PIK SCOPE

THE SCOPE OF PIK ACTIVITY IS:

1. PREVENTION, DETECTION, DOCUMENTATION AND INVESTIGATION OF THECRIMINAL OFFENCES COMMITTED BY KOSOVO POLICE EMPLOYEES, REGARDLESSOF RANK AND POSITION WHILE ON DUTY OR OFF DUTY.

2. INSPECTION OF THE STRUCTURES AND FUNCTIONS OF KOSOVO POLICE TOENSURE ACCOUNTABILITY, EFFECTIVENESS AND EFFICIENCY IN THEIMPLEMENTATION OF APPLICABLE LAWS, SUB-LEGAL ACTS AND STANDARDOPERATIONAL PROCEDURES THAT ARE IN FORCE.

3. INVESTIGATION AND/OR INSPECTION OF HIGH PROFILE DISCIPLINARYINCIDENTS, INVOLVING KOSOVO POLICE EMPLOYEES;

4. INVESTIGATION OF ALL ALLEGED DISCIPLINARY OFFENCES OF POLICE OFFICERSHAVING THE HIGHEST RANK OF THE SENIOR POLICE MANAGEMENT LEVEL ANDSENIOR EXECUTIVE LEVEL POLICE OFFICERS.

5. WHEN THERE IS A BASED SUSPICION THAT THE GENERAL DIRECTOR OF POLICEHAS COMMITTED DISCIPLINARY VIOLATION, THE PRIME MINISTER MAYAUTHORIZE THE PIK TO CONDUCT THE DISCIPLINARY INVESTIGATIONS. UPONCOMPLETION OF DISCIPLINARY INVESTIGATION THE PIK SHALL REPORT ONFINDINGS TO THE PRIME MINISTER.

6. TO RECEIVE ALL CITIZENS COMPLAINTS, AS WELL AS TO REVIEW ANDDETERMINE WHERE THE COMPLAINTS WILL BE DISSEMINATED FORINVESTIGATION, EITHER TO THE KOSOVO POLICE, OR RESPONSIBLEINSTITUTIONS.

I. FOREWORD OF CHIEF EXECUTIVE

Dear readers,It is my pleasure to present results andachievements of PIK for the last year. Evenduring 2017, all organizational levels of PIKhave worked in increasing the effectiveness andefficiency, fulfilling the mission and legalauthorizations for law enforcement, in view ofsupervising the work of Kosovo Police.The engagement of the whole PIK structure infulfilling relevant duties has continuously increased the support and trust of citizens in ourorganization, as a worthy contributor towards developing a democratic, professional andaccountable police force, always taking care for protecting and ensuring citizens’ rights.Increasing professionalism and cooperation level with citizens and partners has beenpresented in the data presented in this Report. PIK, along with local and internationalpartners, will engage to further maintain and strengthen this trust. This trust will bemaintained by ensuring professional and qualitative work, confidentiality when handlinginformation, high integrity level, moral values of employees, as well as expanding servicesas close to citizens as possible.In the path of fulfilling its legal mission, and developing as an institution, including capacitybuilding, implementation of necessary organizational and legal infrastructure reforms, PIKhas been supported in every step by local institutions and international partners. Ministryof Internal Affairs had an important role in providing the whole necessary institutionalsupport. The cooperation with the State Prosecutor is of special importance towardscoordinating actions set forth in the law in force.The role of other local and international partners has been very significant for PIK’songoingdevelopment. Their support increased the quality of our engagement, whether throughtraining programmes, advices and experiences, as well as technical support.PIK remains committed for further professional advancement through professionaltraining programmes for our employees, in view of embracing the most advancedtechniques in the field of criminal investigation and inspections, as a very importantpreventive mechanism.

II. INTRODUCTION

This report summarises the work of the Police Inspectorate of Kosovo (PIK) for the periodJanuary - December 2017, and contains documented activities and achievements. Thisyear's report presents challenges and activities undertaken based on competenciesconferred pursuant to the legislation in force and the main achievements during thisperiod.PIK, as an executive agency within the Ministry of Internal Affairs (MIA), has implementedits functions through operational departments, such as: Department for Management ofComplaints, Department of Investigation, the Department of Inspections, Department forPlanning, Cooperation, Legal Issues and Information, whereas the Department of Financeand General Services, through its activities, supported the functioning of operationaldepartments in administrative and logistic aspect.This year's report presents PIK’s main achievements and challenges during 2017. The mainsections of this report are obviously areas summarizing concrete results in receivingcomplaints and investigating cases pursuant to PIK mandate, based on the number, qualityand results of investigation of cases, as well as the concrete results of exercising inspection,outlining the number, type and outcome of these inspections. Administrative supportwhich is provided by the Department of Finance and General Services provides informationregarding the number of training sessions and budgetary expenditure level by economiccategories.The section on cooperation with citizens, local and international organizations containsconcrete activities of PIK cooperation with others, including various informationcampaigns regarding the rights of citizens, complaints form and mechanisms to raise thelevel of awareness with regards to access to PIK, increasing cooperation with various localand international organizations to increase professionalism and quality of employeesperformance through the exchange of experiences, training, receive counselling and othermechanisms of interest to PIK.

III. PIK ACTIVITIES FOR COMPLAINTS MANAGEMENT

During 2017, the Department for Management of Complaints (DMC) received 1.226complaints in total, out of which 21 were information.Chart 1.Trend of complaints received in DMC

During this year, Complaints Management Division within DMC received and managed1.226 complaints. As noticed in the Chart above, 59% of complaints (cases) have been processed to theDirectorate for Professional Standards of the KP (DPS), as the competent authority forhandling disciplinary violations, whereas 40.5% of complaints have been processed forinvestigation at Department of Investigations of PIK(DI), as the competent authority of PIK,while the remaining part was closed by PIK after being examined by DMC, as there werenot found any elements of disciplinary offense or criminal offence.Based on its data, DMC has recorded a total of 1,038 complainants who have filed theircomplaints through authorized legal means. This figure does not include the submitters ofcomplaints, considered as internal initiations or received information, totalling to 188cases.Regarding the classification of complaints received on a gender basis, we have thefollowing data: we have received 902 complaints from men, and 136 were received fromwomen.

Regarding the classification of complaints received in terms of ethnicity, the followingChart shows that 92% of complainants came from the majority community, while theremaining 8% are from minority communities.Chart no.3: Tabular presentation of complaints by gender and ethnicity of the complainants

PIK has also presented the load per month, regarding the number of complaints, and it canbe noticed that August and September were the months with the highest load, while themonths with fewer complaints submitted to PIK were January and December.Chart No.4: Tabular presentation of complaints received during the months

Moreover, the analysis of complaints submitted based on regional police directorateswhere police officers workhas been conducted. From this we have the following data:1. Prishtina region leads with 484 complaints;2. Prizren region - 91 complaints;3. Gjilan region - 110 complaints;4. Mitrovica South region - 76 complaints;5. Peja region - 122 complaints;6. Ferizaj region - 109 complaints;7. Mitrovica North region - 57 complaints;

IV. PIK ACTIVITIES IN INVESTIGATION OF CASES

During the reporting period, Kosovo Police had 8,750 employees. In total were 190employees of KP that underwent PIK investigation. Presented in percentage, it is estimatedthat 2.2% of KP employees were under investigation under the suspicion of havingcommitted criminal offenses. This percentage is by 0.51% lower than last year. So in 2017the number of investigated employees is lower for 51 employees compared to 2016.Chart 5 Chart 6

According to PIK records, 496 complaints were sent to the Department for Investigation forpreliminary investigations and 135 were transferred from 2016 (631 in total). During thepreliminary investigation of these complaints, 166 complaints (26.3%) resulted inelements of criminal offense and were assigned case number to be investigated further,whereas 326 (51.6%) cases resulted in elements of disciplinary violation and werereturned to DMC in order to be forwarded to the Directorate for Professional Standards fordisciplinary investigations. According to our data, 133 cases (21.1%) are still underpreliminary investigation, cases that are mainly received in the last two months of 2017and six (6) other cases (1%) are cases that have been forwarded to other relevantinstitutions.The total number of cases addressed in 2017 is 496 cases and 135 cases were transferredfrom 2016 (a total of 631 cases addressed during this year). Regarding the disciplinaryviolations presented below in this chart, 234 cases have been sent to DPS this year, while92 have been transferred from 2016.

From the Department of Investigation, out of 166 cases with elements of criminal offence:a) 150 cases (90.4%) were submitted to competent prosecution offices,b) 16 cases (9.6 %) are in processof investigation1, transferred to 2018.Out of the150 cases that were submitted in Prosecution:a) 110 cases (73.3 %)were submitted with criminal report2,b) 40 cases (26.7%) were submitted with a special report3.PIK has managed for 90.4% of cases with criminal elements to investigate and proceedthem further to the Prosecution with criminal reports or special reports.During 2017, out of 110 cases that are submitted to competent prosecution offices withcriminal reports, were filed 57 indictments, whereas six (6) criminal reports have beendismissed by the respective prosecution offices.

During 2017, PIK has undertaken these measures and recommendations: 17 individualswere arrested, out of whom 12 were police officers and 5 citizens, 30 recommendations forsuspensions and 7 recommendations for transfer.

Thedownfall trend of cases involving acts of use of force by police officers such as "Light bodilyinjury" or "Ill-treatment during the exercise of official duty" is seen as positive, which PIKconsiders to have resulted because of the frequency of inspections undertaken by PIK,qualitative investigations in the field and from the commitment of the Police Managementto provide additional training related to this field of police duties.

In 2015, the Regional Police Directorate in Gjakova was added to the Division of PublicSafety. This region was previously under the supervision of the Regional Police Directoratein Peja. Regarding the number of personnel in Regional Police Directorates in Prizren,Ferizaj, Gjilan, Peja and Gjakova, there is an increased number of those investigated by PIK,with the exception of Regional Police Directorates in Prishtina, northern Mitrovica andsouthern Mitrovica, where a decreased number of police officers investigatedhas beennoted.The chart shows the number of cases by Police Stations under the command of the RegionalPolice Directorates within the Division of Public Safety (Department of Operations). ThePolice Station of Ferizaj leads with the largest number of employees investigated by PIK,namely nine (9) employees against whom criminal investigations were initiated, followedby the Police Station of Novo-Brdo and Peja with seven (7) police officers investigated. V. INSPECTIONS DURING 2017

One of the basic functions of the Police Inspectorate of Kosovo is also carrying outinspections against Kosovo Police. Through the inspection process, PIK evaluates themanner in which the duties of Kosovo Police are carried out, by: Determining whether the relevant laws, regulations and the principles andprocedures of KP are properly implemented and whether they are tailored in such amanner as to reach its goal; Determining whether the Police resources are used effectively and efficiently andwhether they are suitable to reach the organizational goals and objectives; Preventing violations that may occur during the activities of KP; Identifying the shortcomings by recommending legal and organizational measuresfor better functioning of KP.

PIK, in fulfilling its legal mandate, in order to assess the performance of police duties inrelation to the applicable legislation and standards required, has carried out eight (8)inspections during the past year, six (6) of which were regular inspections based on theRegular Inspection Plan for 2017 and two (2) were extraordinary inspections. Regardingthe fulfilment of annual objectives, it is estimated that all planned targets have been met.The Annual Report on Regular Inspections was issued within the first quarter of 2017,which was approved by the Chief Executive Officer of PIK.

The issuance of this plan has gone through several phases, taking into account many factorsand circumstances. The plan has set out some inspection objectives, which derived fromthe organization's strategic objectives. Prior to each inspection, a work program detailingthe field operational duties of teams performing the inspectionwas also issued. At theconclusion of the inspection processes, reports were produced with analyses andassessments on the achievement of inspection objectives.Inspections carried out during 2017 are as follows:1. Management of the police vehicles fleet and accompanying equipment (regular);2. Management of traffic patrols and road safety (regular);3. Procurement management in Kosovo Police (regular);4. Management of crime investigation and detection, as well as case administration(regular);5. Management of border security and control, as well as migration (regular);6. Management of Police buildings, infrastructure and accompanying assets (regular);7. Assessment of the efficiency of the common road policing services of the KosovoPolice and the Albanian State Police (extraordinary);8. Use of police vehicles after official working hours (extraordinary).

Main findings from the inspections carried out during 2017

Inspection of the police vehicle fleet and accompanying equipmentThe inspection covered a two (2) year period,namely 2015 and 2016. The findings show that thefleet of vehicles is obsolete with a contigent ofinactive vehicles due to non-functionality. Theinspection has pointed out the need for increasedcare in maintenance but also increased care in theuse by their drivers. Stagnations have beenobserved in implementing the VehicleReplacementPlan. Efforts are needed to pushforward the process of alienating unused vehiclesand take away non-functional vehicles.Positive movements are noted in terms of police vehicles control before their use and the inthe reduction of cases requiring the vehicles to be sent to the operators. Performanceindicators show an increased productivity and efficiency of vehicle maintenance servicescompared to recent years despite that the Vehicle Park beingobsolete.Performance concerning the inclusion of official vehicles in traffic accidents is consideredunacceptable and this is considered as the most negative performance in the recent years.The tendency of untimely reporting the accidents and incidents involving police officers atthe Accident Office requires serious treatment. Progress has been made towards equippingvehicles with a number of accompanying equipment and operational documents.PIK has also verified the fulfilment of recommendations given in the latest inspections andhas ascertained that out of 11 recommendations given in the two (2) past inspections, one(1) of them has been fully implemented, three (3) have been met to a large extent(generally), one (1) has been partially implemented and six (6) have not beenimplemented. In the final inspection Report of this field were made 2 recommendations,which have been accepted as grounded and sustained by the leaders of the police structure.

Inspection of traffic patrols and road safety managementThe inspection covered the two (2) year period 2015 and 2016, and with regard to humanresource capacities for covering areas of responsibility, the findings provide an insight thatthe stations are experiencing difficulties in establishing full-time 24 hourpatrolteams.There are some shortcomings in the proper inclusion of information in the radiologs, which mostly relate to the lack of detailed data on police activities.The Police have issued the Strategic Development Plan and other annual plans that guideactivities toward improving the traffic situation, by defining priorities based on theNational Road Safety Strategy.An important point towards creating conditions for quality and efficient Police workremains the fulfilment of needs for technical equipment that enables quality service inincreasing traffic safety, known as technical equipment for implementation of legalmeasures. There is a need for a more active approach to address black spots, towards theend of their identification process, being road safety risk factors.Adding of pro-active police road safetymeasures, in order to create road safetyconditions, has been assessed as positive. At thelevel of stations and regional road traffic units,it is noted a poor condition of providing patrolteams with devices such speed measuring speeddevices and devices to measures the level ofalcohol in people.From the inspection carried out, it resulted in that out of six (6) recommendations made inthe previous inspection, two (2) of them were fully implemented, two (2) are underimplementation and two (2) were partially implemented.In the final inspection Report of this field were made six (6) recommendations, which havebeen accepted as grounded and sustained by the leaders of the police structure.Compliance has been achieved to fulfil these recommendations in accordance with theestablished Action Plan.

The General Kosovo Police Directorate (GPD) and the General Directorateof State Police (GDSP) have undertaken the necessary concrete preparatory actionsregarding the implementation of the Memorandum of Cooperation between the twocountries.The signatory parties have drafted operational orders that define the concrete operationalobjectives and actions of both countries’ police structures towards the implementation andenforcement of the Memorandum.From 01.07.2017, six (6) patrol teams havebeen engaged from the KP during the two(2) month period, which have assisted injoint patrol teams with the Albanian ones.The joint patrol teams of both police forceshave controlled and monitored the roadtraffic, by being positioned in static pointsand in locations identified as 'black spots'.During the summer season, there has been asignificant increase in police activity andpolice performance in road axes where jointpatrolling services were developed.Performance indicators show that during 2017 there has been an increased number of jointpolice patrols, increased control points and increased number of fines imposed for trafficoffenses. Compared to the last year, during this summer season, there has been a decreasednumber of traffic accidents caused in the areas where joint patrol services have beenconducted. A lack of technical devices to measure motor vehicles speed and radio-communicationdevices was noticed. Motor vehicles speed measuring devices owned by the KP could notbe used in joint patrols within the Albanian territory because they were not calibrated bythe competent institution of the Republic of Albania. The failure to supply all police patrolswith police equipment for handling traffic accidentsshould also be noted. The lack of photocameras, floodlights for lighting accident sites and tape meter is evident.Citizens interviewed by the PIK team and the Internal Affairs and Complaints Service haveexpressed a positive opinion regarding the joint patrolling of both police and havewelcomed such an action. They expressed satisfaction and supported the presence of suchpolice unitstowardroad policing cooperation and road safety. A significant number statedto lack sufficient knowledge regarding organization of joint patrols, while they considersafety situation along the roads as good.None of the contacted citizens complained regarding the behavior of patrol officers in theseroads, but there were certain individuals who did not have sufficient knowledge about whothey could address should they considerthat their rights have been violated in a givensituation.The inspection carried out resulted that out of five (5) recommendations left by theprevious inspection, two (2) of them have been met and three (3) others were not met atall. In the final inspection report of this area, six (6) recommendations have been made,which the leaders of the two police structures have accepted as grounded and sustainable.Agreement has been reached to meet the recommendations set out in the Action Plan.

Procurement management inspection in Kosovo PoliceThis inspection covered the activities of the Contracting Authority for the two (2) yearperiod, 2015 and 2016. The findings provide an overview that the Procurement Directoratehas the necessary human and professional capacity to meet the needs and requirements aswell as to carry out procurement activities within the competences stipulated by the Lawon Public Procurement (LPP). The staff engaged in the Directorate is estimated to havesufficient professional capacity, because they are supported by adequate training as well ascertification programs. The inspection has highlighted a goodcooperation and coordination between somestakeholders involved or related toprocurement functions. The Directorate hascarried out and issued the ProcurementPlanning on time, however it has reflected theneed to be more inclusive, sustainable andsubstantial in the future. The Directorate hasfulfilled its annual reporting to the PublicProcurement Regulatory Commission.A progress has been identified in keepingprocurement files, either as content or as an arrangement and placement in adequatespaces. Folders in the form of a Summary Register are fuller and more complete. There arepositive moves in timely preparation of tender dossiers, setting deadlines for submission oftenders, as well as preparation of technical specifications and reference terms. There issome mobilization in terms of eliminating some of the phenomena that have been incontradiction with the current legislation, such as: filling in tender dossiers by the samepersons, signing contracts after the supplies were made and limited competition.Publication of contract notices has been made in all cases examined; there is a positivemove both in terms of the beginning and ending of the examination period, evaluation andcomparison of tenders within the timeframes. Likewise, no contract was signed beforetime.Work should be done on issuing more sustainable procurement plans, in the generation ofregisters of contacted economic operators, in issuing quoted price minutes, issuing ortimely filing of tender dossiers when submitting applications for them.

One can notice shortcomingsin the adherence of tender opening time-limits and in thesigning the tender opening minutes by the respective procurement persons. There havebeen several cases examined wherein the commissions did not have the necessary accessto evaluatethe tenders, based on the defined selection criteria. Several procurementactivities, whose contract award notices were published after the expiration of time limits,have also been examined. It is necessary to consider the guidelines and rules in respectingthe guidance on the steps in appointing project managers, issuing and signing contractmanagement plans and issuing purchase orders.Out of the 22 recommendations left by the previous inspection, 15 recommendations weremet, four (4) of them are largely met (generally), two (2) were partially met, while one (1)has not been met at all.In the final inspection report of this area, nine (9) recommendations have been putforward, which have been accepted by the police structure leaders as grounded andsustainable. The agreement was reached for the fulfillment of these recommendationsaccording to the established Action Plan.

Inspection of crime investigationand detection management, and caseadministrationThis inspection covered activities of directorates and central investigation divisions, for thetwo (2) year period, 2015 and 2016. The findings provide an insight that the currentstructure enables a distribution of tasks and operational actions towards the effectiveprevention and combating of crime. Operational police activities rely on a broad set of lawsand by-laws. The Kosovo Criminal Code, the Criminal Procedure Code of Kosovo, theJuvenile Justice Code and the Law on Police are the main legal basis governing the policeinvestigation work. The Investigation Department staff structure has not yet beenstabilized, as there are still problems with the placement of qualified staff and filling ofpositions according to the Authorized List.The Investigation Department is considered tohave sufficient professional capacities tooppose the crime level, as the investigativestaff is prepared owing to basic and advancedtraining programs. Regarding the crimeevidence and the involvement in criminalactivities of individuals and criminal groups,there is a need to increase the cooperation ofthe Police-Prosecution-Court Triangle in thefield of feedback regarding outcomes of theinitiated criminal cases. A number ofinvestigative files lacked the informative policereport for the State Prosecution.The forms used within the files are not unique within the directorates and there is nouniform standard of drafting letters in these directorates. In some files, there arestatements that do not comply with the suspectsreserved, witnesses respectively. Some ofthem containing the rights of the interviewees, those rights are not in conformity with theCPCK. There are unsigned statements by the recipients of the statements and the suspectsor witnesses interviewed.Investigative files related to arrested persons included decisions on the detention of thearrested person. Inspected cases are divided according to case competence. Criminalreports have been prepared satisfactorily and contain the necessary substantive elementsin order for them to be submitted to the Prosecution.

Police reports reflect an increase of investigative activity, alongside increasing levels ofcrime. Performance indicators reflect a positive trend in fighting crime. There has been anincrease in the number of charges filed with the Prosecution, the number of arrested, thenumber of operations, the number of raids and the inspected premises. DIECC and DTNIremain the directorates with the largest number of cases with which they have beencharged in the last two years. Increased mobilization is needed in providing more feedbackto the DIA, by investigation directorates.With regard to some files containing material related to crime scene management andhandling of evidence, it is estimated that the actions taken by the criminological techniqueteams have been developed in accordance with the provisions foreseen by the SOP. Theinspection outcomes regarding the field of conservation, identification and handling ofevidence are encouraging at many points. In the Central Evidence Room, the items andevidence associated with the selected files were easily identified, packed and markedaccordingly.As far as evidences are concerned, it is noted that Book of Evidence and ElectronicEvidence are maintained. Physical conditions within the Central Room are deemed tocomply with standards. Criminal records are kept in separate spaces within eachinvestigative directorate. It is intended that they are kept in the ownership of the fund-maker for up to two (2) years, provided that after this period, when deemed to be'completed', they are submitted to the Central Archives for storage under storage terms.The conditions under which files are kept in adapted rooms are not satisfactory.From the inspection performed, it resulted that out of ten (10) recommendations left in theprevious inspection, six (6) of them were partially met, three (3) were not met at all, andone (1) recommendation was not evaluated in this inspection phase. In the final inspectionreport of this area (9) recommendations have been put forward, which were accepted bythe leaders of the police structure as grounded and sustainable. Agreement was reached formeeting these recommendations according to the Action Plan set forth.

Inspection of border protection management, control and migrationThis inspection covered the activities of the Border Department during 2015 and 2016. Thefindings of the inspection show that the Border Police has at its disposal the entirenecessary legal infrastructure, upon which the performance of operational tasks is based.Actions that are being implemented are intended to be undertaken based on practices thatare in the spirit of Schengen standards.The inspection highlights the need of stabilizing the structure with human resources as setout in the Authorized Personnel List. There is stagnation in meeting the staff trainingagenda, lagging behind in terms of conditions for re-certification and internal training.Added attention is needed to the appointment of candidates for participation in trainingsabroad. Personnel refreshing policies should be reviewed based on the age criteria and thestimulation of gender diversity. Progress has been made in advancingequipment used by police stationpersonnel related to the control ofpersons, vehicles and documents. There isa good presentation in keeping recordsand attention to stamps.The vehicles condition is consideredunsatisfactory, affecting the decline oftheir active power and this may beinfluencing the efficiency of bordercontrol.Border Police is included in the Integrated Border Management (IBM) with severaldomestic and international stakeholders, therefore based on the Action Plan of Strategy onIBM 2013-2018their cooperation extends to the level of the authority, within IBM and theinternational field. There has been a decline in terms of joint meetings with thestakeholders of the three levels of cooperation. Operations carried out by police units haveincreased, while the joint ones with the IBM stakeholders have declined.Agreements on joint patrols along the borderline are in force with all the neighboringcountries, with the exception of Serbia. There was an increase in the number of jointpatrols with police in the neighboring countries.

Policies for receiving and handing over border patrol duties within the border surveillancestations should be reviewed, taking into consideration their technical capacities. Control ofpersons and vehicles has increased, and so has the number of second linecontrols. Vërmicaand Hani i Elezit continue to have the largest load per station/officer. Regarding the controlof migration, there has been an increase in the number of fines imposed againstperpetrators regarding the movement of foreign nationals. The activities of the Directoratefor Migration and Foreigners marked an increase regarding inspections of suspiciousbusinesses, institutions and locations.In the area of crime investigation, special attention should be given to fingerprintingsuspects and issuing reports for the State Prosecution in cases of reasonable suspicion thatcriminal offenses have been committed. Reports show that there is a decrease in thenumber of offenses related to cross-border crime. Out of all the cases handled, there was adecline in smuggling with migrants, unauthorized border crossing and illegal possession ofweapons, whereas narcotics smuggling, smuggling of goods and smuggling of animals haveincreased. There is a downward trend in the number of arrests for various criminaloffenses, too.Despite the fact that the Border Management System (BMS) is functional in all BCPs, it facessome technical problems. Updating the data in the Stop List represents a problem, bringingborder control issues due to the fact that they are not updated or sufficientlyupdated.As far as working conditions in police facilities are concerned, some of them faceinsufficient work space. No standards seems to have been created regarding the conditionsto be met by any border station or facility, specifying special premises for meeting rooms,interview rooms, evidence rooms, etc. Some stations perform activities in containerswithout sufficient working space.No weaknesses were noted regarding the maintenance of facilities. Progress was made ininstalling the camera monitoring system in facilities. Efforts must be made towards theimprovement of conditions, including hydrants, air conditioning, fire control, alarm etc.Based on the inspection conducted, it resulted that out of 12 recommendations left in theprevious inspection, eight (8) of them were fully implemented, two (2) were largelyimplemented (generally), one (1) partially implemented and one (1) was not evaluated asthe conditions and circumstances under which Police developed changed and patrols werestructured.In the final inspection Report of this area, eight (8) recommendations have been made,which are accepted by the leaders of the police structure as grounded and sustainable.Agreement was achieved for the fulfillment of these recommendations according to theAction Plan set forth.

The inspection coveredthe inspection of vehicles used by theemployees of General Police Directorateand RPDs. The findings of the inspectionreflect that the use of official policevehicles is regulated by sub-legal acts,which regulate the use of official vehicles.This legal infrastructure is well completedand harmonized and does not constitutean obstacle to the performance of policeduties, but allows the police authority toexercise adequate control over the use of vehicles efficiently, effectively and economically.PIK has been interested in verifying the use of official vehicles beyond official workinghours and in this regard has verified around 100 vehicles used on the day of inspection.From their verification, it was found that a large number of them were used based onauthorizations issued by the General Director of Police, some were engaged in operationaltasks, and a number of them, in the day of inspection, did not justify the official use ofvehicle with an authorization. The phenomenon of not renewing authorizations in due timeby the police approval authoritywas noted.Three (3) recommendations have been drawn from this inspection, which will serve toimprove the performance, eliminate the weaknesses, and rationalize the use of officialvehicles.

Inspection on the performance of police duties in the field of the management ofpolice buildings, infrastructure and associated assetsThis inspection covered the two-year period, 2015-2016, and the findings reflect thatKosovo Police owns and uses a large number of real estate (buildings, residential buildings,shooting ranges and lands/parcels).KP has a register (catalog) with the data onproperty under its ownership or use, adocument that does not have sufficient andcomprehensive information.No document, reflecting the security ofbuildings and property in case of eventualdisasters, has been found. Emergencyequipment (hydrants, fire extinguishers andlighting rod system) have not been testedwithin the defined time limits.There are shortcomings in projects prepared by contracted economic operators, making itdifficult to implement the concerned projects in the field of construction and renovation.Based on the Strategic Development Plan, where standardization of police buildings isforeseen, positive moves in meeting the strategic objectiveare noted.The inspection showed that, out of four (4) recommendations left by the previousinspection, one (1) recommendation was fulfilled and three (3) were partially fulfilled.

The DFGS has, within its responsibilities and competencies, been involved in managing andmaintaining information on human resources, assisting the management in internalorganization, providing administrative, logistical and IT support services, ensuring theimplementation of selection and employment procedures for the qualified staff pursuant tothe legislation in force, coordinating the preparation, implementation, reporting andbudget evaluation, coordinating the timely implementation of the financial obligations ofthe organization, managing the archive system and internal documents, providing logisticalservices, maintaining IT equipment and providing IT services.PIK employees have attended 14 trainings, with the aim of professional capacity building ofoperational and administrative staff. VII. PUBLIC RELATIONS, LOCAL AND INTERNATIONAL COOPERATIONDepending on the operational needs in the field, in cooperation with departments withinthe PIK, press releases were published and meetings were organized reflecting the resultsachieved by the PIK. The following are the activities that were implemented during 2017 byPIK in terms of enhancing transparency and cooperation with citizens: publication of cases of interest to the public opinion (mainly through pressreleases; giving statements to the media, participating in TV debates, informativeprograms etc.; additional engagements in the field of public relations; preparation, design, editing and proofreading of the "Integrity" magazine; response to requests for access to public documents; response to requests addressed by different media on issues related to PIKactivities etc.PIK through the Division for Cooperation and Information has continuously informed themedia on the work and activities that have been carried out, through various forms, inorder to provide proper information and be transparent to the citizens, and mainly byaddressing the requests of different media. An important role in informing the public forthe work of PIK has also been the official website and the use of social networks such asFacebook and Twitter.

Activities for the “Blue Line”The “Blue Line” project is ongoing, as posters have been placed atall border crossing points at the level of Republic of Kosovo, andbrochures have been distributed.Brochures are distributed through activities such as “America withKosovo”, and “Development of Activities with CSATs in KosovoMunicipalities” etc.

inspections and their role in increasing police professionalism and the importance of policeintegrity.University students received additional information about the role of PIK in the rule of lawin Kosovo as well as PIK's regionalization project, respectively the opening of regionaloffices in Prizren, Gjilan and Mitrovica North. PIK part of the project “Të rinjtë për Drejtësi”,Within the project “Të rinjtë për Drejtësi”, YIHR (Youth Initiative for Human Rights) incooperation with local coordinators from “EC ma ndryshe” and “Syri i Vizionit”, held over20 lectures with secondary school students in 10 municipalities of Kosovo.The lectures were held in Prishtina,FusheKosova, Lipjan, Podujeva, Prizren,Suhareka, Dragash, Peja, Decan and Istog.These lectures were attended by DCIrepresentatives from the PoliceInspectorate of Kosovo, theOmbudsperson Institution, the Office ofDisciplinary Prosecutor and the Anti-Corruption Agency.During these lectures, students learned about justice concepts such as access, rights andaccountability of the justice system. Moreover, the representatives of independent andoversight institutions informed the students regarding the institutions the work performedby them. Cooperation with MIA PIK has handled requests addressed byMIA, particularly regarding PIK’speriodic reporting, related to thefulfillment of strategic objectives thatemerge as an obligation for PIK from theannual MIA plan, and othergovernmental strategic documents.

Cooperation with the Parliamentary Commission on Internal Affairs, Securityand Oversight of the KSFIn the light of cooperation with local institutions, thePolice Inspectorate of Kosovo has had a good cooperationwith the Committeeof the Assembly of the Republic ofKosovo on Internal Affairs, Security and Oversight of theKSF. PIK welcomes the support of this ParliamentaryCommission of the Republic of Kosovo in meeting thestrategic objectives.

Cooperation with the Prosecutor's OfficeDuring the daily work, the employees of investigativestructures and its management haveestablished cooperationrelations in terms of the fight against corruption and othercriminal offenses in the police. This has led to the PIK andthe State Prosecution of the Republic of Kosovo to establishcooperation relation in the fight against negativephenomena encountered among KP members, in particularin combating corruption through the exchange ofinformation related to suspicion of implication in criminal activity of police officers. Cooperation with the Kosovo PoliceThe cooperation with Kosovo Police is oriented in givingcontribution in increasing the performance of the two agenciesand offering of the mutual, technical, operational andsupportive aid as foreseen also in the applicable legislation. Thiscooperation is preceded by many meetings held to discuss thematter in relation to the scope of the Police Inspectorate.In addition to regular meetings, PIK has had several other meetings with KP officers onpublic relations. PIK had also few meetings with KP officers in regard to public relations.These meetings have been realized in the spirit of cooperation and strategiccommunication mainly before the publication of inspection reports by discussing thecommon lines of communicating with media.

Cooperation with ICITAPPIK highly appreciates the cooperation with AmericanICITAP, which is of particular importance and has helpedPIK in capacity building. Trainings provided by ICITAP overthe years have been more than necessary and well-suited tohelp fulfill PIK's mission. Among the important trainingdelivered during 2017 was the "Advanced training onsurveillance" for investigators of the Police Inspectorate ofKosovo, organized by American ICITAP, and held by FBIinstructors. This important training is a continuation of the ongoing support to buildingand strengthening the operational capacities of security mechanisms such as the PoliceInspectorate of Kosovo, and also follows the many donation of surveillance equipmentprovided by ICITAP. A member of the PIK has participated in a seminar organized byICITAP that was held in the US (Roswell - New Mexico) along with other officials from theKP, the Prosecution and the Court. Cooperation with the Ombudsperson and CDHRFDuring 2017, in the frameworkof strengthening thecooperation with themechanisms related to theprotection of human rights andfreedoms, PIK has cooperatedwith CDHRF andOmbudsperson officials by replying to all requestssent to PIK. Cooperation with the OSCE MissionPIK continued cooperation with the OSCE Mission in Kosovoby coordinating joint activities, which included trainingsorganized by the mission, whereby PIK officers participatedand helped co-organize the workshop held in November onreviewing PIK's strategic development plan and annual plan.

Cooperation with DCAF DCAF (Geneva Centre for the Democratic Controlof Armed Forces) in cooperation with the PoliceInspectorate of Kosovo (PIK), Kosovo Police(KP) and Kosovo Academy for Public Safety(KAPS) held a four day workshop on“Strengthening Capacities for specializedtraining on police integrity”. 16 PIK, KP andKAPSP officials continued this workshop, led by DCAF officials.

During this workshop was presented the DCAF “Training Manual on Police Integrity” forrepresentatives of security institutions and was discussed about its implementation in thepolice training system in Kosovo. Cooperation with KIPAIn the light of the cooperation with the Kosovo Institute for Public Administration (KIPA),the same has certified 21 investigators and PIK inspectors as trainers. This certificationcame after an intensive training module that was held at PIK premises by KIPA

professionals.

Contacts and meetings with sister organizations from regional countriesDuring 2017, there were also commitments in terms of international cooperation thatincluded participation in international working groups, conferences, seminars andpresentations of PIK's work in these regional and international meetings.PIK representatives participated in the EPACWorking Group meeting on the preparation of amanual on "Risk Management and Risk Analysis"held on 17 and 18 May in Vienna, Austria, at theBAK building, (Federal Bureau of Anti-Corruption -Austria).Participants in this working group wererepresentatives of police oversight agencies,respectively the anti-corruption mechanisms fromPortugal, Azerbaijan, Hungary, and Austria.PIK's Chief Executive Officerattended 17thEPACProfessional Conference (European Partnersagainst Corruption), held in Lisbon - Portugal, 15-17 November.

During the conference, were addressed important topics regarding the strengthening offight against corruption, rule of law and cooperation between different law enforcementagencies, particularly between police oversight agencies.PIK also attended the regional workshop organized by the RAI (Regional Initiative againstCorruption) and Ministry of Internal Affairs of Romania, with OSCE support, which washeld in Bucharest, Romania on 13-14 December 2017.

This conference was attended by representatives of police oversight institutions and anti-corruption agencies from the countries of the region and beyond.In this workshop titled “Integrity and Professional Standards in Law EnforcementAgencies”, the officials of participatory countries have, inter alia, discussed issues ofregional co-operation in this field, practices applied by the countries of the region andbeyond, effective identification of corruption risks, common challenges, etc.In this workshop, there was a presentation of PIK's work and engagements regardingintegrity and professional standards in law enforcement agencies in Kosovo. Other engagementsIn addition to the activities mentioned above, during 2017 PIK has engagedin thepreparation of the PIK’s Risk Identification Document, preparation of PIK 2018 AnnualPlan, attended many activities related to the co-operation with Kosovo Center for SecurityStudies, participated in the working group for drafting the Anti-Corruption Agency’sNational Anti-Corruption Strategy, was engaged with the Council of Europe project and thetasks deriving from this project, was part of working groups for Standard OperatingProcedures and the Administrative Instruction on Discipline and has been part of theworking group for drafting the concept document on the Law on Salaries, etc.Also, as part of the engagements of the various working groups, the following documentshave been prepared and approved for PIK: Job Catalogue for the Operative Structure,Manual on Human Resources, Guidance on Planning, Inspection and Reporting Procedure,Regulation on the administration of official documents, etc.
