ANNUAL REPORT ON THE ADMINISTRATION
OF CRIMINAL JUSTICE
A
The statements required by the High Court for the purposes of the compilation ofthe Annual Report on the Administration of Criminal Justice in the State of Maharashtrashall be submitted by the 1st of February each year correctly drawn up. The forms of theStatements and the instructions relating thereto ( in addition to the instructions below orat the back of the forms) are set out below. The Session Judges and the ChiefMetropolitan Magistrate, Bombay, shall, before submitting their statements, have themchecked in the light of these instructions and assure themselves that they are correctlydrawn up.

Column 3: That is the total of the entries of Columns 4 to 11. The cases of personstransferred from one Court to another in the same District will appear only against theCourt by which decided or in which pending at the end of the year if not decided.
Column 6: Persons whose cases were referred to a superior court for higher punishment,for orders under probation of Offenders Act, 1958, or for confirmation of sentence willbe entered in Column 7 and not in Column 6 against the Courts making the reference.Against the Court receiving the reference, they will be shown as convicted or acquittedaccording to the orders passed by it or as pending, if orders have been passed.
Column 7: These cases will be shown against the Courts, who made the reference entrybeing made as directed above.
Column 8, 9 & 10: A Breakup of the total figures for each Court should be given forshowing separately how many accused persons died, escaped or were transferred toanother District.
Column 11:An insane accused who has been sent to a mental hospital should be kept onthe file and entered in this Column until he has been tried and either convicted oracquitted.

Column 1: That is the total of Columns 3 to 9. Cases transferred from one Court toanother in the same District will appear only against the Court of the District by whichdecided or in which pending at the end of the year if not decided.
The words,”Applicant for revision”in the heading of this column should be held toinclude only accused persons on whose behalf an application for revision is made, or inwhose interest the Magistrate or Judge may take steps to obtain revision on his ownmotion. Where such application is made or such steps are taken on behalf of acomplainant, that fact should be noted with the number of complainants and the numberof accused concerned in the column of Remarks. In the latter case, the accused personsagainst whom the application is made, through not appearing in this column, will fall intotheir proper places in columns 3 to 9, according to the result of such application.
Column 4: Appeals dismissed under Section 384 of the Code of Criminal Procedure1973, should be entered in this column.

Column 1 : (1) “Abetments” should be included with the substantive offences abetted.
(2) When giving the list of Special and local laws, against which offences have beencommitted, care should be taken to specify the title of each Act quoted, as well as itsnumber and year. They should be given in alphabetical order, first the central and then ofthe local legislature distinguishing the latter by initial letters placed after the number ofthe Act.
Column 2 : All offences (cases) of which information was given, complaint made orcognizance taken under Chapter IV, V, XII and XV or the Code of CriminalProcedure,1973, for the first time during the year, are to be shown although some of thecharges may not have been prosecuted or may have turned out to be false.
Column 3 : This column should be the total of Column2, less the number of casesdismissed under Section203, of the Code of Criminal Procedure and less all other cases inwhich a Magistrate declared that the charge was false, and less all other cases in which aMagistrate declared that the charge was false, and that the offence never, occurred orwhich were dismissed as frivolous and vexatious and in which the complainant was finedunder Section 250 of the Code of Criminal Procedure,1973.
Column 5 : This Column should be the total of Columns 6 to 9.
Column 6 and 7 : These Columns are intended to show the results of trials in theMagistrate`s Court as regards persons whose cases were disposed of by Magistrate, andin the Courts of Sessions as regards persons whose cases were disposed of by the court.In cases section referred by Subordinate Magistrates under Section 366 of the Code ofCriminal Procedure, 1973 the results to be shown are those in the Courts which receivedand dealt with reference. Should the Court not have decided the case by the end of theyear, it should be entered as “remaining under trial.”
Column 8 : Persons transferred from one Court to another in the same District are notto be entered in this Column. Persons transferred to another State should, however, beshown separately in the Remarks Column.
General :(1) Cases committed or referred should not be included in the Statement by thecommitting or referring Magistrates. The result of the trials in these cases should beshown by the Courts to which the cases are committed or referred. If the total ofColumns 6 and 9 be deducted from the total of Column 3 of the Statement the differenceshould correspond with the total of Column 5 of the Statement.
(2)Sessions Judge should append to this Statement a memorandum showing the numberof murders reported as true under the heads (1) from motives connected with women,(2)
of children for their ornaments, (3) other murders for the sake of gain, (4) for othercauses.
(3) The word “convicted” in Column 7 includes cases in which no punishment may bepassed, for instance cases in which fulfilment of contract is ordered under Act XIII of1859.
(4) The heading “ Offences under Special and Local Laws” “ Attempts at do and”in statement No.11 (Criminal) should include cases under Secti107,108,109,110,117,121and 122 of Chapter VIII of the Code of Criminal Procedure,1973.
(5)Case of contempt of Court under Chapter XXVI of the code of CriminalProcedure,1973 should appear in the Statement under their appropriate head in theSchedule of offences under the Penal Code.

Column 1 : Sub – head “ Courts of Sessions” includes cases decided by Sessions Judgeon reference under Sections 28 and 122 of the Code of Criminal Procedure, 1973
Column 12 : Includes fines realised during the year, though imposed in previous year.This Column is intended to show the realised portion f fines imposed by officers in theexercise of original jurisdiction only.
Column 13: Represents compensation awarded to complainants under Section 357 of theCode of Criminal Procedure,1973. These awards should also be shown under the headfines “ imposed” and “realised” in Columns 11 and 12, for they form part of such fines.
General : (1) The total of Column 5 should correspond with the total of Columns 14 to17 (both inclusive ) and deducting the number of persons sentenced to forfeiture whichshould be shown in the Remarks column, the total of the remainder in column 6 shouldcorrespond with the total of Columns 9 and 10.
(2) This statement is meant to exhibit every sentence passed, and where two penalties areinflicted on the same offenders, to exhibit them both. Further, to reconcile the number ofpersons entered in this Statement as punished with the number entered as convicted inStatement No.9, it is necessary to note cases such as those in which children are dealtwith under the Bombay Children Act, LXXI of 1948, by Special methods or youngoffendrs are submitted to detentions in a Borstal School in a foot note.
(3) As regards persons whose cases were referred for higher punishment, for orders underSection 3 of the Probation of Offenders Act, 1958, or for confirmation of sentence, thepunishment, if any, sanctioned by the higher Court should be entered against such higherCourt and not against the Court making the reference.

(i)The total of column 2 should correspond with the total of column o2 of statementNo.11
(ii)The figure in column 3 against each subhead should agree with the total ofcolumns 4 to 11
(iii)The total of column 7 when deducted from the total of column 3 shouldcorrespond with the total of columns5 of statement No.11 .
(iv)The total of column 4,5,7 and 8 should respectively correspond with the totals ofcolumns 6,7,and 9 of statement No.11.
(v)The total figure in column No.12 (number of cases pending at the beginning of theyear) should agree with the total figure in column No.12 of statement No.11 for thepreceding year.
(vi)The number of persons transferred outside the district or State are only to beshown in this statement. The number of persons transferred from and to the Courtswithin the same district should not be included in this statement. The number ofpersons transferred to another district in the State, and those transferred to anotherState should be shown separately in column No.10.
STATEMENT No.10
(i) Details of column 8 should be given in the remarks column 13.
(ii)Number of appeal cases or applications for revision disposed of during the yearshould be shown in a separate column 11 against each subhead.
(iii) Appeals: The totals of columns 3 to 9 against each subhead should agree withthe figure in column 2.
(iv) Rivision: The figure in column 2 with the addition of the number of accusedpersons involved in applications for revision made on behalf of complainants mustbe equal to the total of columns 3 to 9 against each subhead. The number ofaccused persons involved in the applications for revision made on behalf ofcomplainants should be shown in the remarks column 13.
(v) A sessions Judge does not possess all the powers of revision under sections 397
and 401 of the Code of Criminal Procedure,1973 and therefore, columns 4 to 6under the heading “ Revision” should be left blank.
STATEMENT No. 11
(i)Column No.2 (offences reported), the number of offences reported during the yearonly should be shown against each subheading. The number of cases pending atthe end of previous year should not be included in column No.2.
(ii)As regards the entries to be made in column No.3 (number of cases returned astrue) instructions to column No.3 printed on the reverse of Statement No.11 shouldbe seen and the entries made in columns Nos. 10 and 11 of this statement should betaken into consideration. The figure in column No.3 against each subhead shouldin no case be more than in column No.2, as cases in column No.3 are those“Returned as true” out of the offences reported during the year and entered incolumn No.2 Column No.3 does not include cases pending at the end of theprevious year.
(iii)All cases brought to trial, whether disposed of or pending, should be shown incolumn 4.
(iv)The total of columns 6 to 9 against each subhead should agree with the figure incolumn 5
(v)The number of complaints dismissed under section 203, Code of CriminalProcedure, 1973 and the number of complainants find under section 250, Code ofCriminal Procedure,1973 should be noted against each subhead in columns 10 and11.
(vii)The total number of cases pending at the end of the year under report should begiven in column 12 and when deducted from the total of column 4, there shouldremain a balance corresponding to the total of column 14 of statement No.9.
(viii) The accompaniment to statement No.11 showing the offences committed underthe Special and Local Acts should be prepared exactly on the lines of StatementNo.11 and the correct titles, numbers and year of all the Central,Bombay or otherLocal Acts should be given. The Acts should be given in the alphabetical order,first the Central Acts and then the Bombay or other Local Acts.
(ix)Sessions Judges should append to this statement a memorandum showing thenumber of murder cases reported as true and the total number of cases ofconvictions under the heads:
(1)From motives connected with women;
(2)Of children for the sake of their ornaments;
(3)Other murders for the sake of gain;
(4)Murder arising out of other causes.
(x) The number of persons transferred outside the district or the State are only to beshown in column 8 of this statement under the heading “ Transferred”, out of whichthe number of persons transferred outside the State should be shown separately inthe remarks column 13 against each subhead.
STATEMENT No.12
(i) The figure in column 5 against each subhead should correspond with the total ofcolumns 14 to 17 against the subhead.
(ii) The figure in column 6 against each subhead should correspond with the total ofcolumns 9 and 10 together with the number of persons sentenced to forfeiture ofproperty, if any The number of such persons sentenced to forfeiture of propertyshould be shown in the remarks column 18 .
(iii)In column 2, the number of persons actually executed in jails out of thosesentenced to death (shown in column 3), are only to be shown against the respectiveheading.
GENERAL
(1)The annual statements should be prepared in regard to both civil and criminal casesby the District and Sessions Judges.
(2)The function of the District Magistrates in relation to the annual statements shouldnot be the compilation of the statements but furnishing the necessary informationavailable to them to the respective Sessions Judges to enable the latter to preparestatements.
(3)The Sessions Judges should arrange the preparation of statements in so far as casesunder the Code of Criminal Procedure are concerned in consultation with the DistrictMagistrates and the District Magistrates should supply all the information necessary forthe compilation f the Annual Statements Nos. I, II, IX, XI, and XII relating to ExecutiveMagistrates as well as cases disposed of by them in exercise of their original, appellateand revisional powers.
