition has provided in the past. We recognize this process

Tenant Law. Changes that reduce the profitability of housing development. This is a big problem for Oregon.

I believe we need to do all we can as Professionals in our Industry to rec-ognize the fears of our renter popu-lation are real. We need to be ready to get involved again to defend the laws developed by Landlord/Tenant Coalitions of the past. We need to remember that those fears are based on the lack of housing supply. This is the reality for Oregon in 2018. Be prepared to give funds to our legis-lative fights through ORH KEY PAC. Your financial help will undoubtedly be necessary. Your voices will un-doubtedly again be necessary as they were for HB2004.

Finally, I believe as developers, builders, property managers and “mom and pop” landlords that we are the best equipped to step up and be-gin relieving pressure on Oregon’s housing shortage. I invite all of you to consider what You can do as an in-

dividual to create more Roofs and More Doors.

is what creates the best laws for the industry, whether you are a tenant or a landlord. If the coalition does not meet prior to the 2019 session, it will not be from a lack of effort on our side. Why disrupt a service that has been a model of bipartisanship for over 30 years? Please start thinking of ways to solve the issues we have been presented with. We know that tenants feel that 30-day no-cause notices are unfair. Are there ways that we can address their concerns without compromising this important tools for us? Are their ways we can broaden the scope of with cause notices that is a compromise for both sides? I don’t know, but I do know that if we don’t try to contribute to the solution, we may have the right taken away entirely. Please think about this, and send your ideas to your local legislative delegate, or to me. The solution might be right in front of us, and it just takes one of you to bring it to our attention. Provided by Cliff Conner-CoashPortland Housing Bureau Interim Rule for Man-datory Relocation Assistance was unanimous-ly approved by the Portland City Council March 7th. The exemption for a single owner of a rental property to pay relocation fees was taken out of the ordinance with few exceptions. Some report-ing to the Portland Housing Bureau is required of landlords that issue no cause termination notices wherein the fee is required. This ordinance is per-manent and is expected to be challenged in court.

Add a specific Place to form for “Service of Notice to Owner Agent”The Month to Month Rental Agreement (2A) and the Fixed Term Rental Agreement (2B) must have a specific place for services of Notices to Owner/agent beyond the address listed on the forms on page 2. The problem stems from a court decision indicating that just the address was not sufficient enough to comply with the statute. James Stout, Attorney looked at those two forms and said the forms were not specific enough to satisfy the statute. You must list an actual place such as the front door, the drop box by the front door or the fence post on the latch side of the front gate. Pick a specific place as long as it is clear where it is and add it to the address box “For Services of Notices to Owner/Agent” on the second page. Further, any form that requires a legal Service of Notice to Owner/Agent address, you must add a specific place.
