Transcript of Are Trucking Accidents Different?
ARE TRUCKING ACCIDENTS DIFFERENT FROM CASES
INVOLVING OTHER TYPES OF VEHICLES?
This presentation will examine the differences that exist between
personal vehicle
accidents and accidents that
involve a commercial
truck
It is important to understand the distinctions
if you have been injured in a trucking accident
Private VehicleAccidents
Let's say that you are injured in an accident with another driver of a privately owned
motor vehicle
You are usually going to seek damages from the other
driver's insurance company
THOUGH THERE ARE EXCEPTIONS, there are generally not going to be multiple entities that may be financially responsible for the damages
Trucking Accidents
Accidents involving commercial trucks
are an entirely different story
If you have been injured in a trucking accident there may be multiple different
parties who are potentially liable for the damages and
injuries you suffer
There are also FEDERAL AND STATE
LAWS that regulate the trucking
industry
Any breaches of compliance could be
relevant to your personal injury case and
help prove the defendants are
responsible for your injuries and damages
The Driver
If you are injured because of the actions of a driver of a
noncommercial vehicle clearly, you can sue this driver for
NEGLIGENCE
In the same manner, you can sue a commercial truck driver
if he or she committed negligent acts that caused you
bodily harm
The Trucking Company that Employs the Driver
As we mentioned previously, trucking businesses are
required to follow strict state and federal laws
You can sue the trucking company for the action of its driver but there may also be
independent causes of action against the trucking
company itself if the company did not adhere to
all mandated SAFETY STANDARDS
Employers are also considered to be
responsible for the negligent actions of people
who work for them
The Owner of the Truck
Trucking businesses often have somewhat
complicated arrangements
Someone could own a truck, be contracted by a
company, and then employ a driver
In situations like thisthe owner of the truck
could be liable for damages
Others Who May Be Liable
Under some circumstances the entity that was shipping the
goods that were being hauled by the truck can be liable
1
The manufacturer of a truck (or truck parts) that may have been
defective could also be sued
2
If poorly maintained roads, lighting, or ongoing
construction caused or contributed to cause the
accident it would be possible to seek damages
from the government entity that was negligent
