authorities of Montenegro to EU standards in the area of Jurisdiction, Laws, Norms and Regulations in Montenegro.

Specific goals: Determining the actual conditions of the Judicial authorities, defining and

assessing key aspects of town planning, architecture, technology, security and energy efficiency as well as forming recommendations for improvement with the aim of enhancing working and administrative capacities, accessibility and attainability of justice.

Purpose: Defining short, middle and long-term recommendations for improving the

infrastructure of Judicial authorities with the aim of realizing required interventions in accordance with recommendations.

Expected results: Assessment of infrastructure of 50 (fifty) Judicial authorities of Montenegro

on 30 (thirty) locations as a basis for initiating activities in accordance with the general and specific goals and recommendations, particularly in the part of developing Terms of Reference, additional studies, analysis, planning and technical documentation for the implementation of future works.

Key activities: Formation of questionnaires, site visits and determining the condition of

Judicial authorities’ infrastructure, discussion with the representatives of the User, analysis and processing of data, defining criteria, assessment of the conditions, formation of recommendations and development of specific Reports on the assessment of Judicial authorities’ infrastructure.

FOREWORD The assessment of Judicial authorities’ infrastructure represents the first step in the process of programme implementation for improving Judicial authorities in Montenegro. The main purpose of this document is to establish conditions for preparation and implementation of future activities on improving the working conditions, comfort, technology and security, with the aim of realizing proposed interventions on ongoing and investment maintenance, repair, energetic repair, adaptation, reconstruction, upgrading and superstructure construction of the existing buildings as well as the construction of new ones. In line with the goals relating to programme-spatial, technological, security and energy conditions, the assessment of the infrastructure in a form of the report should provide better understanding of what is wrong and what needs to be done in order to improve the Judicial system. With regards of topographic and demographic diversity and specificity of locations within the Coastal, Central and Northern regions of Montenegro, as well as changes caused by a permanent demographic migrations, it is noticed that in practice there is no ideal model of the Judicial authority, nor is there a possibility for forming a fixed pattern for the assessment of infrastructure. On the basis of the conducted methodology, research, analysis, assessment of the current condition, definition of the proposal intervention and recommendations for improvement, certain development problems were identified, which in the coming period can be greatly overcome by the proposed interventions. The report is created as a collection of data, which are analysed and presented with the aim of determining short-term, mid-term and long-term recommendations for future programme-spatial, technological, security and energetic improvement as well as increasing efficiency in implementing the procedures of work for Judicial authorities, completely in accordance with the EU standards, Laws, Norms, Regulations and examples of good practice. The report is intended for all those who are directly or indirectly involved in the programme of improving the infrastructure of the Judicial Authorities in Montenegro, for the purpose of perceiving, correcting and modernizing work functions and processes. In addition to reviewing identified problems, the Report gives guidelines in a form of recommendations for taking the next steps, with the aim of implementing interventions and improving the efficiency of Judicial authorities according to defined areas, aspects and criteria. The assessment of infrastructure, recommendations and conclusions are described in more details within the Report, given based on the information obtained through questionnaires filled in by each User, overview of available and accessible planning and technical documentation, site visits and talking to the representatives of Judicial authorities (visual overview of the existing condition, determining key areas, aspects, conditions and criteria important for forming this document). Unfortunately, the planning and technical documentation (As built designs), for a larger number of judicial authorities was not available, hence it was not possible to additionally check proposed recommendations. In our opinion, in this phase of assessing the condition and planning future steps, the lack of such documentation is not of crucial importance. However, it is very important to record all the changes of judicial authorities’ infrastructure which appear after the date of this Report, in

order to form appropriate technical archives necessary for the purpose of maintenance and future enhancements. In part 02 BASIC INFORMATION THE Project entitled “European Union support to the Rule of Law II” (EUPoL 2) is described in more details, its general goals, key participants, implementation partners and main Users. In part 03 GOALS basic information are given regarding general and specific goals and expected results of the total estimate of Judicial authorities’ infrastructure in Montenegro. In part 04 METHODOLOGY there is a detailed overview of the applied work methodology, implemented phases (preparation, research, analysis, processing and finalization) and the activities include data about the duration time and expected results. In part 05 ASPECTS AND CONDITIONS there is a tabular overview of the key aspects and conditions which need to be fulfilled as basic criteria for assessment of the condition of infrastructure and formulation of recommendations, given according to areas; urban planning, architecture, technology, security and energy efficiency.

In part 06 CONCLUSIONS, for each judicial authority from the individual reports, for the purpose of full fulfillment of conditions, the final proposals for interventions for the improvement of the infrastructure of judicial authorities are given.

01 I N T R O D U C T I O N

Project “Assessment of Judicial authorities’ infrastructure in Montenegro” represents the programme of institutional support which implies permanent investments into Judicial authorities’ infrastructure with the aim of improving the existing capacities and creating conditions for forming new ones. The aim of the project is improving Judicial authorities’ infrastructure taking into account accessibility and work efficiency regarding complete programme, spatial, technological, security and energetic modernization of the existing Judicial authorities as well as construction of new ones. A specific goal is to create reliable and accessible judicial institutions, improve administrative capacities, modernize, bring up to date the ways of working and services for various categories of users. As the final outcome the project is focused on providing technical assistance for the timely development of comprehensive terms of reference, for making necessary planning and technical documentation. Technical documentation needs to be created for the implementation of works, according to the type of suggested intervention, and with the aim of increasing programme, spatial, technological, security and energy efficiency, as well as maintaining unique, transparent and efficient judicial system of Montenegro.

Scope of the assessment: The number and type of Judicial authorities which are the subject of the infrastructure assessment is determined by the Project Initiator, Judicial council of Montenegro and the Ministry of justice of Montenegro. The report includes the assessment of infrastructure of 50 (fifty) Judicial authorities, [38 (thirty-eight) courts and 12 (twelve) prosecutor’s offices with the seats in 17 (seventeen) towns on 30 (thirty) separate locations in total, placed in the same number of buildings. 02 B A S I C I N F O R M A T I O N The Project entitled „European Union support to the Rule of Law II“ (EURoL 2) started in April 2017. with the intention to last for 36 months, until April 2020. This Project, in addition to the implementation of planned activities regarding strengthening the capacities of Montenegro in fighting against organized crime and corruption, provides support for the development of infrastructural capacities, among other things directed to the procurement of equipment and services for the needs of institutions that are crucial for strengthening the rule of law. The main goal of the project is strengthening the judicial institutions and authorities for law enforcement with the aim of meeting the criteria for joining of Montenegro to the European Union. The Project represents continuation of support to the previous project „European Union support to the Rule of Law I“ (EURoL 1) and it is a clear indicator of continuous dedication of the European Union in overcoming the challenges in the implementation of reforms to the Rule of law in Montenegro. The Project specifically deals with providing support to Montenegro in improving the efficacy of judiciary in a fight against corruption and organized crime through more efficient investigation and prosecution. The leading implementation partner of the project is the Ministry of internal affairs of Italy (Sector for public security, Central Directorate of the International Police Criminal Police Cooperation Service). Other implementation partners include the High Council of the Judiciary in Italy and the Federal Ministry of the Interior - the Criminal Intelligence Service of Austria. The implementation approach is focused on satisfying the needs of Users regarding the improvement of the existing and construction of new capacities in order to secure long-term sustainability of the results of the project. The main Project users are the institutions of Montenegro: Ministry of justice, Ministry of the Interior, Police Department, Judicial council and courts, State Prosecutor's Office, Prosecutorial Council, State Property Agency, Administration for the Prevention of Money Laundering and Terrorist Financing, Customs and Tax Administration. 03 G O A L S General goal of the assessment of Judicial authorities’ infrastructure in Montenegro is creating conditions for timely coordination of programme, spatial, technological, security and energy conditions of Judicial authorities in Montenegro and facilities with the standards and recommendations of the European Union in the area of judiciary, Laws, Norms and Regulations of Montenegro. The specific goal is determining the real condition of the Judicial authorities’ infrastructure, recognizing development problems, defining common areas for the assessment of conditions, forming separate propositions about the types of interventions and various recommendations for improving the infrastructure with the aim of increasing efficiency of working and administrative capacities, availability and accessibility of justice. The aim of infrastructure assessment is to establish, based on observed irregularities, deficiencies and bad conditions of certain facilities where Judicial authorities function today, appropriate measures for their elimination and suggest interventions which can be successively implemented in the following period. Since in practice none of the Judicial authorities covered in this Report, completely meets the standards and recommendations of the European Union, moreover, it is concluded that most of them do not meet the criteria regarding space, technology, and particularly regarding security and energy efficiency, it is necessary to give advice in a form of recommendations, so that in the following 5 (five) years separate projects would be realized and Judicial authorities structured, with the aim of providing the required level of security, accessibility, comfort and provision of services to all citizens, taking into consideration permanent increase in the needs for Judicial authorities services.

The purpose of making the document entitled „Assessment of judicial authorities infrastructure in Montenegro“ is to formulate recommendations and the ways of realization, as well as those conditions whose fulfilment through a certain time period can be considered as a short-term, mid-term and long-term solution of the improvement. The expected results represents the assessment of the infrastructure of 50 (fifty) Judicial authorities of Montenegro within 30 (thirty) locations as the basis for preparation and initiation of all required activities in accordance with the general and specific goals, recommendations and the intervention suggestion in order to prepare and develop Terms of References, additional studies and expertise, expert thematic analysis, planning and technical documentation required for conducting the procedures regarding the implementation of future works. 04 M E T H O D O L O G Y In order to assess the infrastructure of 50 (fifty) Judicial authorities on the total of 30 (thirty) locations with seats in 17 (seventeen) towns on the territory of Montenegro, with regards to the defined time and scope of the performed expertise, the work methodology is defined which establishes required phases, activities, duration period and expected results:

Phase 01 PREPARATION February, March, April 2018., Phase 02 RESEARCH May, June, July 2018., Phase 03 ANALISYS August 2018., Phase 04 PROCESSING September, October, November 2018, Phase 05 FINALIZATION December 2018, and January 2019.

P R E P A R A T I O N / phase 01

Based on the previously defined number of Judicial authorities of Montenegro the expert team during February, March and April 2018. Established and initiated a number of necessary preparation activities with the purpose of more efficient implementation of all the required activities during the realization of the expertise. The following activities were conducted in the preparation phase:

• Development of the common Questionnaire In order to collect the preliminary data about the Judicial authorities of Montenegro the expert team formed a common Questionnaire with defined questions and key aspects which was distributed during March 2018. by the representatives of the Judicial Council and the Ministry of Justice to Judicial authorities with the aim to make an overview of the basic data of importance for the assessment of the infrastructure and prepare additional questions for specific areas and aspects after the completion of Questionnaires, prior to the direct insight into the state of the Judicial authorities’ infrastructure.

• The overview of available and accessible documentation for Users The Expert team went through the available and accessible documentation to get to know the Laws, Norms and Regulations of Montenegro, expert documentation, standards from the subject area and references from the European Union sources, as well as all available and accessible previously created reports relevant for the assessment of infrastructure.

• Development of the reference example of the Report After completion of filled-up questionnaires and overlooking the obtained data, in order to make the objective evaluation later, in other words to assess the conditions and make easier visual overview and complete readability of the results, the expert team has formed the reference example of the Report as a common – typical document with the tabular overview of defined key aspects and conditions as the significant criteria for the assessment of the

condition, formulation of recommendations and defining suggestions for the required type of intervention. The reference example of the report was submitted to the Ministry of Justice of Montenegro at the end of April 2018.

• Making the plan of visits to Judicial authorities In order to determine the actual condition of the infrastructure and more efficient realization of the activities in the investigation phase, the expert team in cooperation with the representatives of the Judicial Council and Ministry of justice during April 2018. prepared an integral plan of visits to the Judicial authorities which was divided into three groups based on the locations within the territory of Montenegro: Central, Coastal and Northern region. With regards to the previously defined scope of the subject expertise, topographical specificity of the region, size of the facilities, structure of Judicial authorities and specific conditions of the location, in the plan of visits in addition to the order and the date of visit for each Judicial authority, a defined and available time for visits is stated in the interval of 1,2, 4,6 or 8 working hours, thus increasing the efficiency in the implementation of the plan. The expected results are: Questionnaire, User documentation, Reference sample report, Plan of visits.

R E S E A R C H / phase 02 According to the previously adopted plan of visits, with the aim of determining the conditions and the assessment of infrastructure, during May, June and July 2018. by the expert team and the representatives of the Judicial Council of Montenegro a tour of 30 (thirty) locations was organized in 17 (seventeen) towns and the realized visits to Judicial authorities in total 38 (thirty-eight) courts and 12 (twelve) prosecutor’s offices previously arranged and organized by the representatives of Judicial council and Ministry of Justice, in the total effective duration of 15 (fifteen) working days. In the research phase the following activities were conducted:

• Conversation with the representatives of Judicial authorities and employees: The conversation was conducted in a form of an interview by checking the data from the Questionnaire, particularly regarding the existing structure, organization, systematization of work places, processes, procedures, work results, temporary and permanent problems with the building, spatial capacities, condition of the furniture and equipment, functioning of installed systems, existing infrastructure, hygienic and technical building maintenance, previously realized architectural, construction and infrastructural interventions on the facility, as well as general and specific programme, spatial and technological suggestions of the Users with the aim of overall improvement of conditions;

• The overview and verification of available and accessible documentation: Since most Judicial authorities do not have complete property-legal, planning and archive technical documentation, nor documentation about the works performed so far on certain parts of the facilities, the expert team was not able to overview the subject documentation, only to inspect a real estate list which, for most Judicial authorities was available and verified.

• Visiting premises from the inside: Visiting the facility from the inside implied visual overview and making photos of the real condition of typical and characteristic working, utility, communication and technical rooms and spaces, recording dimensions and proportions, total comfort, furniture and equipment in the premises and marking all the relevant data about the capacities, applied technology, security, energy efficiency as well as other recorded irregularities and defects which make an unfavourable impact on functioning of the Judicial authorities.

Visiting premises and a plot from the outside included visual inspection and making photos of the real state of the façade, outer openings, roof, structures in the immediate vicinity, position, size and geometry of the plot, accessibility of various driveways and pedestrian paths, accesses and entrances, possibility of parking cars, security and fencing the plot as well as marking all the other noted irregularities and deficiencies which make an unfavourable impact on functioning of the Judicial authorities. A visit of the subject locations, focusing on the visual inspection of the condition of Judicial authorities’ infrastructure, was performed with the maximum effect in scope according to the available time of the duration of expertise. The aim of the visits was to perform the visual inspection and notice and record developmental problems which will be recognized as a priority and confirmed for a larger number of Judicial authorities and then specific problems depending on the conditions in which Judicial authorities perform their activities, with no deeper analysis which would require additional time for solving such issues and hiring a larger number of experts from different areas. The focus of this phase is identification of key developmental problems, better recognition and understanding of what is wrong, as well as timely noticing, indicating and preventing possible consequences to the system as a whole. Expected results: Minutes from the meetings, User documentation, Photo documentation of the premises (inside and outside), plots and the immediate surrounding.

A N A L Y S I S / phase 03 In order to determine the condition, assess the judicial authorities infrastructure, formulate recommendations and the final suggestion of the intervention for the improvement of judicial authority infrastructure, a complete working material formed during the previous investigation phase combined in the form of minutes from the meetings, User documentation and photo documentation for each judicial authority and location is analysed in details separately and jointly. In the phase of the analysis the following activities are conducted:

• Defining the areas, aspects and conditions:

Analysis of working materials and data from the investigation phase is simultaneously conducted for all Judicial authorities with the aim of defining key aspects and conditions needed to be fulfilled in order to create a matrix, common data base or criteria for the assessment of conditions and formulation of recommendations. The areas, aspects and conditions according to which the assessment of the condition of infrastructure was performed and recommendations formulated for overcoming noticed developmental problems are: Urban planning: Plot; Architecture: Zoning, Space, Construction openings (doors and windows), Construction elements (floors, walls and ceilings), Furnishing (furniture and equipment), Labelling; Technology: Hydrotechnical installations, Electrical installations, Central surveillance and management system, Telecommunication and signal installations, Thermotechnical installations, Fire protection; Safety Energy efficiency.

• Creating a data base: After defining the areas and aspects for the purpose of a simpler, comprehensive visual inspection, a database was created in the form of tables and photographs. The tables are

structured in a way that they contain aspects and conditions that are mandatory or recommended to be fulfilled. In order to overcome the observed irregularities and deficiencies, various types of interventions are defined (ongoing maintenance, investment maintenance, adaptation, energy rehabilitation, reconstruction, upgrading, superstructure construction and construction), which, depending on the assessment, should be applied. The photographs as an integral part of the data base and a confirmation about the results from the location, plot, building, premises and communication, are chosen with the aim of illustrating determined condition according to areas and aspects, indicating and documenting development issues, irregularities and deficiencies. Expected results: Areas, aspects and conditions, Data base.

P R O C E S S I N G / phase 04

In order to define specific recommendations for improving the infrastructure, data processing primarily involved the systematisation of mandatory or recommended conditions according to the areas and aspects that need to be fully met.

In the processing phase the following activities were carried out:

• Assessment and recommendations: According to the data base, aspects and conditions as the basic criteria, the assessment of judicial authorities is carried out in a form of detailed descriptions of the conditions that are to be met and formulation of recommendations for meeting the conditions to overcome noticed developmental issues, irregularities and deficiencies.

• Making individual conclusions Taking into account the fact that the seats of Judicial authorities within various regions of Montenegro are largely located in spaces which are not appropriate, not to mention that some courts and prosecutor’s offices are in central ambient units, residential, commercial or temporary facilities owned or leased, where by applying proposed interventions and recommendations, particularly regarding security, it is not possible to provide required coordination with the European Union standards in the following period for such cases it is necessary to consider the possibility of providing appropriate spatial conditions in which the internal organization of the Judicial Authorities can be partially or fully achieved. Bearing in mind that within the existing spatial and infrastructural capacities of the location and buildings, a number of recommendations cannot be fully realized, in relation to the actual conditions of the plot and the building, as well as the real possibilities of increasing the volume of individual buildings, possible ways of implementing the recommendations and types of intervention are suggested:

• within the existing plot and building without increasing the volume of the building: ongoing maintenance and/or investment maintenance and/or adaptation.

• within the existing plot by increasing the volume of the building, interventions: adaptation and/or reconstruction and/or upgrading and/or superstructure construction.

• Relocation of the judicial authority to the appropriate location, plot and/or building.

On the basis of the suggested ways for implementation of recommendations, the conditions are marked which within the stated areas could be set as the basis for defining the final

On the basis of the suggested ways for implementation of recommendations, the conditions are marked which within the stated areas could be set as the basis for defining the final



proposal for the intervention which is to be applied in order to improve judicial authorities and meet all the necessary conditions.

Taking into consideration defined time scope for the timeframe for the development of the assessment of the state of the infrastructure, as well as the aim to use the assessment as an indicator of noticed irregularities and deficiencies, with the aim of initiating, preparing and conducting priority activities: development of the Terms of Reference, studies, thematic expertise, analysis, planning and technical documentation, the conditions are recognized which can be selectively fulfilled in a certain timeframe thus defining the given recommendations as short-term, mid-term and long term solutions in improving the Judicial authorities’ infrastructure. Short-term solutions: The implementation of recommendations that can be considered as a short-term solution over a certain period of time refer to the integrated proposals for the intervention which, depending on the type, time and number of activities necessary for preparation and realization, in the opinion of the expert team, is possible to be initiated, conducted and realized during the period of up to 2 (two) years. The short-term improvement solution involves the implementation of recommendations and works that, according to the type of proposed intervention, refer to: ongoing maintenance and/or investment maintenance and/or lower level (scope) of energy rehabilitation and which essentially do not contribute to meeting the required criteria according to the EU standards. Mid-term solutions: The implementation of recommendations that can be considered as a mid-term solution over a certain period of time are related to integrated proposals of interventions which, in the opinion of the expert team, can be initiated, implemented and realized in relation to the type, timing and number of activities needed for preparation and realization in the period from 2 (two) to 3 (three) years. Mid-term solutions for improvements imply realization of recommendations and works, which according to the type of proposed intervention relate to: adaptation and/or energy rehabilitation and which largely contribute to meeting the required conditions according to the EU standards. Long-term solutions: The implementation of recommendations that can be considered as a long-term solution over a certain period of time are related to integrated proposals of interventions which, in the opinion of the expert team, can be initiated, implemented and realized in relation to the type, time and number of activities needed for preparation and realization in the period from 3 (three) to 5 (five) years. The long-term solution for improvements implies implementation of recommendations and works which according to the suggested intervention relate to: reconstruction and/or upgrading and/or superstructure construction and/or relocation to other sites and/or building as well as construction, and they completely contribute to meeting the TU standards. The short, mid and long-term solutions are defined depending on the type of interventions, time needed for preparation and initiation of required activities in terms of implementation and realization of the proposed interventions, and partly in relation to the amount of necessary investments. Bearing in mind that a large number of Judicial Authorities, in order to fulfil the necessary conditions defined by EU standards in the subject area, require the exclusive application of

the proposed interventions defined as med and long-term solutions, in the following period, it is necessary for the User to consider the justification of the investment on the proposal of intervention defined by a short-term solution, since the implementation of interventions within the framework of the short-term solution essentially does not meet the necessary conditions for harmonization of the Judicial authorities with the standards of the European Union in the subject area.
