APPELLEES' RESPONSE IN OPPOSITION TO EXPEDITED MOTION FORAPPOINTMENT OF COUNSEL

Appellant has moved this Court to appoint counsel on his behalf. This case has

concluded. A mandate has been issued by this Court on October 21, 2014. No further litigation

will go forward. Counsel for appellant is unnecessary. Nevertheless Appellant asserts he needs

an appointed lawyer to oversee the execution of this Court's order, to participate in any

mediation conferences, and to insure that the substantive errors of Keith's record are corrected.

The Ohio Adult Parole Authority ("OAPA") is working with Keith to correct his record, and the

record is being corrected (Exhibit 1, Oct. 14th Letter and exhibits). The OAPA continues to

receive correspondence from Appellant (Exhibit 2) and is still investigating the record pursuant

to this Court's decision and order. Appointed counsel is unnecessary.

"Unless there is a showing of exceptional circumstances justifying the appointment of

counsel, an individual plaintiff is not ordinarily entitled to a court-appointed attorney in a civil

action." Smith v. Ohio Dept. ofRelaab. & CoYY., 104 Ohio App.3d 210, 214 (10th Dist. 1995),

citing Perotti v. Ohio Dept. ofRehab. & Corr., 61 Ohio App.3d 86 (loth Dist. 1989). "This court

notes that appellant filed numerous documents in the trial court and does not appear to have been

prejudiced by the trial court's failure to appoint him counsel. Instead, it appears that appellant

prosecuted his action in the same manner as other pro se inmates. Appellant has not shown that

the trial court abused its discretion in not appointing counsel to handle appellant's case." Smith,

104 Ohio App.3d at 214. Here, Appellant filed numerous documents in the lower court, and

appears to have prosecuted his action in a manner similar to other pro se inmates, if not more

effectively. He has not shown extraordinary circumstances justifying the appointment of

counsel.

Appellant argues that Appellees should be penalized with the costs of appointed counsel

because he wrote letters to counsels for the ODRC and the Ohio Attorney General (who were

representing the ODRC) requesting that "an examination of his record and files be performed, to

determine the validity of the claimed errors in his record and that additional/continued litigation

be eliminated." (Motion for Counsel, p. 3). At the time in the course of litigation when he wrote

these letters - May 10, 2013, August 5, 2013, and August 12, 2013 - the Magistrate Judge in the

10tb District Court of Appeals (on January 16, 2013) and the 10th District (on June 18, 2013) had

already ruled in Appellees' favor. As made clear in his letter to Assistant Attorney General

Stacy Hannan, he already asked the Ohio Public Defender to perform the exact act he asked

counsels for the ODRC to perform. (Motion, Attachment #2, p. 2: "A simple examination of the

record, such as was done by the Office of the Ohio Public Defender..."). It was the duty of

counsels for the ODRC to defend the favorable rulings of the 10th District, as opposed to

acquiescing to the opposing party's requests. Thus, Appellees should not have to bear the

punitive cost for appointed counsel, for avoiding a situation that would have constituted a

conflict of interest.

In any case, Appellant has proved to be very effective at acting as his own lawyer. His

portrayal of himself as an unskilled, unlearned layman (Motion, p. 1) is quite off the mark. His

claims of the difficulty in accessing the law library, or typewriters (Motion, p. 1), are vague, and

in any case, the record before this Court, and in the 10th District, reveals that Appellant has had

no difficulty advocating on his own behalf. Counsel for Appellees is anenable in allowing

extensions of time if Appellant has difficulty timely prosecuting his case due to the constraints of

incarceration. Of course, there is no more "case" left to prosecute - only the implementation of

the remedy remains, which, as demonstrated, is occurring.

For the foregoing reasons, this Court should dismiss Appellant's motion to appoint

counsel.

Dear Mr. Keith,

As you may have been aware, the Ohio Supreme Court issued a judgment in thiscase in your favor, reversing the decision of the Tenth District Court of Appeals. In theirorder, the Ohio Supreme Court stated the following:

[W]here a credible allegation of substantive inaccuracies in a prisoner'srecord is made, the OAPA is obligated to correct those errors beforeconsidering the inmate for parole. We therefore reverse and grant a writordering appellees to investigate Keith's allegations and correct anysubstantive errors in the record used to consider hiin for parole.

Pursuant to the Court's order, the Ohio Parole Board has examined your claims oferror in the lower court record. Attached to this letter is the original decision sheet fromyour February 17, 2012 parole hearing, which stated that you were paroled eight times inthe past. The Board has stamped that sheet as "void." The Board has elected to rehearyour case, and plans to convene a new parole hearing as soon as practicable.

I have examined your pleadings before the Tenth District. In a motion tosupplement your complaint, which you filed in the Tenth District on July 5, 2012, youalleged several errors related to a letter Parole Board member Trayce Thalheimer wrote toyou on June 5, 2012. The alleged errors were:

4) Relator was incarcerated as a Technical Parole Violator from 6/24/91until 5/1/2000 and did not appear at any hearing with a hearingofficer.

5) Relator was not released at no hearing on 7/17/92.

The Parole Board reviewed these allegations. Attached to this letter is a letter fromParole Board Chair Cynthia Mausser. In this letter, in response to your first and secondallegations, the Board acknowledges that you were not housed in the London CorrectionalInstitution at the time of your hearing, and that you were actually incarcerated at theRichland Correctional Institution.

The Mausser letter also acknowledges in response to your fifth allegation that youwere not paroled on "7/17/92," and this reference in the June 5, 2012 Thalheimer letter wasmade in error. The actual date of the violation hearing was on July 1.7, 2002.

In your third allegation, you state that you do not recall any discussion with BoardMember Trayce Thalheimer. After looking into this claim, the Board found that Ms.Thalheimer was the primary board member for your hearing on February 17, 2012. Thatmeans that she would have prepared and led the conversation with you. Therefore, despiteyour lack of recollection, you had a conversation with Ms. Thalheimer during your February17, 2012 hearing.

Regarding your fourth allegation, the Parole Board's records show that you wereincarcerated from 1991 until 2000. However, you had the following release considerationhearings during that time: July 2, 1992; March 23, 1993 ; March 23, 1995; May 23, 1995;March 11, 1997; March 11, 1999; December 10, 1999.

The letter from Cynthia Mausser correcting the errors in the June 5, 2012Thalheimer letter will also be a part of your parole record. The Ohio Parole Board has thuscomplied with the order of the Ohio Supreme Court in this xnatter. Contact me if you haveany further questions.
