Definition of Piggybacking:

A procedure of procuring materials, supplies or equipment by utilizing another public entity’s award of an Invitation to Bid or Request for Proposal.

Legal Basis for Piggybacking:

Public Contract Code Section 20118

In order for a bid to be piggybackable:

1) The original bid by the awarding agency must contain a piggyback clause

2) The awarded vendor must agree that your agency can piggyback on the contract

Steps to follow for successfully participating (piggybacking) on another agency’s bid:

1) Contact the awarding agency and have them forward you a copy of their bid documents

2) Verify the Terms and Conditions meet your district’s requirements.

3) Verify the bid was advertised and awarded legally

Steps to follow for successfully participating (piggybacking) on another agency’s bid:

4) Verify the bid is still valid (check expiration date and possible contract renewals)

5) Verify that it’s in the best interest of your district

6) Take to your Board for approval

Sample piggyback clause:Other school districts and public agencies may purchase under this

bid at the same prices, terms and conditions stated in these bid documents, at the discretion of the successful bidder.

Agencies participating in this bid shall be responsible for obtaining approval from their approving body of authority when necessary and shall hold the (School District/Public Entity Name) harmless from any disputes, disagreements or actions which may arise as a result of using this bid.

The (School District/Public Entity Name) waives its right to receive payment, and authorizes each district to make payment and place orders directly to the successful bidder.

• CA Govt. Code 6500 defines “public agency” as including the federal government and other states/agencies
