TEXT OF ARTICLE 24

1. In order to ensure prompt and effective action by the United Nations, itsMembers confer on the Security Council primary responsibility for the maintenanceof international peace and security, and agree that in carrying out its duties underthis responsibility the Security Council acts on their behalf.

2. In discharging these duties the Security Council shall act in accordance withthe Purposes and Principles of the United Nations. The specific powers granted tothe Security Council for the discharge of these duties are laid down in Chapters VI,VII, VIII, and XII.

3. The Security Council shall submit annual and, when necessary, special reportsto the General Assembly for its consideration.

INTRODUCTORY NOTE

1. The primary character of the responsibility for themaintenance of international peace and security conferredupon the Security Council by Article 24 is also reflectedin the terms of Article 11 (2), where it is provided thatany question on which action is necessary should bereferred to the Security Council by the General Assembly,and in the provisions of Article 12 (1) which, togetherwith those of Articles 10, 11 (2) and 14, limit the author-ity of the General Assembly in respect of any dispute orsituation while the Security Council is exercising thefunctions assigned to it by the Charter.2. As indicated in the Repertory and its SupplementsNos. 1-4, examination of the practice of United Nationsorgans in respect of an Article of such broad scope asArticle 24 has necessarily been confined to matters whichhave arisen only in the proceedings of the Security Coun-cil. The practice of the General Assembly in connexionwith the maintenance of international peace and security,though relevant to a better understanding of the subjectas a whole, is dealt with under the Articles' governingthe functions and powers of the General Assembly.3. Article 24 defines the general field of responsibilityof the Security Council for the maintenance of interna-tional peace and security but, as indicated in its para-graph 2, other Articles of the Charter set forth the specificpowers granted to the Council for the discharge of thatresponsibility. The analysis of the decisions of the Councilin the Repertory under Article 24 has been, therefore,confined to those questions bearing upon the main ques-tions which arose in the proceedings of the Council in

connexion with its general responsibility for the main-tenance of international peace and security, as distinctfrom its specific powers defined in other relevant Articles.Since no constitutional discussion on this general respon-sibility of the Security Council took place in its pro-ceedings or in those of the General Assembly during theperiod under review, this study consists only of a Sum-mary of Practice.4. For reasons explained in the previous Repertorystudies, questions considered by the Security Councilunder its responsibility for the maintenance of interna-tional peace and security as provided for in Article 24 (1)and (2), and the decisions adopted by the Council in con-nexion with these questions, are presented in this studyin the form of two annexes.5. Annex I contains a list of questions which the Secu-rity Council has considered under its responsibility for themaintenance of international peace and security as pro-vided for in Article 24 (1) and (2), during the period underreview. The range of questions on the list may be deemedto fall under Chapters VI and VII of the Charter.6. Annex II contains a tabulation of various measuresprovided for in positive decisions of the Security Counciladopted in connexion with questions considered underits responsibility for the maintenance of internationalpeace and security. As indicated in previous Repertorystudies, the headings in the tabulation have been devisedfor convenience of presentation and no constitutionalsignificance should be attached to the inclusion of anyparticular decision under any given heading.

SUMMARY OF PRACTICE

A. Article 24 (1) and (2)

7. During the period under review, Article 24 wasexplicitly cited by the United States of America in its letterdated 7 October 19732 calling for a meeting of theSecurity Council in connexion with the situation in theMiddle East,3 as well as in the preambles of three draftresolutions, one submitted to the Security Council by

Burundi, Sierra Leone, Somalia and Syrian Arab Repub-lic in connexion with a complaint by Zambia4 and twocirculated in the Security Council as a result of consulta-tions among members of the Council in connexion withthe situation in Cyprus.5 The consideration of thesetexts did not involve any constitutional discussion.8. The draft resolution submitted in connexion with thecomplaint by Zambia was adopted,6 in its revised form,as resolution 300 (1971) of 12 October 1971, which no

longer contained an explicit reference to Article 24. The' fifth pYeambular paragraph of that resolution, however,may be considered to contain an implicit reference toArticle 24 in scffar as it stated that the Security Councilwas "Conscious that it has the responsibility to takeefficient collective measures to prevent and eliminatethreats to peace and'security". Similarly, the fifth pream-bular paragraph of resolution 290 (1970) of 8 Decem-ber 1970, adopted in connexion with the complaint byGuinea, may be considered to have an implicit bearingon Article 24 in so far as it stated that the Council was"Mindful of its responsibility to take effective collectivemeasures for the prevention and removal of threats tointernational peace and security".9. Of the two draft resolutions circulated in connexionwith the situation in Cyprus, both of which containedthe same explicit invocation of Article 24, one7 wasadopted8 as resolution 353 (1974) of 20 July 1974 andthe other one9 was not put to a vote.10. During the period under review, resolutions adoptedby the Security Council and a draft resolution submittedto the Council contained preambular paragraphs in whichthe language of Article 24 was used, but during their con-sideration no constitutional discussion arose.11. In resolution 303 (1971) of 6 December 1971,adopted in connexion with the situation in the India/Pakistan subcontinent, the Security Council "Taking intoaccount that the lack of unanimity of its permanent mem-bers at the 1606th and 1607th meetings of the SecurityCouncil has prevented it from exercising its primaryresponsibility for the maintenance of international peaceand security", decided to refer the question under consid-eration to the General Assembly at its twenty-sixth ses-sion, as provided for in Assembly resolution 377 A (V)of 3.November 1950.12. , In resolution 417 (1977) of 31 October 1977,adopted in connexion with the question of South Africa,the Security Council "Mindful of its responsibilities underthe Charter of the United Nations for the maintenanceof international peace and security" inter alia stronglycondemned South Africa for its resort to massive violenceand repression against the black people and other oppo-nents of apartheid.13. The above-mentioned draft resolution10 was sub-mitted to the Security Council by Burundi, Nepal, SierraLeone, Syria and Zambia in connexion with the questionof race conflict in South Africa resulting from the policiesof apartheid of the Government of the Republic of SouthAfrica; under the terms of the last preambular paragraphand operative paragraph 1 of that draft resolution, theSecurity Council "Taking note that the permanent rnern-bers of the Security Council have a primary responsibilityfor the maintenance of international peace and securityand thus are under a special obligation to abide by theresolutions of the Security Council", would reiterate itstotal opposition to the policies of apartheid of the Gov-ernment of the Republic of South Africa. The draftresolution, in its revised form from which the last pre-ambular paragraph was deleted, was adopted" asresolution 282 (1970) of 23 July 1970.14. The language of Article 24 was used also in the com-muniqué issued by the Secretary-General at the close of

the first periodic meeting12 of the Security Council inaccordance with rule 55 of the provisional rules of pro-cedure of the Council. Paragraph 6 of that communiquéstated that "In view of the primary responsibility of theSecurity Council for the maintenance of internationalpeace and security, members of the Council emphasizedthe importance of reaching early agreement on guidelinesfor future peace-keeping operations in conformity withthe Charter".15. During the period under review, the issue of thegeneral powers of the Security CoUncil, more specificallythe question whether the Council has specific powers, aslaid down in Chapters VI, VII, VIII and XII of the Char-ter only, or whether it may exercise such other powers,consistent with the Purposes and Principles of the Char-ter, as are necessary for it to discharge its responsibilities,came up in connexion with the consideration by the Secu-rity Council of the advisory opinion of the InternationalCourt of Justice rendered on 21 June 1971l3 in con-nexion with the question of Namibia.16. By its resclution 284 (1970) of 29 July 1970 theSecurity Council had asked the Court for its advice on"the legal consequences for States of the continuedpresence of South Africa in Namibia, notwithstandingSecurity Council resolution 276 (1970)". Under resolu-tion 276 (1970) of 30 January 1970, the Council haddeclared that the continued presence of the South Africanauthorities in Namibia was illegal and that all acts by theSouth African Government on behalf of or concerningNamibia subsequent to the General Assembly's decisionto terminate the mandate14 were illegal and invalid.17. The Court, in arriving at its opinion, considered thatthe legal basis of resolution 276 (1970) was the authorityvested in the Security Council under Article 24 of theCharter.15 According to the Court, the reference-in Arti-cle 24 (2) to specific powers of the Council under certainChapters of the Charter did not exclude the existence ofgeneral powers to discharge the responsibilities conferredin paragraph 1. In this connexion the Court made refer-ence16 to a statement by the representative of the Secre-tary-General in 1947 to the effect that "the powers ofthe Council under Article 24 are not restricted to the spe-cific grants of authority contained in Chapters VI, VII,VIII and XIII . . . the Members of the United Nationshave conferred upon the Security Council powers com-mensurate with its responsibility for the maintenance ofpeace and security. The only limitations are the funda-mental principles and purposes found in Chapter 1 of theCharter".18. While the majority of the members of the SecurityCouncil agreed with the conclusions of the Court on themain question put to it,17 the observation was made thatthe opinions expressed by the Court on various otherquestions, some of which involved constitutional prob-lems, might raise controversial issues, such as a far-reaching interpretation of various Articles of the Charter,

including Article 24,18 which were not essential fordealing with the question of Namibia.19 It was alsoasserted that, if the interpretations of various provisionsof the Charter, including Article 24, were to give rise toreservations among Member States, it was doubtful thatthe Security Council would be the appropriate forum inwhich to debate them.20

19. Explicit and implicit references to Article 24 weremade in the Security Council in connexion with the con-sideration of various questions21 but there was no con-stitutional discussion.20. There was one instance in which Article 24 wasinvoked by the representative of a permanent member ofthe Security Council22 to emphasize the position of hisGovernment with regard to the exclusive competence ofthe Security Council in the matter of peace-keeping andthe maintenance of international security. He emphasizedthat his Government considered that the competence ofthe Council should not be limited simply to the establish-ment of an international force, but that the Councilshould also have control over all operations that mightbe ordered by it. Thus it was for the Council to definethe force's terms of reference, its duration, its size andits composition; to decide upon the appointment of itscommander, the basic directives to be given to the com-mander; to prepare the method of financing; and toensure constant control over the application of its direc-

The point was made also that, to enable the Councilto do so, a subsidiary organ could be setup whose pur-pose would be to lessen the Council's work without prej-udice to the primary responsibilities conferred upon theCouncil by the Charter. • '21. In another instance, Article 24 was cited to makethe point that, in so far as the Security Council wasentrusted with the responsibility to act on behalf of theMembers of the United Nations, it was in duty boundto take into consideration the general views of the Mem-ber States, as expressed in resolutions adopted by theGeneral Assembly.23

22. Finally, on two occasions during the period underreview, the Security Council took decisions and, on athird occasion, statements were made in the Councilwhich might be considered implicitly to fall within thepurview of the general mandate of the Security Councilunder Article 24.23. In 1970 and again in 1972, the Council took deci-sions24 by consensus, in the first instance at a formalmeeting,25 and in the second instance without a meet-ing,26 in connexion with the situation created by increas-ing incidents involving hijacking of commercial aircraft.In connexion with this item, the Security Council did notpronounce itself either in 1970 or in 1972 on the ques-tion of the Charter Article under which it acted.27

24. In 1976, during the consideration of a complaint28

concerning developments following an incident of hijack-ing of a commercial aircraft, the observation was madethat international action to ensure that future acts ofhijacking did not succeed would contribute to fulfillmentof the primary aim of the Council in helping to maintaininternational peace and security.29 Such internationalaction, it was noted, required bringing together the con-cern of the international community for the necessity toensure safety of international civil aviation, the considera-tion that States exist for the protection of their peoples,and the principle of respect for national sovereignty andterritorial integrity.25. It was also suggested30 that the Security Councilshould not only record its collective view that interna-tional terrorism, and specifically hijacking, must bestopped but should also address itself to "the interna-tional crime of terrorist hijacking" as one of the mostdangerous threats to peace and security in the world.31

action on the part of the Security Council and the GeneralAssembly to eradicate the underlying causes of terrorism.27:"" During {Hefperiod under review, one resolution wasadopted by thé General Assembly in which Article 24 wasexplicitly invoked! Thus, in the second preambular para-graph of resolution 3283 (XXIX) of 12 December 1974on'peaceful settlement of international disputes, theGeneral Assembly recalled, in particular, that the SecurityCouncil was charged under the terms of Article 24 of theCharter with the primary responsibility for the main-tenance of international peace and security, and that dis-putes may be brought to the attention of the Council forpurposes of pacific settlement under the provisions ofChapter VI of the Charter.28. There were also several instances in which the Gen-eral Assembly adopted resolutions including provisionsin which language similar to that of Article 24 wasutilized.33 There was no constitutional discussion in theproceedings leading to the adoption of those resolutions.29. In paragraph 13 of its resolution 2734 (XXV) of16 December 1970 containing the Declaration on theStrengthening of International Security, the GeneralAssembly called upon the Security Council, including thepermanent members, to intensify efforts to discharge, inconformity with the Charter, its primary responsibilityfor the maintenance of international peace and security.That recommendation was reiterated in paragraph 2 ofGeneral Assembly resolution 32/154 on implementationof the Declaration on the Strengthening of InternationalSecurity.30. In the fifth preambular paragraph of its resolu-tion 3324 B (XXIX) of 16 December 1974 and in theseventh preambular paragraph of its resolution 31/6 Dof 9 November 1976 on policies of apartheid of the Gov-ernment of South Africa, the General Assembly was interalia "mindful" of the primary responsibility of the Secu-rity Council for the maintenance of international peaceand security.34

Committees36 in connexion with various agenda items.The Article was repeatedly cited to draw attention to theprinciples laid down in its provisions, namely: that theMembers of the United Nations conferred on the Councilprimary responsibility for the maintenance of interna-tional peace and security; that the Council acted on theirbehalf; and that the powers granted to the Security Coun-cil were laid down in Chapters VI, VII, VIII and XII ofthe Charter.33 Article 24 was also invoked to recall that it was forthe purpose of ensuring prompt and effective action bythe United Nations that the Council, under the Charter,had been entrusted with primary responsibility for themaintenance of international peace and security. Thatresponsibility, it was observed, was neither absolute norexclusive, as evidenced by the general powers for actionwhich Articles 10 and 11 conferred on the GeneralAssembly.34. Furthermore, reference was made to Article 24 inthe context of statements regarding enhancement of therole of the Security Council by all means available toMembers of the United Nations. Council and those of the General Assembly were com-plementary and not contradictory, since paragraph 1 ofArticle 24 provided that, in carrying out its duties underits responsibility for the maintenance of internationalpeace and security, the Council acted on behalf of Mem-ber States.35. Rights and duties assumed by Member States underthe provisions of Article 24 were recalled also in thediscussions regarding effective functioning of UnitedNations peace-keeping forces, in particular, the necessitythat the forces must operate with the full co-operationof the parties concerned. It was maintained that the com-position of the Security Council, which represented allgroups of States, and its special role and responsibilityunder the Charter, established firm bases for working outagreed guidelines for United Nations peace-keepingoperations. It was noted that the Council, as the mainUnited Nations organ responsible for restoring or pre-serving peace on behalf of Member States, had the ulti-mate authority to establish, direct and control peace-keeping operations.36. In connexion with the question of defining aggres-sion, the observation was also made that, in applying thedefinition to individual cases of aggression, the SecurityCouncil, as the organ primarily responsible for the main-tenance of international peace and security, would notbe exercising discretionary power; rather, it would beacting according to Article 24 (2) of the Charter.

B. Article 24 (3)

37. Article 24 (3), in conjunction with Article 15 (1),places upon the Security Council the obligation to submitannual and, when necessary, special reports to the Gen-eral Assembly on how it has discharged the responsibilityconferred upon it by the Members for the maintenanceof international peace and security. During the periodunder review, the Security Council submitted its twenty-fifth through thirty-third annual reports, as well as specialreports. All the special reports concerned the admissionof new Members.37

38. The accepted procedure with regard to the prepara-tion of annual reports includes the following stages:

Consideration of the annual report of the SecurityCouncil by the General Assembly has continued to be aformality. The General Assembly has not debated thesubstance of the annual report submitted by the Councilbut has adopted38 resolutions taking note of the report.40. It should be noted, however, that, at its twenty-sixthand twenty-seventh sessions, the Assembly, in connexionwith its consideration of the Council's report, decided toseek the views of Member States on ways and means ofenhancing the effectiveness of the Council in accordancewith the principles and provisions of the Charter.39 Atits twenty-eighth session, in its resolution 3186 (XXVIII),the Assembly drew the attention of the Council, whenconsidering steps to enhance its effectiveness in accord-ance with the principles and provisions of the Charter,to the views and suggestions submitted by Member Statesin response to the above-mentioned resolutions as con-tained in the Secretary-General's reports on the matter.40

At its twenty-ninth session, in its resolution 3322 (XXIX),the Assembly recalled the resolutions adopted at the threeproceeding sessions. No final decision was taken on thismatter by the General Assembly during the period underreview.41. It should also be noted that Article 24 (3) was explic-itly cited in a note41 by the President of the SecurityCouncil regarding a decision by the Council to make itsannual report to the General Assembly shorter and moreconcise without changing its basic structure.
