The Civil Aviation Authority (in this licence referred to as 'the CAA') in exercise of its powers under l\nick l2S of the Air Navigation Order hereby licenses the above-named aerodrome as an aerodrome to be used l:l place of take-otT and landing of aircraft engaged in 11ights for the purpose of the public transport of passengers or fur tile purpose of instruction in flying, subject to the following conditions:
The aerodrome is licensed for use by the licence holder and by persons specifically authorised by him.
2 No aircraft shall take-off or land at the aerodrome unless such fire-fighting and rescue ~ervices and such medical .services and equipment as are required in respect of such an aircraft in the CAA's public~lliotl CAP 168 (Licensing of Aerodromes) are provided there. Such services and equipment shall at all times when the aerodrome is available for the take-off or landing of aircraft be kept fit and ready for immediate turnout.
3 Changes in the physical characteristics of the aerodrome including the erection of new buildings and alterations to existing buildings or to visual aids shall not be made without prior approval of the CAA.
4 The licence holder shall, by the quickest means available, notify the CAA of any material change 111 tile surface of the landing area, or in the obstruction characteristics of the approach, take-off or circuit in relation to the aerodrome.
5 The aerodrome is licensed for the take-off and landing of aircraft at night. Such systems uf lighting appropriate to the Category of runway in use as described in the CAA's publication CAP 168 (Licensing of Aerodromes), shall be in operation at all limes when aircraft are taking-off or landing at the aerodrome at night, provided that minor temporary unserviceability, not of a character likely to affect the of operations, shall not preclude the take-off or landing of aircraft.
6 Any public light of way crossing or bordering the landing area shall be adequately sign-posted with notices warning the public of danger from aircraft.
7 Expressions used in this licence shall have the same respective meanings as in the Air Navigation Order.
8 The 'Air Navigation Order' in this licence means the Air Navigation Order 2005 and any reference to the Order or to any Articie of the Order shall, if that Order be amended or replaced, be taken to be a relCrence to the Air Navigation Order for the time being in force or the corresponding Article of that Order.
This licence shall remain in foree until it is varied, slIspended or revoked.

Terry, I have checked the contents of the revised submission, particularly the the section on Noise impacts from the runway. The primary reference is a report by Parsons Brinkerhoff, dated August 2008. this contains a number of charts and noise contours etc. There is still a mismatch with the operational procedures which have been outlined by Lydd Airport Previously. In an email from Tim Maskins the Manager of Air Traffic Control at Lydd Airport he confirms the following
• All Aircraft above 5700kg MTOW (maximum take-off weight) turn right on departure runway 21 if D044 active. If latter not active may climb straight-ahead and establish on track, subject to remaining clear of Dungeness Power Station by at least 1.5 nautical miles and/or 2000ft (the dimensions of R063 to Lydd arrivals or departures – SI 1929/2007 para. 6)
• Aircraft below 5700kg may turn left after departure runway 21 but must remain at least 1.5nm from the power station.
This was repeated in the draft heads of terms agreement which stated that
However, on consulting the Parson Brinkerhoff Report it is apparently suggested in a number of figures in Appendix 2 "flight path information" that the following planes will execute a right turn on take off from 21 Dash 8 ATR42-500 Saab 340/SF340B Learjet35A Citation II CNA750 Citation X These have maximum take off weights of between 8 and 29 tons. Clearly, there is some mismatch between operational expectations and the noise estimation exercise.

This reinforces our view that the Schedule 106 agreement requires careful construction to ensure that the flight paths and numbers of aircraft are clearly understood by all, and that this type of confusion is avoided.
In summary, we have no objection to the development, however we are concerned that the flight path details are clear and are restricted to the arrangements laid down by Tim Maskins, which are in turn consistent with our assumptions in the risk analysis for the Dungeness Reactors.

ERECTION OF NEW TERMINAL BUILDING AND RUNWAY EXTENSION, LYDD AIRPORT, KENT.

PUBLIC INQUIRY
Further to our recent telephone discussion, I can confirm that British Energy (part of
EDF Energy) do not wish to appear at the Public Inquiry which commences in February 2011.
The basis of our concerns in relation to the above proposal is unchanged from the representations we made in December 2007.
The main reason for the objection is the focus on the very small increase in risk
presented by the development. We recognise the increased risk is extremely small and would not compromise our
current or future activities at the site, however, as a nuclear operator we are duty bound to resist any increase in risk however small.
The position in respect of Dungeness B is therefore unchanged, but the position in respect of the building of new nuclear power stations has moved
forward since 2007.
The Government has made clear, in its draft National Policy Statement for Energy published in October 2010, that there is an urgent need for
new electricity generation plant, including new nuclear power. Although the
Government’s assessment is that Dungeness is not suitable for deployment of a new nuclear power station by 2025, this does not rule it out as a site for possible future development, as long as the reasons for deeming it unsuitable can be addressed.
Accordingly, we would wish the Planning Inspector to consider the written
representations made and construct his decision in the light of these comments. If this position changes and we wish to supplement our representation or appear at
the Public Inquiry I will contact you.
