On the second pageof that letter, you asserted a claim of business confidentialityover all the records submitted to EPA.

EPA has received a Freedom of Information Act request concerningthe Blosenski site, which includes the February 27, 1986 letter fromyou. EPA must now make a preliminary determination of your businessconfidentiality claim. See 40 C.F.R. § 2.204(b)(2) and 2.204(c)(1).

Pursuant to 40 C.F.R. § 2.204(d)(1) , we have determined thatthe information in question may be entitled to confidential treatment,and are presently determining whether the information is, in fact,entitled to confidential treatment. The second item, the letter to Tim Travers,dated February 27, 1986, from Gerald E. Guiles, Vice President,Reading Alloys, Inc., is no longer claimed to be entitled toconfidential treatment. A letter written by Mr. Guiles datedJune 10, 1987 withdrew Reading Alloy's claim of confidentiality.Therefore, the documents submitted to EPA by the company areenclosed.

Please note that a final determination of the claim ofIrving Textile Products has not yet been made, but you will beadvised when that has occured. '--

This office has received a new request under the Freedom ofInformation Act, 50 U.S.C. §552, for the customer list of theBlosenski Disposal Company. As I am sure you recall, thecompany asserted a claim of confidentiality over the list, andon February 6, 1986, Regional Counsel issued a determinationpertinent to that claim. It has come to my attention that thecircumstances under which the claim was made have changed andthat grounds may exist for reconsideration of the February 6,1986 determination, pursuant to 40 C.F.R. §2.205(b).Specifically, I understand that Mr. Blosenski sold BlosenskiDisposal Company and is presently employed by Eastern WasteIndustries.

This letter is to afford you and Mr. Blosenski anopportunity to furnish comments on pertinent issues, pursuantto 40 C.F.R. §2.205 and 2.204(e). Your comments should beaddressed to me. The information which should be provided isoutlined in my letter to you dated November 25, 1985 and shouldbe sent within 15 working days of your receipt of this letter.The terms of my November 25th letter, which pertain to requestsfor additional time and claims of confidentiality over yourcomments are applicable here.

By this letter we are appealing, pursuant to 40 C.F.R. §2.114(a), an initial determination we received from EPA on June15, 1987 denying us a copy of the response submitted by WilliamA. Irving, Jr., President of Irving Textile Products, Inc. toEPA's section 104 letter.

; On March 26, 1987, we submitted a letter to EPA's RegionIII Freedom of Information Officer requesting copies of theresponses received by EPA to the Section 104 letters it mailed topotentially responsible parties (PRPs) regarding the BlosenskiLandfill. On June 15, 1987, we received a letter from James M.Seif, Regional Administrator at EPA Region III, 841 ChestnutBuilding, Philadelphia, PA 19107. Mr. Seif .informed us that theletter submitted to Tim Travers at EPA, in response to the EPA's104 letter, by William A. Irving, Jr., President of IrvingTextile Products, Inc., with enclosures, dated March 14, 1986was, pursuant to an initial determination, being denied to uswhile EPA determines the confidentiality of these documents.
