Jun2009,Jan2010 WiththeaimtoincorporatetheconceptoffinancialplanningandMPFknowledgeintothecurriculumoftheNewSeniorSecondaryLiberalStudies,twotrainingworkshopsnamely“FinancialPlanningandPersonalDevelopment”forsecondaryschoolteacherswereco-organizedwiththeEducationBureauandtheHongKongTeachers’Centrerespectively,tointroducetoteacherstheapplicationofthetopicstotheirteaching.TheimportanceoffinancialmanagementskillsandearlyplanningforMPFinvestmenttoadolescents’personaldevelopmentwaspresented.Ateachingkitwasalsoproducedtoencourageandhelpteacherstoincorporatetherelevantconceptsintheirteaching.

RetirementSchemeshasissuedanexemptioncertificateundersection7oftheORSOandanywithdrawalundersection12oftheORSOhasnotcomeintoeffect;or

b)anoccupationalretirementschemewithinthemeaningoftheORSOwheretheemployeroftheschemeisthegovernmentofaplaceoutsideHongKongoranagencyorundertakingoforbysuchagovernmentwhichisnotoperatedforthepurposeofgain.



ORSOregisteredscheme Meansanoccupationalretirementschemewhichisregisteredundersection18oftheORSO.

ORSOschemeadministrator

Means:a)inthecaseofaschemeorpoolingagreementgovernedbyatrust,thetrustee

concerned;b)inthecaseofaschemeorpoolingagreementwhichisthesubjectofor

regulatedbyaninsurancearrangement,theinsurerconcerned;c)inanyothercase,thepersonwhoisprincipallyresponsibleforthe

managementoftheschemeanditsassetsotherwisethanasapersonwhoissolelyconcernedwiththeinvestmentorcustodyoftheassets.

Poolingagreement Meansanagreementorarrangement:a)whichis:

i) governedbyasingletrust;orii) thesubjectoforregulatedbyaninsurancearrangementincludingaseriesof

insurancearrangementswhichareofthesameclassordescription;b)whichappliesto2ormoreindividualoccupationalretirementschemeseachof

whichis:i) governedbysuchtrust;orii) (whereappropriate)thesubjectoforregulatedbysuchinsurance

arrangement,byvirtueofsuchapplication;

c)underwhich,inthecaseofanagreementorarrangementgovernedbysuchtrust,theassetsofitsparticipatingschemesarevestedwiththeadministratoroftheagreementorarrangement,asthecasemaybe;

d)whichismanaged,inthecaseofanagreementorarrangementgovernedbysuchtrust,byaregisteredtrustcompany;

e)inrelationtowhich,anditsparticipatingschemes,properaccountsandrecordsarekept;and

f) underwhichthevalueoftheassetsattributableto,andtheliabilitiesof,eachofitsparticipatingschemesarereadilydeterminablefromsuchaccountsandrecords.

RegistrarofOccupationalRetirementSchemes

MeanstheMandatoryProvidentFundSchemesAuthority.

Relevantemployer Means,inrelationtoanoccupationalretirementscheme,theemployerwhoprovidestheemploymentwhichentitlesorenablestheemployeetobeamemberofthescheme.

Top-upscheme MeansanoccupationalretirementschemewhichprovidesbenefitssupplementarytothoseprovidedunderanMPFscheme.



(b) MPFSchemes

Accruedbenefits Inrelationtoaregisteredscheme,meanstheamountofeachschememember’sbeneficialinterestintheregisteredschemeatanytime,includingsumsderivedfromthecontributionsmadebyorinrespectofthatschememember,togetherwiththeincomeorprofitsarisingfromanyinvestmentsthereof,buttakingintoaccountanylossesinrespectthereof.

Approvedpooledinvestmentfund

Aninvestmentfundwhichisaninsurancepolicy,authorizedunittrustorauthorizedmutualfundthat:a)complieswiththerequirementssetoutinsection17(2)ofSchedule1tothe

GeneralRegulation;andb)isapprovedbytheMPFA.

Approvedtrustee MeansacompanyoranaturalpersonapprovedbytheMPFAasatrusteeinaccordancewithsection20oftheMPFSO.

Casualemployee Meansarelevantemployeewhoisdeclaredbyanordermadeundersection2(2)oftheMPFSOtobeacasualemployeeforthepurposesoftheMPFSO.Section2(2)oftheMPFSOprovidesthatifrelevantemployees:a)areengagedinanindustryforwhichaprovidentfundschemeisregisteredas

anindustryscheme;andb)employedinthatindustrybyanemployeronadaytodaybasisorforafixed

periodoflessthan60days,theMPFAmay,byorderpublishedintheGazette,declarethoseemployeestobecasualemployeesforthepurposesoftheMPFSO.

Constituentfund Inrelationtoaregisteredscheme,meansthefundthatconstitutesaregisteredscheme,orafundthatformspartofthescheme,andcomplieswiththerequirementssetoutinsection36oftheGeneralRegulation.

Employersponsoredscheme

Meansaregisteredschememembershipofwhichis:a)inthecaseofanemployerwhoisnotacompany,openonlytotheemployees

ofthatemployer;orb)inthecaseofanemployerthatisacompany,openonlytotheemployeesof

thatcompanyoranassociatedcompany.

Industryscheme Meansaprovidentfundschemeregisteredundersection21AoftheMPFSOasanindustryscheme.Suchaschememaybeforthepersonsengaged(whetherasemployeesorasself-employedpersons)inaparticularindustryoraparticularclassofindustriesorin2ormoreindustriesorclassesofindustries.

Mandatorycontribution Meansa)anamountthatisrequiredtobepaidasacontributiontoaregisteredscheme

undersection7Aor7CoftheMPFSO;b)anamountthatisrequiredtobepaidasacontributiontotheMPFAunder

section7AAoftheMPFSO;c)anamountthatispayabletotheMPFAundersection7AEoftheMPFSO;ord)minimumMPFbenefits,towhichsection5(1)ofSchedule2totheExemption

Regulationapplies,thathavebeentransferredtoaregisteredscheme.

Mastertrustscheme Meansaregisteredschememembershipofwhichisopento:a)theemployeesofmorethanoneemployer;andb)self-employedpersonsandformerself-employedpersons;andc)personswho,havingbenefitsinanORSOexemptedscheme,oranORSO

registeredscheme,withinthemeaningofsection2(1)oftheExemptionRegulation,wishtohavethosebenefitstransferredtothefirst-mentionedscheme,

butdoesnotincludeanindustryscheme.

Providentfundscheme Meansaschemegovernedbyatrust:a)thetermsofwhicharesetoutinoneormoredocuments;andb)that:

i) providesforthepaymentofpecuniarybenefitstothemembersoftheschemewhentheyreachtheretirementage,oranyotherprescribedeventoccursinrelationtothem;or

ii)inthecaseofmemberswhodiebeforereachingthatageorbeforetheoccurrenceofsuchanevent,providesforthepaymentofthosebenefitstothepersonalrepresentativesorbeneficiariesoftheestatesofthosemembers,

andincludesaproposedprovidentfundscheme.

Registeredscheme Meansaprovidentfundschemeregisteredundersection21oftheMPFSOasanemployersponsoredschemeoramastertrustschemeorregisteredundersection21AoftheMPFSOasanindustryscheme.

Theterm“Registeredscheme”isusuallyusedinterchangeablywiththeterm“MPFscheme”.

Relevantemployee Meansanemployeeof18yearsofageoroverandbelowretirementage.

Relevantincome Means:a)inthecaseofarelevantemployee,anywages,salary,leavepay,fee,

commission,bonus,gratuity,perquisiteorallowance,expressedinmonetaryterms,paidorpayablebyanemployer(directlyorindirectly)tothatrelevantemployeeinconsiderationofhisemploymentunderthatcontract,butdoesnotincludeseverancepaymentsorlongservicepaymentsundertheEmploymentOrdinance(Cap.57);

b)inthecaseofaself-employedperson,incomeofthatpersonasascertainedinaccordancewiththeregulationsmadeundersection46oftheMPFSOandinforce.

Retirementage Inrelationtoanemployeeoraself-employedperson,means65yearsofageor,iftheregulationsprescribeanearlierage,thatearlierage.

Schememember Inrelationtoaregisteredscheme,meansapersonwhohasabeneficialinterestintheregisteredscheme.

Self-employedperson Meansapersonwhoserelevantincome(otherwisethaninthecapacityasanemployee)derivesfromhisproduction(inwholeorinpart)ofgoodsorservicesinHongKong,orhistradeingoodsorservicesinorfromHongKong.

Serviceprovider Inrelationtoaprovidentfundscheme,meansaninvestmentmanager,custodianofschemeassetsorotherpersonappointedorengagedbythetrusteeoftheschemetoprovideservicesforthepurposesofthescheme,andincludesapersontowhomtheprovisionofthoseservicesisdelegatedbysuchamanager,custodianorotherperson,butdoesnotincludeapersonappointedorsoengagedasanauditor,solicitororactuary.

Voluntarycontribution Meansacontributionpaidtoaregisteredschemeinaccordancewithsection11oftheMPFSO.
