On February 27, 1986, you sent a letter, with certain attach-ments to Tim Trayers, CERCLA Remedial Entorcement Section of EPA,Region III. That letter was sent in response to EPA's inquiry aboutReading Alloys, Inc. ana the Blosenski Landfill. On the second pageof that letter, you asserted a claim of business confidentialityover all the records submitted to EPA.

EPA has received a Freedom of Information Act request concerningthe Blosenski site, which includes the February 27, 1986 letter fromyou. EPA must now make a preliminary determination of your businessconfidentiality claim. See 40 C.F.R. § 2.204(b)(2) and 2.204(c)(1).

Pursuant to 40 C.F.R. § 2.204(d)(1) , we have determined thatthe information in question may be entitled to confidential treatment,and are presently determining whether the information is, in fact,entitled to confidential treatment. We hereby provide you with theopportunity to comment concerning whether the information is entitledto confidential treatment. Your comments should be addressed to me.

4) the extent to which the intormation has been disclosed to others,and the precautions taken in connection therewith;

5) pertinent confidentiality determinations, if any, by EPA or otherFederal agencies, ana a copy of any such determination, orrererenece to it;

6) whether disclosures of the information would be likely to resultin substantial harmful effects on Reading Alloys' competitiveposition, and if so, what those harmful effects would be, and

• why they should be viewed as substantial, and an explanationof the causal relationship between disclosure and such harmfuleffects; and

7) whether Reading Alloys asserts that the intormation is voluntarilysubmitted, in that EPA has no statutory authority to requiresubmission of the information.

If you wish to obtain an extension of the 15 day period, youmust submit a request to that effect to me, 40 C.F.R. § 2.205(b)(2),and the request must be approved by the EPA legal office.

Information submitted to EPA by Reading Alloys as part or yourcomments in response to this letter may be regarded by EPA as entitledto confidential treatment. Your comments will not be disclosed byEPA without your consent, if the information submitted pertainsto the Reading Alloys claim, is not otherwise possessed by EPA, andit is marked in accordance with 40 C.F.R. § 2.203(b). If your firmdesires to assert a business confidentiality claim covering part orall of the information which you will be submitting, you shouldfollow the procedure specified in 40 C.F.R. § 2.203(b).

If no such confidentiality claim accompanies the informationwhen it is received by EPA, it may be made availaible to the publicby EPA without further notice to Reading Alloys. It has come to my attention that thecircumstances under which the claim was made have changed andthat grounds may exist for reconsideration of the February 6,1986 determination, pursuant to 40 C.F.R. §2.205(b).Specifically, I understand that Mr. Blosenski sold BlosenskiDisposal Company and is presently employed by Eastern WasteIndustries.
