Status report on implementation of the Scheduled Tribes and Other Traditional Forest Dwellers

(Reco8nition of Forest Rights) Act, 2005 [for the period ending 31.1,2020]

Rea d ss of the States in the implementation of the Act:n e

(i) An updated status of State-wise implementation of the Act is given in Annexure-|. As

per the information collected till now,42,50,602 claims (41,01,689 individual and

L,4a,9t3 community claims) have been filed and 19,82,103 titles (19,05,726

individual and 76,377 community claims) have been distributed. A total of

37,39,286 187.97%l claims have been disposed of. A statement on claims received

a nd distribution of title deeds in various states, as in Annexure-ll, is being ma intained.

tribal dominated State and almost all lands are wholly possessed bythevarious ethnic tribal groups. As such there is no instance of eviction of

forest dwellers who have been dwelling in the Forest even beforeimplementation of the Act, 2006. Consequently, there are no claimsof

Forest received under the Act, 2006.

The State Government of Manipur has informed that there has been nosubstantial progress in the implementation of the Act due to the facethat apart from reserved forest/ wild life sanctuaries the tribalcommunities and Tribal Chiefs are already holding ownership of forestland as they are ancestral land. Therefore, implementation of said Act is

likely to be very minimum.

16 Meghalaya

State Government has submitted that it has i6.44yo area underforest cover amongst which only 5.10% area is under directadministrative control of the State Forest Department in the form ofReserved Forest, Protected Forest, protected areas, and rest of theForest areas are either privately or community owned. The majorportion of forest areas are owned and administered by the traditionalinstitutions like Syiem, Dolloi, and Nokma and communities are enjoyingsurface rights and sub-surface rights since time immoral.

It was further stated that Gram Sabha is absent due to application of Gth

Schedule Area. The State Government is in the process of identifyingsuitable institution or elected village committee to substitute the Gram

l1 Mizoram

State Government informed that being a Sixth Schedule state, nearly

100% of the population of Mizoram are Scheduled Tribe and is sharing

common ownership of non- reserved forest land under the jurisdiction

of every village. Hence, the issue of deprivation or rejection of rights

never arise till date as forest ownership rights was recognized and vested

in the hands of the community of every villages since time immemorial.

18 Nagaland

Government of Nagaland informed that in the State of Nagaland, theScheduled Tribes and Other Traditional Forest Dwellers (Recognition ofForest Rights) Act, 2006 is not applicable in view of the provisions ofArticle 371 A of the Constitution which gives special status to the State

of Nagaland with regard to the rights of the people over land and its

resources. The inhabitants of the State are predominantly tribal withdistinct linguistic, culture, tradition, customs and socio- political

characteristics and also the land and Forests belongs to the private

individuals, clans or community in the villages and land holding and

resources therein are governed by traditional and customary practices ofthe people. That the said Article also specifically provides that No Act ofParliament in respect of ownership and transfer of land and its resources,

shall apply to the State of Nagaland unless the Legislative Assembly ofNagaland by a resolution so decides. That in view of the said provision ofthe Constitution, there is no resolution passed by the LegislativeAssembly to make the Scheduled Tribes and Other Traditional ForestDwellers ( Recognition of Forest Rights) Act 2006 applicable to the Stateof Nagaland

The Andaman & Nicobar Administration has informed that the area

inhabited by the Scheduled Tribes in the Union Territory Andaman and

Nicobar lslands has been declared as Reserved Areas under The

Andaman and Nicobar lslands (Protection of Aboriginal Tribes), theirinterests are fully protected under the said Regulation by exclusivelypreserving the area for them in which they enjoy unfettered rights to use

forests products for their bonafide use, so no claim as such is thereforesettlement under the Scheduled Tribes and Other Traditional ForestDwellers ( Recognition of Forest Rights) Act, 2006. And nobody qualifiesfor being the traditional forest dwellers having resided on the forest/land / tribal reserve for the bonafide livelihood needs for threegenerations (75 years), prior to 13.12.2005 for the purpose ofrecognition of forest right under the above said Act.

Administration of Oaman & Diu has informed that as per records ofForest Department, no village in the District of Daman and Diu has beendeclared as forest village so far

34The UT Administration has intimated that there are no terrestrial forestsand no forest tribes or traditional forest dwellers in Lakshadweep.

The UT has submitted that there are no recorded forests i.e. Reserved orProtected forest land in Puducherry. The notified Scheduled Tribes in theUT does not reside on Forest Land hence as such the ,,Scheduled Tribesand Other Traditional Forest Dwellers (Recognition of Forest Rights) Act,2006 " is not applicable to the Union Territory of puducherry
