The Amusement Ride Safety ActSection 37

PART 1Preliminary Matters

Title

1 These regulations may be cited as The Amusement Ride Safety Regulations, 2017.

Definitions

2 In these regulations:

“Act” means The Amusement Ride Safety Act;

“adopted standards” means the standards adopted pursuant to section 5;

“air-supported structure” means an air-supported structure as defined pursuant to ASTM F2374-10 Standard Practice for Design, Manufacture, Operation, and Maintenance of Inflatable Amusement Devices;

“ASTM” means the American Society for Testing and Materials;

“attendant” means a person who actively engages in or supervises:

(a) the loading or movement of passengers on, or the unloading of passengers from, an amusement ride;

(b) the marshalling of passenger-carrying units; or

(c) two or all of the functions mentioned in clauses (a) and (b);

“class A amusement ride” means:

(a) a coaster ride, flume ride or other similar ride that travels more than 500 metres; or

(b) an amusement ride that requires more than 4 hours of inspection based on the manufacturer’s inspection requirements;

“class B amusement ride” means:

(a) a coaster ride, flume ride or other similar ride that travels 500 metres or less; or

(b) an amusement ride, other than a class A amusement ride or a concession go-kart, that has one or more of the following characteristics:

(i) transports passengers to a height exceeding 6 metres;

(ii) tilts passengers more than 45 degrees from the horizontal with or without inversion of passengers;

(iii) has a simultaneous operating capacity of more than 8 passengers;

(iv) has a total passenger capacity exceeding 30;

“class C amusement ride” means:

(a) an inflatable type amusement ride or any amusement ride designed to carry adults other than a class A or class B amusement ride or a concession go-kart; or

(b) any amusement ride that is designed primarily for use by children and has none of the characteristics listed in clause (b) of the definition of Class B amusement ride;

“competent”, with respect to a person, means qualified by reason of the person’s knowledge, maturity, training and experience to perform the work that the person is assigned to do;

“concession go-kart” means concession go-kart as defined in ASTM F2007-12 Standard Practice for Design, Manufacture, and Operation of Concession Go-Karts and Facilities;

“concession go-kart track” means concession go-kart track as defined in ASTM F2007-12 Standard Practice for Design, Manufacture, and Operation of Concession Go-Karts and Facilities;

“employ” includes engage the services of, whether or not an employer and employee relationship exists;

“fence” means fence as defined in ASTM F2291-15 Standard Practice for Design of Amusement Rides and Devices;

“inflatable amusement ride” means inflatable amusement ride as defined in ASTM F2374-10 Standard Practice for Design, Manufacture, Operation, and Maintenance of Inflatable Amusement Devices;

“itinerant amusement ride” means an amusement ride that is installed in a fixed location for 12 months or less;

“major modification” means major modification as defined in ASTM F747-15 Standard Terminology Relating to Amusement Rides and Devices;

“manufacturer” means manufacturer as defined in ASTM F747-15 Standard Terminology Relating to Amusement Rides and Devices;

“maximum capacity” means the maximum passenger capacity by number or weight as determined by the manufacturer;

“non-itinerant amusement ride” means an amusement ride that is installed in a fixed location for more than 12 months;

“owner/operator” means an owner/operator as defined in ASTM F747-15 Standard Terminology Relating to Amusement Rides and Devices;

“restraint” means restraint as defined in ASTM F747-15 Standard Terminology Relating to Amusement Rides and Devices;

“technical dossier” means a manual with all documentation mentioned in section 13;

“training and experience” means the qualifications of contractors and their employees, established by bylaw pursuant to sections 7 and 30 of The Technical Safety Authority of Saskatchewan Act and published by the Technical Safety Authority of Saskatchewan with respect to the installation, operation, repair or maintenance of an amusement ride.

Application

3 The Act and these regulations do not apply to:

(a) coin-operated amusement rides that are:

(i) on a non-moving base; and

(ii) designed to be operated without the assistance of an operator;

(b) amusement rides for which passengers are not usually charged a fee;

(c) amusement rides that are provided in any public park, playground or similar facility for children and that are operated by muscular power only;

(d) devices within the scope of The Passenger and Freight Elevator Act;

(e) devices within the scope of The Swimming Pool Regulations, 1999;

(f) all vehicles not operated on a concession go-kart track;

(g) air supported pillows that meet the following criteria:

(i) are less than 900 millimetres thick; and

(ii) do not have inflated walls;

(h) air-supported structures that are buildings or that are used solely for advertising or spectator participation;

(i) children’s play space and equipment within the scope of ASTM F191812 Standard Safety Performance Specification for Soft Contained Play Equipment;

(j) devices within the scope of ASTM F2959-16 Standard Practice for Aerial Adventure Courses;

(k) mechanical bulls and other rides designed to dismount the passenger during operation;

(l) amusement devices operated at private dwellings, including the land on which the private dwellings are situated and used exclusively by the manager or occupants and their invited guests;

(m) trampolines and trampoline facilities within the scope of ASTM F2970-15 Standard Practice for Design, Manufacture, Installation, Operation, Maintenance, Inspection and Major Modification of Trampoline Courts;

(n) gravity or patron controlled non-mechanical spherical devices;

(o) devices that use gravity as the motive force to move a passenger along a fixed or unfixed course;

(p) amusement rides designed in accordance with ASTM F1159-16 Standard Practice for Design of Amusement Rides and Devices that are Outside the Purview of Other F24 Design Standards;

(q) live animal rides; and

(r) hot air balloons.

PART 2Adopted Standards

Standard definitions

4 Subject to the Act and these regulations, words, symbols and abbreviations defined in the adopted standards apply to these regulations.

Adoption of standards

5(1) The following codes and standards are adopted:

(a) ASTM F2783-14 Standard Practice for Design, Manufacture, Operation, Maintenance and Inspection of Amusement Rides and Devices, in Canada as amended by Part 1 of the Appendix;

(b) ASTM F2291-15 Standard Practice for Design of Amusement Rides and Devices;

(c) ASTM F1193-16 Standard Practice for Quality, Manufacture and Construction of Amusement Rides and Devices;

(d) ASTM F770-15 Standard Practice for Ownership, Operation, Maintenance, and Inspection of Amusement Rides and Devices;

(e) ASTM F2007-12 Standard Practice for Design, Manufacture, and Operation of Concession Go-Karts and Facilities;

(f) ASTM F2374-10 Standard Practice for Design, Manufacture, Operation, and Maintenance of Inflatable Amusement Devices;

(g) ASTM F2974-15 Guide for Auditing Amusement Rides and Devices;

(h) ASTM F747-15 Standard Terminology Relating to Amusement Rides and Devices;

(i) CSA W47.2-11(R2015) Certification of Companies for Fusion Welding of Aluminum.

(2) Compliance with a more recent standard than a standard adopted by these regulations does not mean non-compliance with the adopted standard unless:

(a) a conflict or inconsistency between the more recent standard and the adopted standard exists or;

(b) the chief inspector is of the opinion that the more recent standard does not protect the public interest.

(3) If there is a conflict or inconsistency between a provision of an adopted standard and the Act or these regulations, the provision of the Act or regulations prevails.

Compliance with standards

6(1) No person who inspects, installs, operates repairs or maintains an amusement ride governed by the Act shall fail to carry out that activity in accordance with any applicable adopted standard.

(2) Compliance with any adopted standard is required as though the provisions of that standard had been made pursuant to the Act.

Manager compliance

7 The manager shall ensure that:

(a) every amusement ride within the manager’s control that is manufactured after the coming into force of these regulations meets the standards set out in any adopted standard;

(b) every activity with respect to an amusement ride that is required by an adopted standard to be carried out is carried out in accordance with the adopted standard; and

(c) every person employed to do any work in relation to an amusement ride within the manager’s control:

(i) carries out any activity that is required by an adopted standard in accordance with the adopted standard;

(ii) possesses qualifications required by an adopted standard to carry out an activity mentioned in the adopted standards;

(iii) fulfils any duty imposed by an adopted standard on that person.

PART 3Itinerant and Non-itinerant Amusement Rides

Classes of rides

8 The following classes of amusement rides are established:

(a) itinerant amusement rides, other than concession go-karts, consisting of:

(i) class A amusement rides;

(ii) class B amusement rides; and

(iii) class C amusement rides;

(b) non-itinerant amusement rides, other than concession go-karts, consisting of:

(i) class A amusement rides;

(ii) class B amusement rides; and

(iii) class C amusement rides;

(c) concession go-karts.

Licence re amusement ride

9 No person is to be issued a licence for an amusement ride unless, in addition to meeting any other requirements set out in the Act or these regulations:

(a) the applicant satisfies the chief inspector that the contractor and the employees of the contractor who will carry out the work authorized by the licence have training and experience in the installation, operation, repair or maintenance of amusement rides;

(b) the applicant has registered the design of the amusement ride pursuant to section 12;

(c) the applicant has arranged for an initial inspection of the amusement ride pursuant to section 14 at least 7 days before the scheduled operation of the amusement ride;

(d) in the case of non-itinerant amusement rides, the amusement ride has passed an initial inspection by an inspector.

Expiry of licences

10 Every licence issued pursuant to the Act expires on December 31 of the same year the licence was issued, unless otherwise stated in the licence.

Insurance

11 For the purposes of clause 13(1)(c) of the Act, the amount of liability insurance coverage to be held by an applicant for a licence is an amount not less than $2,000,000.

Application for registration of design

12(1) An applicant for a licence for an amusement ride not previously approved and licensed for operation in Saskatchewan shall:

(a) apply for registration of the design of the amusement ride in the form and manner provided by the chief inspector; and

(b) file a technical dossier for the amusement ride with the chief inspector in accordance with section 13.

(2) The design of the amusement ride and any major modifications to the amusement ride must comply with the applicable adopted standards.

Technical dossier

13 A technical dossier mentioned in clause 12(1)(b) must include copies of:

(a) the manufacturer’s drawings of the amusement ride and if applicable, the electrical and hydraulic schematics of the amusement ride;

(b) the manufacturer’s instructions for the erection or assembly of the amusement ride;

(c) the manufacturer’s maintenance manual for the amusement ride;

(d) the manufacturer’s inspection manual for the amusement ride;

(e) the manufacturer’s parts list for the amusement ride;

(f) any major modifications bulletins published by the manufacturer after the amusement ride was manufactured;

(g) the manufacturer’s operating instruction document;

(h) operational testing and non-destructive testing requirements;

(i) the manufacturer’s certification document for compliance to the applicable adopted standards; and

(j) any other manufacturer service and safety bulletins issued with respect to the amusement ride.

Initial inspection of an amusement ride

14 An applicant for a licence for an amusement ride shall arrange for the initial inspection of the amusement ride to be conducted by an inspector after the applicant has carried out a preliminary examination of the amusement ride and is satisfied that:

(a) the amusement ride has been erected in accordance with the technical dossier filed pursuant to clause 12(1)(b);

(b) all necessary work on the amusement ride has been completed; and

(c) the amusement ride meets the requirements of the Act and these regulations.

Conditions re licence for an amusement ride

15 Every amusement ride licence is subject to the following conditions:

(a) the manager shall keep a copy of the technical dossier at the location of the amusement ride;

(b) the manager shall update the technical dossier to include all data respecting any major modification made to the amusement ride;

(c) the manager shall not modify the amusement ride or cause it to be modified unless the manager has received written approval from the manufacturer to make the major modification; and

(d) the manager shall register with the chief inspector a copy of the manufacturer’s written approval mentioned in clause (c) for any major modification that is made to the amusement ride.

PART 4Managers, Operators and Attendants

Duties of the manager, operator and attendant

16 The manager, operator and attendant shall comply with the applicable adopted standards respecting:

(a) owner/operator responsibility;

(b) maintenance program requirements;

(c) inspection program requirements;

(d) classification of injuries and illnesses; and

(e) information transferred with used amusement rides.

Minimum age

17 No person shall employ any person under the age of 16 as an operator or attendant.

PART 5Installation, Operation, Repair and Maintenance

Conditions re installation, operation, repair and maintenance

18 Every amusement ride licence is subject to the following conditions respecting installation, operation, repair and maintenance:

(a) the manager shall ensure that amusement rides within his or her managerial control conform to the applicable adopted standards;

(b) the manager shall employ only competent persons to perform any work of installation, repair or maintenance on the amusement ride;

(c) the manager shall ensure that all parts of the amusement ride are:

(i) inspected, cleaned, lubricated and adjusted in accordance with the requirements of the original manufacturer; and

(ii) replaced or repaired if defective or broken;

(d) the manager shall ensure that the quality of any replacement part used on the amusement ride is equivalent to or better than the original part supplied by the manufacturer of the amusement ride; and

(e) the manager shall ensure that the amusement ride is not operated beyond its maximum capacity as determined by:

(i) an inspector, pursuant to section 21; or

(ii) in any other case, the manufacturer.

Restrictions on working with or around amusement rides

19 No person shall undertake any work on an amusement ride that is beyond the scope of the person’s training or experience.

Determining frequency of maintenance

20 The frequency and methods of maintenance of an amusement ride are to be determined by the manufacturer on the basis of:

(a) the design and workmanship of the amusement ride;

(b) the inherent qualities of the materials used in the amusement ride;

(c) the recommendations of the manufacturer of the amusement ride or an agent of the manufacturer; and

(c) the frequency and method of usage of the amusement ride.

Maximum capacity

21 An inspector may determine a new rated capacity for an amusement ride if, in the course of an inspection, the maximum capacity of an amusement ride determined by the manufacturer is inappropriate by reason of the condition of the amusement ride at the time of inspection.

Log book

22(1) Every manager shall ensure that a logbook is kept in accordance with this section for each amusement ride that is within the manager’s control.

(2) A logbook kept pursuant to subsection (1) must contain:

(a) daily operating records with respect to the amusement ride, including all data concerning incidents and accidents involving the amusement ride;

(b) repair and maintenance records with respect to the amusement ride, including all data concerning major modifications carried out on the amusement ride; and

(c) a record of each test and inspection carried out on the amusement ride.

(3) Each record mentioned in clause (2)(c) is to be signed by the person performing the test or inspection or the supervisor of the person performing the test or inspection attesting to the carrying out of the test or inspection.

(4) The manager shall ensure that a logbook kept pursuant to subsection (1) is kept:

(a) at the location of the amusement ride to which it relates; and

(b) for a period of at least 4 years from the date of the last entry in the logbook.

PART 6Amusement Ride Construction

Construction

23 A manager shall ensure, with respect to each amusement ride within the manager’s control, that:

(a) the amusement ride is constructed and installed to safely withstand:

(i) operation at its rated capacity; and

(ii) any stresses that it may be subjected to;

(b) all structures used in connection with the amusement ride are designed and constructed to safely carry any loads that those structures may be subjected to; and

(c) before the amusement ride is used by a passenger, the amusement ride and any structures used in connection with the amusement ride are:

(i) erected; or

(ii) secured with blocking, cribbing, outriggers, guys or other means so as to be stable under all operating and climatic conditions.

Guards

24 The manager shall ensure that every mounting, drive mechanism, structure or other component of an amusement ride that may entangle any part of a passenger or the clothing of a passenger is guarded to prevent injury to a passenger.

Fencing, guardrails, and gates for amusement rides

25(1) The manager shall provide:

(a) fencing that is designed and manufactured to provide protection to spectators or patrons and that is constructed to meet the minimum requirements set out in the applicable adopted standards; or

(b) guardrails that are designed and manufactured to inhibit falls from elevations in primary circulation areas for patrons, and that are constructed to meet the minimum requirements set out in the applicable adopted standards.

(2) If the presence of a crowd of people may constitute a hazard to the safe operation of an amusement ride, the manager shall provide fencing for crowd control or to control access to the amusement ride, as the circumstances may require.

(3) The manager shall provide gates designed to the applicable adopted standards at each opening to an amusement ride that provides access to or exit from the amusement ride for the public with a means of preventing persons from entering the amusement ride inadvertently.

Clearances

26 Clearances to amusement rides must meet the requirements of the applicable adopted standards.

Passenger restraining devices

27 If a passenger restraining device is provided on an amusement ride, the manager shall ensure that the device will prevent a passenger from being accidentally or inadvertently dislodged from the passenger seat during both the normal operation of the amusement ride and emergency stopping.

Dark rides

28 In the case of an amusement ride in which darkness is an integral feature of the amusement ride, the manager shall provide:

(a) permanent fixed lighting that:

(i) is sufficient to permit safe evacuation of the amusement ride; and

(ii) can be manually activated by the operator from the entrance for use in an emergency; and

(b) a smoke detector that is connected to an alarm system.

PART 7Concession Go-karts, Go-kart Tracks and Inflatable Amusement Rides

Go-karts and go-kart tracks

29(1) The design, operation and maintenance of every concession go-kart and concession go-kart track must conform to the standards provided in the applicable adopted standards.

(2) Every concession go-kart and concession go-kart track is subject to the following:

(a) the speed of every concession go-kart is inherently limited to a maximum speed of 45 kilometres per hour;

(b) no person shall drive a concession go-kart unless the person is wearing an approved and certified motorcycle helmet.

Inflatable amusement rides

30 The owner/operator of an inflatable amusement ride shall ensure that the design, operation and maintenance of the amusement ride complies with the applicable adopted standards.

PART 8Repeal, Transitional and Coming into Force

RRS c A-18.2 Reg 1 repealed

31 The Amusement Ride Safety Regulations are repealed.

Transitional

32 Any amusement ride licence that was issued pursuant to The Amusement Ride Safety Regulations and that was in force on the day before the coming into force of these regulations is continued pursuant to these regulations, subject to the terms and conditions pursuant to which it was issued, and may be dealt with as if it were a licence issued pursuant to these regulations.

Coming into force

33(1) Subject to subsection (2), these regulations come into force on January 1, 2018.

(2) If these regulations are filed after January 1, 2018, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

Interpretation

2 In these regulations, “Act” means The Saskatchewan Natural Resources Transfer Agreement (Treaty Land Entitlement) Act.

Agreements confirmed 3 Pursuant to clause 2(2)(d) of the Act, the following agreements in English and French are confirmed and are to take effect according to their terms:

(a) the Muskoday Natural Resources Transfer Agreement Amendment Agreement entered into between the Government of Canada and the Government of Saskatchewan, dated March 10, 2008;

“(e) in the case of a person described in clause (1)(c), any beverage alcohol purchased to fill an order but not delivered and sold is:

(i) if accepted by the seller, returned to the retail store or the craft alcohol producer from which the beverage alcohol was purchased; or

(ii) otherwise disposed of in a manner satisfactory to the authority”.

Section 28 amended

5(1) Subsection 28(2) is repealed and the following substituted:

“(2) Subject to the Act, these regulations and any other law, the holder of a manufacturer permit may:

(a) manufacture beverage alcohol:

(i) of a kind specified in the permit; and

(ii) on the premises specified in the permit as manufacturing premises;

(c) in the case of a brewer, sell on behalf of the authority and deliver to a permittee beverage alcohol manufactured by the brewer;

(i) du genre désigné sur son permis,

(ii) dans les lieux de fabrication désignés sur son permis;

b) vendre et livrer à la régie les boissons alcoolisées qu’il fabrique;

c) dans le cas d’un brasseur, vendre pour le compte de la régie et livrer à un titulaire de permis les boissons alcoolisées qu’il fabrique;

(d) in the case of a craft alcohol producer:

(i) sell on behalf of the authority and deliver to a permittee craft alcohol manufactured by any craft alcohol producer;

(ii) sell at a farmers’ market, as defined by the authority and in accordance with the terms established by the farmers’ market, craft alcohol manufactured by any craft alcohol producer; and

(iii) sell at a location adjacent to the craft alcohol producer’s manufacturing premises, craft alcohol manufactured by any craft alcohol producer; and

(e) export beverage alcohol of a kind specified by the authority”.

(2) The following subsection is added after subsection 28(3):

“(4) During any hours that beverage alcohol may lawfully be sold pursuant to subsection 49(1), a craft alcohol producer may sell craft alcohol for consumption off the premises”.

Section 35 amended

6 Clause 35(3)(b) is repealed and the following substituted:

“(b) a craft alcohol producer”.

Section 44 amended

7 Subsection 44(3) is repealed and the following substituted:

“(3) An off-sale endorsement granted pursuant to clause (1)(a) authorizes the craft alcohol producer to sell, at an off-sale location located away from the manufacturing premises, craft alcohol that is manufactured by any craft alcohol producer.

“(4) For the purposes of the definition of ‘reviewable endorsement’ in section 2 of the Act, an off-sale endorsement granted pursuant to clause (1)(a) is prescribed as a reviewable endorsement”.

Section 45 repealed

8 Section 45 is repealed.

Section 51 amended

9 Subsection 51(1) of the French version is amended by striking out “vendre de l’alcool artisanal” and substituting “vendre des boissons alcoolisées artisanales”.

(ii) vendre dans un marché de producteurs, au sens défini par la régie et conformément aux conditions établies par ce marché, des boissons alcoolisées artisanales fabriquées par un producteur quelconque de boissons alcoolisées artisanales,

(iii) vendre, dans les environs de son lieu de fabrication, des boissons alcoolisées artisanales fabriquées par un producteur quelconque de boissons alcoolisées artisanales;

e) exporter des boissons alcoolisées du genre indiqué par la régie ».

(2) Le paragraphe qui suit est inséré après le paragraphe 28(3) :

« (4) Un producteur de boissons alcoolisées artisanales peut, pendant tout ou partie des heures auxquelles des boissons alcoolisées peuvent être vendues légalement selon le paragraphe 49(1), vendre des boissons alcoolisées artisanales en vue de la consommation hors du lieu ».

Modification de l’article 35

6 L’alinéa 35(3)b) est abrogé et remplacé par ce qui suit :

« b) un producteur de boissons alcoolisées artisanales ».

Modification de l’article 44

7 Le paragraphe 44(3) est abrogé et remplacé par ce qui suit :

« (3) Une mention vente à emporter décernée en vertu de l’alinéa (1)a) autorise le producteur de boissons alcoolisées artisanales à vendre, à un point de vente à emporter situé à l’écart du lieu de fabrication, des boissons alcoolisées artisanales qui sont fabriquées par un producteur de boissons alcoolisées artisanales quelconque.

« (4) Pour l’application de la définition de “mention révisable” qui apparaît à l’article 2 de la Loi, une mention vente à emporter décernée en vertu de l’alinéa (1)a) est une mention révisable ».

Abrogation de l’article 45

8 L’article 45 est abrogé.

Modification de l’article 51

New section 60

10 Section 60 is repealed and the following substituted:

“Notice of application

60(1) On an application for a retail store permit, restaurant permit, tavern permit, special use permit, or endorsement granted pursuant to clause 44(1)(a), the authority may require the applicant to post a notice of the application on the premises to which the application relates if the premises have not been the subject of a permit or endorsement for at least 60 consecutive days as at the date of application.

(2) The notice required pursuant to subsection (1) must:

(a) be posted for two consecutive weeks in a conspicuous place on the premises to which the application relates;

(b) be in a form acceptable to the authority;

(c) identify the type of permit or endorsement applied for;

(d) specify the date on which the notice was first posted; and

(e) specify that any objection to the granting of the permit or endorsement must be submitted, in writing, to the authority not more than two weeks after the date specified pursuant to clause (d)”.

New sections 63 to 63.3

11 Section 63 is repealed and the following substituted:

“Fees – general

63(1) For permits mentioned in section 3, other than special occasion permits and direct to consumer delivery permits, applicants shall pay to the authority the following fees in the amounts set out in Table 1, as the case requires:

(a) an application fee;

(b) an annual fee, for each year that the permit is in force;

(c) an annual fee for the following endorsements, for each year that the endorsement is added to the permit:

(i) a lounge endorsement granted pursuant to section 15;

(ii) a tavern endorsement granted pursuant to section 16;

(iii) an off-sale endorsement granted pursuant to clause 44(1)(a).

(2) The authority may reduce the fee to be paid pursuant to clause (1)(a), (b) or (c) by 20% if the application is completed and submitted to the authority through the authority’s online services.

(3) Notwithstanding subsections (1) and (2), for permits mentioned in section 3, other than special occasion permits, applicants shall pay to the authority:

(a) $100 for the issuance of a permit on an interim basis pursuant to section 40; or

(b) $100 for the issuance of a permit on a provisional basis pursuant to section 41.

Nouvel article 60

10 L’article 60 est abrogé et remplacé par ce qui suit :

« Avis de la demande

60(1) La régie peut exiger que l’auteur d’une demande de permis de magasin de détail, de permis de restaurant, de permis de taverne, de permis d’usage spécial ou de mention décernée en vertu de l’alinéa 44(1)a) affiche un avis de sa demande sur les lieux visés par la demande, si ceux-ci n’ont pas fait l’objet d’un permis ou d’une mention pendant au moins 60 jours consécutifs lorsque est présentée la demande.

(2) L’avis prévu au paragraphe (1) doit remplir les conditions suivantes :

a) être affiché bien en évidence pendant deux semaines consécutives sur les lieux visés par la demande;

b) être acceptable, dans sa forme, pour la régie;

c) préciser le genre de permis ou de mention demandé;

d) préciser la date à laquelle l’affichage a commencé;

e) préciser que toute opposition à la délivrance du permis ou de la mention doit être présentée par écrit à la régie dans les deux semaines qui suivent la date visée à l’alinéa d) ».

Nouveaux articles 63 à 63.3

11 L’article 63 est abrogé et remplacé par ce qui suit :

« Droits exigibles – régime général

63(1) Dans le cas des permis énumérés à l’article 3, sauf le permis de circonstance et le permis de livraison directe au consommateur, l’auteur de la demande paie à la régie les droits suivants, conformément aux montants indiqués à la table 1, qui s’appliquent :

a) un droit de demande;

b) un droit annuel, pour chaque année de validité du permis;

c) un droit annuel pour les mentions qui suivent, pour chaque année où la mention est apposée au permis :

(i) la mention salon décernée en vertu de l’article 15,

(ii) la mention taverne décernée en vertu de l’article 16,

(iii) la mention vente à emporter décernée en vertu de l’alinéa 44(1)a).

(2) La régie peut réduire de 20 % le droit prévu aux alinéas (1)a), b) ou c) dans le cas d’une demande remplie et présentée à la régie par l’entremise de ses services en ligne.

(3) Malgré les paragraphes (1) et (2), dans le cas des permis énumérés à l’article 3, sauf le permis de circonstance, l’auteur de la demande paie à la régie :

a) 100 $ pour un permis temporaire régi par l’article 40;

b) 100 $ pour un permis provisoire régi par l’article 41.

“Fees – special occasion permits

63.1(1) For special occasion permits, applicants shall pay to the authority an application fee in the amount set out in Table 3.

(2) The authority may reduce the application fee to be paid pursuant to subsection (1) by 20% if the application is completed and submitted to the authority through the authority’s online services.

(3) The authority may reduce the application fee to be paid pursuant to subsection (1) by 20% if the application is received by the authority at least 10 days before the day on which the event is to be held for which the special occasion permit is sought.

“Fees – direct to consumer delivery permits

63.2 For direct to consumer delivery permits issued pursuant to section 59, applicants shall pay to the authority:

(a) an application fee of $500; and

(b) an annual fee of $500, for each year that the permit is in force.

“Fees – other

63.3(1) For permits issued pursuant to section 86 or 87 of the Act, applicants shall pay to the authority the applicable application fee set out in Table 4.

(2) For a transfer of a permit pursuant to section 69.1 of the Act, applicants shall pay an application fee of $100 to the authority.

(3) If the authority cancels a permit or endorsement issued pursuant to these regulations, the authority may, in its discretion, refund any prorated amount it considers appropriate”.

Section 64 amended

12 Subsection 64(2) is amended by adding “, 63.1, 63.2 or 63.3” after “section 63”.

Appendix, Part I amended

‘casino’ means a place that is owned, leased or occupied by the Saskatchewan Gaming Corporation or the Saskatchewan Indian Gaming Authority for the purpose of playing games of chance, and includes all facilities that are ancillary to or operated in conjunction with that place; (« casino »)

‘charitable gaming event’ means a gaming event for which a licence has been issued to conduct and manage a bingo event held alone or in conjunction with one or both of the following:

(a) a break-open lottery;

(b) a raffle; (« activité de jeux de hasard caritatifs »)

‘exhibition table games licence’ means a licence issued by the authority to an agricultural or exhibition association in accordance with clause 207(1)(c) of the Criminal Code, authorizing the association to operate table games during a fair or exhibition hosted by the association; (« licence d’exhibition de jeux sur table »)

‘gaming area’ means the physical area within a casino in which games of chance are located as approved by the authority; (« aire de jeux »)

‘gaming employee’ means gaming employee as defined in section 3; (« préposé aux jeux de hasard »)

‘gaming supplies or services’ means:

(a) the provision of the use or possession of a gaming establishment if the owner of the gaming establishment has an interest in the operation or conduct and management of a lottery scheme carried on in the gaming establishment;

(b) the sale, rental, lease, gift, exchange, loan, printing, publication, distribution or manufacturing of any gaming supplies, including any lot, card, ticket, paper, slip, symbol, token, coin, machine, device, equipment or game;

(c) the provision of management or consulting services with respect to the operation or conduct and management of a lottery scheme;

(d) the provision, distribution, installation, maintenance or repair of a surveillance or security system for any premises kept for the operation or conduct and management of a lottery scheme;

(e) the manufacture, provision, distribution, installation, maintenance or repair of gaming equipment;

(f) the provision of gaming employees;

(g) the provision of training to persons in the installation or maintenance of gaming equipment, in the operation or playing of a lottery scheme or in any other gaming-related aspect of the operation or conduct and management of a lottery scheme; or

“fournisseur” Personne qui, moyennant rémunération ou promesse de rémunération, soit seule, soit par l’intermédiaire d’un préposé aux jeux de hasard inscrit ou d’un mandataire, fournit ou distribue à un tiers des fournitures pour jeux de hasard ou des services relatifs aux jeux de hasard ou encore des fournitures ou des services non destinés aux jeux de hasard pour la gestion ou pour la mise sur pied et l’exploitation d’une loterie; n’est pas assimilée à un fournisseur la personne qui ne possède aucun intérêt dans la gestion ou dans la mise sur pied et l’exploitation de la loterie, sinon celui d’accorder un intérêt dans les lieux d’exploitation de la loterie ou de mettre à disposition l’utilisation ou la possession de ces lieux. (“supplier”)

“fournisseur en réserve” Personne qui fournit à un titulaire de licence de jeux de hasard caritatifs en réserve tout ou partie de ce qui suit :

a) des fournitures pour jeux de hasard ou des services relatifs aux jeux de hasard qui se rapportent aux jeux de hasard caritatifs;

b) des fournitures ou services non destinés aux jeux de hasard qui se rapportent aux jeux de hasard caritatifs. (“on-reserve supplier”)

“fournitures pour jeux de hasard ou services relatifs aux jeux de hasard” S’entend :

a) de la mise à disposition de l’utilisation ou de la possession d’un établissement de jeux de hasard, si le propriétaire de l’établissement possède un intérêt dans la gestion ou dans la mise sur pied et l’exploitation d’une loterie ayant lieu dans l’établissement;

b) de la vente, de la location, du bail, du don, de l’échange, du prêt, de l’impression, de la publication, de la distribution ou de la fabrication de fournitures pour jeux de hasard, notamment les lots, cartes, billets, pièces, talons, symboles, jetons, pièces de monnaie, machines, appareils, équipements ou jeux;

c) de la prestation de services de gestion ou de consultation concernant la gestion ou la mise sur pied et l’exploitation d’une loterie;

d) de la fourniture, de la distribution, de l’installation, de l’entretien ou de la réparation d’un système de surveillance ou de sécurité pour tous lieux tenus en vue de la gestion ou de la mise sur pied et de l’exploitation d’une loterie;

(h) the provision of any other supplies or services that, in the authority’s opinion:

(i) could influence the outcome of a lottery scheme; or

(ii) are integral to the operation or conduct and management of a lottery scheme; (« fournitures pour jeux de hasard ou services relatifs aux jeux de hasard »)

‘gaming technical services area’ means the physical area within a casino where electronic gaming equipment inventory is stored or where the servicing of electronic gaming equipment occurs; (« aire des services techniques pour le matériel de jeux »)

‘monte carlo’ means a lottery scheme in which one or more of the following games may be played:

(a) wheel of fortune;

(b) blackjack;

(c) any other game that the authority authorizes from time to time for inclusion in monte carlo; (« monte carlo »)

‘on-reserve employee’ means on-reserve employee as defined in section 3.1; (« préposé en réserve »)

‘on-reserve supplier’ means a supplier of either or both of the following to an on-reserve charitable gaming licensee:

(a) gaming supplies or services related to charitable gaming;

(b) non-gaming supplies or services related to charitable gaming; (« fournisseur en réserve »)

‘raffle’ means a lottery scheme in which tickets are sold for a chance to win a prize; (« tombola »)

‘supplier’ means a person who, for compensation or the promise of compensation, either alone or through a registered gaming employee or agent, supplies or distributes gaming supplies or services or non-gaming supplies or services to another for the operation or conduct and management of a lottery scheme, but does not include a person who has no interest in the operation or conduct and management of the lottery scheme other than to provide an interest in or the use or possession of the premises in which the lottery scheme is operated; (« fournisseur »)

‘Texas Hold ’em poker’ means a lottery scheme in which the card game of Texas Hold ’em poker is played in tournament style; (« poker Texas Hold’em »)

‘Western Canada Lottery Corporation’ means the Western Canada Lottery Corporation incorporated pursuant to the Canada Business Corporations Act (Canada); (« Société de la loterie Western Canada »)

‘wheel of fortune’ means a gambling device bearing some resemblance to a revolving wheel with sections indicating chances taken or bets placed. (« roue de fortune »)

g) de la dispensation d’une formation à des personnes visant l’installation ou l’entretien d’équipements de jeux de hasard, la gestion d’une loterie ou la participation à une loterie ou tout autre aspect connexe de la gestion ou de la mise sur pied et de l’exploitation d’une loterie;

h) de l’approvisionnement en autres fournitures ou de la prestation d’autres services qui, selon la régie, répondent à l’un des critères suivants :

(i) ils pourraient influencer le résultat d’une loterie,

(ii) ils font partie intégrante de la gestion ou de la mise sur pied et de l’exploitation d’une loterie. (“gaming supplies or services”)

“licence d’exhibition de jeux sur table” Licence délivrée par la régie à une association agricole ou à une association d’expositions conformément à l’alinéa 207(1)c) du Code criminel, qui autorise l’association à exploiter des jeux sur table durant une foire ou une exposition présentée par l’association. (“exhibition table games licence”)

“Loi” La Loi de 1997 sur la réglementation des boissons alcoolisées et des jeux de hasard. (“Act”)

“loterie de billets en pochette” Loterie dans laquelle un participant doit ouvrir une pochette pour déterminer s’il a gagné un prix. (“break-open lottery”)

“Gaming employee

3 For the purposes of the Act and these regulations, ‘gaming employee’ means an individual who, for compensation or the promise of compensation, is employed:

(a) by a supplier and has access to the gaming area, gaming technical services area or other secure areas of a casino to which the public does not have access;

(b) by a person licensed by the authority pursuant to section 207 of the Criminal Code for duties directly associated with the operation of a lottery scheme; or

(c) by the Saskatchewan Gaming Corporation, the Saskatchewan Indian Gaming Authority or the Western Canada Lottery Corporation”.

Section 4.1 repealed

4 Section 4.1 is repealed.

New sections 9 and 10

5 Sections 9 and 10 are repealed and the following substituted:

“Licences

9(1) Every holder of a class A charitable gaming event licence shall pay an annual fee of $1,000 to the authority.

(2) Subject to subsection (3), for each of the following licences, every applicant shall pay an application fee of $50 to the authority:

(a) a class B charitable gaming event licence;

(b) a class C charitable gaming event licence;

(c) a licence to conduct and manage a break-open lottery;

(d) a licence to conduct and manage a raffle in which the total value of all prizes to be awarded in the raffle will exceed $2,500;

(e) a licence to conduct and manage monte carlo;

(f) a licence to conduct and manage Texas Hold ’em poker;

(g) an exhibition table games licence.

(3) The authority may reduce the fee mentioned in subsection (2) by 20% if the application for the licence is completed and submitted to the authority through the authority’s online services.

(4) For the purposes of clause 141(1)(b) of the Act, a local authority may issue a licence to conduct and manage a raffle in which the total value of all prizes to be awarded in the raffle will not exceed $2,500.

(5) A local authority shall not charge more than $20 for the issuance of the licence mentioned in subsection (4).

(6) The authority shall not charge a fee for the issuance of a licence to conduct and manage a raffle in which the total value of all prizes to be awarded in the raffle will not exceed $2,500.

b) le titulaire d’une licence délivrée par la régie en vertu de l’article 207 du Code criminel lui permettant d’exercer des fonctions directement liées à l’exploitation d’une loterie;

c) la Société des jeux de hasard de la Saskatchewan, la Régie des jeux de hasard des Autochtones de la Saskatchewan ou la Société de la loterie Western Canada ».

Abrogation de l’article 4.1

4 L’article 4.1 est abrogé.

Nouveaux articles 9 et 10

5 Les articles 9 et 10 sont abrogés et remplacés par ce qui suit :

« Licences

9(1) Les détenteurs de licences d’activité de jeux de hasard caritatifs de catégorie A paient à la régie un droit annuel de 1 000 $.

a) la licence d’activité de jeux de hasard caritatifs de catégorie B;

b) la licence d’activité de jeux de hasard caritatifs de catégorie C;

c) la licence de mise sur pied et d’exploitation d’une loterie de billets en pochette;

d) la licence de mise sur pied et d’exploitation d’une tombola dans laquelle la valeur globale de tous les prix à accorder sera supérieure à 2 500 $;

e) la licence de mise sur pied et d’exploitation d’une loterie monte carlo;

f) la licence de mise sur pied et d’exploitation d’un poker Texas Hold’em;

g) la licence d’exhibition de jeux sur table.

(3) La régie peut réduire de 20 % le droit mentionné au paragraphe (2) dans le cas d’une demande de licence remplie et présentée à la régie par l’entremise de ses services en ligne.

(4) Pour l’application de l’alinéa 141(1)b) de la Loi, une autorité locale peut délivrer une licence de mise sur pied et d’exploitation d’une tombola dans laquelle la valeur globale des prix à accorder ne sera pas supérieure à 2 500 $.

“Certificates of registration

10(1) Subject to subsections (2) and (3), the annual fee to be paid to the authority for a certificate of registration is as follows:

(a) $50 for a gaming employee;

(b) $50 for a gaming director;

(c) $1,000 for a supplier.

(2) The authority may waive the fee required pursuant to clause (1)(c) if the supplier:

(a) supplies gaming supplies or services or non-gaming supplies or services having a value that is less than $10,000 on an annual basis; and

(b) is not otherwise exempt from registration pursuant to these regulations.

(3) The authority may reduce the fee mentioned in subsection (1) by 20% if the application for the certificate of registration is completed and submitted to the authority through the authority’s online services.

(4) The fee for the replacement of a lost certificate of registration is $10”.

Coming into force

6(1) Subject to subsection (2), these regulations come into force on October 2, 2017.

(2) If these regulations are filed with the Registrar of Regulations after October 2, 2017, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

(6) Aucun droit ne sera exigé par la régie pour la délivrance d’une licence de mise sur pied et d’exploitation d’une tombola dans laquelle la valeur globale des prix à accorder ne sera pas supérieure à 2 500 $.

« Certificats d’inscription

10(1) Sous réserve des paragraphes (2) et (3), les droits annuels payables à la régie pour un certificat d’inscription sont les suivants :

a) dans le cas d’un préposé aux jeux de hasard, 50 $;

b) dans le cas d’un directeur des jeux de hasard, 50 $;

c) dans le cas d’un fournisseur, 1 000 $.

(2) La régie peut dispenser du droit prévu à l’alinéa (1)c) le fournisseur qui répond à l’ensemble des conditions suivantes :

a) il fournit des fournitures pour jeux de hasard ou des services relatifs aux jeux de hasard – ou des fournitures ou services non destinés aux jeux de hasard – d’une valeur inférieure à 10 000 $ par année;

b) il n’est pas déjà exempté de l’obligation d’inscription par application du présent règlement.

(3) La régie peut réduire de 20 % les droits mentionnés au paragraphe (1) dans le cas d’une demande de certificat d’enregistrement remplie et présentée à la régie par l’entremise de ses services en ligne.

(4) Les frais de remplacement d’un certificat d’inscription perdu sont de 10 $ ».

6(1) Sous réserve du paragraphe (2), le présent règlement entre en vigueur le 2 october 2017.

Section 8 amended

3 Subsection 8(1) is amended:

(a) by striking out “or” after clause (c);

(c) by adding the following clause after clause (d):

“(e) is an individual who, on or after September 1, 2017, begins to receive a monthly pension pursuant to Part I of the Old Age Security Act (Canada)”.

Section 23 amended

4 Clause 23(1)(b) is repealed.

Appendix amended

5 Section 4 of Table 2 of the Appendix is amended in item 36:

1 These regulations may be cited as The Transitional Employment Allowance Amendment Regulations, 2017.

2 The Transitional Employment Allowance Regulations, 2005 are amended in the manner set forth in these regulations.

Section 2 amended

3 Clause 2(m) is repealed and the following substituted:

“(m) ‘SAP regulations’ means The Saskatchewan Assistance Regulations, 2014 ”.

Section 7 amended

4(1) Subsection 7(1) is amended:

(a) in the portion preceding clause (a) by striking out “a unit administrator” and substituting “the minister”; and

(b) in clause (e) by adding “, or any greater period the minister considers appropriate,” after “months”.

(2) The following subsection is added after subsection 7(1):

“(1.1) The minister may pay the reasonable fees charged by any financial institution that provides information to the minister in relation to the performance of his or her duties and responsibilities or the exercise of his or her powers pursuant to subsection (1)”.

(3) Subsection 7(4) is repealed and the following substituted:

“(4) An individual does not have a budget deficit if the minister is satisfied that:

(a) the individual or an eligible family member of the individual’s family unit owns excess assets;

(b) a disposal of assets or an unusual expenditure, within the six calendar months, or any greater period the minister considers appropriate, immediately preceding the calendar month in which the individual’s application for a transitional employment allowance was made, was carried out for the purpose of causing the individual to have a budget deficit; or

(c) in the case of an individual who is determined to be not eligible to receive a benefit pursuant to section 18 of the SAP regulations, within the number of months immediately preceding the calendar month in which that determination was made, if the period the individual is not eligible to receive a benefit exceeds six months”.

“(4.1) If a driver’s licence is suspended pursuant to clause (4)(b) or (c), the calculation of the ignition interlock period is to be interrupted until:

(a) the driver is the holder of a valid driver’s licence; and

(b) the driver is participating in the ignition interlock program”.

Part II, Appendix amended

5 Part II of the Appendix is amended in item 39 of Division 6 by adding “or amber and blue lights” after “amber lights”.

Coming into force

6(1) Subject to subsection (2), these regulations come into force on the day on which The Traffic Safety Amendment Act, 2017 comes into force.
