Artistic Swimming Australia Incorporated (ASAI) By-Laws shall be read in conjunction with the Constitution of Artistic

Swimming Australia Inc.

1 Interpretation

In these By-Laws:

ASAI means Artistic Swimming Australia Incorporated

Artistic Swimmer means an individual member registered in a swimming related membership category (any level of

ability or program).

ASAI Athletes’ Representative means the person appointed in accordance with the constitution to act as Chair of the

Athlete Commission and be the liaison between the Athlete Commission and the Board.

ASAI Athletes’ Commission means the committee of athletes comprising of an athlete from each Member Association

(selected by each Member Association)

Board means the Board elected in accordance with ASAI Constitution

By-Laws means these By-Laws made by the Board under Rule 43 of the ASAI Constitution

Clubs means organizations affiliated to Member Associations

Competitions means and includes:

International competition

• Any international competition, series, meet or championship at which ASAI is represented

• Any international competition, series, meet or championships at which a club or State Member Association is

represented (must have clearance by ASAI to attend)

Australian competition

• Any championships (national or otherwise) organized or conducted by a Member Association for or on behalf of ASAI

• Any championships, competition, series or meet sponsored by or conducted by or on behalf of ASAI; or

• Any international competition, series, meet or championship at which ASAI is represented

State competition

• Any championships, competition, series or meet sponsored by or conducted by or on behalf of a State Member

Association

• Any championships, competition, series or meet sponsored by or conducted by or on behalf of a Club

Competitor means an artistic swimmer who competes in any form or level of competition

Constitution means the Constitution of ASAI

Council means the body, comprised of the State Councillors’ and the Athlete Commission Representative who are

entitled, as a right (and not by invitation), to be present and vote at General meetings of ASAI.

Councillor means the person elected or appointed from time to time by a Member association to act for and on behalf

of that Member Association and represent the Member Association at General Meetings and includes Alternate State

Councillors (where appointed)

Director means a member of the Board (other than the National Executive Director) and includes any person acting in

that capacity from time to time.

FINA means the Federation Internationale de Natation or its successor or assignee responsible for the administration of

natatorial activities internationally.

Financial Year means the year ending 30 June each year

General Meeting means the Annual or any Special General meeting of ASAI.

Individual Member means a registered financial member of a Member Association and/or a Club, may or may not

include Participants.

Intellectual Property means all rights or goodwill subsisting in copyright, business names, names, trademarks (or signs),

logos, designs, patents or service marks (whether registered or registrable) relating to ASAI or any Event, competition,

championship, meeting or Artistic Swimming activity of or conducted, promoted or administered by ASAI.

Judiciary Committee means a committee of ASAI having such functions as set out in ASAI Constitution Rule 18.

Life Member means an individual upon whom Life Membership of ASAI has been conferred under ASAI Constitution

Rule 12(4).

Member means a member for the time being of ASAI under ASAI Constitution Rule 12.

Member Association means and includes those entities recognized under ASAI Constitution Rule 10(1).

National Executive Director means the National Executive Director of ASAI for the time being appointed under this

Constitution or in the absence of an appointed National Executive Director, a member of the Board or such other person

or persons the Board appoints or delegates from time to time.

Office Bearer means and includes any of the following: Coaching Director, Judging Director, Technical Director,

Recreation/Participation Director, Public Relations Director and/or Publicity Director and National Registrar.

Official means any person elected or appointed to any position within ASAI or the Member Associations.

President means the President for the time being of ASAI.

Recreation athlete / Participant means any athlete who participates in any Artistic Swimming Activity other than any

level of competition

State means a State of Australia and includes (where appropriate) the Territories of Australia.

2 FINA Rules

2.1 The FINA rules shall be binding on all competitions held in Australia

2.2 ASAI may make rules for domestic competition to supplement and/or vary FINA rules

2.3 ASAI will, as soon as possible, notify all Member Associations of any alterations or amendments to FINA

rules.

2.4 The alterations/amendments shall become operative as soon as possible, but no later than 12 months,

from the date of notification from FINA.

2.5 Where no provision is made in the rules, ASAI may make application to FINA for a ruling on a Technical

matter. No individual member may contact FINA independently.

3 Procedures for General Meetings

3.1 Where procedural matters for General Meetings are not covered in the ASAI Constitution or By-Laws, the chair shall refer to PlaybytheRules.net.au guidelines.

3.2 When possible, the Annual General Meeting will follow the following format: 3.2.1 Be held on a weekend

3.2.2 Be held over two days

3.2.3 Commence approximately 1 pm to allow travel from other states

3.2.4 Conclude approximately 1 pm on the second day to allow travel home to other states

3.2.5 Include presentations with allotted time frames from each Member Association, High

Performance, Strategic Plan and other sections as appropriate and dependent on resources in

the location

3.2.6 The last two hours of the scheduled timetable to allow a meeting of old and new board for a

face to face handover and exchange of knowledge

3.2.7 Billeting or centralized accommodation to be arranged when possible to minimize costs for ASAI

and each Member State Association

4 Board Directors reimbursable costs

4.1 Nationals - Travel allowance for Directors to attend Nationals (when a board meeting is held), will not

exceed the best available economy airfare and reasonable ground transport costs. Flights are to be

booked by, or in consultation with, the High-Performance Program Manager. No accommodation

allowance is payable.

4.2 AGM - Travel allowance for Directors to the Annual General Meeting will not exceed the best available

economy airfare and reasonable ground transport. Flights are to be booked by, or in consultation with,

the High-Performance Program Manager. Travel allowance is not covered retrospectively for a Director

for the AGM they are initially elected at.

4.3 An accommodation allowance for Directors will not exceed $150 per person per night when

accommodation is necessary.

4.4 No accommodation allowance is payable for Nationals

4.5 One night’s accommodation is payable for AGM when held over two (2) days. For Directors with flight

time in excess of 4 hours each way, a second nights accommodation may be payable.

4.6 The necessitation of accommodation must be approved by the Board in all instances.

4.7 Directors may claim any genuine cost incurred whilst performing the business of ASAI providing the cost

can be substantiated and the cheapest option available was used. Receipts must be provided.

5 Councillors

5.1 All Member Associations are responsible for an equal share of the travel cost of all Councillors attending

the ASAI Annual General Meeting or Extraordinary General Meeting

5.2 Travel Cost includes

5.3 The cheapest available economy flight

5.4 The cheapest available ground transport (if necessary)

5.5 The cheapest available share accommodation (if necessary) or billeting fee (as per ASAI billeting policy),

one night only when meetings are scheduled over two days. If flight time (each way) is in excess of four

(4) hours, one (1) additional night’s accommodation may be required for the evening prior to the

commencement of the meeting.

5.6 Member Associations shall submit copies of receipts for the travel cost incurred by their respective

Councillor to attend the ASAI Annual General Meeting or Extraordinary General Meeting to the ASAI

Treasurer.

5.7 ASAI Treasurer will calculate the total cost of the travelling Member Associations councillors and apportion

an equal share to all member associations. Member Associations will receive either a reimbursement if

their costs were greater than the equal share value, or an invoice if their cost was less than the equal

share value.

6 Athletes’ Representative and Commission

6.1 An athletes’ Commission will be formed consisting of an Athlete Representative from each Member

Association (each Member Association representative shall be a registered Artistic Swimming member of

18 years of age or over, selected by their Member Association)

6.2 ASAI board will appoint an ASAI Athletes’ representative from the Commission within eight (8) weeks of

the AGM being held

6.3 The ASAI Athletes’ Representative shall chair the Athletes’ Commission and be the liaison between the

Athletes’ Commission and the ASAI Board.

6.4 The Athletes’ Commission will meet at least four (4) times per year

6.5 The ASAI Athletes’ Representative will provide a written report to be a part of the ASAI annual report presented to members at the AGM

6.6 To minimize costs to the Association, the Athlete Representative to attend the AGM and cast the Athlete Representative vote will be the Athlete Representative of the Member Association on the Athletes commission from the State in which the AGM is held. If the ASAI Athlete Representative is from a different state, a proxy vote will be provided to facilitate the Athlete Representative vote.

7 Directors

7.1 President

7.1.1 Subject to ASAI Constitution Rule 34(2), the President is the Chairperson for any general

meetings and for any Board meetings.

7.1.2 Shall be the senior spokesperson on behalf of ASAI, representing it to further the objectives, as a

true representative of the Board’s vision and not as a lone entity.

7.1.3 Shall allocate portfolios to respective Board Directors

7.1.4 Shall be available for meetings and liaison for the purpose of management of the business,

policies and affairs of ASAI.

7.1.5 Shall consult with and obtain advice from the Office Bearers of ASAI

7.1.6 Shall, in conjunction with other Board Directors, monitor and review the current Strategic Plan

with attention to new and emerging issues.

7.1.7 Shall liaise with Member Associations to ensure a commitment from States and Clubs to unite in

the National direction

7.1.8 Shall, in conjunction with the National Executive Director and Promotions Officer, endeavor to

secure sponsorship, and/or maintain current relationships, for ASAI

7.1.9 Shall report to the Board on a monthly basis on all business matters

7.1.10 Other activities as may be deemed necessary from time to time

7.2 Vice Presidents and Independent Board Directors

7.2.1 Subject to ASAI Constitution Rule 34(2), in the President's absence, a Vice-President is the

Chairperson for any general meetings and for any Board meetings

7.2.2 Shall represent the interests of ASAI to further the objectives of the Association

7.2.3 Shall be available for meetings and liaison for the purposes of management of the business, policy

and affairs of ASAI

7.2.4 Shall consult with and obtain advice from the Office Bearers of ASAI

7.2.5 Shall contribute to the formation of the ASAI Strategic Plan in conjunction with other officers of

ASAI

7.2.6 Shall act to implement the ASAI Strategic Plan and shall be responsible for implementation of the

sections of the ASAI Strategic Plan

7.2.7 Shall report to the Board on a monthly basis on matters from their portfolio or other ASAI business

matters

7.3 Independent Board Directors

7.3.1 Shall represent the interests of ASAI to further the objectives of the Association

7.3.2 Shall be available for meetings and liaison for the purposes of management of the business, policy

and affairs of ASAI

7.3.3 Shall consult with and obtain advice from the Office Bearers of ASAI

7.3.4 Shall contribute to the formation of the ASAI Strategic Plan in conjunction with other officers of

ASAI

7.3.5 Shall act to implement the ASAI Strategic Plan and shall be responsible for implementation of the

sections of the ASAI Strategic Plan

7.3.6 Shall report to the Board on a monthly basis on matters from their portfolio or other ASAI business

matters

7.4 Secretary

7.4.1 Shall receive, maintain, manage and disseminate all correspondence to Board Directors, Member

Associations, individual members, other Organizations and any other party.

7.4.2 Shall prepare the Agenda for meetings of the Board

7.4.3 Shall prepare the Agenda and distribute relevant paperwork to members for any General meetings

7.4.4 Shall record and maintain minutes of Board meetings and any Board decisions determined outside

of a meeting

7.4.5 The Secretary must perform any duty or function required under the Act to be performed by the

secretary of an incorporated association

7.4.6 The Secretary must be a resident in Australia

7.4.7 The Secretary must maintain the register of members in accordance with ASAI constitution rule 18

7.4.8 The Secretary must keep custody of the common seal of the Association and, except for the

financial records referred to in ASAI Constitution Rule 30(2), all books, documents and securities of

ASAI in accordance with ASAI Constitution Rules 47 and 44

7.4.9 Shall, subject to the Act and these Rules, provide members with access to the register of members,

the minutes of general meetings and other books and documents; and (d) perform any other duty

or function imposed on the Secretary by these Rules.

7.4.10 Shall liaise with and submit annual returns to the Consumer Affairs Victoria.

7.4.11 Shall, once elected, give to the Registrar (Consumer Affairs Victoria) notice of their position within

fourteen (14) days

7.4.12 Once elected, the Secretary shall continue in this position until replaced by the Board or when

their office becomes vacant in accordance with the Act and the ASAI Constitution Rules.

7.4.13 If the Secretary should retire then the Board shall appoint a replacement in accordance with these

Rules within the time prescribed by the Act for such replacement.

7.4.14 If a new Secretary cannot be appointed within the fourteen (14) days specified an ‘interim’

Secretary is to be appointed.

7.5 Treasurer

7.5.1 Shall be responsible for the Financial management of the Association under the direction of the

Board and within the bounds of the budget as approved by Council

7.5.2 Shall prepare and present financial statements and budgets to the board on a monthly basis

7.5.3 Shall receive all moneys paid to or received by the Association and issue receipts for those moneys

in the name of the Association

7.5.4 Shall ensure that all moneys received are paid into the account of the Association within five (5)

working days after receipt

7.5.5 Shall make any payments authorized by the Board or by a general meeting of the Association from

the Association's funds

7.5.6 Shall ensure at least two (2) Board Directors authorize any electronic payment from ASAI’s bank

account(s)

7.5.7 Shall ensure that the financial records of ASAI are kept in accordance with the Act

7.5.8 Shall coordinate the preparation of the financial statements of ASAI and their certification by the

Board prior to their submission to the Annual General Meeting

7.5.9 Shall ensure that at least one (1) other Board Director has access to the accounts and financial

records of ASAI

8 National Executive Director

8.1 Please refer to ASAI constitution for appointment, conditions and duties 8.2 Shall perform Day to day tasks including, but not limited to:

8.2.1 Assistance to Secretary and Treasurer with their duties as required 8.2.2 Liaising with Board Directors

8.2.3 Working in conjunction with the Member Association which will host the Australian Artistic

Swimming Championships

8.2.4 Liaising with Peak Sporting Organizations in conjunction with the President and Secretary

8.2.5 Other tasks and agreed by the Board

8.3 When no NED is appointed, the roles will be performed by the Board, with communication via the

Secretary

9 High Performance Program Manager

9.1 Shall prepare all documentation required for HP Program

9.2 Shall book all flights, accommodation, venues and specialists required for HP Program

9.3 Shall ensure all Policies are in place for HP Program

9.4 Shall attend monthly Board Meetings

9.5 Shall be the contact for all HP athletes, coaches and officials for any HP program or International

competitions

9.6 Shall submit all documentation and entries required for any international competitions

9.7 Shall manage all Anti-Doping procedures in accordance with the current Anti-Doping Policy

9.8 Shall be a member of the HP Committee

9.9 Shall prepare a HP report for the ASAI Annual General Meeting

9.10 Shall present a HP program information session at Nationals for athletes and families currently on or

potentially interested in future HP programs.

9.11 Shall perform other tasks as agreed by the Board

10 Office Bearers

10.1 Office Bearers are responsible to the Board and are subject to direction as per the ASAI Constitution

10.2 Office Bearers are appointed by the Board as per the ASAI Constitution

10.3 Judging Director

10.3.1 Judging Director position to be rotated between all States

10.3.2 On new appointment by ASAI board, previous Judging Director will assist new Judging Director in

a three (3) month transition for effective transfer of duties and knowledge

10.3.3 Judging Director to chair judging committee and to be liaison with ASAI board

10.3.4 Shall develop/source, implement and review Judge education courses across Australia utilizing

FINA resources and education

10.3.5 Shall encourage, monitor and assist in Judge education courses at all levels

10.3.6 Shall apply for FINA judging schools to be held in Australia in consultation with ASAI board.

10.3.7 Shall ensure all judges are kept informed of FINA judge schools and opportunities internationally

10.3.8 Shall ensure all Judging procedures are current and comply with FINA and/or Australian rules

10.3.9 Shall cause to be kept and maintain records of all Judges and their level of qualification

10.3.10 Shall prepare all required documentation for FINA Judges certification (annually) and assist

judges as needed

10.3.11 Shall prepare a list annually, of judges to travel with National teams for board approval

10.3.12 Shall liaise with High Performance Manager to ensure correct entry of judges into FINA online

system as access to the system needs to be limited due to importance of information contained

within that system

10.3.13 Shall ensure all judges attending international events are fully aware of their roles and

responsibilities when judging internationally, including a report of the event to the board.

10.3.14 Shall maintain a register of events any judges have attended international competitions

10.3.15 Shall formulate a panel of Selectors (minimum of 5, maximum of 9) based on criteria in ASAI

Bylaw 12 Selectors and submit to the Board annually for ratification.

10.3.16 Shall formulate the judging panels (from Selectors), for each selection event and submit to the

board for ratification.

10.3.17 Shall recommend to the board an Evaluator for the Australian Championships, and/or any

national/international event held in Australia that an evaluator be invited to attend (evaluator

will be based on international feedback and also requirements for the Australian international

Judges annual evaluation requirements).

10.3.18 Shall make recommendations to the Board of ASAI on all Judging related matters.

10.3.19 Shall maintain open communication with Member Association Judging Directors and conduct at least one face to face meeting with Member Association Judging Directors (at Nationals, or if not possible, to be programmed, a conference/internet meeting may be held) each calendar year to formulate the Judging component of the ASAI Strategic Plan.

10.3.20 Shall present a Budget Forecast for the Judging component of the ASAI Strategic Plan to the NED not later than the end of July each year.

10.3.21 Shall submit an annual report and a financial statement to the NED not later than the end of July each year.

10.3.22 In conjunction with the Board and Member Association Judging Directors shall develop, initiate and co-ordinate policy which implements the Judging component of the ASAI strategic plan.

10.3.23 Shall report to each General Meeting of the Association and to the Board at regular periods in

between, the progress of Strategic Plan initiatives.

10.4 Coaching Director

10.4.1 Shall develop, implement and review Coach Education and accreditation courses in accordance

with Australian Coaching Council guidelines.

10.4.2 Shall encourage, monitor and assist in Coach education courses at all levels.

10.4.3 Shall cause to be kept and maintained records of all Coaches and their level of qualification.

10.4.4 Shall make recommendations to the Board of ASAI on all Coaching related matters except those

under the jurisdiction of the National Team Coach

10.4.5 Shall liaise with the Australian Coaching Council.

10.4.6 Shall maintain open communication with Member Association Coaching Directors and conduct

at least one face to face meeting with Member Association Coaching Directors each calendar

year to formulate the Coaching component of the ASAI strategic plan

10.4.7 Shall present a Budget Forecast for the Coaching component of the ASAI Strategic Plan to the

NED not later than the end of July each year.

10.4.8 Shall submit an annual report and a financial statement to the NED no later than the end of July

each year.

10.4.9 In conjunction with the Board and Member Association Coaching Directors shall develop, initiate

and co-ordinate policy which implements the Coaching component of the ASAI strategic plan.

10.4.10 Shall report to each General Meeting of the Association and to the Board at regular periods in

between, the progress of the Strategic Plan initiatives.

10.5 Public Relations Director and or Publicity Director

10.5.1 This may be two (2) roles or a joint role as determined by the Board

10.5.2 Shall in conjunction with the President and National Executive Director endeavor to secure

sponsorship for the Association

10.5.3 Shall pro-actively identify opportunities for exposure of Artistic Swimming in all forms of media

and to interested parties

10.5.4 Shall make recommendations to the Board of ASAI on all public relation matters

10.5.5 Shall maintain open communication with Member Association Public Relations Directors and

conduct at least one meeting per year (via skype or similar means) to formulate the Marketing

and Publicity component of the ASAI strategic plan.

10.5.6 Shall present a Budget forecast for the Marketing and Publicity component of the Strategic plan

to the NED no later than the end of July each year

10.5.7 Shall submit an annual report and a financial statement to the NED no later than the end of July

each year.

10.5.8 In conjunction with the Board and Member Association Public Relations Directors, shall develop,

initiate and co-ordinate policy which implements the Marketing and Publicity component of the

Strategic plan.

10.5.9 Shall submit a report in writing to each General Meeting of the Association and to the Board at

regular periods in between, the progress of the Strategic plan initiatives.

10.5.10 Shall liaise with Member Association Publicity Directors to:

10.5.11 Co-ordinate, draft and publish ASAI newsletter and regular articles in the print media

10.5.12 Maintain a comprehensive record of media coverage and High-Performance athlete profiles in all

Member Associations.

10.5.13 Shall liaise with the High-Performance Manager to ensure effective promotion of National Teams

or Squads.

10.5.14 Shall liaise with Web Administrator to ensure maintenance of website is current

10.5.15 Shall adopt web-based and social media solutions to ensure a positive presence of Artistic

Swimming both at National and International level

10.6 Technical Director

10.6.1 Shall develop, implement and review Officials (volunteers) education courses

10.6.2 Shall encourage, monitor and assist in Officials (volunteers) education courses at all levels

10.6.3 Shall ensure that all Officiating (Volunteering) procedures are current and comply with FINA

and/or Australian rules.

10.6.4 Shall cause to be kept and maintained records and Qualification levels of all Scorers, Referees,

Assistant Referee, Competition Manager, Music Controller and Timekeepers.

10.6.5 Shall make recommendations to the ASAI Board and shall act as an advisor to Member

Associations on all Technical related matters.

10.6.6 Shall liaise with the National Executive Director and National Judging Direct concerning the

technicalities for the preparation of any National or International competition in Australia.

10.6.7 Shall maintain open communication with the Judging Director, Coaching Director and Recreation

Director and their committees to formulate the Technical Component of the Strategic Plan.

10.6.8 Shall develop, initiate and co-ordinate policy which implements the Technical component of the

ASAI Strategic Plan.

10.6.9 Shall present a Budget forecast for the Technical component of the ASAI strategic plan to the NED

no later than the end of July each year

10.6.10 Shall submit an annual written report and a financial statement to the NED no later than the end

of July each year.

10.6.11 Shall submit a written report to each General Meeting of the Association and to the board at

regular periods in between, the progress of the Strategic Plan initiatives.

10.6.12 Shall liaise with the Oceania TASC representative and circulate all information received from

them.

10.7 Recreational Director

10.7.1 Liaise with Member Associations to assist with Recreational/Participation programs and

development of Artistic Swimming at the grass roots level.

10.8 National Registrar

10.8.1 Shall liaise with all Member Associations and Clubs to ensure that all members are registered as

per the registration policy in the Revolutionise Portals

10.8.2 Shall cause to be kept and maintained records of all members in the following areas:

10.8.2.1 Life members

10.8.2.2 Recreation / Participation members

10.8.2.3 Competitors

10.8.2.4 Officials

10.8.2.5 Other members

10.8.3 Shall submit an annual report and a financial statement to the NED no later than the end of July

each year. Shall provide a written report to each General meeting of the Association and to the

Board at other times when requested.

11 High Performance Committee

11.1 Minimum of one (1) member from each Member Association

11.2 Members to be selected by Board annually from nominations received, or invited members

11.3 High Performance Manager to be a member of the HPC

11.4 Members of HPC should be experienced in High performance programs and have a broad knowledge of the

sport

11.5 HPC meetings to be held monthly or as required by online meetings

11.6 HPC Chair to be elected annually by the HPC

11.7 HPC Chair to liaise with the ASAI board

11.8 Shall develop National High-Performance program for all age group ASAI National Teams

12.3 Selector Panels for each round of selections will be based on the above criteria, and well as consideration

of the following:

12.4 The Judging Director will ensure the selection panel has the full selection criteria to study prior to the

12.5 The costs of any flights, ground travel and accommodation required will be at the expense of ASAI if pre-

arranged with the High-Performance Manager

12.6 Selectors will receive a per diem of $50 per day of selections (excluding travel days) except when attending

events per diem is payable by FINA.

13 Scoring committee

13.1 A scoring committee (consisting of one member from each Member Association) will be appointed to

ensure all Member Associations have the current information required for effective utilization of the

program.

13.2 A FINA approved scoring system must be used at the Australian Championships. The current system

utilized by ASAI is the ISS MMS scoring system. This system was purchased by ASAI for use by all Member

Associations.

13.3 A scoring manual has been produced and indicates the processes to be used during any competitions

conducted by or on behalf of ASAI.

13.4 States may adapt the manual for use within their specific states to meet their state requirements.

14 High Performance Team Positions

14.1 High Performance squad/teams include (additional National Teams may be included at ASAI board

discretion, with some squads/teams not having competition programs every year):

15 International Competition Participation

15.1 Any Australian Representation at International competitions must be selected as per the current ASAI

selection policy and criteria.

15.2 All competitors, officials, coaches, team managers and any other support staff must be registered and

financial members of ASAI prior to the competition.

15.3 No individual, Club or Member Association may enter a competition as Australia.

15.4 All policies must be adhered to by competitors, officials and team personnel.

15.5 The ASAI HP Program will adhere to FINA rule GR2.5. To be a member of a National Team, athletes must

be Australian Citizens, and have a valid AUS passport with at least six (6) months expiry beyond the

competition travel dates.

16 Club or State Representation at International Events

16.1 Prior to nomination, any athletes or officials, wishing to represent their Club or State at any International

competition must obtain clearance from the ASAI board to nominate for the International competition.

16.2 Application to ASAI should include

16.2.1 Club or State name

16.2.2 Competitors names

16.2.3 Intended nominations

16.2.4 Previous results for the intended nomination

16.2.5 Name of any coach, officials and team personnel travelling with the athletes

16.3 Clubs or States must ensure that the nomination is from the Club/State (not an Australia entry) and no

Australian uniform is worn at the competition by the athlete, coach, team manager or any officials.

16.4 All competitors, officials, coaches, team managers and any other support staff must be registered and

financial members of ASAI prior to the competition.

16.5 Masters World Championships are club entries (not Australian entry). Athletes are required to have

competed at the preceding National or State Championships and submit official results to board to obtain

clearance to represent their club (no selection criteria are applicable, merely to demonstrate they have

fulfilled this requirement).

17 Registration

18 Logo and Colours

18.1 The colours of the Association shall be green and gold

20 Australian Championships

20.1 A Member Association or Club shall not conduct any competition which shall have the title of “Australian

Championships”, “National Championships” or any other title implying it is an Australian or National

competition without the authorization of ASAI.

20.2 The scoring system used at any National Competition must be a FINA approved system. The current

System utilized in Australia is the ISS MMS for which ASAI has authorized use of. The latest version must

be used.

20.3 The Australian Championships are to be held annually, the last weekend of March (unless that weekend

falls on Easter or a major event in the host city, when the date may be moved one to two weeks either

side in consultation with ASAI)

20.4 The Australian Championships will be held on a rotational basis between Member Associations in the

following order:

• Western Australia

• Victoria

• Queensland

• New South Wales

20.5 If a Member Association is unable to host, or for other reasons determined by the Board, another Member

Association will be invited to host the Championships.

20.6 Dates and venue for the following Championships are to be announced at the preceding Championships

20.7 Host Member Associations are responsible for all costs associated with the Championships unless stated in

these Bylaws that ASAI will fund the cost.

20.8 Medals

20.8.1 Any medals remaining from the previous Championships will be forwarded to the new host

State.

20.8.2 ASAI will fund the cost of any additional medals required purchased from the ASAI appointed

supplier, provided points 20.8.3, 20.8.4, 20.8.5 and 20.8.6 are followed.

20.8.3 Medals are not to be engraved prior to presentations

20.8.4 Host State will arrange an engraver to be onsite so that competitors may, at their own cost,

have medals engraved or

20.8.5 Host State may, at their own cost, have plaques engraved for the back of the medals. These are

NOT to be applied until the final results are known so that there will be no wastage of medals as

the medals cannot be reused once a plaque has been applied, unless another plaque is used,

and the following years host state may not want to incur that cost

20.8.6 The Lanyard/ribbon upon which the medal hangs should be generic Australian Championship

with no date or state printed to ensure suitability for use at future Australian Championships

20.8.7 Refer to Australian Rules, Awards in regard to multiple medals for International and Australian

Competitors and also reserves.

20.9 Referee

20.9.1 Host state may nominate a preferred referee to the ASAI Board at least four (4) months prior to

the Championships

20.9.2 The ASAI Board will appoint the referee in consultation with the National Judging Director

20.9.3 The Referee will be appointed at least three (3) months prior to the championships

20.9.4 The Referee shall conduct the event in accordance with FINA and Australian rules

20.10 Jury of Appeal

20.10.1 Jury to be appointed by President of ASAI prior to event.

20.10.2 Jury to consist of a representative from each Member Association

20.10.3 Jury not to include referee or judge from event

20.10.4 Each member shall have one vote except if conflict of interest applies

20.11 Chief Scorer

20.11.1 Host state may nominate a preferred Chief Scorer to the ASAI Board at least 3 months prior to

the Championships (must be a member of the Scoring Committee)

20.11.2 The ASAI Board will appoint the Chief Scorer

20.11.3 The Chief Scorer will be appointed at least two (2) months prior to the championships

20.11.4 The Chief Scorer shall score the event in accordance with FINA and Australian rules

20.12 Meet Manager

20.12.1 Host Member Association to advise ASAI board of Meet Manager within one (1) month of the

preceding championships.

20.13 Judging Panels

20.13.1 Host Member Association is to obtain judges names from Clubs, including judge experience,

conflict of interest and availability.

20.13.2 Referee to compile judge panels and submit to National Judging Director for review. NJD will

discuss any required amendments with referee to finalize panels. Referee may request

National Judge Director to compile judge panels

20.13.3 Priority to ensure evaluations are given to FINA listed judges.

20.13.4 Judging panels to be submitted for approval by ASAI board at least one (1) month prior to the

Championships

20.13.5 The list of Australian club judges to be sent to National registrar at least one (1) month prior to

Championships to ensure all judges are correctly registered and have current Working with

Children check

20.14 Competitor and entry check

20.14.1 The list of Australian club entries is to be supplied to National Registrar to ensure all entries are

registered correctly and entered with the correct spelling and date of birth at least six (6) weeks

prior to the commencement of the championships

20.14.2 National Registrar to confirm correct registration, spelling of name and date of birth to Meet

Manager and Referee at least one (1) month prior to commencement of championships

20.14.3 The list of international entries, along with copy of passport, to be supplied to Meet Manager

and Referee to confirm spelling of name and date of birth at least one (1) month prior to

commencement of championships

20.14.4 Referee to receive entries to ensure all entries conform with FINA and Australian rules

20.15 Coach Championship Accreditations

20.15.1 Australian club coaches will only be issued Championships accreditation to coach poolside

during the Championship if they are a Current Australian Accredited Level One Coach

20.15.2 A list of coaches applying for Championship accreditation is to be provided to the National

Coaching Director at least one (1) month prior the Championships to confirm each coach has

20.15.3 Correct current coaching accreditation level

20.16 Team Personnel Accreditations

20.16.1 The list of Team Personnel should be submitted to National Registrar to ensure all are correctly

registered and have current Working with Children check in order to be granted Championship

accreditation

20.17 Championship Accreditations

20.17.1 Should be color coded to ensure easy identification

20.17.2 Where an individual is in multiple accreditation classifications (eg. competitor, judge and coach),

all colours should appear on the single accreditation for easy identification.

20.17.3 No individual is to be on deck without appropriate accreditation.

20.18 Presentations

20.18.1 Should be held throughout the Championships on the day of the applicable event whenever

possible

20.18.2 The Member Association hosting the Championships should arrange VIP’s to present medals and

the Club Championship trophy.

20.18.3 If requested, a Member Association will incorporate any VIP’s nominated by ASAI to be included

in the presentations.

20.18.4 Refer to ASAI bylaw 21.22 Australian Rules for presentation protocol

20.19 Meetings

20.19.1 Member Association hosting Championships to liaise with ASAI for any meetings to be

programmed during Championships.

20.19.2 Any meetings should be programmed to maximize attendance

20.20 Evaluator

20.20.1 Host state may nominate a preferred FINA Judge Evaluator to the ASAI Board at least six (6)

months prior to the Championships

20.20.2 The ASAI Board will appoint the Evaluator in consultation with the National Judging Director

20.20.3 The Evaluator will be appointed at least four (4) months prior to the Championships

20.20.4 ASAI will fund an amount of up to $5000 for the Evaluator flights, accommodation and daily per

diem of $50 per day (host State to supply receipts to ASAI for reimbursement. In the case of per

diem and billeting (if applicable) an invoice from the Host State is to be provided for payment.)

20.20.5 It is highly recommended that the Evaluator be suitable to present a judge/coach seminar the

day before the Championships commence

20.21 Results

20.21.1 To be emailed to all Clubs by Chief Scorer upon sign-off by referee

20.21.2 A hard copy should be delivered to the Notification Zone for Clubs unable to access email during

the Championships (SMS to be sent to these Clubs to advise the results have been posted)

20.21.3 To be posted on a wall at the venue for easy access by all Clubs (after posting)

20.21.4 The publication of results is considered to have occurred at the time emailed to clubs by Chief

Scorer

20.22 Notification Zone

20.22.1 All participating clubs should be advised as to the location of the Notification Zone prior to the

commencement of the Championships

20.22.2 Only the nominated Team Manager may enter Notification Zone

20.22.3 Is where clubs will lodge change of reserve forms

20.22.4 Is where clubs will lodge scratch forms

20.22.5 Is where clubs will receive results if unable to access email during Championships

20.22.6 Is where clubs will receive penalty forms

20.22.7 Is where clubs will lodge any protest form with applicable payment

20.23 Penalties

20.23.1 At the conclusion of a session, the Referee will advise the Chief Scorer of any penalties via

penalty forms. The form will include the reason for the penalty

20.23.2 Clubs will be advised of any penalty via SMS sent by Chief Scorer

20.23.3 Copy of penalty form will be delivered to Notification for collection by Team Manager

20.24 Protests

20.24.1 Must be lodged at the Notification Zone by Team Manager

20.24.2 The appropriate Penalty form must be used when lodging a protest

20.24.3 Penalty form must be accompanied with fifty Australian dollars (AU $50)

20.24.4 The protest must lodged within thirty (30) minutes from the Publication of results (time results

are emailed to Clubs)

20.24.5 The Referee will consider the protest with Assistant Referees

20.25 Protest Upheld procedure

20.25.1 Referee will advise club via SMS or phone call

20.25.2 Referee will advise Notification Zone and Chief Scorer via protest form

20.25.3 Chief Scorer will amend results and distribute as per ASAI bylaw 20.21 Results

20.26.1 Referee to advise Club via SMS or phone call stating reason for decision, and record on Protest

20.26.3 Jury of Appeal committee will consider appeal. Jury of Appeal decision is final and no

correspondence will be entered into

20.26.4 Decision and reason to be recorded on appeal form

20.26.6 If protest is denied, Referee will advise club via SMS or phone call

20.27 Entry Fees

20.27.1 Entry fees for routines are determined by the host Member Association in consultation with

20.27.2 Entry fee for figures is $10 per competitor per age group

20.27.3 Entry fee structure is per competitor, per event (NOT per event only basis)

21 Australian Rules

21.1 The Australian Artistic Swimming Championships shall be conducted in accordance with FINA Artistic

Swimming Rules together with the relevant Australian Rules

21.2 Unless attending by invitation, all athletes and officials participating in the Australian Artistic Swimming

Championships shall be registered in the correct registration category, and a financial member of the

Association.

21.3 Entries are to be by Club.

21.4 Age is as per FINA rule ASAG 2.1

21.5 Athletes are restricted in the number of routines permitted:

21.6 Regardless of the age group they are competing in, swimmers aged 12 years and Under are restricted to

compete in a maximum of four (4) routines for the Championships

21.7 Athletes aged 13 years or older are restricted to compete in a maximum of six (6) routines for the

Championships.

21.8 Athletes aged 12 years and Under may compete in a 13-15 Years Team or make up one half of a 13-15

Years Duet.

21.9 Athletes aged 13 or 14 years may compete in a Junior Team or make up one half of a Junior Duet

21.10 No age restriction applies to the Free Combination. These teams may consist of any mix of 12 years and

Under, 13-15 Years, Junior, Senior and Masters athletes

21.11 No age restriction applies to the Free Age Free Team. These teams may consist of any mix of 12 years and

Under, 13-15 Years, Junior, Senior and Masters athletes excepting that at least one (1) athlete must be

aged 14 years or under. A Free team all aged 15 years or over should enter in the Senior Free Team

event.

21.12 Reserves:

21.12.1 Solos, no reserves permitted

21.12.2 Duets, only one reserve permitted

21.12.3 Team, maximum of 2 reserves for teams of 8 only

21.12.4 Free Combination, maximum of 2 reserves for teams of 10 only

21.13 Each club is limited to one solo per age group per division

21.14 Athletes may not compete in figures only. However, swimmers aged 15 Years and Under who are

competing in routines with no figure component (Free Combination or Free Age Free Team), may

(optional) compete in their relevant age group figure competition for development or selection purposes.

21.15 For teams of less than eight (8), the 0.5 penalty per member less than 8 (FINA rule AS18.1) will NOT be

applied.

21.16 Junior, Senior and Masters – Technical and Free are considered separate events.

21.17 Entries may consist of athletes from multiple clubs.

21.18 Entries with Disabled athletes are encouraged and will be classified accordingly.

21.19 Entries may be male or female or a mixture of both in the same event (excepting Duet and Mixed Duet).

21.22 Presentation protocol would be to present in the following order

• Bronze (Aus)

Where there are multiple medals awarded, the Australian athletes would (after receiving their medals), step

forward off the dais and to the side, to enable the international to be presented with their medals.

The Australian athletes would then stand in front of the internationals for photos. For the above example, there would only be one silver medal presented as no international placed 2nd. Reserves shall receive the appropriate medals for placing 1st, 2nd or 3rd in events where reserves are permitted.

22.1 A Perpetual trophy will be awarded to the Championship Club (only Australian Clubs are eligible).

22.2 Points are awarded as defined in the FINA rules.

22.3 In the case of a tie, each competitor will be awarded the same number of points and the lower placing will

be negated.

22.4 When competitors are from multiple Clubs, the points awarded will be divided proportionally between the

clubs.
