Plaintiff, OFFICE OF THE ATTORNEY GENERAL, DEPARTMENT OF LEGAL

AFFAIRS, ST ATE OF FLORIDA (hereinafter referred to as "Plaintiff'), sues Defendant

DAVID L. MERKA TZ, an individual (hereinafter referred to as "Defendant" or "Merkatz").

JURISDICTION

1. This is an action pursuant to Florida's Deceptive and Unfair Trade Practices Act,

Chapter 501, Part II, Florida Statutes ("FDUTPA"). The action seeks declaratory and injunctive

relief, civil penalties, and attorney's fees and costs.

2. This Court has jurisdiction pursuant to the provisions of Chapter 501, Part II,

Florida Statutes.

3. Plaintiff is an enforcing authority of Florida's Deceptive and Unfair Trade

Practices Act as defined in Chapter 501, Part II, Florida Statutes, and is authorized to seek

consumer restitution, civil penalties, attorney's fees and costs, and other statutory relief pursuant

to this part.

4. Venue is proper in this Circuit under Sections 47.011 and 47.021 as the residence

and/or principal place of business of Defendant is in Broward County, Florida and the violations

alleged herein occurred in Broward County as well as Palm Beach County, Florida.

5. Plaintiff has conducted an investigation, and the head of the enforcing authority,

Attorney General Pamela Jo Bondi, has detennined that an enforcement action serves the public

interest. The Attorney General's Determination of Public Interest is attached as Exhibit A.

6. Defendant, at all times material hereto, was in the business of providing goods or

services as defined within Section 501.203(8), Florida Statutes.

7. Defendant, at all times material hereto, solicited consumers within the definitions

of Section 501.203(7), Florida Statutes.

8. Defendant, at all times material hereto, was engaged in a trade or commerce

within the definition of Section 501.203(8), Florida Statutes.

DEFENDANT

9. Defendant David L. Merkatz is sui juris, is not in military service and resides in

the state of Florida in Coconut Creek, Broward County, Florida.

DEFENDANT'S DECEPTIVE AND/OR UNFAIR TRADE PRACTICES CHAPTER 501, PART II FLORIDA STATUTES

10. Plaintiff adopts, incorporates herein and re-alleges paragraphs 1 through 9 as if

fully set forth hereinafter.

11. Section 501.204(1), Florida Statutes, declares that unfair, deceptive, or

unconscionable acts or practices in the conduct of any trade or commerce are unlawful.

12. During the pertinent period of time, commencing on a date unknown, but at least

subsequent to January 1, 2012, Defendant engaged in various willfui, deceptive or unfair trade

practices, as hereinafter set forth, in violation of Chapter 501, Part II, Florida Statutes.

Defendant engaged in a systematic pattern of conduct designed and intended to induce

consumers to purchase locksmith services via a series of deceptive or unfair acts or practices.

13. At all times material hereto, Defendant knew of, managed, controlled, ratified,

and/or participated in the business actions at issue herein. Defendant had actual knowledge or

knowledge fairly implied on the basis of objective circumstances that the acts, as described

below, were deceptive or unfair.

14. Defendant's wrongful acts and/or practices included deceptively marketing

locksmith services by placing deceptive ads or other marketing information on the internet or in

other advertising media which mimicked or mirrored the ads or contact information of

competing, reputable locksmiths. Defendant intended that his deceptive marketing would divert

business away from competing, reputable locksmiths and in fact Defendant obtained customers

at the expense of competing locksmiths as a result of Defendant's marketing diversion tactics.

Defendant then referred the business leads generated by consumer responses to his marketing to

bis agents. Under the pretext that Defendant's agents worked for competing locksmiths,

Defendant's agents would contact consumers to schedule appointments and then render

locksmith services. In many instances, Defendant's agents were not professionally qualified to

perform locksmith services, or did not satisfactorily perform the services in a good and

workmanlike manner or overcharged the consumer for services rendered.

15. Defendant's deceptive marketing included ads on the internet or in telephone

directories with trade-names very similar to the trade-names of competing, reputable locksmiths.

The competing locksmiths generally maintained a physical "brick and mortar" location in Palm

Beach or Broward counties while Defendant or his agents were "mobile", i.e. they relied only on

mot0r vehicles and telephones to conduct business. Defendant deceptively mimicked or

mirrored competing locksmiths' advertising by tactics as simple as adding an "s" to a

competitor's trade-name or duplicating the competitor's displayed ad but with the Defendant's

phone number or making a minor variation to a competitor's domain name or extension. In

conjunction with his deceptive marketing, Merkatz also registered the various mimicked or

mirrored trade-names of competing locksmiths as his trademarks or fictitious names.

16. Defendant's agents contacted consumers, entered their homes or businesses, and

performed the locksmith services. Defendant's agents presented a public safety hazard because

they were generally self-taught locksmiths whose qualifications to provide locksmith services

was not evaluated by any professional standard and who were not subject to fingerprinting and/or

background investigation as to criminal history. These facts were not disclosed to consumers

and were impliedly misrepresented through the Defendant's fraudulent marketing methods. In

return for these consumer referrals from Merkatz, Defendant's agents shared with Merkatz the

revenue they obtained from consumers.

17. On at least two occasions, the Palm Beach Police Department arrested two of

Defendant's agents who performed locksmith services in private residences as a result of

Defendant's marketing tactics. The two arrested individuals were charged with Burglary and

Obtaining Property by Deception. As a result of further investigation by the Palm Beach Police

Department, an Lt:iformation was filed against Merkatz on or about October 9, 2013 in the Circuit

Court of the Fifteenth Judicial Circuit. Exhibit B. On or about February 14, 2014, an Amended

Information charging six counts of Petit Theft, Florida Statutes Chapter 812, was filed against

Merkatz. Exhibit C. On February 14, 2014, Merkatz pied guilty to the six counts, was placed

on probation for three years and ordered not to engage in any locksmith business of any kind.

18. As set forth above, Defendant engaged in deceptive acts or practices in violation

of the provisions of Chapter 501, Part II of the Florida Statutes and in violation of§ 772.103, Fla.

Stat1•

19. Attendant to Merkatz' guilty plea to the six count Amended Information, Merkatz

is now estopped from denying the elements of the instant civil complaint pursuant to the terms of

§ 772.14, Fla. Stat.2

20. Plaintiff is entitled to injunctive and equitable relief under Florida Statutes

Section 501.207, and civil penalties up to $10,000 per incident or $15,000 if the consumer is a

senior citizen or handicapped person pursuant to Florida Statutes Sections 501.2075 and

501.2077.

WHEREFORE, the Plaintiff, STATE OF FLORIDA DEPARTMENT OF LEGAL

AFFAIRS, OFFICE OF THE ATTORNEY GENERAL, prays that the Court issue the following

relief:

1. Grant a permanent injunction against Defendant David L. Merkatz, his agents,

servants, employees, attorneys and those persons in active concert or participation with the

Defendant who receive actual notice of this injunction, prohibiting and enjoining Merkatz and

such persons from engaging in any business activity or operations offering, soliciting, providing

or otherwise generally dealing in or related to the locksmith business, including but not limited to

the marketing to and/or the referral of consumers who seek locksmith or other building trade

services.

2. Assess against the Defendant David L. Merkatz civil penalties in the amount of at

least ten thousand dollars ($10,000.00) for each act or practice found to be in violation of

Chapter 501 , Part II, Florida Statutes.

3. Award such equitable or other relief as is just and appropriate pursuant to Section

501.207(3), Florida Statutes;

4. Award reasonable attorneys' fees pursuant to Section 501.2075, Florida Statutes.

5. Grant such other relief as this Honorable Court deems just and proper.
