INSTRUCTIONS TO EE(E) The Executive Engineer (Elect.) shall attend to the following points before inviting tenders:-

1. Time and date of sale, receipt and opening of tenders, EMD to be drawn in favour of shall be filled in.

2. Any instructions issued by the Chief Engineer (Elect.) after the approval of the

NIT shall be included before call of tenders. 3. Any additional specification, particular to the locality, shall be included in the

NIT before issuing the same.

4. The Executive Engineer (E) should make early arrangement to procure the materials stipulated for supply to the contractor.

1. Item rate tenders for the RATE CONTRACT are invited on behalf of the BSNL for following work from the contractors :-

NAME OF WORK :-“Providing Free cooling system for BTS/Exchange sites under BSNL Bihar Electrical Zone, Patna .”

TENDER OPENING DIVISION: - BSNL Electrical Division, Patna. ESTIMATED COST: - Rs. 59,70,600/- (This estimate however is given merely as a rough guide.) EMD: - Rs.1,19.412/- COST OF TENDER DOCUMENT: - Rs. 1000/- + Service Tax TIME:- 6 (six) months for RC and 1 (one) month for individual work. PERFORMANCE GUARANTEE:- The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value subject to a maximum of Rs. 5 lacs for each telecom territorial circle in the form of Bank Guarantee of a Nationalized / Scheduled Bank in a standard format)/ CDR/FDR/DD within two weeks from the date of issue of award letter. The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of work.

SECURITY DEPOSIT: - In addition to performance guarantee stated above, a sum @ 5% of the tendered amount of individual agreement shall be deducted from the Running Bill of the contractor.

1.1 Tenders will be issued to eligible contractors satisfying under mentioned eligibility condition:- Criteria of eligibility for issue of tender documents - The Contractors satisfying the following conditions:- Average annual turnover during the last 3 years, ending 31

st March of the previous financial year, should

be at least 30% of the estimated cost put to tender.

AND

Experience of having successfully completed similar works in at least 149 sites in Central Government /State Government /Central Autonomous Body/Central Public Sector Undertaking / licensed telecom operator during last 7 years ending last day of the month previous to the one in which applications are invited. Testimonials of satisfactory work completion from the Department concerned shall be obtained from an officer not below the rank of Executive Engineer

The Contractor shall submit and confirm following documents duly attested from a gazetted officer or certified by any BSNL Executive not below the rank of Executive Engineer.

02. a) Printed forms of tenders consisting of the detailed plans, complete specifications, the schedule of quantities of the various classes of works to be done and the set of conditions of contract to be complied with by the persons whose tender may be accepted, can be purchased, at the Divisional office between 11:00 hrs and 16:00 hrs. every day except on Sundays and public Holidays on payment of Rs.1,000/- + Service Tax in cash/ DD of a scheduled Bank or Nationalized Bank / State Bank guaranteed by Reserve Bank of India in favour of Accounts Officer(Cash) ,o/o The PGMTD Patna. (b) The site for the work shall be made available in parts. This is a Rate Contract, and LOI for individual work shall be issued and individual agreement shall be framed for each work. In case the agency fails to start any awarded work, proportionate Performance Guarantee for the awarded amount shall be forfeited. Generally the work is to be carried out in jurisdiction of respective Division under CE (E), Bihar as per the LOI issued. (c) The tender forms can also be downloaded from our website www.tender.bsnl.co.in. 03. Tenders which should always be placed in sealed covers with the name of the work written on the envelope will be received by the Executive Engineer (Elect.), Electrical Division, PATNA Up to 15.00 hrs on 19.01.2015and will be opened by him in his office on the same day at 15.30 hrs. 04.The time allowed for carrying out the individual work will be 1 (one) month from the10th day after the date of written order to commence the work. However the currency of contract shall be six months.. 05. Issue of tender form will be stopped on 17.01.2015 i.e, two days before the date fixed for opening of tenders. Tenders will be sold on working days, no tenders will be sold after 16:00 hours. 06. a) Earnest Money amounting to Rs.1,19,412/- in the form of Demand Draft/ FDR/ BG/ CDR of a nationalized/ scheduled bank guaranteed by the Reserve Bank of India, drawn in favour of Accounts Officer (cash) O/o The PGMTD Patna must accompany each tender and each tender should be in two sealed covers marked as „1

st Cover‟ & „2

nd Cover‟. The 1

st cover should contain the EMD in proper form and other cover should

contain the tender documents, superscribed as Tender for the work of “Providing Free cooling system for BTS/Exchange sites under BSNL Bihar Electrical Zone, Patna” and addressed to Executive Engineer (Electrical), BSNL Electrical Division, Patna. The Validity period of EMD is 120 days, from the date of opening of tender. In case of downloaded tenders, each tender should be in two sealed covers, first containing credentials for meeting the Eligibility conditions alongwith the cost of tenders and EMD in proper form, second cover containing tender documents. The second envelope shall not be opened in the following cases:-

i) EMD is not in proper form.

ii) Tender fee is not submitted in proper form - In case of downloaded tenders

iii) Firm fails to fulfill eligibility criteria on the basis of document submitted in the first envelope - In case of downloaded tenders NOTE:- i) If any difference/ discrepancies is/are found between downloaded tender form and hard copy issued from Division Office, the contents in the Draft NIT issued from C.E. (E)‟s office will be final & binding.

ii) A clear print out of tender document shall be taken on good quality A4 size paper and the printer settings etc, shall be such that the document is printed as appearing in the web and without any change

in format, number of pages etc. and shall also ensure that no page is missing, Only original computer print out of the document shall be used. Photocopy shall not be accepted.

iii) There shall be no correction / addition/ alteration / omission made in the text of the downloaded tender document. If found otherwise, the same shall be treated as non- responsive and rejected. b) The EMD of all the unsuccessful tenderers shall be released on issue of award letter to the successful tenderer. c) Exemption from payment of earnest money and security deposit by any other unit/ department shall not hold good for BSNL. 07. a) The contractor should submit and confirm Chartered Accountant Certificate in respect of turnover and other registration certificate [Enlistment in BSNL, Electrical License, Sales Tax] with attested copies (self attested and counter attested by any executive of BSNL/MTNL or Gazetted officer of GOI) as applicable along with the application on printed letter head for purchase of tender. b)The contractor shall submit and confirm his permanent account number (PAN) issued by the Income Tax Department. c) The tenderer should submit the valid WCT/Sales Tax/ VAT registration certificate. 08. i) PERFORMANCE GUARANTEE:- As per NIT Schedule 1g) . ii) SECURITY DEPOSIT: - As per NIT Schedule 1h) . 09. The acceptance of a tender will rest with the Chief Engineer (E), who does not bind himself to accept the lowest tender or any other tender and reserves to himself the authority to reject lowest or all the tenders received without assigning any reason. All tenders in which any of the prescribed conditions are not fulfilled or incomplete in any respect are liable to be rejected. Tenders with any condition including that of conditional rebates shall be rejected forthwith summarily. 10. Canvassing in connection with tender is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable for rejection.

11. The BSNL reserves itself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted. 12. i) The tenderer should give a certificate that none of his/her relative is employed in BSNL units. In case of proprietorship firm, certificate will be given by the proprietor and for partnership firm certificate will be given by all the Directors of the company. ii) Near relatives of all BSNL employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. The near relatives for this purpose are defined as:- a) Members of a Hindu Undivided family b) They are husband and wife. c) The one is related to the other in the manner as father, mother, son(s) & son's wife(daughter-in-law), Daughter(s) & daughter's husband(son-in-law), brother(s) & brother's wife, sister(s) & sister's husband(brother -in-law). iii) The company or firm or any other person is not permitted to tender for works in BSNL Unit in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer/Chief Archt./Corporate Office for non executive employees and all SSA in a circle including circle office/Chief Eng./Chief Archt./Corporate office for executive employees (including those called as Gazetted officers at present). The tenderer should give a certificate that none of his/her such near relative is working in the units as defined above where he is going to apply for tender/work, for proprietorship I parternership firms and limited company certificate shall be given by the authorized signatory of the firm. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/performance guarantee will be forfeited at any stage whenever it is so noticed. BSNL will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit. The format of the certificate to be given is enclosed.

13. No employee in BSNL/Govt. of India is allowed to work as a contractor for a period of two years of his retirement from service without the prior permission. The contract is liable to be cancelled if either the contractor or any of his employees is found at any time to be such a person who had not obtained the permission as aforesaid before submission of tender and engagement in the contractors service. 14. The tender for the works shall not be witnessed by the contractor who himself/themselves has/ have tendered or who may and has/have tender for the same work. Failure to observe this condition would render tenders of the contractors tendering as witnessing the tender is/are liable for summarily rejection. 15. It will be obligatory on the part of the tenderer to sign each page of the Schedule of work and the tender documents for all the component parts and after the work is awarded he will have to enter into a separate agreement for each component with the officer concerned. 16. Any tender not submitted in proper manner or if it contains too many corrections, over writings of absurd rates, and absurd amount will be liable to be rejected and the BSNL will be at liberty to take such action as it may deem fit without any reference to the tenderer. 17. The tenders for the work shall remain open for acceptance for a period of 90 days from the date of opening of the tenders. If any tenderer withdraws his tender before the said period or makes any modification in the terms and conditions of the tender which is not acceptable to the BSNL shall, without prejudice to any other right of remedy be at liberty to forfeit 50% (fifty percent only) of the said earnest money absolutely.

18. Extension of validity:- In case, where the letter of award of work cannot be placed within the validity period of the tender, the BSNL can request all tenderers to extend the validity of their respective tenders and the Earnest Money deposit by a reasonable period. In such cases, extension of validity of Earnest Money deposit by 30 days beyond the extended validity date of tender should also be asked for. While BSNL can make the request for extension, the tenderer is free to either extend the validity or refuse the request to extend the validity. 19. Unsealed tenders will be summarily rejected. 20. The contractor should read the tender documents carefully before submitting the tender. 21. Agreement shall be drawn with the successful tenderer on prescribed form BSNL EW8. Tenderer shall quote his rates as per various terms and conditions of the said form, which will form part of the agreement. 22. The tenderer shall furnish a declaration to this effect (incase downloaded tender) that no addition/deletion/correction have been made in the tender document submitted and is identical to the tender document appearing on website. Every page of downloaded tender shall be signed by the tenderer with stamp (seal) of his firm /organization. 23. This Notice Inviting Tender shall form part of the Contract document. The successful tenderer/contractor on acceptance of his tender by the Accepting authority, shall, within 15 days from the stipulated date of start of the work, sign the contract consisting of :-

a) The Notice Inviting Tender, all the documents including additional conditions, specifications and drawings, if any forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.

b) Standard form BSNL EW8.

All works proposed for execution by contractor will be notified in a form of invitation to tender displayed on Notice Board in select BSNL offices and signed by the officer inviting tender or by publication in News papers/internet (designated web page) as the case may be. 2. This form will state the work to be carried out, as well as the date of submitting and opening tenders and the time allowed for carrying out the work; also the amount of earnest money to be deposited with the tender, and the amount of performance guarantee to be deposited by the successful tenderer(s). Copies of the specifications, designs and drawings and any other documents required in connection with the work signed for the purpose of identification by the Officer inviting tender shall also be open for inspection by the contractor at the office of Officer inviting tender during office hours. 3. In the event of the tender being submitted by a firm it must be signed by the authorized signatory. 4. Receipts for payments made on account of work when executed by a firm, must also be signed by authorized signatory. 5. Any person who submits a tender shall fill up the usual printed form stating at what rate he is willing to undertake each item of the work. Tenders, which propose any alteration in the work specified in the said form of invitation to tender, or in the time allowed for carrying out the work, or which contain any other condition of any sort including conditional rebates will be summarily rejected. However, tenders with unconditional rebate will be acceptable. No single tender shall include more than one work, but contractors who wish to tender for two or more works shall submit separate tender for each. Tenders shall have the name and number of the works to which they refer written on the envelopes. The rates(s) must be quoted in decimal coinage. Amounts must be quoted in full rupees by ignoring fifty paise and considering more than fifty paise as rupee one. 6. The Officer inviting tender or his duly authorized assistant will open tenders in the presence of any intending contractors who may be present at the time, and will enter the amounts of the several tenders in a Comparative Statement in a suitable form. In the event of a tender being accepted, a receipt for the earnest money forwarded therewith shall thereupon be given to the contractor who shall thereupon for the purpose of identification sign copies of the specifications and other documents mentioned in Rule 1. In the event of a tender being rejected, the earnest money forwarded with such unaccepted tender shall thereupon be returned to the contractor, remitting the same, without any interest. 7. The officer inviting tenders shall have the right of rejecting all or any of the tenders, and, will not be bound to accept the lowest or any other tender. 8. The receipt of an accountant or clerk for any money paid by the contractor will not be considered as any acknowledgement of payment, to the Officer inviting tender and the contractors shall be responsible for seeing that he procures a receipt signed by the concerned Accounts Officer. 9. The memorandum of work tendered for and the schedule of materials to be supplied by BSNL shall be filled and completed in the office of the Officer inviting tender before the tender form is issued. If a form is issued to an intending tenderer without having been so filled in and incomplete, he shall request the officer to have this done before he completes and delivers his tender. 10. The tenderer shall sign a declaration under the officials Secret Act, 1923 for maintaining secrecy of the tender documents drawings or other records connected with the work given to them. The unsuccessful tenderers shall return all the drawings given to them. 11. Rates quoted by the Contractor in the tender both in figures and words shall be accurately filled-in so that there is no discrepancy in the rates written in figures & words. However, if a discrepancy is found the rates which correspond with the amount worked out by the contractor shall unless otherwise proved be taken as correct. If the amount of an item is not worked out by the contractor or it does not correspond with the rates written in either in figures or words then the rates quoted by the contractor in words shall be taken as correct. Where the rates quoted by the contractor in figures and in words tally but the amount is not worked out correctly, the rates quoted by the contractor will unless otherwise proved be taken as correct and not the amount. 12. Performance Guarantee / Security Deposit: As per the NIT Schedule 1g) & 1h).

13. All rates shall be quoted on the tender form. The amount for each item should be worked out and requisite totals given. Special care should be taken to write the rates in figures as well as in words and the amount in figures only, in such a way that interpolation is not possible. The total amount should be written both in figures and words. In case of figures, the word „Rs.‟ Should be written before the figure of rupees and word „P‟ after the decimal figures, e.g. „Rs.2.15 P‟ and in case of words, the word, „ Rupees‟ should precede and the word „Paise‟ should be written at the end. Unless the rate is in whole rupees and followed by the word „only‟ it should invariably be upto two decimal places. While quoting the rate in schedule of quantities, the word‟ „only‟ should be written closely following the amount and it should not be written in the next line. 14.A. The bidder shall give the total composite price inclusive of all Central & state‟s levies and taxes i.e. Sales-tax, purchase tax, turnover tax, service tax, works contract tax etc. or any other taxes or duties like octroi, local area development tax on materials / labour etc. However the evaluation and comparison of respective bids shall be done on the basis of net cost to BSNL on the total cost offered inclusive of duties and taxes (but excluding CENVAT-able duties and taxes) sales tax, packing, forwarding ,freight and insurance charges etc. 14.B. The total composite price shall comprise of unit price and all other components of price need to be individually indicated quoted against the goods/material/service, it proposes to supply under the contract in the following manner:- i) The Basic Unit Price (Ex-Factory Price) of the goods /services/ materials, Excise Duty, Sales Tax, Freight, Forwarding, Packing, service tax, insurance and any other levies /charges already paid or payable by the contractor/ supplier shall be quoted separately. ii) The liability to pay all taxes, levies, etc shall be of contractor and BSNL will not entertain any claim whatsoever in this respect. 14C No concessional form except Sales Tax form „C‟ for the items as specified in the schedule of works and meant for use in BSNL, shall be provided by BSNL. Form „ C‟ shall be provided by the BSNL only on the specific request of the contractor.” • The unit wise cost / break up is necessary for the purposes of information and verification of composite price so quoted by the contractor/supplier. • The contractor/supplier shall submit to BSNL documents /proof of payment of all taxes / levies alongwith exemption certificate if any, to avail CENVAT benefits by BSNL • However the evaluation and comparison of respective bids shall be done on the basis of net cost to BSNL on the total cost offered inclusive of duties and taxes (but –excluding CENVAT-able duties and taxes) sales tax, packing, forwarding, freight and insurance charges etc. 15.A. However, pursuant to the constitution (forty-sixth amendment) act, 1982, if any further tax or levy is imposed by statute, after the last date of receipt of tenders, and the contractors thereupon necessarily and properly pays such taxes/ levies, the contractor shall be reimbursed the amount so paid, provided such payment, if any, is not in the opinion of Superintending engineer (whose decision shall be final and binding) be attributable to delay in execution of work within the control of contractor. 15.B. In case of statutory variation in regard to excise duty or service tax within the stipulated date of completion of individual agreement, the same shall be paid or recovered as per the actual against documentary proof. However, beyond this period BSNL will take advantage of any duty reduction but will not pay extra on account of duty increase. 15.C. The contractor shall, keep necessary books of account and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorized representative of BSNL and further shall furnish such other information/ document as engineer-in-charge may require. 16. The Contractor shall, within a period of 30 days of imposition of any further tax or levy in pursuant to the constitution of (forty sixth amendment) act 1982 give a written notice thereof to the Engineer-in-charge that the same is given pursuant to this condition, together with all necessary information relating thereto.

17. BSNL shall deduct work contract tax, income tax and other statutory deductions from payments due to the firm as per rules of the State/Central Government. The Accounts Officer of the concerned Division shall issue certificates for such deductions to the firm. 18. The tender for the work shall not be witnessed by a contractor or contractors who himself/ themselves has/have tendered or who may and has/have tendered for the same work. Failure to observe this condition would render, tenders of the contractors tendering, as well as witnessing the tender, liable to summary rejection. 19. Other agencies will also simultaneously execute the works like horticulture, external services, installation of telephone exchange equipment and other building works for the same project alongwith this work in particular. The contractor shall afford necessary facilities for the same. No claim in the matter shall be entertained.

20. Some restrictions may be imposed by the security staff etc on the working and/or movement of labour, material etc. The contractor shall be bound to follow all such restrictions /instructions and nothing extra shall be payable on this account. 21. The contractor shall comply with the provisions of the Apprentices Act 1961, and the rules and orders issued there under from time to time. If he fails to do so, his failure will be a breach of the contract and the Engineer-in-charge may in his discretion without prejudice to any other right or remedy available in law cancel the contract. The contractor shall also be liable for any pecuniary liability arising on account of any violation by him of the provisions of the said Act. 22. Agency has to observe all labour rules and regulations in force. Agency shall be fully responsible for any violation observed at any time. 23. Bye laws Indemnity against liabilities:- • The contractor shall comply with all by laws and regulations of the local and statutory authorities having jurisdiction over the works and shall be responsible for payment of all fees and other charges and giving and receiving all necessary notices and keep the Engineer –in-charge informed about the notices issued and received. • The contractor shall indemnify the department against all claims in respect of patent rights design, trademark or name of other protected rights in respect of any plant, machine, work or materials used for or in connection with the works or temporary works and from and against all claims demands, proceedings, costs, charges and expenses whatsoever in respect of or in relation thereto. The contractor shall defend all actions arising from such claims and shall himself pay all royalties, License fees, damages, costs and charges of all and every sort that may be legally incurred in respect hereof shall be borne by the contractor. • All liabilities / penal recoveries on matters arising out of tax/excise /levies such as incorrect deductions discrepancies in the filing of returns, revised assessments by the concerned authorities etc, shall be borne by the contractor. 24. Rates quoted by the contractor shall be firm and shall be valid for the currency of contract. No cost escalation shall be permitted during the currency of contract.

SCHEDULE “D”

(Relevant terms and conditions of standard BSNL Contract documents EW-8 shall be modified to the extent in schedule “D”)

The firm shall read carefully the following conditions and shall quote accordingly confirming all the points in their offer.

CONDITIONS OF CONTRACT

1. CENVAT CREDIT:- In order to avail CENVAT credit as per CENVAT Credit Rules 2004,

BSNL, who is an output service provider, is entitled for duty credit. In order to avail the

CENVAT credit, the contractor has to furnish an invoice favoring BSNL indicating the following

at the time of delivery:-

a) Basic value of goods excluding the excised duty and education cess on ED.

b) Excise Duty and Education Cess on excise duty

c) Sales tax and any other duties and taxes.

d) Packing forwarding, insurance and other levies.

e) Tariff Schedule Head No.

f) SERVICE TAX shall be included in the quoted rates. The agency shall pay the Service

Tax at the prevailing rate together with Education Cess to the Excise Department and

submit the proof of the last paid bills for claiming CENVAT credit. If the contractor fails

to pay the due service tax together with Education Cess the same shall be paid by BSNL

to the concerned Excise Department and the corresponding amount along with

compensation amount equal to 10% of the amount paid to the Excise Department shall

be deducted by BSNL from the contractor bill.

2. EPF REGISTRATION:- The EPF contribution of both employer and employee shall

be deposited by the contractor with the EPF authorities. The documentary proof of such

contributions shall be produced to the BSNL. In case of failure on the part of the

contractor the corresponding amount will be deposited by the BSNL with the EPF

authorities and such amount together with the 10% compensation shall be recovered

from the payment due to the contractor.

3. QUOTING OF RATES:-

The rates quoted shall be inclusive of levies and taxes, packing, forwarding, freight and

insurance as mentioned

THE EVALUATION AND COMPARISON OF RESPONSIVE TENDER SHALL

BE DONE ON BASIS OF NET COST TO THE BSNL ON THE PRICES OF THE ITEMS

OFFERED INCLUSIVE OF DUTIES AND TAXES, SALES TAX, PACKING,

FORWARDING, FREIGHT AND INSURANCE CHARGES ETC. BUT EXCLUSIVE OF

CENVAT-ABLE DUTIES AND TAXES.

o Duties and taxes for which the firm has to furnish CENVAT-able Challans / Invoices

will be indicated separately.

o Contractors should furnish the correct E.D tariff head in the price Schedule. If the credit

for the duties and taxes under CENVAT Credit rules, 2004 is found to be not admissible

at any stage subsequently owing to wrong furnishing of Tariff head, then the contractor

will be liable to refund such non-admissible amount, if already paid alongwith penalty if

charged by the concerned authority.

o In case the duties & taxes which are non CENVAT- able as per the quotes indicated in

the price schedule by the contractor and subsequently at any stage it is found that Credit

for such Duties & Taxes is admissible as per CENVAT Credit Rules, 2004, the vendors

will be liable to refund the amount equivalent to such Duties & Taxes if already paid to

them. However, BSNL may allow the contractor to submit necessary documents in this

regard which may enable BSNL to avail the CENVAT credit provided such credit is still

available for the amount so paid as per CENVAT Credit Rules 2004.

4 INCREASE/ DECREASE OF TENDERED QUANTITY

a) BSNL will have the right to increase or decrease up to 25% of the contract value

depending upon the requirement of goods and services specified in the schedule of items

without any change in the unit price or other terms and conditions at the time of award of

contract, at any time during the currency of the contract.

b) In exceptional situation where the requirement is of an emergent nature and it is

necessary to ensure continued supplies from the existing venders, the purchaser reserves

the right to place repeat order up to 50% of the quantities of goods and services

contained in the running tender /contract within a period of twelve months from date of

award of work at the same rate or a rate negotiated (downwardly) with the existing

venders considering the reasonability of rates based on prevailing market conditions and

the impact of reduction in duties and taxes etc.

5. WORK/QUANTITY DISTRIBUTION:

The Department will split up the work quantities of items of work (Schedule of

work) to first two lowest firms if L2 agrees to match the rate of L1.

(a) In case the work is split amongst the first two lowest firms, the proportion of

work distribution shall be as follows: -

(i) 70% to the first lowest tenderer.

(ii) 30% to the second lowest tenderer.

(b) In case the second lowest tenderer does not agree to accept the rates of lowest tenderer then 100% work shall be awarded to the first lowest tenderer.

6. VARIATION IN EXCISE DUTY

(a) In case of statutory variation in regard to excise duty, within the stipulated date of

completion of individual agreement, the same shall be paid or recovered as per

the actual against documentary proof.

(b) Tendered rates are inclusive of taxes and levies payable under the respective

statutes. However, pursuant to the Constitution (Forty Six Amendment) Act

1982, if any further tax or levy is imposed by statute after the date of receipt of

tenders and the contractor(s) thereupon necessarily and properly pays taxes or

levies, the contractor(s) shall be reimbursed the amount so paid, provided such

payment, if any, is not in the opinion of SE (whose decision shall be final and

binding) attributable to delay in execution of work within the control of the

contractor(s).

(c) The contractor(s) shall keep necessary books of accounts and other documents for

the purpose of this condition as may be necessary and shall allow inspection of

the same by a duly authorized representative of Government and shall furnish

such other information/documents as the Engineer-in-charge may require.

(d) The contractor(s) shall within a period of 30 days of imposition of any further tax

or levy pursuant to the constitution (Forty Six-Amendment) Act 1982 give a

written notice thereof to the Engineer-in-Charge that the same is given pursuant

to this condition together with all necessary information relating thereto.

NOTE: - No additional condition whatsoever will be accepted for turnover

tax/sales tax on works contract. In case of additional conditions for the

payment of such claim by the contractor, the tender will not be

considered by the accepting authority.

7. Conditions of Rate Contract:- a) The rate contract shall remain in force for a period of SIX MONTHS to be reckoned from the

date of acceptance of work by the Chief Engineer (E) and extendable for another 6 months with mutual consent. The time allowed for individual work is ONE MONTH from the 10th day after the date of award by EE (E).

b) Rates incorporated in the Rate Contract in respect of different items are uniformly applicable to all the works in the state of Bihar irrespective of their geographical locations.

c) The operation of the Rate Contract is for bonafide use of this department only and is further

restricted to only such works as authorized by CE (E), BSNL Bihar Zone, Patna.

8. Operation of Master and Individual agreements shall be governed as follows:- It is a consolidated contract for a number of works to be executed at different sites in the

state of Bihar. FOR SUPPLY AND ITC & MISC. ITEMS:- a. Separate Letter of Intent (LOI) shall be issued for Supply & ITC items by the C.E.(E), Patna to the firm giving details of site, name of concerned EE (E) and other relevant details. b. On the basis of LOI issued, EE shall draw separate individual agreements for “Supply portion” & “ITC portion” based on above letter of intent.

c. Date of start of individual agreement shall be reckoned from the 10th day after the date of issue of the Work Order by the E.E(E).

d. Individual agreement shall be operated independently without co-relation with the other individual agreements for the purpose of payment, deduction/release of Security Deposit, extension of time, closing of contract etc. as per terms and conditions of individual agreement. If the firm fails to commence any work, the proportionate PG of the work shall be forfeited.

e. The formal agreement for each work allotted shall be drawn between EE (E) concerned and the contractor. Such agreement (s) shall incorporate the following.

a. LOI issued by the office of Chief Engineer (E). b. Award letter issued by EE (E) c. Abstract of cost along with schedule and specification as per LOI. d. BSNL EW-6 & 8 and other terms and conditions as per specimen draft

agreement. f. S.D and other deposits as per terms and conditions of individual agreement shall be kept with the concern EE (E) and refunded / adjusted as per relevant clause of individual agreement.

9. The firm has to fulfill / compliance of the provisions of EPF & Misc. Provisions Act 1952 & Employees‟ Provident Fund Scheme 1952.The each claim bill of contractors must accompany the 1) List showing the details of laborers / employees engaged. 2) Duration of their engagement. 3) The amount of wages paid to such laborers / employees for the duration in question. 4) Amount of EPF contributions (both employer‟s and employees contribution) for the duration of engagement in question, paid to the EPF authorities. 5) Copies of authenticated documents of payments of such contribution to EPF authorities and 6) A declaration from the contractors regarding compliance of the conditions of EPF Act, 1952.

10. PAYMENT TERM: -

i) a) For supply items, 85% of the price shall be paid on receipt of goods at site by the consignee. For claiming this payment the following documents are to be supplied to the paying authority:-

i. Excise gate pass / Invoice or equivalent document favoring BSNL shall be supplied by the supplier.

ii. Delivery challan. iii. Consignee receipt. iv. Proof of payment of octroi / entry tax, if any

b) 15% of pro-rata of the approved contract value after successful commissioning of unit.

ii) For I.T.C items, 100% payment shall be done after successful commissioning.

SCHEDULE “D”

SECTION-I

(A) SPECIFICATION OF FREE COOLING SYSTEM FOR BTS SHELTERS/EXCHANGES (DC version)

Supply Voltage

System shall be able to work at a nominal voltage of 48V (42V to 56V range), DC supply.

Power Consumption

The selection of fans and other equipments shall be based on energy efficient and only reputed makes consuming minimum power only shall be selected

Working ambient temperature < 30oC maintaining the inside temperature below 32oC & RH 60%.

Working ambient relative humidity Up to 60%. No condensing dew. Adjustable in the 60% - 70% Range.

Working Logic

The free cooling system in a normal mode shall operate whenever the ambient temperature is < 30oC and through a logical controller which will switch OFF the Air-conditioners. The fans of the free cooling system will provide the necessary ventilation/cooling in BTS. When the BTS shelter inside temperature reaches 33oC, the

first AC unit is switched ON and whenever it reaches 35oC, the 2nd AC unit is switched ON through the AC controller.

Air inlet configuration

Inlet unit shall be installed as low as possible at a position which allows proper air circulation in the shelter and there is no hindrance for suction of fresh air. 42V to 56V DC powered step less variable speed electronically commutated motor with centrifugal fan with backward curved blower suitable for delivering a minimum of 1200 CFM at the outlet of damper/grill and shall be having capacity to overcome the static pressure drop across the air filter/damper/grill, supply air grill /dampers, protection net, HDPE washable micro-vee fine filters - EU4 with filtration up to 90% down to 20 microns. The filter shall be easily removable. The top cover of the unit shall be sufficiently inclined to prevent rain water accumulation. Air suction shall be through bottom of unit and air discharge from front open able dampers/grill.

Air outlet configuration

Gravity based dampers without any fan operating on pressure built up inside due to working of inlet fan and inside grills provided with worm protection net. The assembly shall ensure no water / rain water leak into the shelter. The damper is closed when AC units are operating and damper will open when the fresh air blower fan is working. Outlet unit shall be installed diagonally opposite (as far as possible, suitable to site condition) to the free cooling inlet unit above door height as far as possible. This should be adequately sealed to prevent any leakage of cool air when AC unit is ON.

Airflow at full capacity Minimum 1200 CFM

Microprocessor based controller

The Control unit (controller) shall be provided to automatically control the operation of Free cooling Unit in all possible conditions in telecommunications equipment room in auto mode. It shall also have facility to switch ON and OFF the air conditioning units installed in the room. There shall be provision to terminate AC units supply wiring (2 Nos) IN/OUT to the controller. Auto Mode Operation – 1. Under favourable environment conditions, the controller shall switch OFF the air-conditioning unit and start free cooling.

2. Whenever room temperature rises above set temperature, then Controller shall switch OFF the Free cooling Unit and switch ON the air-conditioning unit. 3. Controller shall have provision to measure Run Hour of Free cooling system and cooling with A/C units. 4. Whenever the temperature of BTS room exceeds set temperature (site settable) say, 40oC on account of A/C failure or any other reason, there should be a provision to start Free Cooling Unit again

through controller for emergency cooling. Provision for extending the high temperature alarm through NO/NC contact shall be available. 5. There shall be provision to display the ambient and room temperature as well as RH in the controller.

6. Controller shall have the provision to change the temperature/RH settings through key pad at site. 7. The controller shall have Green LEDs for Power, Fan ON indication & Red LEDs for alarm indication. One potential free contact for remote alarm shall be provided. 8. Power to existing AC units (2 nos) shall be routed through controller by providing two electro-mechanical power relays. 9. The controller shall have real time clock. 10. The controller shall have the provision to interchange the sequence of operation of AC units 1 & 2. 11. It should be possible to automatically switch off the Free Cooling Unit when the battery voltage is at site settable value in the range of 42V to 56V 12. On receiving alarm signal from the Fire Panel the Free Cooling Unit should switch off and the controller indication should show Fire Alarm. The alarm LED should be turned ON. 13. The controller shall be capable of storing the data for a minimum of 2 months.

INSTALLATION

1. Making suitable openings /cut outs in the shelter /wall for inlet & outlet unit shall be the firms responsibility.

2. The power for free cooling unit shall be drawn from the dc DB after providing a 10 A dc MCB.

3. The firm shall be responsible for installation, testing and commissioning of Free cooling system on turnkey basis

4. Extension of power to the units, power supply for the AC units, control wiring etc shall be done by the contractor. The control wiring shall be done through flexible PVC conduit properly clamped as per the direction of the Engineer in-Charge.

5. All electrical works shall comply with Indian Electricity rules and C.P.W.D general specifications for Electrical work.

6. Both AC and DC wiring shall be run through different conduits

Note:- 1. The agency shall offer the free cooling system for proto type inspection by the BSNL representatives for approval before supply to various sites. 2. Warrantee for the system:- The agency shall offer warrantee for the free cooling system for one year from the date of commissioning including replacement of all faulty components at free of cost to BSNL. 3. The agency shall hang a laminated operation manual in the room near to the Inlet unit. A separate laminated instruction on cleaning and maintaining the air filter shall be fixed near the filter unit.

SCHEDULE “D” SECTION – II

SPECIFICATIONS FOR ELECTRICAL WORK

1. Scope This section sets out the basic requirement for switchboards, electrical power wiring to

individual motors and other equipments, control circuit wiring and earthing etc. 2. General

1. Unless otherwise specified particularly the entire equipment shall be suitable for operation on 415 volts/240 volts, 50Hz earthed neutral, 3/single-phase alternating current system as may be required.

2. All components, accessories, raw materials and finished parts used in manufacture and

assembly of switch boards, power and control circuit wiring and earthing system shall comply with the relevant Indian Standards amended up to date. Where Indian Standards do not exist British Standards shall apply.

3. The entire work shall comply with Indian Electricity rules and C.P.W.D general

specifications for electrical work. Particular care shall be taken to ensure compliance to I. E. rules 41, 45, 51 and 61.

4. When cables pass through pipes, wooden bushes shall be provided at both the ends.

When cables are required to pass through floors or walls, pipe inserts shall be provided and openings sealed in approved manner.

3. Control Wiring

1. Control circuit wiring shall be carried out with 250 volts grade PVC insulated armored multi core copper conductor cables.

2. Control cables shall be of adequate cross sections to restrict the voltage drop but each

conductor shall be not less than 1.5 sq. mm. 3. Runs of control wires within the switchboard shall be neatly bunched and suitably

supported / clamped. Means shall be provided for easy identification of the control wires by means of labeled ferrules.

4. The control wiring shall correspond to the circuit / sequence of operations and inter locks

as required for satisfactory performance of the plant.

4. Earthing 1. In accordance with Rule 61 of IE Rules, metallic frame of all medium voltage equipments /

supporting frames, shall in all cases be connected to 2 separate and distinct earths. The size of such earth wires shall be not less than 4-mm dia. GI wire.
