I hope all are well. It is very dry here in Western South Dakota. We have already had numerous fires due to the lack of moisture and all the dry grass. The forecast is calling for rain and snow tonight so I will be praying that we get some of that. The legislative session is over and as you all know by now it was a win/win situation for all of the issues that concerned our industry and the auto industry. Myron once again did a great job in his lobbying efforts on our behalf. Please, next

time you see him, pat him on the back and thank him for his hard work. I attended the Black Hills Log Haulers Association event yesterday in Lead, SD. It was a great meeting! Robert and his crew are doing an awesome job with that as-sociation. The meeting was well organized, well run, and well attended. I found the whole event very interesting, very informative, and very impressive. Hat’s off to you guys. You are gaining some good traction for your industry. They also expressed their appreciation for the work that Myron and the SDTA has done for them as well. Robert will be giving the details in his letter. Make sure you read it - there are a lot of things happening in the Black Hills logging industry. This month I would like to touch on another important issue that is happening on Capitol Hill. Really? More government interference? As most of you probably know, the current minimum amount of liability insurance for transportation carriers is at $750,000 per incident. It has been at this level since the mid-eighties. No one really knows where that figure originated from. Now there has been talk of raising it to as high as $4.5 million. There is no proven documentation from any source that would make any sense as to why it should be raised that high. It appears that the big trial lawyers are the party responsible for backing this ridiculous increase. They would be the biggest winners financially over this proposed change. I believe an increase is necessary maybe to $1 million. We need to resist this folks or we will be opening a can of worms full of high dollar law suits, huge increases in insurance premiums, and sue happy nuts from all over the country. There is a crew of about 10 of us heading to DC in two weeks for our annual Call on Washington. I believe this event is bar-none the best way to educate, inform, and discuss face to face with our Congressional Delegation the issues concerning our industry, not only on federal issues, but state issues as well. I will report on our trip next month. Please everyone, keep in mind our goal for membership this year is 600 members. If we all sign up one, we would easily attain that goal. Also, there are a lot of upcoming events. Please check your schedules and attend as many as you can. Thank you everyone for your support. It appears that spring is just around the corner. Warm days are followed by cold days, but it is bet-ter than having snow on the ground. I just hope we get some appreciable rainfalls in the next few weeks; it is extremely dry in most if not all parts of South Dakota.

At the end of March, I traveled to Louisville, KY to man the NORPASS booth at the Mid-America Truck Show (MATS). We saw record attendance with over 80,000 attendees for the three day event. I man-aged to see a few South Dakotans at the show that attracts people from all around the world. If you have the time, I suggest you go to this annual event

sometime in the future. If it has anything to do with trucking, you can find it at MATS.

On the 21st through the 23rd of this month, a dozen SDTA Members will travel to Wash-ington, DC for our annual Call on Washington. This is the eleventh year that a contin-gency of SDTA Members will make the trip to Washington, DC. I personally think this is one of the best trips we make. The American Trucking Associations (ATA) briefings are comprehensive and the interaction with our Congressional Delegation is invaluable. If you have an issue that you feel we need to carry to Capitol Hill, please contact Chair-man Mike Habeck or me and we will be happy to present the issue to our Congressional Delegation and/or to the ATA.

Also in May, your SDTA Chairman and ATA State Vice President, Mike Habeck and I will attending the ATA Leadership Meeting in Scottsdale, AZ. This meeting serves as the semi annual board of directors meeting for the American Trucking Associations. Again, this is a great time to spend with truckers from across the country to share issues of mutual concern. This is a very important meeting for our State Vice President and I to attend; it is where ATA Policies are discussed, changed and formed. If there is an issue that you would like Mike or I to carry to the meeting, please give either one of us a call and give us your thoughts about the matter.

As usual, your SDTA Staff has a very busy May schedule. The South Dakota Trucking As-sociation’s Annual Truck Driving Championships are scheduled for Saturday, May 16th at the Southeast Technical Institute in Sioux Falls. We are still in need of volunteers to act as judges for this event and the field is wide open for drivers to participate. If you have questions about how you can participate, please call your SDTA Office.

The summer meeting of the SDTA Board of Directors is scheduled immediately follow-ing our annual Cliff Tjaden Fishing Event. Also coupled with the board meeting is the annual meeting of the Agricultural Commodities Conference and the Log Haulers Con-ference. Please review the “Dates to Remember” printed in this edition of the Trucking News. We have an action packed couple of months ahead. Please participate in any way you can!

REMEMBER: If you do not have a seat at the table, you may be what is served for dinner and perhaps that will be WELL DONE. Get involved and stay involved!

FMCSA Announces new Smartphone App Providing Safety data on interstate Commercial truck and Bus Companies

WASHINGTON – The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) today announced a new Smart-phone app that will allow for more convenient access to currently available online safety performance information for interstate truck and bus companies. “By making currently available safety information on interstate truck and bus companies more easily accessible for both law enforcement per-sonnel and the general public, we are providing greater transparency while making our roadways safer for everyone. Safety is our highest priority, so we are committed to using every resource available at our finger tips to ensure the safety of travelers,” said U.S. Transportation Secretary Anthony Foxx. Called “QCMobile,” (QC standing for “Query Central”), the new app is expected to be a particularly valuable tool for state and federal law enforcement personnel, as well as insurers, brokers, freight-forwarders, and others interested in reviewing the USDOT registration and safety performance information of motor carriers. “FMCSA will continue to use all the tools, resources, and partnerships available to further strengthen commercial vehicle safety across the coun-try,” said FMCSA Acting Administrator Scott Darling. “Aggressive safety enforcement, research, and technology development and deployment, combined with strong stakeholder participation, will continue to be directed toward removing unsafe trucks and buses from our roadways and protecting every traveler from needless harm.” Law enforcement officers and commercial motor vehicle safety inspectors use customized software at the roadside to log-into national safety databases to obtain highly detailed safety information on all interstate truck and bus companies. The new QCMobile app, which requires no log-in, immediately reveals whether the federal operating status of the carrier is authorized while helping to expedite an “inspect/pass” decision by a certified commercial vehicle safety inspector. QCMobile retrieves data from a number of FMCSA sources and provides a clear summary of the results. Law enforcement officers and safety in-spectors then have the option of retrieving more detailed information on carriers covering their seven Behavior Analysis and Safety Improvement Categories (BASICs) that are a part of FMCSA’s cornerstone safety program, Compliance, Safety, Accountability (CSA). FMCSA is proactively working to implement the provisions of the Moving Ahead for Progress in the 21st Century Act (MAP-21), as well as advanc-ing core safety initiatives including the CSA program. CSA is designed to further reduce the number and severity of crashes involving large trucks and buses by providing law enforcement personnel, motor carriers, and professional truck and bus drivers with detailed information outlining areas of potential safety concern, while also triggering processes to implement corrective action. We had a very good turnout for our log haulers seminar. What a plate full - but we were able to stay focused to absorb and enjoy every speaker and topic. South Dakota Motor Car-rier Services took the time to talk about compliance issues that pertained to our specialized industry.

I think we can all agree that radio communications on logging roads is at the point of being next to impossible and has created some very dangerous conditions. The FM communication radios we have experimented with should prove to be the answer to these problems. If we decided this is the solution to the problem, it will have to be mandatory that everyone use this radio or we just compound the existing problems.

Michelin tire did an excellent job showing the importance of proper tire care. We’ve all seen the consequences of improper care. Again thanks to Michelin for their presentation and for covering the cost of dinner.

SDTA chairman and SD ATA Vice President Mike Habeck was able to spend the whole day with us and talked about local, state and federal issues. He also shared some of the challenges other state organizations like ours face. We should be very proud of the associations we have and of their accomplishments.

SDTA President Myron Rau and Senator Bob Ewing did a review of the 2015 legislative session and the bills that were of our interest. Hats off to all the State delegates for recognizing the conditions of our highways and bridges and taking the bold move to address the highway funding issue. If only we could get our delegates in DC to quit kicking the can down the road. We have driven on substandard bridges and roads for so long that we now believe that condition is an acceptable.

Dave Parker, Attorney for Great Western Casualty did what I am going to call an educational presentation on insurance. To say the very least this was a real eye opener. There are only 8 states remaining that still lneed to adopt anti-indemnification laws.

Again thanks to all the speakers and members who attended.

No one will ever look out for your best interest better than you. Therefore it is our responsibility as business persons to keep current and educated on all the issues that have a positive or negative affect on us.

Time now to prepare for the Call on Washington. I hope that soon we will all be back to work from spring break. Survey results are in and will be evaluated sometime early this summer.

Crashes are the leading cause of on-the-job death for truck drivers in the US. Many truck drivers do not use a seat belt on every trip. Our nation depends on truck drivers to deliver goods and services safely and efficiently. Yet, crashes involving large trucks continue to take a toll on truck drivers, their passengers, other road users, businesses, and the community. Overall, 317,000 motor vehicle crashes involving large trucks were reported to police in 2012, according to the latest Vital Signs report by the Centers for Disease Control and Prevention. The estimated cost of truck and bus crashes to the United States economy was $99 billion that same year.

About 2.6 million workers in the US drive trucks that weigh over 10,000 pounds. After dropping to 35-year lows in 2009, the number of crash fatalities of truck drivers or their passengers increased between 2009 and 2012. Approximately 700 drivers of large trucks or their passengers died in crashes in 2012, and an estimated 26,000 were injured. About 65 percent of on-the-job deaths of truck drivers in 2012 were the result of a motor vehicle crash. More than a third of the drivers who died were not wear-ing a seat belt.

"We know that using a seat belt is the single most effective intervention to prevent injury or death in a motor vehicle crash. However, in 2012 more than 1 in 3 truck drivers who died in crashes were not buckled up, a simple step which could have prevented up to 40 percent of these deaths " said CDC Principal Deputy Director Ileana Arias, Ph.D. “Employers and government agencies at all levels can help improve truck driver safety and increase seat belt use among truck drivers by having strong company safety programs and enforcing state and federal laws."

This Vital Signs report includes data from the National Survey of US Long-Haul Truck Driver Health and Injury, conducted by CDC at 32 truck stops along interstate highways across the United States in 2010. Key findings from the survey include:

• An estimated 14 percent of long-haul truck drivers reported not using a seat belt on every trip.

• Over one-third of long-haul truck drivers had been involved in one or more serious crashes during their driving careers.

• Long-haul truck drivers who reported not wearing seat belts also tended to engage in other unsafe driving behaviors such as speeding and committing moving violations. They were also more likely to work for an employer that did not have a writ-ten workplace safety program.

• Long-haul truck drivers who lived in a state with a primary seat belt law – the law that allows police to stop motorists solely for being unbelted – were more likely to report often using a seat belt.

“Using a seat belt is the most effective way to prevent injury or death in the event of a crash,” said Stephanie Pratt, PhD, coordinator of the National Institute for Occupational Safety and Health (NIOSH) Center for Motor Vehicle Safety. “The smartest strategy for overall safety is to prevent truck crashes from happening in the first place. Employers can help prevent crashes and injuries through comprehensive driver safety programs that address other known risk factors such as drowsy and distracted driving.”

South dakota now offering drivewyze inspection Site Bypass Service: Bypass Now Available for First Time at 61 of State’s 65 Sites

BURLINGAME, Calif., April 2, 2015 – Drivewyze has announced that Drivewyze PreClear bypass service has been added in South Dakota. The mobile-based weigh station and inspection site bypass service is now available at 545 locations in 34 states.

With the addition of Drivewyze, the Mount Rushmore State for the first time has a bypass service at all of its mobile vehicle inspection sites. Drivewyze PreClear users can now receive bypasses at 65 sites in South Dakota, including 61 mobile sites and these four fixed locations:

• U.S. Interstate 29 southbound at milemarker 235 near Sisseton;

• U.S. Interstate 90 westbound, near Exit 81-Russell Street in Sioux Falls;

• I-29 northbound at milemarker 13 near Jefferson, and;

“We’re pleased that Motor Carrier Services officials with the South Dakota Highway Patrol recognize Drivewyze technology as an effective way to prescreen safe commercial operators,” said Brian Heath, president of Drivewyze. “South Dakota officials know the importance of trucking to the state’s indus-tries. By offering safe truck fleets and operators the opportunity to earn bypasses, officials can reduce congestion in and around weigh stations and inspection sites. This allows freight to move more quick-ly.”

“With mobile bypass applications, our commercial vehicle inspectors with the South Dakota Highway Patrol can accomplish their mission without delaying safe commercial truck fleets and operators,” Bro-ers said. “They can better protect the motoring public because they can devote more of their attention to truck and fleet operators who have a past history of unsafe operating practices.

“We also like the fact that we can now offer these bypasses at our 61 mobile sites, which we can’t do with a transponder-based system,” he added. “Because our unit must cover a large amount of territory with limited resources, our mobile sites are an important part of our enforcement strategy.

“With the ability to offer bypasses even at our mobile sites to those fleets that have established a his-tory of safe performance on the road, this allows for more efficient vehicle screening especially when truck traffic numbers peak during high volume times,” Broers said.

Drivewyze uses cellular technology and the internet to add transponder-like functionality to electronic logging devices, smartphones and tablets instead of dedicated short-range communication transpon-ders and transponder readers, Heath said.

Advance directives: your Life on your terms By: Sanford Health

The hardest conversations are usually the most important. But communicating your wishes around end-of-life care today can alleviate confusion or difficult decisions for your family later.

That was Patti Buehler’s main motivation when she completed her advance directive more than 15 years ago. At the time, her father had just experienced a series of small strokes.

“He was at risk of having a major stroke,” she recalls. “That raised some concerns and questions regarding my father’s future care.”

Patti and her brothers encouraged their father to complete an advance directive to provide them with a clear understanding of his wishes in the event he was unable to communicate his desires.

“It was then that I began to think about my husband and the difficult decisions he could face regarding my care,” Patti says. “I didn’t want to burden him with those decisions, which can be heart-wrenching when it comes to those you love.”

Patti initiated the discussion with her husband, and verbally explained her personal wishes and desires about end-of-life care. She put her wishes in writing with a living will and also appointed a medical power of attorney, two types of advance directives.

In a young, healthy state, Patti completed her advance directive with no pressure or deadlines. LuAnn Eidsness, MD, medical director of palliative care at Sanford Health, says this is exactly when people should complete a document of this magnitude.

“Ideally, advance directives should be completed by anyone who has reached maturity, or around the age of 18,” she says. “Unexpected situations or accidents can happen at any time, not just when you’re older.”

Dr. Eidsness has witnessed what can happen between patients and family members when a care plan is not clearly communi-cated.

“I’ve seen patients who are afraid their family will not fulfill their wishes around end-of-life care, which is such a stressful time for everyone involved,” she says. “Our patients are dealing with a lot of stress due to their illness, they don’t need to also be struggling with ensuring their wishes are respected.”

Dr. Eidsness stressed the importance of completing both the living will and designating a medical power of attorney.

“A medical power of attorney is someone who is appointed to speak for you if you are unable to speak for yourself. They can fill in any gaps that may arise regarding your care,” she says. “There are so many details and situations that can arise when it comes to end-of-life care. If you’ve shared your feelings about how you define quality of life, this person is able to make deci-sions that might not be included in your living will or treatment directive.”

Broaching the subject isn’t easy, and it can be a lot to process. But Patti and Dr. Eidsness both suggest starting with a simple conversation with your loved ones to initiate the process.

“No one wants to think about their mortality, but the benefits of completing an advance directive make it all worth it,” Patti says. “I felt so much relief after my parents completed their advance directives – I knew all those difficult decisions were al-ready made by them. I hope I’ve helped my husband and children feel the same way.”

What can be done to reduce the risk of motor vehicle crashes, injuries, and deaths among truck drivers?• States can help increase seat belt use by truck drivers through high-visibility enforcement of seat belt laws by state troop-

ers and motor carrier safety inspectors.

• Employers can establish and enforce company safety policies, including belt-use requirements for truck drivers and passen-gers as well as bans on text-messaging and use of handheld phones.
