1 Omnibus Objections to Claims Without Prejudice to Right to File Subsequent Objections Thereto

2 and (2) Waiving Compliance with Federal Rules of Civil Procedure 26(a) and (f) in Certain Claims

3 Objection Proceedings.

4 Debtor is asking the Court to issue an order authorizing the use of procedures contrary to

5 those set forth in the Federal Rules of Bankruptcy Procedure and the Federal Rules of Civil

6 Procedure. Although Debtor gives examples of types of claims and issues that it states might be

7 subject to the requested procedures, Debtor does not limit its motion to any specific claims, types of

8 claims or objections. By its motion, Debtor is asking the Court for a "blank check" to enable

9 Debtor to decide, on its own, which claims are to be subject to the procedures requested and which

10 preliminary omnibus objections it should be entitled to make. Regardless of whether, as Debtor

11 claims, the Court has the authority to decide with respect to a specific claim or objection, or type of

12 claim or objection, that the procedures requested should be followed, Debtor is certainly not

13 entitled to have the Court issue an order delegating that decision-making authority to Debtor.

14 Accordingly, Association of Bay Area Governments requests that Debtor's motion be

15 denied. If Debtor has a proposal for how a specific claim, objection or class of claims or objections

16 should be treated, it should make that specific proposal to the Court so that the Court can make a

17 decision on the subject.
