The following comments were offered by Commissioners:

Commissioner Jennings reported on the status of the Hannah Community

Center Committee. She has been most struck by the level and variety of

uses that take place in the Center and how every space is programed for

multiple uses.

iii. East Lansing Art Festival Liaison

Vice Chair Holland reported that she met with the Chair of the Art

Festival Board who was concerned that she hadn’t heard from the City yet

(Longpre shared that the City Manager and Director of Parks and Rec

have since communicated with the Chair). Commissioner Holland

suggested that there be a resolution from the City acknowledging the

contribution of the Festival Board, Julie Levy-Weston, and Tim Lane

toward this year’s festival. The Commissioners supported this suggestion

and Council Liaison Stephens indicated that he would work with staff to

draft a bring a resolution to City Council for action.

D) Other Communications

i. City Council Liaison

Council Liaison Stephens reported that the idea of a full-time Arts

Director position is being discussed. He also reported that the City

Manager has had conversations with the Art Festival Board Chair

regarding a process for moving forward. Commissioners asked for an

update on the status of Art Festival staffing at the July meeting.

The report as presented in the packet was reviewed.

A) Ordinance 1339 Applications

There were no applications to review.

B) Urban Mural (Crack Art) Proposal, MSU Broad Art Lab

The Urban Mural Proposal from the MSU Broad Art Lab was reviewed. They are

requesting approval to stencil the sidewalk along the east side of the Art Lab

using a hydrophobic paint that will only be visible when the sidewalk is wet. The

painting would be done as part of a summer camp class. MSU is also asking for

$130 from the Public Art Fund for the paint. Staff Longpre indicated that the

request had been distributed to the pertinent Department at the City for their

feedback.

Moved by Commissioner Hughes, seconded by Commissioner Biering, to

approve the request from the Broad Art Museum to implement a public

hydrophobic installation on the sidewalk of Bailey Street, adjacent to the Broad

Art Lab

Discussion: Commissioners asked what happens if the paint fades irregularly. The

proposal indicates that the paint should last 3-6 months but can be washed off

with soap and water.

C) Michigan Passageways Mural Repair (memorandum distributed at meeting)

Damage was recently noticed on a corner of the Michigan Passageways mural

which is in the stairwell of the Division Street garage. The artist, Tony Hendrick

has provided a quote to repair the damage and install baseboard to combat future

corrosion.

Moved by Commissioner Jennings, seconded by Commissioner Hughes, that up

to $1,200 be identified in the Public Art Fund to repair the Michigan Passageways

Mural and that staff work with the Artist to minimize the cost of the repair but

only as such it does not compromise the quality of the repair.

5) Discussion Items 6:25 PM

A) Cultural Arts Plan RFP Update

A draft Request for Proposals for Cultural Arts Plan Consultant services was

distributed. Commissioners were asked to review the information and provide

feedback to staff by the end of June, so the RFP could be released in early July.

Staff will provide a revised schedule to the Commission at the July meeting.

B) Greetings Tour Mural

Commissioner Hughes indicated that the Greetings Tour team had contacted her,

and they have begun working with Jackson to design a mural for them. Staff

indicated that contact had not been made with the neighbors who lived just north

of the Hannah Community Center and that should happen before a

recommendation was made to City Council. Councilmember Stephens suggested

that the Commission look at the façade of the development on the corner of Abbot

and Grand River as a possible location. Commissioners asked if a wall could be

constructed specifically for this purpose. If the Commission were interested in

that an estimate of probable cost could be developed.

Move by Commissioner Hughes, seconded by Commissioner Borghi-Weil, to

recommend installation of a Greetings Tour Mural on the Hannah Community

Center north wall, provided that there is no opposition from the neighborhood.

C) Disruption for Dignity Proposal

At the last meeting, the Commission had discussed developing a limited call for

muralists interested in being considered for a mural commission but hadn’t

provided specific direction on moving forward. Commissioners discussed the

Disruption for Dignity proposal, the potential RFP call to artists, and the process

for choosing specific artists.

Moved by Commissioner Borghi-Weil, seconded by Commissioner Hughes, to

move forward with the Disruption for Dignity project.

YEAS: Vicechair Holland, Commissioner Hughes, Borghi-Weil, Biering,

and Jennings

to request proposals from Marketing/Communication consultants to develop a

logo.

“LEMON GRASS” Public Art Sculpture to be Unveiled at this Sunday’s ELFM

19-098 July 5, 2019 EAST LANSING, Mich. — The City of East Lansing is excited to announce that a new public art sculpture, entitled “LEMON GRASS,” will be unveiled at the East Lansing Farmers Market (ELFM) this Sunday, July 7 at noon in Valley Court Park, 280 Valley Court. “LEMON GRASS” was created by local, Holt-based artist Dane Porter and it is the first public art piece to be commissioned by the City of East Lansing with Percent for Art* funds. The sculpture, which was inspired by nature, stands at approximately 12 feet in height and has been installed in the circular plaza that serves as an entryway to the park and the ELFM. Here is the artist’s statement about the piece: “Just as the beautiful tropical plant grows, the sculpture “LEMON GRASS” visually sprouts from the grounds of East Lansing, creating a modern, organic form. The piece was designed with twisted, organically shaped materials that reflect light and create the effect of tall, moving grass.” At the young age of 23, Porter’s custom, distinctive artwork can already be found at several locations throughout the region, including homes, outdoor settings and corporate offices. “LEMON GRASS” sculpture this Sunday. * The City of East Lansing’s Percent for Art Program requires developers of new construction projects greater than $500,000 in value to use up to $25,000 to incorporate public art into their project. In lieu of incorporating public art into their project, developers may instead donate 1 percent of their budget to the City’s Public Art Fund, which is administered by the East Lansing Arts Commission. The “LEMON GRASS” sculpture was funded through the City’s Public Art Fund.

EAST LANSING, MI (WILX) -- On Sunday, the city of East Lansing revealed a new public art sculpture called "Lemon Grass."

"Lemon Grass" was created by local, Holt-based artist, Dane Porter and it is the rst public art piece to be commissioned by the city of East Lansing with percent for art* funds.

The sculpture, which was inspired by nature, stands at approximately 12 feet in height and has been installed in the plaza that serves as an entryway to the park and the East Lansing Farmers Market.

"I had the the sketch in my sketch book for quite awhile. When this opportunity came up to make a piece for this park, I thought it would be perfect," said 23-year-old Porter. "I am honored that they picked me, it's really humbling actually."

Porter's artwork can already be found at several locations throughout the region, including homes, outdoor settings and corporate o ces.

He is a graduate of Lansing Christian School.

The unveiling of the City of East Lansing’s first project funded by donations to its “Percent for Art” program Sunday at Valley Court Park was, by most accounts, a 100 percent success. In short, the initial investment appears to be have been very well spent.

The city commissioned Dane Porter, 23, of Holt to construct a $50,000 sculpture he named "Lemon Grass" because of the manner in which the blades of grass are suspended in mid-air.

“Dane is a real rising star on the Michigan art scene. I personally love how he combines metal and acrylic and shots of color and movement into his pieces,” said Meegan Holland of the East Lansing Arts Commission.

Porter graduated from Lansing Christian High School and then attended Siena Heights University for a year to study art. He works from his parents’ home in Holt and a studio in Dimondale—Dane Porter Art Company—where he builds and designs pieces for sale.

“We are super excited about this project because the commission has spent the past few years working our way through the Percent for Art Ordinance,” Holland said.

Holland was referring to Ordinance 1339, which was passed in 2017. It mandates that developers allocate 1 percent of their project costs (capped at $25,000 for projects that cost over $2.5 million) to a public art project. The developers can either choose a project to spend the money on or donate the funds to the East Lansing Arts Commission.

The $50,000 that was used to commission Lemon Grass was donated to the Arts Commission by developers and is the first project to be completed using donated funds from the Percent for Art program.

“This is really a big deal to us and something the residents of East Lansing should be really proud,” Holland said. “It shows a real commitment to the arts, it supports artists with real money and it also shows the city knows the importance of placemaking and the inspirational elements that heighten the quality of life in our city.”

Sculpture’s color captures the artist’s spirit

The sculpture is constructed mostly of steel for the support and the blades of grass are made of aluminum that are powder coated to prevent rust and corrosion.

“The artist in me says you could have done this or that differently but I'm really happy with it,” said Porter, whose work is also on display at Michigan State University Federal Credit Union's corporate headquarters, Granger Construction, Delphi Glass and First National Bank of East Lansing. “We started developing (Lemon Grass) and sketching it out probably a year ago, while the physical work started a couple of months ago.

“It’s been a long process but it's been a good one. It's a piece that's really special to me; I like a lot of color. I'm so honored that they chose me I'm still humbled by the fact that I was asked to create this piece. It's really special that I can not only have a piece of art in this park in East Lansing but it's something people will see every day and get to enjoy.”

Porter’s family attended Sunday’s unveiling. His mother sewed the sheets together to cover the sculpture prior to the unveiling.

“I'm really excited that he has pursued what he set out to do at a young age and is succeeding at it,” his twin Rachel Porter said.

“The extraordinary thing about Dane is that he’s been self-employed as an artist since 2010,” Holland said. “Making a living at art is hard, so this is an extraordinary young man. On many levels this truly a special day for East Lansing.”

A welcoming entrance to Valley Court Park

Mayor Pro Tem Erik Altmann and Councilmember Ruth Beier also attended Sunday’s unveiling.

“It's great to be here and a great day to dedicate this piece of art,” Altmann said. “First, I want to congratulate the artist Dane Porter. I have to confess we stopped by here last night to try to get a sneak peek but they had already bundled it up. If you haven’t looked at his portfolio on the Web I encourage you to do so. We were thinking something like this would look good in our backyard.”

Altmann noted the unique green color of the sculpture and generated laughter from the audience when he said, “I think it’s going to look great here all the time, but I think it’s going to look especially great on those rare Michigan days that are cloudy and overcast.”

Altmann thanked the East Lansing Arts Commission, explaining that the process of choosing the artist for the project was a competitive one and noted that the East Lansing Art Commission is comprised up of community members, not professional artists or city officials.

“They got a bunch of proposals and reviewed them all, got input from art experts and ended up making a great choice,” Altmann said.

The area that “Lemon Grass” was placed, at the entrance of Valley Court Park, was initially designed to hold a statue but it corroded over time and had to be removed.

“I don't think that will happen to this statue I'm looking forward to laying eyes on it every time I come to this beautiful park and I'm also looking forward to seeing other people lay their eyes on it because I think watching people react to public art is part of the fun,” Altmann said.

According to Holland, the city put out a call out for interested artists and received seven submissions. The art selection panel of the Arts Commission selected Porter’s work over four other finalists.

“Looking forward to the future we want to see that healthy mix of developers coming to us with their own ideas and also donating, and I think this is a perfect example,” said Arts Commission member Lisa Biering. “This is a space that didn't have anything there and now it was this vibrant piece that is going to catch people's eyes. Our hope for the Percent for Art program is that we can look around East Lansing where we can really do some creative placemaking.”

Staff has the following items to report:

1. The dedication of LEMONGRASS was held Sunday, July 7, and was quite

exciting. We worked with Dane Porter to have the sculpture covered for a

true “unveiling” and it was quite stunning in the full sun. Lemongrass

Incense was given to those in attendance to commemorate the event and a

plaque is being fabricated for installation within the next few months. Some

photographs of the dedication are attached.

2. Tony Hendrick, the artist of the Michigan Passageways mural will be in

East Lansing on Tuesday and Thursday, July 23 and 25, to repair the mural.

3. The MSU Broad Art Museum will begin implementing the urban mural

project on the sidewalk along the east side of the B2 Art Lab this week. If

we get rain in August, staff will visit the site to photograph the work and

document the project for our files.

4. Doug DeLind is scheduled to install the community created ceramic mural

in City Hall early the week of July 15. Recall, the mural will be installed in

the main stairwell, between the 1st and 2nd floors. We will also be installing

the People’s Choice artwork from this year in the stairwell, on the wall to

the right of the DeLind piece.

5. Attached is the Meeting Attendance Chart for the Commission.

City of East Lansing Arts Commission FY20 Cultural Arts Grant Application

The City of East Lansing Arts Commission promotes art in the community; encourages cooperation with local arts agencies; develops and recommends proposals for activities related to exhibition, performance and instruction in the arts; and works with other boards and commissions to strengthen the aesthetics and appeal of projects that affect public places. Allocations are based upon the following criteria and guidelines. GRANT DESCRIPTION The Cultural Arts Grant supports projects that encourage artistic awareness, public participation and/or cultural art appreciation. FUNDING The East Lansing Arts Commission has up to $17,500 to allocate to the Cultural Arts Grant. CRITERIA Projects must take place within the City of East Lansing. The project must primarily benefit City of East Lansing residents. The project must encourage artistic awareness, public participation and/or cultural arts

appreciation. The funds cannot provide support for East Lansing Urban Mural Project “Crack Art” projects. The project must provide evidence of artistic merit. The project must take place between November 1, 2019 and June 30, 2020.

APPLICATION INFORMATION All submissions must be received by the application deadline October 4, 2019. Incomplete applications or those that do not meet the eligibility requirements will not be

considered. Funds will be released in November, 2019.

APPLICATION GUIDELINES This is a competitive process and projects or events are recommended based on the applicant’s

ability to meet the eligibility requirements and review criteria. Applications will be reviewed by the East Lansing Arts Commission in September. The Arts Commission reserves the right to allocate funds to a specified portion of a project and/or

event. If the project/event is canceled or cannot be completed by its intended due date, unused funds

must be returned for redistribution. The grant cannot be used to pay salaries or benefits, however, an honorarium is acceptable. Funds will be released once a written letter has been submitted to the East Lansing Arts Commission

stating that the funds will be used for the arts and cultural activity described in the grant application and that they will be returned if the activity does not take place.

Unless otherwise provided by this Code or by law, members of boards and commissions established by this article shall serve at the will of the council. Nonattendance at three regularly scheduled consecutive board or

commission meetings or 90 days, whichever is longer, is hereby determined to constitute neglect of duty and shall automatically create a vacancy without further action. Except in a circumstance of an automatic

New Public Art Piece Installed at East Lansing City Hall

19-106 July 16, 2019 EAST LANSING, Mich. — Members of the community are invited to stop by East Lansing City Hall, 410 Abbot Road, to check out the City of East Lansing’s newest public art installation: “Faces of the Community.” This commissioned public art piece was the result of a partnership between the East Lansing Arts Commission and East Lansing Art Festival (ELAF). The installation was created by local ceramic artist Doug DeLind with assistance from the community during this year’s ELAF. During the festival, community members of all ages were invited to carve their own personalized designs in a large slab of clay at an activity station near the Albert-Division intersection. From that clay, DeLind made raku-fired tiles that he mounted to large wooden boards and he completed the piece with abstract faces.

“We are so excited that East Lansing City Hall is now home to a piece of beautiful public art that so many of our community members had a hand in creating. We would like to thank artist Doug DeLind for his efforts to bring this creative concept to life,” said Wendy Wilmers Longpre, who serves at the City staff liaison to the East Lansing Arts Commission. “We encourage community members to stop by City Hall and check out the installation next time they are in the area. They just might spot their own artwork among the displayed tiles.”

PROJECT INFORMATION

INTRODUCTION TO PROJECT The City of East Lansing is requesting proposals from qualified arts and cultural planning consultants to develop a cultural arts plan to guide the East Lansing Public Art Program for the next five years. This plan will identify existing cultural resources and needs, establish cultural goals and priorities, and create a cohesive strategy for encouraging and supporting arts and culture in the City of East Lansing. BACKGROUND INFORMATION The City of East Lansing is located in south-central Michigan, adjacent to Michigan State University and within five (5) miles of the State Capitol. It has a population of over 48,000 residents, approximately 50% of which are Michigan State University students (see Attachment A, Location Map). East Lansing is the home to the world-renowned Broad Art Museum and has a long history of supporting arts and cultural activities.

• The East Lansing Art Festival is a preeminent arts event in the United States. The juried fine arts show celebrated its 56th year in 2019.

• The East Lansing Jazz Festival is a two-day festival that began in 1996 and grows in popularity annually.

• The Department of Parks, Recreation and Arts, the East Lansing Downtown Management Board and the East Lansing Downtown Development Authority sponsor numerous additional smaller festivals and community events throughout the year.

• East Lansing City Council appointed the first East Lansing Arts Commission and the Art Selection Panel in 19XX. The Commission is responsible for advising City Council on matters pertaining to the arts programs, promoting arts in the community, and implementing a public art program (see Attachment B, Arts Commission Ordinance).

• The City of East Lansing has a public art collection of sculptures, murals, paintings and other art works in excess of 60 pieces. The collection was started in 1967 (see Attachment C, Public Art Map).

PURPOSE OF THE PROJECT In 2014, the City of East Lansing adopted Ordinance 1339, the Public Art Ordinance, which legislates that all capital improvement projects undertaken in the City of East Lansing integrate public art into the project or contribute a percentage of the value of the project to the East Lansing Public Art Fund (see Attachment D, Ordinance 1339). Contributions from Ordinance 1339 subjected properties provide funds to support arts and cultural programs, events and art related purchases in the City of East Lansing.

The City of East Lansing is interested in developing a cultural arts plan to articulate a direction for the City arts and cultural program and identify methods to fully integrate arts and culture into the agency. The plan will also clarify the role of the City of East Lansing in supporting arts and culture in the region and identify ways in which East Lansing is uniquely positioned to be impactful in this work. The cultural arts plan will need to address the following (self-identified) challenges:

• Grant dollars to support the arts in general are scarce and, if available, often go to communities who are perceived to have a greater need.

• Lack of foundation money, limited sponsorship dollars, and an aging funding community make tapping additional individual and organizational resources extremely difficult and competitive.

• Attendance for festivals is declining. • The City of East Lansing has a long and complicated history with festivals and fairs

within its borders. There is a need for more clarity around the operations/involvement between the City of East Lansing and several arts organizations.

• Throughout the years, many communities have seen East Lansing as a leader in the development/support for the arts and culture. Today, mid-Michigan residents have significantly more opportunities to fill their cultural/creative needs than ever before as more municipal leaders understand the importance of art to a strong community and have included arts and culture as a part of their community development plans.

• Minority populations continue to be under-represented in arts and cultural events, programs and activities in East Lansing. Securing input and participation from marginalized populations (English language learners, differently abled, LGBTQUIA+, college students, etc.) remains an ongoing challenge.

• The City of East Lansing cannot create meaningful and sustainable arts and cultural opportunities solely by tapping ad hoc planning through volunteers. Developing and overseeing a robust arts and cultural plan within the City of East Lansing can be best supported by developing a position to serve the arts within the city administration. Currently, a few city staff members include the arts on their already crowded portfolio.

The following (self-identified) opportunities exist

• The City of East Lansing is currently providing some funding/support for the arts: o The City of East Lansing remains the only city in the State of Michigan with a

percent-for-art ordinance which is designated funding for public art to support the purchase, installation, and identification of public art in East Lansing as well as arts programming. An average of $10,000 is contributed annually by the City of East Lansing to support the Percent for Art program. These dollars have helped to raise more than $150,000 from private developers to add vibrancy, create an identity, and bring the community together in and through the arts.

o Cultural Arts Grants in the amount of $17,500 are allocated annually as small grants to artists, arts organizations, and creative practitioners to support programming/events.

• As the home of Michigan State University, East Lansing has untapped potential to better promote close cooperation between the city and all private citizens, institutions, and agencies interested in or conducting activities related to the arts in the city.

• Formulate in cooperation with private citizens, institutions, agencies and City agencies a long-range plan for development of a thriving cultural climate in East Lansing.

• Promote the arts in the community to include, but not be limited to, dissemination of knowledge with regard to the arts, recognizing local artists and their work when appropriate.

• Expand the cultural resources of East Lansing, thereby facilitating employment for artists and the development of self-sustaining arts programs.

• Work alongside city hall to grow opportunities for a sector that adds essential value to the City of East Lansing’s infrastructure.

SCOPE OF SERVICES

The following tasks are to be provided based on the City of East Lansing’s initial concept of the project. These tasks may be modified in each of the individual firm’s proposals to reflect their approach to the project. The selected Proposer shall complete execution of the items listed below, and as described further throughout this RFP. This effort involves the creation of a Public Art Master Plan, the process and product of which is to include, but not be limited to the following: Community Engagement

• Consultant will recommend methods to engage community cultural stakeholders in input sessions to influence the creation of the Cultural Plan, using a minimum of three methods which could include: surveys, community meetings, stakeholder interviews, charrettes, etc.

• Consultant will • Consultant will develop, organize, lead and analyze the findings from the chosen

community engagement activities. • City staff will assist in meeting coordination, invitations, and marketing of community

input sessions. Inventory and Assessment

• Consultant will perform a comprehensive inventory and assessment of the cultural assets and opportunities, including reviewing with existing polices, documents and local codes.

• Consultant will review the City of East Lansing Comprehensive Development Plan and recommend opportunities to integrate arts and culture.

Cultural Plan

• Consultant will produce a detailed narrative and illustrative document that presents a vision statement and 5-year strategic plan for implementation of a comprehensive Cultural Art Program in East Lansing.

• Consultant will produce a plan that demonstrates a comprehensive understanding of the current state of arts in East Lansing and will use a collaborative process to identify and analyze the cultural needs of the community.

INSTRUCTIONS TO CONSULTANTS TERMS & CONDITIONS

PROPOSALS All proposals must be submitted following the proposal format supplied by the City of East Lansing in this document and shall be subject to all requirements of this document. The City may consider as irregular any proposal in which there is an alteration of or departure from the format stated in the RFP Documents, and at its option may reject the same. The City of East Lansing, by policy, has several special directives and preferences for contractors. These include: small, minority, and women owned businesses, prevailing wage, local purchasing preference, green fleet purchasing provision, directives on environmental impacts and contractors providing other eligible individual benefits. There are some exceptions for these policy directives, therefore each firm shall include in its proposal: if the firm is a small, minority or woman owned business, if any craftsman, mechanics or laborers employed receive at least the prevailing wages and fringe benefits of the Building Trades Department for classes as determined by US Department of Labor for the Ingham County area, if the firm is a registered local or regional vendor, if the firm provides benefits to its employees, and if benefits are offered to other eligible individuals (i.e. domestic partners). Each firm shall include in its proposal, in the format requested thereof, the cost of performing the work. The prices set forth in the proposal submitted by each firm shall remain in effect for the duration stated for each phase of the project. Each firm shall include in their proposal a listing of each principal and the names of any proposed subcontractor and the name and address of each office which may be involved in the project. Before executing any subcontract, the successful firm shall submit the name and principals of any proposed subcontractor for prior approval. SUBMITTAL OF PROPOSALS Consultants may submit proposals by hard copy only. Three (3) copies of the proposal documents shall be submitted in a sealed envelope. If mailed, send the proposal to City of East Lansing, Attention Wendy Wilmers Longpre, 410 Abbot Road, East Lansing, MI, 48823. If hand delivered, submit the proposal to the Parks, Recreation, and Arts Department, 410 Abbot Road, East Lansing, MI.

The envelope shall be clearly marked on the exterior denoting the name of the firm submitting the proposal and “Cultural Art Master Plan Consultant Services”. The proposals shall be submitted by no later than 5:00 P.M., Tuesday, January 8, 2019. SIGNATURES Prior to awarding a contract, all proposals, notifications, claims and statements must be signed as follows:

CORPORATIONS: Signature of official shall be accompanied by a certified copy of the resolution of the Board of Directors authorizing the individual signing to bind the corporation. PARTNERSHIPS: Signatures of one partner shall be accompanied by a certified copy of the Power of Attorney authorizing the signing to bind all partners. If all partners sign the proposal no authorization is needed. LIMITED LIABILITY COMPANY: Signature of a member, or if organized on a managing member basis, a certified copy of a resolution appointing the signer as the managing member. INDIVIDUAL: No authorization is needed.

TYPE OF CONTRACT It is proposed that the contract entered into as a result of this RFP will have either a lump sum; hourly rate not to exceed cost; or hourly rate with an estimated cost for those tasks noted. Negotiations may be undertaken with those firms whose proposals show them to be qualified, responsible and capable of performing the work. The contract that may be entered into will be that one which is most advantageous to the City of East Lansing, price and other factors, considered. The City reserves the right to consider proposals or modifications thereof received at any time before the award is made, if such action is deemed to be in the best interest of the City. NO THIRD-PARTY RIGHTS It is agreed and understood that any contract is made solely for the benefit of the City of East Lansing and the Provider of Services; that it is not made for the benefit of any third party; and that no action or defense may be founded upon any contract except by the parties hereto.

INSURANCE The firm shall provide proof of professional liability insurance which shall insure against negligent acts, errors or omissions which occur as a result of professional services performed by the firm. If a contract is entered into, the firm and any subcontractor shall maintain such professional liability insurance during the life of the contract with limits of not less than $1,000,000.00 and, if written on a claims made basis, for a period of two years following the end of the contract. ORAL PRESENTATIONS Firms who submit a proposal may be required to make an oral presentation of their proposal to the City. If held, these presentations will provide an opportunity for the firm(s) to clarify their proposals and to ensure mutual understanding of its contents. The City will schedule any such presentations. BID AMENDMENTS & QUESTIONS If amendments are made to the project scope or description, each firm receiving this RFP will be notified via email, or another preferred contact method, to the primary contact. That contact will also receive responses to any questions posed to City staff from a potential responding firm. ACCEPTANCE OF PROPOSAL CONTENTS The contents of the proposal of the successful offerer will become contractual obligations, if a contract is executed. Failure of the successful firm to accept these obligations will result in cancellation of the award. CITY RESPONSIBILITIES The City of East Lansing will provide information as to the City’s requirements for the project and make available pertinent information which may be useful in the project work. The City will designate a person to act as the City’s Project Manager with respect to the work to be performed. Such person will have the authority to transmit instructions, receive information, interpret and define the City’s policies and decisions with respect to elements pertinent to the project. The City will examine all studies, reports, estimates, proposal, and other documents prepared by the firm and render in writing, if necessary, decisions pertinent thereto within a reasonable time. The City will direct the consultant in writing to begin the work on each phase of the project upon receipt of written evidence from the firm of the appropriateness of such action.

The City will direct the firm in writing to furnish any special services, sub-consultants and/or extra work that may be required on the project upon receipt of written evidence from the firm detailing as to cost, time schedule, and reason for such special service or extra work. CONTRACT PAYMENT SCHEDULE Payment for a contract entered into as a result of this request will be made monthly upon receipt of the firm’s billing invoice. The firm’s billing invoice should include detailed information regarding person-hours expended by classification and by task, as well as information regarding such items as mileage, materials, and other non-overhead costs. CITY OF EAST LANSING CONTRACT REQUIREMENTS The following City of East Lansing Contract requirements will be included in the contract (some exclusions may apply): Civil Rights Ordinance. Contractor agrees that it will comply with the City’s Civil Rights Ordinance, Article II, Chapter 22 of the Code of the City of East Lansing, which in part requires that an employer not discriminate against any employee or applicant for employment with respect to hire, tenure, terms, conditions, or privileges of employment including benefit plan or system, or a matter directly or indirectly related to employment because of religion, race, color, national origin, age, sex, height, weight, marital status, sexual orientation, gender identity or expression, or student status, because of the use by an individual of adaptive devices or aids, or because of an arrest record when a conviction did not result, except as allowed under Section 22-33(b)(6) of Chapter 22. Further, for contracts in which the total contract price will be $20,000.00 or more, the City’s Civil Rights ordinance also prohibits discrimination on the basis of marital status, sexual orientation, or gender identity or expression by the Contractor failing to provide employment benefits for employees with domestic partners that it otherwise provides for the spouse of a married employee. An employer may apply to the City Human Relations Commission for an exemption on the basis that religion, national origin, age, sex, height, weight, marital status, sexual orientation, gender identity or expression, or student status is a bona fide occupational qualification reasonably necessary to the normal operation of the business or enterprise. These requirements of Article II, Chapter 22, shall be considered material terms of this Agreement, and breach of any of these requirements will be regarded as a material breach of this Agreement. Independent Contractors. The parties agree that Contractor is an independent contractor as that term is commonly used and Contractor’s employees are not and shall not be considered subcontractors or employees of the City and has no authority to bind the City in any manner. Contractor shall be solely responsible for the withholding and reporting of all federal, state, and local income and employment taxes. Contractor acknowledges that it is not insured in any manner through the City for any bodily injury, personal injury, or property loss whatsoever. Limitation of Liability. Except for indemnification pursuant to this agreement, neither party shall be liable to the other, or any of their respective agents, representatives, or employees for any lost revenue, lost profits, loss of technology, rights or services, incidental, punitive, indirect, special or consequential damages, loss of data, or interruption or loss of use of service, even if advised of the

possibility of such damages, whether under theory of contract, tort (including negligence), strict liability or otherwise. Indemnity. Contractor shall, to the fullest extent permitted by law pursuant to MCL 691.991(2), defend, indemnify and hold harmless the City, and its elected and appointed officers, agents, servants, and employees from any and all claims, damages, losses, expenses, liability, judgment, or liens, including reasonable attorney fees and other costs of defense arising out of any acts, errors or omissions or the discharge, release or escape of contaminants or hazardous substances by Contractor or by anyone acting on their behalf under or in any matter connected with this agreement. Contractor’s obligations to indemnify the City shall survive the expiration, non-renewal, or termination of this Agreement. Liability Insurance. Contractor shall obtain and maintain in full force and effect during the entire term of this agreement a policy of comprehensive general liability insurance, including professional errors and omissions, with limits of liability of not less than $1,000,000 and workers disability compensation insurance in compliance with Michigan’s statutory limits, and shall provide a certificate of insurance to the City naming the City as a certificate holder, which certificate shall provide that the City shall receive at least 30 days prior written notice of cancellation or nonrenewal of such insurance. Non-Assignment. The parties agree that there shall be no authority on the part of Contractor to subcontract, assign, or otherwise dispose of any portion of the services to be performed herein without the prior written approval of the City. In the event that the City approves a subcontract, assignment, or disposition, Contractor solely shall be responsible for managing, directing and paying the subcontractors or assignees, and the City shall have no obligations whatsoever toward said subcontractors or assignees. Consent to subcontract, assign, or otherwise dispose of any portion of this Agreement shall not be construed to relieve Contractor of any responsibility for the fulfillment of this Agreement. Criminal Background Investigation Requirement. (for work not in an area with LEIN access) The City of East Lansing requires satisfactory completion of a criminal background investigation for all persons having access to City facilities under this Contract. The Contractor will be required to provide to the City a list of all employees and employees of Sub-Contractors who are proposed to be working under this Contract within 10 days of award of Contract. This list shall include the full name, date of birth, and drivers license number of each employee, and any aliases of each employee including maiden names. The Contractor shall investigate the listed employees proposed to work under this Contract using the Michigan Internet Criminal History Access Tool (IChAT), the central registry for child abuse and neglect, the Michigan Sexual Offenders Registry, the Michigan Department of Corrections website, as well as a review of driving records and provide that information to the City of East Lansing.

The City of East Lansing reserves the right to limit areas of access for individual employees, to prohibit certain employees’ work in City facilities under this Contract, or to otherwise limit or

restrict any employee’s access to any City facility or portion of City facility, based on the information provided, as the City deems to be in its best interest.

CONTENTS OF PROPOSAL As a minimum each proposal shall include the following items: BUSINESS ORGANIZATION State the full name and address of your organization, and if applicable, any branch offices or other subordinate elements that will perform or assist in performing the work. Indicate whether you operate as an individual, partnership, limited liability company or corporation. If a corporation or limited liability Company, indicate the State in which you are incorporated. Provide proof or certification of license to operate in the State of Michigan. Also, please note if your organization is currently a registered local or regional vendor with the City of East Lansing. APPLICABLE EXPERIENCE Include a brief description of 5 projects of similar scope that your firm has completed in the last 10 years. Highlights from example studies, models, and other work products can be included. APPROACH TO THE PROJECT Describe in narrative form your technical plan for accomplishing the work. Explain the choice of methodology including its strengths and weaknesses. Provide a time line indicating each event task and decision points in your work plan. PROJECT STAFFING Identify the key professional personnel by skill and qualification that will be employed in the work and include their resumes. Indicate where these individual personnel will be physically located during the time they are engaged in the work. AUTHORIZED NEGOTIATIONS Include the names and telephone numbers of those persons in your organization authorized to negotiate the proposed contract with the City of East Lansing. CUSTOMER REFERENCES Include three customer references with contact names, phone number and e-mail address. ADDITIONAL INFORMATION The firm may also include any additional information and/or comments believed to be pertinent but not specifically requested elsewhere in the document.

EVALUATION OF PROPOSALS

All proposals received shall be subject to an evaluation by representatives of the City.

AWARD OF CONTRACT/REJECTION OF PROPOSALS The contract will be awarded to the firm who provides a proposal that is most responsive to meeting both the needs of the project and the City of East Lansing. The City reserves the right to reject any and all proposals and to waive any irregularity in proposals received whenever such rejection or waiver is in the best interest of the City. The firm to whom the award is made will be notified at the earliest possible date. All firms submitting proposals will be notified when the award is made. The contract shall be considered executed after the City of East Lansing City Manager or other designated official signs it. The following factors will be considered in making the final selection: VERIFICATION Will be based on the verifiable information provided about the firm, including but not limited to: entity name, principals, incorporation, licensing, and customer references. UNDERSTANDING OF THE PROJECT/PROBLEM Will be based upon the understanding exhibited by the firm in statements of work presented in the proposal. METHOD OF APPROACH Will be based upon the technical soundness of the firm’s stated approach to the project, the comprehensiveness of the proposed work tasks, the techniques to be used and the products to be delivered. EXPERIENCE Will be based upon applicable experience of the firm and key team members with similar type projects within the recent past. TIME & EFFORT Will be based upon a review of the time-line for each task (presented in bar chart), designated decision points, the critical path, the total time necessary to accomplish the work, and the firm’s acknowledgement of any critical deadlines.
