1987PHILIPPINECONSTITUTIONARTICLEIII,BILLOFRIGHTS

Section1.Nopersonshallbedeprivedoflife,liberty,orpropertywithoutdueprocessoflaw,norshallanypersonbedeniedtheequalprotectionofthelaws.

Section2.Therightofthepeopletobesecureintheirpersons,houses,papers,andeffectsagainstunreasonablesearchesandseizuresofwhatevernatureandforanypurposeshallbeinviolable,andnosearchwarrantorwarrantofarrestshallissueexceptuponprobablecausetobedeterminedpersonallybythejudgeafterexaminationunderoathoraffirmationofthecomplainantandthewitnesseshemayproduce,andparticularlydescribingtheplacetobesearchedandthepersonsorthingstobeseized.

Section3.(1)Theprivacyofcommunicationandcorrespondenceshallbeinviolableexceptuponlawfulorderofthecourt,orwhenpublicsafetyororderrequiresotherwise,asprescribedbylaw.

(2)Anyevidenceobtainedinviolationofthisortheprecedingsectionshallbeinadmissibleforanypurposeinanyproceeding.

Section4.Nolawshallbepassedabridgingthefreedomofspeech,ofexpression,orofthepress,ortherightofthepeoplepeaceablytoassembleandpetitionthegovernmentforredressofgrievances.

Section5.Nolawshallbemaderespectinganestablishmentofreligion,orprohibitingthefreeexercisethereof.Thefreeexerciseandenjoymentofreligiousprofessionandworship,withoutdiscriminationorpreference,shallforeverbeallowed.Noreligioustestshallberequiredfortheexerciseofcivilorpoliticalrights.

Section6.Thelibertyofabodeandofchangingthesamewithinthelimitsprescribedbylawshallnotbeimpairedexceptuponlawfulorderofthecourt.Neithershalltherighttotravelbeimpairedexceptintheinterestofnationalsecurity,publicsafety,

orpublichealth,asmaybeprovidedbylaw.

Section7.Therightofthepeopletoinformationonmattersofpublicconcernshallberecognized.Accesstoofficialrecords,andtodocumentsandpaperspertainingtoofficialacts,transactions,ordecisions,aswellastogovernmentresearchdatausedasbasisforpolicydevelopment,shallbeaffordedthecitizen,subjecttosuchlimitationsasmaybeprovidedbylaw.

Section8.Therightofthepeople,includingthoseemployedinthepublicandprivatesectors,toformunions,associations,orsocietiesforpurposesnotcontrarytolawshallnotbeabridged.

Section9.Privatepropertyshallnotbetakenforpublicusewithoutjustcompensation.

Section10.Nolawimpairingtheobligationofcontractsshallbepassed.

Section11.Freeaccesstothecourtsandquasijudicialbodiesandadequatelegalassistanceshallnotbedeniedtoanypersonbyreasonofpoverty.

Section12.(1)Anypersonunderinvestigationforthecommissionofanoffenseshallhavetherighttobeinformedofhisrighttoremainsilentandtohavecompetentandindependentcounselpreferablyofhisownchoice.Ifthepersoncannotaffordtheservicesofcounsel,hemustbeprovidedwithone.Theserightscannotbewaivedexceptinwritingandinthepresenceofcounsel.

(2)Notorture,force,violence,threat,intimidation,oranyothermeanswhichvitiatethefreewillshallbeusedagainsthim.Secretdetentionplaces,solitary,incommunicado,orothersimilarformsofdetentionareprohibited.

(3)AnyconfessionoradmissionobtainedinviolationofthisorSection17hereofshallbeinadmissibleinevidenceagainsthim.

(4)Thelawshallprovideforpenalandcivilsanctionsforviolationsofthissectionaswellascompensationtotherehabilitationofvictimsoftortureorsimilarpractices,andtheirfamilies.

Section13.Allpersons,exceptthosechargedwithoffensespunishablebyreclusionperpetuawhenevidenceofguiltis

strong,shall,beforeconviction,bebailablebysufficientsureties,orbereleasedonrecognizanceasmaybeprovidedbylaw.Therighttobailshallnotbeimpairedevenwhentheprivilegeofthewritofhabeascorpusissuspended.Excessivebailshallnotberequired.

Section14.(1)Nopersonshallbeheldtoanswerforacriminaloffensewithoutdueprocessoflaw.

(2)Inallcriminalprosecutions,theaccusedshallbepresumedinnocentuntilthecontraryisproved,andshallenjoytherighttobeheardbyhimselfandcounsel,tobeinformedofthenatureandcauseoftheaccusationagainsthim,tohaveaspeedy,impartial,andpublictrial,tomeetthewitnessesfacetoface,andtohavecompulsoryprocesstosecuretheattendanceofwitnessesandtheproductionofevidenceinhisbehalf.However,afterarraignment,trialmayproceednotwithstandingtheabsenceoftheaccused:Provided,thathehasbeendulynotifiedandhisfailuretoappearisunjustifiable.

Section15.Theprivilegeofthewritofhabeascorpusshallnotbesuspendedexceptincasesofinvasionorrebellion,whenthepublicsafetyrequiresit.

Section16.Allpersonsshallhavetherighttoaspeedydispositionoftheircasesbeforealljudicial,quasijudicial,oradministrativebodies.

Section17.Nopersonshallbecompelledtobeawitnessagainsthimself.

Section18.(1)Nopersonshallbedetainedsolelybyreasonofhispoliticalbeliefsandaspirations.

(2)Noinvoluntaryservitudeinanyformshallexistexceptasapunishmentforacrimewhereofthepartyshallhavebeendulyconvicted.

Section19.(1)Excessivefinesshallnotbeimposed,norcruel,degradingorinhumanpunishmentinflicted.Neithershalldeathpenaltybeimposed,unless,forcompellingreasonsinvolvingheinouscrimes,theCongresshereafterprovidesforit.Anydeathpenaltyalreadyimposedshallbereducedtoreclusionperpetua.

punishmentagainstanyprisonerordetaineeortheuseofsubstandardorinadequatepenalfacilitiesundersubhumanconditionsshallbedealtwithbylaw.

Section20.Nopersonshallbeimprisonedfordebtornonpaymentofapolltax.

Section21.Nopersonshallbetwiceputinjeopardyofpunishmentforthesameoffense.Ifanactispunishedbyalawandanordinance,convictionoracquittalundereithershallconstituteabartoanotherprosecutionforthesameact.

Section22.Noexpostfactolaworbillofattaindershallbeenacted.
