What is a Non-Banking Financial Company?

A Non-Banking Financial Company (NBFC) is a company

a) registered under the Companies Act, 1956

b) Its principal business is lending, investments in various types of shares/stocks/bonds/

debentures/securities, leasing, hire-purchase, insurance business, chit business

c) Its principal business is receiving deposits under any scheme or arrangement in one lump sum or

in installments.

However, a Non-Banking Financial Company does not include any institution whose principal

business is agricultural activity, industrial activity, trading activity or sale/purchase/construction of

immovable property. (Section 45 I (c) of the RBI Act, 1934) . One key aspect to be kept in view is that

the financial activity of loans/advances as stated in 45 I ( c) , should be for activity other than its own.

In the absence of this provision, all companies would have been NBFCs.

Does the Reserve Bank regulate all financial companies?

No. Some financial businesses have specific regulators established by law to regulate and

supervise them, such as, IRDA for insurance companies, Securities Exchange Board of India (SEBI) for

Merchant Banking Companies, Venture Capital Companies, Stock Broking companies and mutual

funds, National Housing Bank (NHB) for housing finance companies, Department of Companies

Affairs (DCA) for Nidhi companies and State Governments for Chit Fund Companies. Companies

which do financial business but are regulated by other regulators, are given specific exemption by

the Reserve Bank from its regulatory requirements, such as, registration, maintenance of liquid

assets, statutory reserves, etc.

… Contd.

What kind of specific financial companies are regulated by the RBI?

The Reserve Bank of India regulates and supervises Non-Banking Financial Companies which

are into the business of

a) lending

b) acquisition of shares, stocks, bonds, etc., or

c) financial leasing or hire purchase.

The Reserve Bank also regulates companies whose principal business is to accept deposits.

(Section 45I (c) of the RBI Act, 1934).

Can all NBFCs registered under the RBI accept deposits ? Does getting a Certificate

of Registration from the RBI mean the company can also raise deposits?

No. As stated above, registration with RBI does not automatically allow an NBFC to accept

deposits. The Reserve Bank specifically authorizes an NBFC to accept deposits. This permission is

given after verifying a registered NBFC's performance for three years. That an NBFC is permitted to

raise deposits from public is specifically mentioned in its certificate of registration. In fact as a matter

of public policy, Reserve Bank has decided that only banks should be allowed to accept public

deposits and as such has since 1997 not issued any Certificate of Registration (CoR) for new NBFCs

for acceptance of public deposits.

Krav Maga, which translates to “contact combat” is a self-defense system that

emphasizes threat neutralization, defensive and offensive maneuvers, and aggression.

As a part of empowerment with self protection, a half–day workshop was organized on

Krav Maga in Mumbai to empower women in SCUF and SHFL. Various topics like threat

neutralization, self defense, release from chokes, knife attacks, escape strategies etc were

covered. The workshop had the enthusiastic participation of Shriram employees, and all the

participants agreed that it was a super fun workout.

Krav Maga workshop @ Mumbai

Did you know?

Krav Maga was developed by Imre Lichtenfeld in the 1940s for the Israeli

military. This self-defense system encourages students to avoid a confrontation. If

that is impossible, then the fight should be finished as quickly as possible. Krav

Maga combines realistic fight training and techniques drawn from Judo, Aikido,

boxing, and wrestling. It also has a colored belt grading system which is similar to

the Judo ranking system.

CORNER

Featuring thought-provoking stories and forwards that are doing the rounds on social media.

A beggar came to an emperor, and asked for his help. The emperor readily agreed,

since there were many such people who came to him for help each day. He immediately instructed

his courtier to bring money and clothes for the beggar.

However, the beggar said, “If you are going to give me anything

there is a condition.” The emperor asked, “What do you mean? What is your

condition?” The beggar replied, “This is my condition: I accept only if you

can fill my begging bowl absolutely.”

It was a small begging bowl. The emperor

angrily said, “Who do you think I am? A beggar? Can I

not fill your small, dirty begging bowl?”

The beggar said, “It is better that I tell you

before you start, because you can get into trouble

later. If you are confident of filling it, go ahead.”

The emperor called his vizier and told him to fill it with precious stones,

with diamonds, rubies, and emeralds. Let this beggar know who he is talking to!

The bowl was filled.

And then something strange happened.

The king was surprised to see the stones disappear as soon as they fell into the bowl. It was

filled many times and each time it was again empty.

Now he was in a terrible rage, but he told the vizier, “Even if I

lose my kingdom, even if all my treasuries are emptied, so be it. But I

cannot allow this beggar to defeat me!”

One by one, the king’s treasures disappeared into the begging

bowl. By and by, over many months, the king’s riches were reduced to

nothing. The people of the kingdom watched in amazement, and wondered

how and when this would end.

Finally the king had to fall at the feet of the beggar. He said, “Forgive me, I have failed. But

before you leave, tell me the secret of this begging bowl. How could it make everything disappear?”

The beggar started laughing. He said,

“It is made of human ego. I have made this begging bowl of a human ego:

everything disappears in it, nothing ever satisfies it.'

It is a tremendously beautiful story. That's what is happening to you. It is not a story, it is

your life.

You go on putting cars, bank balances, and houses into your bowl - everything disappears.

But still you are empty.

Never any satisfaction, never any contentment. Again you start begging.

It is a truth in everybody's life, in every man's life.

The ego is never fulfilled.

….Contd.

Greed does not rest until it is satisfied and greed is never

satisified.
